장애연구에의 지적장애인의 참여를 둘러싼 쟁점에 대한 고찰 (A Study on the Issues of Participation of People with Intellectual Disabilities in Research Process in Korea)

  • 본 연구는 지적장애인은 의사소통능력이 부족하고 진술에의 진실성을 담보하기 어렵기 때문에 연구과정에 이들을 포함시키는데 소극적인 입장에서 탈피, 지적장애인의 적극적인 참여 패러다임으로의 변화를 강조한다. 이와 관련하여 '언어를 매개로 한 의사소통능력의 부족'은 지적장애인의 특성을 고려한 면접도구 개발과 대화분석방법을 도입함으로써, '진술의 진실성'에 대해서는 사회적 실재의 재현(representation)을 둘러싼 다양한 질적연구방법을 개발하고 진술 의미를 재구조화함으로써, 그리고 무지에 따른 배제와 억압의 메커니즘은 지적장애인의 삶 드러내기를 통해 극복될 수 있음을 보여주고 있다. 동 연구결과는 앞으로 장애정도별로 다양한 자료 수집 및 분석방법이 개발되어야 하며 아울러 각종 정부연구용역에서 지적장애인이 연구과정에 포함되도록 하는 연구방법론의 변혁이 필요하다는 함의를 제공해 준다.

도서관 지적자유 침해 양상과 대처방안 (Aspects of Intellectual Freedom Restrictions in Libraries and Countermeasures)

  • 본 연구는 최근 국내 도서관계에서 행해지는 지적자유 침해의 다양한 행태를 분석하고 현장 사서의 애로사항을 파악하여 그 대처방안을 제시하고자 한다. 구체적으로 국내외 전문가 단체의 관련 선언문에 나타난 도서관 지적자유의 정의와 선언, 논란의 중심에 있는 나다움어린이책의 선정 배경 및 선행연구 분석 등 문헌 연구를 수행하였다. 다음으로 사서를 대상으로 소속 도서관에 행해지는 지적자유 침해와 현장의 애로사항 및 개별 도서관 차원의 대응 사례를 조사하였다. 또한 협회·전문가 단체 차원의 지적자유 침해에 대한 대처방안, 향후 지적자유 보장 방안 등에 대한 현장의 인식도를 조사하였다. 도서관 지적자유 침해 상황이 복잡·다양한 가운데 협회·전문가 차원의 성명서는 법적 효력이 없으므로 실효성을 담보하기 위한 법적 근거의 마련과 도서관 현장에서 상황별로 적용할 수 있는 대응 매뉴얼의 작성도 시급하다. 따라서 이러한 상황을 바탕으로 국가도서관위원회, 문화체육관광부, 협회·전문가 단체, 개별 도서관 차원에서 지적자유 침해에 대한 대처방안을 제안하였다.

지역특산물의 지식재산권 현황 및 브랜드화 발전 방향 (The Status of Intellectual Property Rights and Developmental Direction for Brands of Special Rural Products in Korea)

  • The purpose of this study was to analyze the status of intellectual property rights and developmental direction for brands of special rural products in Korea. The data was derived from 166 special rural products in Korea. The major results of this study were as follows: Enterprises having intellectual property rights above one were Traditional soybean sauce 18(56.2%), Hangwa 15(42.9%), Kimchi 18(43.9%), Traditional tea 20(80%) and Crafted products 10(31.3%), respectively. Enterprises acquiring designation and certification due to national and local autonomous entities over one were Traditional soybean sauce 17(56.7%), Hangwa 23(63.9%), Kimchi 33(80.4%), Traditional tea. 13(52%), and Crafted products 20 (62.5%), respectively. The trademark registration of special rural products was invested with total 62 cases(37.3%) as Traditional soybean sauce 14(43.7%), Hangwa 15(41.7%), Kimchi 17(41.5%), Traditional tea. 12(48%) and Crafted products 4(12.5%). And Patent registration 39 cases(23.5%), design registration 32 cases(14.5%), and utility model registration 5 cases (3.01%) were invested respectively. It was shown that, where the origin of brand names was a proper non 107 were things(53%), 39 were materials(19.3%), 17 were the production method(8.41 %) and 55 were a composite trademark(33.1%).

지적재산권의 역사적 연원- 저작권과 특허를 중심으로 -

  • In recent years, the intellectual property rights (IPR) are increasingly becoming trade goods and the subject of international trade negotiations. During the past decades, intellectual properties earned critical importance for economic development in both developed and developing countries. Developed countries, headed by the United States, that recognize the economic value of the IPR in the world market are aggressively seeking for universal protection of IPR throughout the world. Intellectual properties have unique qualities that distinguish them from other tangible goods. Most importantly, they are public goods created on the basis of knowledge and information accumulated throughout human history and shared by different cultures. However, there is a growing tendency that the quality of public goods are being etched away as the property concept in IPR expands. In this paper, I discuss how copyright and patent laws incorporated the concept of property right as natural right to one's intellectual creations in early formation of the laws in Europe. I argue that copyright law and patent law are the historical products resulting from political, economic, and ideological factors interacting in a certain society. A history of copyright and patent points to that the intellectual property rights as natural lights of authors and inventors as argued by developed countries in international disputes, are not universal, but unique historical products. Copyright and patent laws have been shaped and developed as regulatory measures by governments to promote and control industries by providing authors and inventors with monopoly incentives. Since property right was used as a regulatory device it was restricted. This is to enhance the distribution of knowledge and information rather than to ensure the property right as an absolute right.

지적장애아동의 기능성 게임 참여에 따른 행동변화 및 운동수행능력 (Behavior and Motor Skill of Children with Intellectual Disabilities Participating Functional Games)

  • 본 연구는 지적장애아동들이 가상현실을 기반으로 한 기능성 게임에 참여하는 과정에서 행동 및 운동수행능력에 어떠한 변화가 보이는지 분석하는데 그 목적이 있다. 본 연구는 지적장애아동 5명을 대상으로 주 2회, 16주간 프로그램을 진행하였다. 그 결과 가상현실을 기반으로 한 기능성 게임에 참여한 지적장애아동은 주의집중, 안정된 움직임, 자신감있는 동작 등과 같은 행동의 변화를 보였으며, 운동수행능력의 경우 하위영역 - 정적 협응, 손동작 협응, 일반동작 협응, 운동속도, 동시적 자발동작, 단일 동작 수행능력- 모두에서 긍정적 변화를 나타냈다. 이와 같은 연구 결과를 바탕으로 가상현실을 기반으로 한 기능성 게임을 체계적이고 규칙적으로 적용하게 되면 지적장애인의 행동변화와 운동수행능력에 긍정적 효과를 가져올 수 있을 것이다.

20세기 대학연구의 상업화와 지적재산권 제도의 변화 (The Commercialization of Academic Research in the Context of Shifting Intellectual Property Regimes in the Twentieth Century)

  • This article chronicles key shifts in intellectual property regimes in the twentieth century as they related to the commercialization of academic research. The institutionalization and growth of scientific research in the research university in the twentieth century and the increasing awareness of its potential to promote technology innovation and economic growth posited an important question of the ownership of knowledge created in the academic setting, where knowledge was traditionally regarded as a common property among academic researchers. This paper shows the ownership of academic knowledge emerged as a key public policy and legal issue in the latter half of the twentieth century for academic researchers and government officials who pursue the commercialization of academic knowledge for private gain and public benefit. The resulting institutionalization of patent management in the research university and shifts in federal patent policy in turn opened a new legal avenue for the establishment of the private ownership of academic knowledge and the expansion of intellectual property rights in academia, especially in the area of biological and biomedical research. Reflecting upon historical shifts in intellectual property regimes in the twentieth century, this paper suggests recent controversies regarding ownership of biological knowledge and profit sharing in developing counties are linked to critical issues pertinent to the welfare of indigenous population, utilization of new natural resources, and sustainable development for humanity.

Effects of Intellectual Property Rights Protection on Services Export Diversification in Developing Countries

  • The effects of the betterment of enforced intellectual property rights (IPRs) provisions on services export diversification are investigated. The analysis used an unbalanced panel dataset of 76 developing countries over the period of 1970-2014. The empirical analysis is based on the feasible generalized least squares estimator. It suggests that the implementation of weaker IPR protection fosters services export diversification in less developed countries (i.e., those whose real per capita incomes are less than US$US$ 1458.60), including those with a low level of export product upgrading. Conversely, in relatively advanced developing countries (countries whose real per capita income exceeds US$ 3356.80), including those with high levels of export product upgrading, the implementation of stronger IPR laws induces greater services export diversification. Finally, the analysis revealed the existence of a non-linear relationship between IPR protection and services export diversification. The implementation of stronger intellectual property laws spurs services export diversification in countries with high degree of IPR protection, especially when IPR protection exceeds a certain level, recorded here as having a score of 1.197. In contrast, in countries with weaker IPR protection, in particular those with IPR protection levels that score less than 0.915, it is rather the implementation of weaker intellectual property laws that promotes services export diversification.

Environmental and Interpersonal Factors on Development of the Mathematically Gifted: Cases of International Mathematical Olympiad Winners from Korea

  • Spending as much time outside of school as in school, gifted youth are affected by non-school aspects including parents, other family members, peers, mentors, mathematics competitions and camp participations. These influences have been known to shape children's intellectual development, academic achievement, interests, and eventually college and career choices. From interviews with five former Olympians from Korea to identify out-of-school influences on their academic achievement and development, we discovered, in addition to confirmation of previously identified factors, additional sources of positive influence seldom previously mentioned and more common to Korean culture were gleaned - mathematics workbooks and Ha-Gwon. The findings of this study are informative for teachers and parents who are interested in development of gifted youth in providing ways to accommodate their special needs and in showing how they can carefully individualize those sources to be positively affecting intellectual development as well as academic achievement.

  • 본 논문에서는 미용기기 분야에 대한 특허 동향 분석을 통해 주요 경쟁자별 기술경쟁력 등의 분석을 실시하고, 지식재산권 중심의 기술 동향 분석 등을 바탕으로 과제기술의 특허 포트폴리오 및 특허 확보 전략을 도출하였다. 전략적인 IP(Intellectual Property) 기반 연구개발 계획 수립에 활용할 수 있도록 특허 포트폴리오를 분석하여 특허 장벽 및 공백분야를 제시함으로써, 연구개발의 방향을 설정하기 위한 기초정보로 활용하여 중복연구를 방지하고 연구개발과제 수행의 타당성에 대한 객관적인 특허정보를 제공하고자 한다.

중.고등학생들의 논리적 사고력 형성에 관한 연구 I

  • It is apparent to anyone who has taught science in secondary. schools that a substantial percentage of students find the subject difficult: What is the cause of difficulty? There is season to believe that part of this difficulty is associated with students' intellectual development as deserifed by Piaget. To investigate the difficulty students face with learning science in the light of Piagetian developmental theory, the stages of the intellectual development of the secondary school student s were assessed in this study using the instrument called Group Assessment of Logical Think ing (GALT). The results of this study showed that more than 60% of 7th and 8th grade students were Classified as concrete operational level. It was also found that only 20% of the students from 9th through 11th grade were formal operational stage, while about 40% of them were still at concrete operational stage. This study showed that. there was a significant main effect on the intellectual development of the students by grade. However, it showed that at 0.5 level of significance there was no main effect by sex although mean scores of male on the assessment were higher than those of female.
