A Study on the Introduction of IMO Casualty Investigation Code and Marine Safety Investigation System in Korea (IMO 해양사고조사코드의 도입과 해양사고조사제도에 관한 고찰)

  • The marine safety investigation inquires and concludes the facts and causes of the marine casualties and incidents with the objective of preventing similar roses in the future. Thus, IMO and most states adopt and revise marine safety related conventions and national laws based on the results of marine safety investigation. In particular, IMO recently adopts mandatory IMO Casualty Investigation Code to identify the precise cause of rose with states' cooperation, to report the result of investigation, and to establish new international safety standard helping prevention of similar cases based on the report. The Judgement of the Korean Maritime Safety Tribunal system based on the 'Act on the investigation of and inquiry into marine accidents' is used for the purpose of marine safety investigation in Korea to prove cause of marine accident and to improve marine safety. Therefore, this study examines the Code and compares the Code with the Act to reflect the contents of provisions in the Code into the Act. The study would also be the basic references in relation to revising of marine safety investigation system in Korea Specially, the contents in relation to the independence of investigation authority and mandatory counselling system, and guarantee of seafarers human rights to ensure fairness of investigation would be included.

준해양사고 통보제도 활성화 방안

  • 준해양사고 통보제도(Marine Incidents Reporting System)는 우리나라의 선박소유자 및 선박운항자가 선박의 구조 설비 또는 운용과 관련하여 시정 또는 개선되지 않으면 선박과 사람의 안전 및 해양환경 등에 위해를 끼치거나 위해를 끼칠 수 있는 사태로서 해양사고를 제외한 사건이나 사고에 대하여 자율적으로 중앙해양안전심판원에 통보하도록 하여 심판원은 이를 분석하여 교훈을 발굴하고 정기적으로 업계에 전파하여 해양사고 예방에 도움이 되고자 하는 제도이다. 동 제도는 2010월 4월 조기 시행 한 후 시행 5년차에 접어들었지만 홍보부족, 선박의 특수성, 제도적 장치의 부족으로 통보제도 운영에 어려움을 격고 있다. 본 논문에서는 IMO 해양사고조사코드와 국내외 유사 준사고 보고제도 분석 후 통보대상자를 대상으로 준 해양사고 통보제도의 현황에 대한 설문을 실시하고 분석함으로써 동 제도의 활성화 방안을 제시하고자 한다.

  • 선박산업에서의 국내외 해양사고 통계에 의하면, 모든 해양사고의 80% 정도가 직접적 또는 간접적으로 관련된 인적요인(Human Factors)에 의하여 발생한다고 보고되고 있다. 이러한 해양사고의 원인을 규명함으로써 유사 해양사고의 발생을 방지하고, 또한, 해양사고 조사에 있어서 공통적인 접근방법의 이용과 국가 간의 협력을 증진시키기 위한 목적으로, IMO(International Maritime Organization)에서는 해양사고 인적요인 조사지침(Guidelines for the Investigation of Human Factors in Marine Casualties and Incidents)을 포함한 해양사고조사코드(Casualty Investigation Code: Code of the International Standards and Recommended Practices for a Safety Investigation into a Marine Casualty or Marine Incident)를 채택하였으며, 동 코드는 2010년 1월 1일 발효되었다. 이에 따라, 해양안전심판원에서는, 3단계 절차로 구성된 인적요인 조사 및 분석 방법론을 제안하고, "해양사고 인적요인 분석 매뉴얼"을 마련하였다. 본 논문에서는, 해양안전심판원에서 제안한 인적요인 조사 및 분석 방법론을 실제 해양사고에 적용하여 인적요인 조사분석 모델의 적용사례를 마련하고, 분석 모델을 검토 및 보완하고자 한다.

Development of an Evaluation Model for the Implementation of IMO Instruments (IMO 협약이행에 대한 평가모델 개발)

  • In order to reduce marine accidents, each contracting Government needs to implement the instruments enacted and amended by the International Maritime Organization (IMO). The III Code requires each administration of the government to have a system for improvement through periodic review and evaluation and to include performance indicators in its evaluation methods. Thus, each IMO Member State needs to develop its own performance indicators. The purpose of this paper is to develop and present an evaluation model using the Balanced Scorecard (BSC) and Key Performance Indicators (KPI) in order to quantify and evaluate the level of implementation of the instruments by the administrations. From the perspective of 'III-BSC', which applies the BSC concept to the III code requirements, the Critical Success Factors (CSF) that must be secured to achieve the established vision were drawn up, and candidate KPIs for each evaluation area were developed to measure the derived key success factors and an initial study model was designed composed of four levels. The validity of the KPIs was verified and the study model was finalized using the survey design using the SMART technique. Furthermore, based on the developed study model, an evaluation model for the implementation of the BSC-based IMO instruments was developed by deriving the weights of elements for each level through AHP analysis. The developed evaluation model is expected to contribute toward improving the administrations' level of implementation of the IMO instruments as a tool for quantitatively grasping the level of performance of the implementation.

해양안전심판제도의 개선방안에 관한 연구

  • 해양안전심판제도는 해양사고의 원인을 밝혀 해양안전에 이바지함을 목적으로 하고 있음에도, 실질적으로 원인조사보다는 징계를 주목적으로 하는 것처럼 보일 수 있다. 해양사고가 발생하였을 경우, 지방해양안전심판원은 원인재결 및 징계재결을 하는데, 해기사나 도선사에게 징계재결을 하면 이는 침익적인 행정처분에 해당된다. 이러한 행정처분에 다툼이 있을 경우 중앙해양안전심판원에 구제를 요청하면 행정심판이 된다. 행정심판의 재결에 대하여 다시 대법원에서 다투는 것이 행정소송이 된다. 일반적으로, 행정심판의 재결은 3심제의 재판을 받을 수 있으나, 해양안전심판제도에서 중앙해양안전심판원의 재결에 대한 행정소송은 대법원 전속관할 단심제로 운영되고 있어 헌법의 기본권 중의 하나인 재판청구권에 대한 위헌 논란이 계속되고 있으므로, 이 논문에서는 해양안전심판제도의 본래의 목적인 해양사고 원인규명을 통한 해상안전의 확보 및 징계재결로 인한 침해된 국민의 권리를 구제하기 위한 개선방안을 제안하고자 한다.

A Study on the Effective Implementation of a Marine Incident System (준해양사고제도의 효율적 이행을 위한 개선방안에 관한 연구)

  • Standard guidelines for marine accident investigation have been prepared through the enforcement of the Casualty Investigation code as of January 2010. In addition, as the International Maritime Organization (IMO) recommended contracting the state to manage a marine incident system established under this code, Korea also has newly established provisions for a marine incident system in the 'Act on the Investigation of and Inquiry into Marine Accidents' also as of 2010. The Korean Maritime Safety Tribunal (KMST) has made a multilateral effort to prevent marine accidents through the efficient operation of a marine incident system, but this system has not been properly activated. This study examines the operational status and problems of a marine incident system and analyzes the marine incident systems of foreign countries and similar transportation agencies such as railroads and aviation. Options include switching to voluntary reporting of marine incidents, transferring responsibility to a non judicial private organization, expanding incentive systems for a marine incidents, revising regulation and preparing detailed implementation guidelines.

A New Investigation Methodology of Marine Casualties and Incidents using Digital Forensic Techniques (디지털 포렌식 기법을 이용한 해양사고 조사 방법론)

  • The results of investigations into marine incidents have become an important basis in determining not only possible causes, but also the extent of negligence between the perpetrator and victim. However, marine incidents occur under special circumstances i.e. the marine environment, and this leads to difficulties in identifying causes due to problems in scene preservation, reenactment and acquisition of witnesses. Given the aforementioned characteristic of marine incidents, the International Convention for the Safety of Life at Sea (SOLAS) has adopted mandatory regulations on the carriage of Voyage Data Recorders (VDRs) and Automatic Identification Systems (AIS) for ships of a certain gross tonnage and upwards, so as to reflect recent developments in radio communication and marine technology. Adopted to provide an international standard for investigations and to promote cooperation, the Code of the International Standards and Recommended Practices for a Safety Investigation into a Marine Casualty or Marine Incident (Casualty Investigation Code) recommends member states to build capacity for analysis of VDR data. Against this backdrop, this paper presents methods for efficient investigations into the causes behind marine incidents based on data analysis of VDR, which serves as the black box of ships, as well as digital forensic techniques.
