The Formation and Ratification of ISDS in International FTA and Its Characteristics -with a special emphasis on KORUS FTA, NAFTA & AUSFTA- (국제자유무역협약에서 ISDS의 생성과 비준에 관한 연구 -KORUS FTA, NAFTA 및 AUSFTA를 중심으로-)

  • This article deals with the nature of ISDS along with the admissibility thereof, for the settlement of investment disputes between states and nationals of other states. ICSID as an organization of World Bank Group, has been established in 1966 and as of May in 2011, 157 nations ratified its convention. As for the Republic of Korea(ROK) it has been involved in the problematic situation with regard to ISDS of the KORUS FTA in negotiation with the United States. The ruling Grand National Party is pushing the FTA for ratification including ISDS. However, the opposition party, the Unified Democratic Party rejected the ISDS with a view to a toxin infringing on its judiciary sovereignty. The ROK has invested in the US 3.5 times more than the US did in Korea up to now. As a result, it seems that the ROK is more concerned about ISDS than the US is, considering that exhausting local remedy through the US local courts, applying even a municipal ordinance in their decisions which will be unsatisfactory toward the ROK side. The ROK is now struggling with the ISDS as a political issue between the ruling party and the opposition party mostly based on sovereignty with a reference on AUSFTA which excluded the ISDS. Australian model about ISDS has been impacted by the experience from the NAFTA which allowes direct claims against each other(the US against Canada and Canada against the US). It seems not to be much sympathy for developed countries because it has long been held to standards for pressing on developing countries. Australia is also struggling with ISDS from the political point of view likewise the ROK. And the ISDS is destined to the political situations established within the domestic countries among the political parties in relation with the acceptance or rejection of thereof.

  • Currently, due to global warming, occurrences of extreme climate phenomena such as heat wave, heavy snow, heavy rain, super typhoon are continuously increasing all over the world. Due to these extreme climate phenomena, concrete structures and infrastructures are exposed to serious deterioration and damage. However, researches on construction technologies and standards to confront the climate change generated problems are needed presently. In order to better handle these problems, the validity of the present concrete mixture proportions are evaluated considering wind speed and sunlight exposure time based on climate change record in Seoul, Korea. The specimens cured at various wind speed and sunlight exposure time conditions were tested to obtain their compressive and split tensile strengths at various curing ages. Moreover, performance based evaluation (PBE) method was used to analyze the target strength satisfaction percentage of the concrete cured for the curing conditions. From the probabilistic method of performance evaluation of concrete performance, feasibility and usability of current concrete mix design practice for climate change conditions can be evaluated.

A Study on Analyzing Precedents and Legal System of Landscape Tree Damage by Natural Disasters (자연재해로 인한 조경수목 피해 판례 및 제도분석 연구)

  • With the increase in occurrence frequency and severity of natural disasters due to climate changes arising from global warming, damage in the landscaping field is rising. This leads to legal disputes, and is increasing social and economic damage, too. Especially even though landscape trees which are highly affected by external environments, suffer lots of damage from natural disasters, there is no specific scope of disaster criteria and thus it brings plenty of problems of damage restoration and compensation. Therefore, this study aims to suggest that gives ways to improve related criteria for damage of landscape trees from natural disasters. For this objective, this study analyzed damage cases of landscape trees and precedents, and compared Korean and Japanese legal systems and criteria regarding natural disasters with each other. The analysis result showed that opinions of experts have a great deal of influence on judgment results, since there is no definite legal basis on damage from natural disasters in the landscaping field. This implies the need for a professional and objective appraisal process. According to the comparative analysis of Korean and Japanese legal systems and criteria regarding natural disasters, Korea lacked in laws and criteria on natural disasters of landscape plants in Korea, whereas there were concrete disaster assessment standards of landscape trees in Japan. For improving natural disaster-related systems and criteria in the landscaping field, therefore, this study presented 'Revision of related laws', 'Revision of appraisal and loss assessment criteria', 'Revision of standard specification of landscaping project', 'Compulsory insuring against disasters', 'Reasonable fulfillment of contract', and 'Compulsory cost estimation for disaster restoration', as improvement plans.

Analysis of Trench Slope Stability in Permafrost Regions According to the Equipment Load (동토 파이프라인 매설공사 시 장비하중에 의한 트렌치 안전성 분석)

  • Recently, the need of alternate energy resources is increasing due to the global warming issue. The natural gas buried in the extremely cold regions of Alaska and Siberia is of much interest these days. However, the construction standards are needed to be used in extremely cold regions. Particularly, more research work need to be carried out on the trench stability so that the safety of the workers is ensured and the damage to the construction machinery can also be reduced resulting in smaller construction period. In this study, the process for lowering of the pipelines of 30 and 40 in. diameters in the ground conditions (silt and peat) of Yakutsk, Russia was analyzed. The slopes of the ground surface were considered as $0^{\circ}$, $10^{\circ}$, and $20^{\circ}$ to be excavated in summer and winter. The analysis results show that the weight of pipelayer affects the trench stability. Numerical analysis was performed by considering the types of pipelayers, distance between the trench and pipelayer, and the distance between the pipelayers placed longitudinally along the trench. The results show that as the distance between the pipelayer and the trench decreases, the factor of safety of the slope decreases with an increase in the slope of the ground surface. When the slope of the ground surface was $20^{\circ}$, the breakout surface was anticipated to continue from the pipelayer to the trench boundary. In winter season, stability problem of the trench was not observed when the slope of the ground surface was less than $20^{\circ}$.

POTENTIAL APPLICATIONS FOR NUCLEAR ENERGY BESIDES ELECTRICITY GENERATION: A GLOBAL PERSPECTIVE

  • Energy supply is increasingly showing up as a major issue for electricity supply, transportation, settlement, and process heat industrial supply including hydrogen production. Nuclear power is part of the solution. For electricity supply, as exemplified in Finland and France, the EPR brings an immediate answer; HTR could bring another solution in some specific cases. For other supply, mostly heat, the HTR brings a solution inaccessible to conventional nuclear power plants for very high or even high temperature. As fossil fuels costs increase and efforts to avoid generation of Greenhouse gases are implemented, a market for nuclear generated process heat will be developed. Following active developments in the 80's, HTR have been put on the back burner up to 5 years ago. Light water reactors are widely dominating the nuclear production field today. However, interest in the HTR technology was renewed in the past few years. Several commercial projects are actively promoted, most of them aiming at electricity production. ANTARES is today AREVA's response to the cogeneration market. It distinguishes itself from other concepts with its indirect cycle design powering a combined cycle power plant. Several reasons support this design choice, one of the most important of which is the design flexibility to adapt readily to combined heat and power applications. From the start, AREVA made the choice of such flexibility with the belief that the HTR market is not so much in competition with LWR in the sole electricity market but in the specific added value market of cogeneration and process heat. In view of the volatility of the costs of fossil fuels, AREVA's choice brings to the large industrial heat applications the fuel cost predictability of nuclear fuel with the efficiency of a high temperature heat source tree of Greenhouse gases emissions. The ANTARES module produces 600 MWth which can be split into the required process heat, the remaining power drives an adapted prorated electric plant. Depending on the process heat temperature and power needs, up to 80% of the nuclear heat is converted into useful power. An important feature of the design is the standardization of the heat source, as independent as possible of the process heat application. This should expedite licensing. The essential conditions for success include: ${\bullet}$ Timely adapted licensing process and regulations, codes and standards for such application and design ${\bullet}$ An industry oriented R&D program to meet the technological challenges making the best use of the international collaboration. Improving Assessment of External Environment for Green Standard for Energy & Environmental Design Certification according to Climate Change (기후변화에 따른 녹색건축인증제도의 외부환경 평가항목 개선방향 연구)

  • In 1990s, as the extreme weather events according to the global warming climate change are occurred frequently all around the world and the scale of the damage increases, the developed countries are promoting various policies for reducing greenhouse gas emissions setting the goal of greenhouse gas reduction with the level of State and local government. Especially for the greenhouse gas reduction of buildings and the inducement of eco-friendly design, the green certification system is strengthened with the assessment of energy and greenhouse management, and recently, according to the policy change of climate and energy, the certification system expanded from the buildings to the level of city and district is piloted. So this research is to understand the main contents and the assessment system of domestic green building certification system implemented in March 2013 in response to the policy change of climate and energy and to suggest the basic data for the improvement of present domestic greenhouse certification standard through the analysis of actual certification and the main case analysis of international green certification system. Recently in developed countries, in 1990s, for the reduction of building's greenhouse gas emission and the inducement of eco-friendly design, from the building of LEED, BREEAM, DGNB to the level of city and district such as LEED Neighborhood Development, BREEAM Communities, DGNB Stadtquartiere, the system is expanded and piloted. On the contrary, as for the domestic standard of green building certification system, the distribution ratio according to the assessment items in each category consists of the assessment system based on the buildings, and just the simple adjustment of some items and the improvement of weighted value are performed. Actually, as a result of selecting the 30 districts of apartment housing with the most certification performance by use among the 49 buildings certified by Institute of Land & Housing from December 2014 to July 2016 and analyzing the assessment score, the certification level is determined by the sectors of high distribution like indoor environment and energy not by the ineffective sector of external environment with low distribution so this system has a limitation to perform the practical means for the policy change of climate and energy. Thus for the national green building certification standards, the assessment system in the sector of external environment is to complemented and furthermore, reflecting domestic reality, through the introduction of certification system and the assessment system with the level of city and district, this system should be improved to meet the international certification standard.

A Study on the Impacts of Paste Type Torrefied Wood Flour Coagulants on Water Ecosystem (반탄화목분 Paste상 응집제의 수생태계 미치는 영향에 관한 연구)

  • Due to global warming and abnormal climate, the incidence and scale of green tracts in rivers and water intake dam are increasing every year. Therefore, in this study, developed eco friendly positively charged Torrefied Wood Flour(TWF) coagulant by reusing wood damaged by blight as a natural material. In order to evaluate the effect of coagulant on water ecosystem, green algae contaminated water was collected and TOC showed high removal rate of 86% ~ 92% under 1% and 5% TWF C-PAM treatment condition. The $NH_3-N$ showed 53% removal efficiency. The average pH of the polluted water was 7.9 in the case of hydrogen ion concentration, and the pH of the treated water was in the range of 6.5 ~ 7.7, It was found to be suitable for water quality standards. In ecotoxicity tests, all the results of the experiment showed that both the number of green algae and that of treated water were not affected by the survival of the daphnia. Therefore, as a result of the analyzing, developed paste type TWF coagulants is considered to be able to remove algae using natural resources.

Efficacy of ketamine in the treatment of migraines and other unspecified primary headache disorders compared to placebo and other interventions: a systematic review

  • Background: Migraine headaches are the second leading cause of disability worldwide and are responsible for significant morbidity, reduction in the quality of life, and loss of productivity on a global scale. The purpose of this systematic review and meta-analysis was to evaluate the efficacy of ketamine on migraines and other primary headache disorders compared to placebo and other active interventions, such as midazolam, metoclopramide/diphenhydramine, and prochlorperazine/diphenhydramine. Methods: An electronic search of databases published up to February 2021, including Medline via PubMed, EMBASE, Web of Science, and Cochrane Library, a hand search of the bibliographies of the included studies, as well as literature and systematic reviews found through the search was conducted to identify randomized controlled trials (RCTs) investigating ketamine in the treatment of migraine/headache disorders compared to the placebo. The authors assessed the risk of bias according to the Cochrane Handbook guidelines. Results: The initial search strategy yielded 398 unduplicated references, which were independently assessed by three review authors. After evaluation, this number was reduced to five RCTs (two unclear risk of bias and three high risk of bias). The total number of patients in all the studies was 193. Due to the high risk of bias, small sample size, heterogeneity of the outcomes reported, and heterogeneity of the comparison groups, the quality of the evidence was very low. One RCT reported that intranasal ketamine was superior to intranasal midazolam in improving the aura attack severity, but not duration, while another reported that intranasal ketamine was not superior to metoclopramide and diphenhydramine in reducing the headache severity. In one trial, subcutaneous ketamine was superior to saline in migraine severity reduction; however, intravenous (I.V.) ketamine was inferior to I.V. prochlorperazine and diphenhydramine in another study. Conclusion: Further double-blind controlled studies are needed to assess the efficacy of ketamine in treating acute and chronic refractory migraines and other primary headaches using intranasal and subcutaneous routes. These studies should include a long-term follow-up and different ketamine dosages in diagnosed patients following international standards for diagnosing headache/migraine.

The Effects of the Capital Adequacy and Liquidity Regulation on Internet Primary Banks (인터넷전문은행의 자본적정성과 유동성 규제에 관한 연구)

  • Basel III (Third Basel Accord or Basel Standards) is a global, voluntary regulatory framework on bank capital adequacy, stress testing, and market liquidity risk. Basel III regulatory ratios include capital adequacy, asset soundness, and liquidity. The capital adequacy variables include BIS capital adequacy ratio, BIS tier 1 capital ratio, and tangible common equity ratio. The asset soundness variables include non-performing loan ratio and non-performing loan coverage ratio. The liquidity regulation variables include KRW liquidity coverage ratio and foreign currency liquidity coverage ratio. This study aims to investigate how capital adequacy standard affects efficiency of internet primary banks. As a result of this study, BIS capital adequacy ratio of domestic internet primary banks is lower than that of commercial banks. In order to maintain sustainable operation considering capital adequacy regulations, it is necessary to expand additional capital. In addition, the delinquency rate and non-performing loan ratio of domestic internet primary banks is gradually increasing due to the maturity of high-yield loans in 2019.

EU Smart City Demonstration and Expansion by the Lighthouse Project (EU 라이트하우스 프로젝트 분석을 통한 스마트시티 실증과 확산을 위한 시사점 도출)

  • The purpose of this study is to provide implications for the demonstration and the spread of smart cities. For this, the European Lighthouse project, a well-known smart city initiative, is analyzed. This article investigates agendas, applied solutions, stakeholders and cooperation, and expansion strategies in the 18 Lighthouse projects implemented by the EIP-SCC Smart City Demonstration Project. Four implications are discussed for Korean smart city projects. First, in promoting smart cities, clear philosophies and principles should be established in response to global issues such as climate change. Second, smart cities should be understood as the approaches for problem-solving rather than simply applying advanced technology. Third, a business system should be established in a way to meet the needs of the actors participating in the smart city demonstration project. Finally, an evaluation framework should be established to verify the performance of the project. High-performing best-practice projects should be supported by articulating their standards for their lessons to be spread into other cities. The implications presented here can contribute to developing smart city models along with follow-up studies.
