국제투자에 있어서 간접수용에 관한 연구 - 간접수용의 요건을 중심으로 - (A Study on the Indirect Expropriation in International Investment - Focused on the Requirements of Indirect Expropriation -)

  • The contours of the definition of an indirect expropriation are not precisely drawn. In some recent ICSID decision, tribunals have interpreted the concept of indirect expropriation narrowly and have preferred to find a violation of the standard of fair and equitable treatment. Thus, I analyzed the three Requirements of Indirect Expropriation basis of ICSID Cases as below. First, the effect of measure upon the economic benefit value as well as upon the control over the investment will be the key question when it comes to deciding whether an indirect expropriation has taken place. Whenever this effect is substantial and lasts for a significant period of time, it will be assumed prima facie that a taking of the property has occurred. Second, legitimate play a key role in the interpretation of the fair and equitable treatment standard. But they also found entry into the law governing indirect expropriation. Finally, the duration of a government measure affecting the interests of a foreign investor is important for the assessment of whether an expropriation has occurred.

  • Under current international investment law clear criteria to determine standards of indirect expropriation are absent. Arbitral tribunals determine on a case-by-case whether an indirect expropriation has occurred by conducting a fact-based inquiry. However, three common determination standards can be inferred by analyzing prior arbitration cases. The appropriate analytical framework that can be applied to determine whether a state's measure constitutes an indirect expropriation is as follows. i) the degree of economic invasion of the state's action into the foreign investor's property rights and durability of the period, ii) interference with the foreign investor's distinct and reasonable investment-backed expectations, and iii) the nature, purpose and character of the state's measure. Therefore, it is necessary to fully acknowledge and to utilize strategically this determination standard. However, derived standards cannot be applied to all disputes en masse. So, it is desirable to exclude ambiguity and to clearly define the determination standard of indirect expropriation in investment agreements, since arbitral tribunals can apply different determination standards on a case-by-case basis. And, based on the discussions until now, more developed standards and direction in response to demand should be established through consistent analysis and review of precedents related to indirect expropriation. Lastly, This study is expected to be a useful guideline to prepare a necessary countermeasure to prevent dispute related to indirect expropriation beforehand or in case of dispute occurrence.

부모의 양육태도가 공동체의식에 따라 대학생의 다문화 수용에 미치는 영향 (The Effect of Parenting Attitude on the Multicultural expropriation of University student According to Community Spirit)

  • 본 연구의 목적은 대학생이 인식하는 부모의 긍정적 부정적 양육태도가 다문화 수용에 미치는 영향과 그 과정에서 공동체 의식의 매개효과를 검증하는데 있다. 이를 위해 한국청소년정책연구원 7차 년도 자료를 기준으로 대학교에 입학한 1학년 학생 1,336명을 표본으로 추출하여 회귀분석을 실행하였다. 연구결과를 살펴보면 첫째, 대학생이 인식하는 부모의 긍정적 양육태도는 다문화 수용에 정(+)적인 영향을 미치며, 부정적 양육태도는 다문화 수용에 부(-)적인 영향을 미치는 것으로 나타났다. 둘째, 공동체 의식은 대학생의 다문화 수용에 정(+)적인 영향을 주고, 긍정적 부정적 양육태도와 다문화 수용 사이에 부분매개 역할을 하는 것으로 나타났다. 위와 같은 연구결과를 바탕으로 부모의 긍정적 양육태도와 다문화 수용을 높이고, 긍정적 양육 태도와 공동체 의식을 고취시키기 위한 다양한 프로그램의 개발과 적용을 제시하였다.

간접수용의 보상에 관한 ICSID 중재사례 연구 (A Study on the ICSID Arbitration Cases for Compensation of Indirect Expropriation)

  • State's compensation obligation accompanied in case of indirect expropriation of foreign investor's investment asset has been established definite principle under international investment law. But the concrete and unified application criterion regarding valuation methods for measuring compensation have not been established yet. The World Bank investment guideline is adopting the Hull's Formula, which is understood as the full compensation standard with prompt adequate effective compensation and Fair Market Value method. It is a general principle that compensation should be equal to the fair market value of investment asset just before indirect expropriation date. However, there is a problem of the valuation method of fair market value of investment asset. In general, discounted cash flow, liquidation value, replacement value, book value, etc. can be the applicable standards. Arbitral tribunals determine compensation by adopting proper valuation method on a case-by-case basis according to the discretion based on the arbitration parties' experts' review on the presented opinion and by considering fact relevance of the issued dispute. This compensation includes also interest, recently it tends to award according to compound interest rather than simple interest. Beginning of the period to generate interest is the next day of the indirect expropriation occurrence date. And it should be considered that interest until the payment of compensation is also included. In addition, it should be considered that mental damages is available only when there's a basis to prove this or special case. Therefore, this study suggests to review of precedents related to indirect expropriation and concretely specify compensation valuation standard and method of indirect expropriation on investment agreements through enough consultation beforehand.

  • It is a well recognised rule in international law that the property of aliens cannot be taken. The question of whether indirect expropriation and government regulatory measures require compensation is an important issue in international investment law. Bilateral investment treaties and other investment agreements contain brief and general indirect expropriation provisions. These focus on the effect of government action and do not address the distinction between compensable and non-compensable regulatory actions. It is generally accepted that a state is not responsible for loss of property or for other economic disadvantages resulting from bona fide general taxation accepted as within the police power of states, provided it is not discriminatory. Yukos Oil Company is a Russian oil and gas company engaged in exploration, refining, and marketing activities. It is one of the largest oil and gas companies in the world. Yukos Oil Company has its production operations in Russia and markets its products in Europe. An international tribunal ordered the Russian government to compensate a group of Spanish investors for the losses they suffered when Russia seized the Yukos Oil Company on July 26, 2012. This has been the subject of several judicial proceedings and academic publications. This paper explores which circumstances do not lead to taxation amounting to expropriation. The author suggests that under the following circumstances, taxation would not amount to expropriation. First, taxation should be non-discriminatory. Also a lawful exercise of the taxation powers of governments would not amount to expropriation.

  • 본 논문은 "지방토지수용위원회" 제도의 문제점을 개선하기 위해 영국과 미국의 토지수용 제도 등 이론적 고찰을 통해 정책적 시사점을 도출하는 한편 지방자치단체 토지수용 사례를 중심으로 개선방안을 모색했다. 첫째, 미국의 토지수용(Takings)은 공청회(Public hearing)와 배심제(The jury)의 활용이다. 토지수용권(Eminent domain)을 통해 재산을 강제수용하기 위해서는 공청회를 통해 이해관계인과 시민들에게 수용에 대한 필요성과 인식을 나누고 있으며 사업시행자 (행정기관)가 법원에 소송을 제기하여 공용수용권을 행사하도록 한다. 둘째, 영국의 강제매수(Compulsory Purchase) 제도는 의회가 제정한 법률에 근거를 가져야 하고 CPO를 사용하겠다는 결의도 지방의회에서 결정하게 하여 권력남용을 방지하는 시스템을 갖추고 있다. 셋째, 한국의 지방자치단체 토지수용위원회 개선방안으로 ${\triangle}$지방토지수용위원회 전문성 확보 ${\triangle}$유형별 신속한 토지수용 ${\triangle}$권리보호를 위한 대안제도 마련 등이 필요하다.

공공수용 보상에 관한 유인체계 분석 (Incentive Structures in the Compensation for Public Expropriation)

  • 본 연구에서는 토지수용 관련 보상액 산정과정과 관련한 이해구조를 순차게임모형을 통하여 분석하였다. 우선 공공사업을 추진하는 수용자와 토지를 수용당하는 피수용자 모두가 특정한 조건하에서는 법에서 정하는 정당보상액에 비해서 많은 금액을 보상액으로 책정하고자 하는 유인이 존재할 수 있음을 모형을 통해 도출하였다. 또한 토지수용에 대한 피수용자의 반발 수준을 정하는 모형을 통해 피수용자가 보상금을 더 많이 받기 위해 전략적으로 갈등을 일으킬 유인이 존재함을 보였다. 그리고 이를 통해 과다보상의 문제를 해결하고 정당보상이 이루어지도록 하기 위해서는 수용자와 피수용자가 가지는 인센티브가 보상액 산정에 미치는 영향을 최소화할 필요가 있음을 보였다. 이를 바탕으로 현재의 감정평가제도의 문제점을 살펴보고 관련 제도 개선방향 등을 모색하였다.

Changes in Parks and Green Spaces Ratio According to Land Ownership Processing Method in Urban Development

  • The purpose of this study was to analyze land use plans of 61 residential complexes and identify the factors that caused the variation of urban parks and green space ratio depending on the land ownership processing method. The ratio of urban parks and green space of expropriation districts was higher than that of replotting districts. Within the same city and country as well as other regions, the parks and green space ratio of land expropriation districts increased higher than 7% compared to that of replotting districts. The variation of urban parks and green space ratio was mainly related to the ratio of road. Small housing complexes such as detached house and quasi-residential sites resulted to expand space for road construction, thus, the areas of urban parks or green space came to reduce. The average urban parks and green space ratio in the urban development by the expropriation method and replotting method are 24.5% and 16.8% respectively. In order to prevent the reduction of urban parks and green space ratio according to the preference of detached house sites or quasi-residential sites in development zones, it is necessary to make systematic adjustment such as adjusting the urban parks and green space ratio securing standard.

NAFTA 환경관련 투자중재사건 분석과 한미 FTA에의 시사점 (Analysis of Environment-Related Investment Arbitration Cases under NAFTA and Their Implications for the Korea-U.S. FTA)

  • Because the Korea-U.S. Free Trade Agreement (Korea-U.S. FTA) and the North American Free Trade Agreement (NAFTA) have an overlapping contracting party, the United States, their provisions have much in common. The investment chapters of these agreements, especially, show many similarities, and thanks to these similarities, it is likely that the Korea-U.S. FTA arbitration tribunal for investor-state disputes regarding the environment will put great weight on the NAFTA tribunals' interpretations of those similar provisions. Since the NAFTA tribunals have already handled many environment-related arbitration cases, their interpretations will help heighten the predictability of environment-related Korea-U.S. FTA arbitration cases. This paper analyzes the environment-related NAFTA cases in which the tribunal has issued an award, which are the Metalclad case, S.D. Myers case, Waste Management case, Methanex case, Glamis Gold case, and Chemtura case. According to this analysis, the most controversial NAFTA provisions have been Article 1102 (national treatment), Article 1105 (minimum treatment standard, fair and equitable treatment), and Article 1110 (expropriation). The NAFTA tribunals applied the requirement of these articles in a strict manner, reducing the possibility of finding a violation. After the aforementioned analysis, this paper proceeds to compare the national treatment, minimum treatment standard (fair and equitable treatment), and expropriation provisions of the Korea-U.S. FTA and NAFTA and to predict the impact that the environment-related awards under NAFTA can have on environment-related Korea-U.S. FTA cases. It is expected that the NAFTA interpretations of the national treatment and minimum treatment provisions are likely be used as they are, but not the interpretations of expropriation, because of the differences in the expropriation provisions of the two agreements.

지리정보체계 기반의 지방청 용지보상시스템 구축 (Development of Land Compensation System Based on GIS for the Regional Construction Management Office)

  • 도로건설과 같은 공공사업을 수행하기 위해서는 사유재산의 사용이 불가피하게 발생하게 되며, 토지 등의 사유재산을 사용하기 위해서는 적절한 보상이 이루어져야 한다. 이러한 보상업무는 업무절차가 복잡하고 보상대상이 다양하여 업무처리를 위한 전자처리체계 개발이 요구된다. 지방청 용지보상시스템은 도로건설시 보상업무의 기반이 되는 용지도에 지리정보체계(GIS) 기술을 적용, 도면상의 토지위치 정보와 연계하여 보상계획의 수립, 보상현황의 파악, 보상업무의 관리를 할 수 있도록 하였으며, 협의보상, 수용$\cdot$재결 및 공탁 등의 제반업무를 효과적으로 처리할 수 있도록 구현하였다. 향후 본 시스템을 활용하여 토지재산관리체계로 확장$\cdot$발전시켜 운영함으로써 보상결과의 활용성을 제고하고, 국가로 소유권이 이전된 토지에 대한 정확하고 합리적인 관리를 실현할 수 있을 것이다.
