Price Escalation Clause of Letter of Credit (신용장의 에스컬레이션 조항)

  • The purpose of price escalation clauses has the effect of increasing the L/C value subject to external pricing mechanisms. This will be found inter alia in metals and oil products transactions. Such a clause gives rise to a question. That is, whether it is enforceable or whether it constitutes a letter of credit. The problem is what to reference to a source outside the context of a letter of credit constitutes a non-documentary condition rendering the undertaking something other than a letter of credit. Reference to an objective and readily available index is not something that renders the undertaking obscure and is not "non-documentary in the sense that it is possible to make an objective verification of the data. The possible solution is that not every non-documentary condition will be disregarded. For example, an index specified in the credit will not be disregarded as stipulated in ISP98 and URDG758. If a non-documentary is "central and fundamental", it seems that the parties intended a dependent payment obligations. The most common means of overcoming this conflicts of interests is to issue an instrument incorporatingan escalation clause, but capping the bank's maximum payment obligation.

Bright Light Therapy in the Morning or at Mid-Day in the Treatment of Non-Seasonal Bipolar Depressive Episodes (LuBi): Study Protocol for a Dose Research Phase I / II Trial

  • Objective This study protocol aims to determine, using a rigorous approach in patients with bipolar disorder (BD) and non-seasonal major depressive episode (MDE), the characteristics of bright light therapy (BLT) administration (duration, escalation, morning and mid-day exposures) depending on the tolerance (hypomanic symptoms). Methods Patients with BD I or II and treated by a mood stabilizer are eligible. After 1 week of placebo, patients are randomized between either morning or mid-day exposure for 10 weeks of active BLT with glasses using a dose escalation at 7.5, 10, 15, 30 and 45 minutes/day. A further follow-up visit is planned 6 months after inclusion. Patients will be included by cohorts of 3, with at least 3 days of delay between them, and 1 week between cohorts. If none meet a dose limiting toxicity (DLT; i.e hypomanic symptoms), the initiation dose of the next cohort will be increased. If one patient meet a DLT, an additionnal cohort will start at the same dose. If 2 or 3 patients meet a DLT, from the same cohort or from two cohorts at the same dose initiation, the maximum tolerated dose is defined. This dose escalation will also take into account DLTs observed during the intra-subject escalation on previous cohorts, with a "Target Ceiling Dose" defined if 2 DLTs occured at a dose. Discussion Using an innovative and more ergonomic device in the form of glasses, this study aims to better codify the use of BLT in BD to ensure a good initiation and tolerance.

  • Android platform is designed to be user-friendly, yet sometimes its convenience introduces vulnerabilities that normal users cannot justify. In this paper, after making an overview of popular open source analysis tools for android applications, we point out the dangerous use of Permission Group in current Google Policy, and suggest a technique to mitigate the risks of privilege escalation that attackers are taking advantage of. By conducting the investigation of 21,064 malware samples, we conclude that the proposed technique is considered effective in detecting insecure application update, as well as giving users the heads-up in security awareness.

  • The business market of architecture has got a system that controls a deposit according to the price function. This system is written on a law of contract about countries. So the main body of construction has to make a reasonable contract. This study is written about a rate of numerical index on controling a deposit. We tried to fine problems and solutions of labor expenses, instrument costs and material costs which is so big and changable on the construction market Labor expenses are expressed according to the rate of construction scale between direct and indirect cost that applies ability of works. Instrument costs are expressed according to an output method of a unit price annually and a weight allowance of local instrument conditions and use frequence. The last material costs expressed according to a local weight allowance make a decision of the material cost index. They applies locally relative index more than absolute one on what uses the price rate of producers and importations. This solutions are not enough to apply to the real market, so it needs to exam and to be on the market after a feasibility study.

Statistical model for forecasting uranium prices to estimate the nuclear fuel cycle cost

  • This paper presents a method for forecasting future uranium prices that is used as input data to calculate the uranium cost, which is a rational key cost driver of the nuclear fuel cycle cost. In other words, the statistical autoregressive integrated moving average (ARIMA) model and existing engineering cost estimation method, the so-called escalation rate model, were subjected to a comparative analysis. When the uranium price was forecasted in 2015, the margin of error of the ARIMA model forecasting was calculated and found to be 5.4%, whereas the escalation rate model was found to have a margin of error of 7.32%. Thus, it was verified that the ARIMA model is more suitable than the escalation rate model at decreasing uncertainty in nuclear fuel cycle cost calculation.

  • This study is the results to survey on the problems and improvable Policies for current escalation system in construction contracts, through a Delphi survey to experts. From the survey results, it is desirable to decide the fluctuation rate of construction cost, which is the requirement of escalation clause, on the basis of inflation rate or construction cost index. The desirable price fluctuation rate is proposed as a $3\%$ level. However, it is difficult for construction companies to cope with the sudden increase of material price in advance, arising from short-term shock factors such as exchange rate and international raw material's price. Accordingly escalation system for specified materials, as an exceptional mode, should be introduced. As a method to calculate the fluctuation rate, ARCA(adjustment rate for the categories of articles) is more desirable than ARI(adjustment rate for an index), because the ARCA can be more reflected the characteristics of each construction work.To rationalize the ARI method, it is needed to announce the wage index, material index and machinery expense index via detailed classification by construction types. Also, it is desirable to prescribe the bidding date as a starting date of the price change, rather than contact signing date. considering the price change can happen since the biddiilg stage.

  • The level of sunk cost and risk-taking theory have been offered as one explanation for the escalation of commitment behavior. This Study attempted to replicate Keil's study in Korea. Keil examined the level of sunk cost associated with the risk propensity and risk perception of decision-makers, and these factors are assessed for cross-cultural robustness using matching laboratory experiments carried out in three countries. The level of sunk cost and the risk perception of decision-makers contributed significantly to their continuous willingness to their project. Moreover, the risk propensity of decision-makers was inversely related to risk perception, and this inverse relationship was significantly more weak in Korea than in Singapore. These results show that the sunk-cost effect exists across cultures, and that the risk-taking behaviors are partially mediated by cultural factors.

  • Since 80th, in the monetary markets due to the escalation of creditable promptness dealing of financial goods, Korea monetary business has been confronted with structual contradictions. The first like a men power reduction, inorder to meet and satisfying with cost reduction policy of the holding firms and secondly, escalation and expention of business networks or facilities inorder to meet and satis~'ing with customers continuously seeking for prompt, acurate, and helpfulness service nearly like one similar to a door to door service. Accordingly, the firms eventually poured mere sweaty money into procuring such devices for upgrading. On the contrary, however, regardless the escalation monetary expenditure may be, inorder to promote quality of the same devices are keen necessary because present days customer groups were tended to receives ample service almost like door to door service without moving too$$\mu$h apart from the immediate spot where they belongs tl or veryspot of where actually they spend instead of deep consideration of natures, quality or sttractiveness of service medias what they can received from. Under the present circumstance, the financial business firms, however, would highly suffering and recei\ulcornerves pressures from imblalance natures ofincoming and out go of the business budget due to excessive inc1ease of managerial expences. For these reasons, therefor, in order to solves, compensates, improves, and developes most effective fina\ulcornerncial service for customers can use under most pleasant environment, the establishment of adequate standardization of such service devices based on the foregoing environmental circumstances. This analytical study, therefor, mainly aimed and emphasized based on pre- estimatimation of proper de\ulcornervlopment and use of the unattended servicing devices such as Cash Dispenser and Auto Teller Machine bygeneralization, automating. and innovation of design to meet compactness and door to door like convenient service for customers which can be achieved by performing constant comparative analysis and continual study toward development of such devices those of which produced by Five (5) major domestic producers aro~nd the country.
