中國通用航空立法若干問題研究 (Some Issues on China General Aviation Legislation)

  • General aviation and air transport are two wings of the civil aviation industry. Chinese air transport is developing rapidly, and has become the world second air transport system only second to US since 2005. However, Chinese civil aviation is far behind the world average level, and cannot meet requirements of economic construction and social development. The transition and structural adjustment of Chinese economy provide the general aviation with a unprecedented broad market. The prospect of general aviation is promising and anticipated. The development of general aviation industry needs the legislative supports, and the current legislative conditions of Chinese general aviation are undoubtedly far behind the realistic requirements. Accelerating the legislation in Chinese general aviation industry requires scientific legislation concept. First, Legislation must promote development of general aviation industry. The general aviation will serves as a Chinese emerging industry that boosts domestic demand, promotes employment and expedite domestic economic development. We should, based on both the concept of promoting the industrial development of general aviation and national industrial planning, enact and rectify relative laws and regulations. And we should also straighten out the relationship between aviation security and industrial development and promote the revolution of low-altitude airspace management in an all-round way, in order to improve the utilization rate of airspace resources, classify and establish airspace, simplify examination and approval procedure and intensify operation management. In addition, what we should do is to expedite the infrastructure layout construction, guide the differentiated but coordinated development of general aviation industries in various areas, establish a united supervision mechanism of general aviation, redistrict the responsibilities of Chinese Air Control Agency and set up legislation, law enforcement and judicial systems with clarified institutions, clear positioning and classified responsibilities, so as to usher in a new era of the legislative management of Chinese general aviation industry. Second, shift the focus from regulations to both regulations and services. Considering the particularity of the general aviation, we should use American practices for reference and take into account both regulation and service functions when enacting general aviation laws. For example, we should reduce administrative licensing and market supervision, and adopt "criteria" and "approval" management systems for non-commercial and commercial aviation. Furthermore, pay attention to social benefits. Complete social rescuing mechanism through legislation. It should be clarified in legislation that general aviation operators should take the responsibilities of, and ensure to realize social benefits of environmental protection and ecological balance .Finally, rise in line with international standards. Modify Chinese regulations which is inconsistent with international ones to remove barriers to international cooperation. Specify basic legislative principles. One is the principle of coordination. Realize coordination between the civil aviation and general aviation, between military aviation and civil aviation, and among departments. Two is the principle of pertinence. The general aviation has its own rules and specialties, needing to be standardized using specialized laws and regulations. Three is the principle of efficiency. To realize time and space values of general aviation, we should complete rules in aerospace openness, general aviation airport construction, general aviation operations, and regulation enforcement. Four is the principle of security. Balance the maximum use of resources of Chinese airspace and the according potential threats to Chinese national interests and social security, and establish a complete insurance system which functions as security defense and indemnificatory measure. Establish a unified legal system. Currently, the system of Chinese general aviation laws consists of national legislation, administrative laws and regulations and civil aviation regulations (CAR). Some problems exist in three components of the system, including too general content, unclear guarantee measures, incomplete implementation details, and lacking corresponding pertinence and flexibility required by general aviation regulations, stringency of operation management and standards, and uniformity of standards. A law and regulation system, centered on laws and consisting of administrative laws regulations, industrial regulations, implementation details, industrial policies and local laws and regulations, should be established. It is suggested to modify the Civil Aviation Law to make general aviation laws complete, enact the Regulations of General Aviation Development, and accelerate the establishment, modification and abolition of Chinese general aviation laws to intensify the coordination and uniformity of regulations.

복잡계 패러다임에서 환경규제의 출현에 대한 연구 (A Study on the Emergence of Environmental Regulation in Complex System Paradigm)

  • 본 연구는 20세기 이후 급속한 과학기술의 발달로 산업의 공업화 및 인구의 도시화 등으로 인류의 생활터전인 환경이 위협받는 현 시점에, 이슈가 되고 있는 환경문제의 해결방안인 환경규제를 복잡계적 사고로 해석을 한 것이다. 산업혁명이후 출현한 산업의 고도화 과정에서 발생하고 있는 다양한 문제점들을 해결하기 위하여 오래전부터 많은 노력들이 시도되었다. 하지만 이러한 현상을 이해하기 위해서는 단순한 무역수준이나 경제 기술적 수준에서 해석할 수 없는 문제가 제기 되고 있다. 이러한 이슈들에 대해 복잡계적 사고를 통해 기술의 진화에 대한 우발성이 아니라 그들이 만들어낸 차이를 인식하고 혼돈의 가장자리에서 새로운 질서를 창발하는 현상에서 복잡계 시스템을 이해하고 선제적 대응 및 관리에 대한 기술적 혁신을 예측할 수 있는 기반을 제공하고자 한다. 복잡계적 사고로 분석해보면 지구가 처한 환경문제는 혼돈의 가장자리에 자리잡고 있다. 이러한 부분은 공공적인 부분에서 주도를 하고 있지만 이들만의 노력만으로는 해결이 되지 않는 다양한 구성요소들 간의 상호작용을 통한 인과관계를 형성하고 있다. 본 연구는 이러한 상호작용으로 환경규제에 대한 새로운 질서의 창발현상을 설명하고 있으며 환경규제를 공공적인 부분만의 질서가 아니라 민간 혹은 기업에서의 의지와 행동이 임계점에 도달하여 새로운 질서를 창발하는 노력이 필요함을 제시하고자 한다. 따라서 불확실성에 대한 환경규제의 새로운 질서를 이해하려는 기반을 제공하고자 한다.

주거지역 종세분화에 따른 주거환경 개선에 관한 연구 - 바람길을 중심으로 - (A study of Improvement for Residential Environment according to Segementation of Residential Zoning)

  • Various environmental problems due to rapid industrialization and urbanization have worsened to such an extent that they threaten the environmental restitution of the globe and become a critical international issue. Korean government has presented the concept of green growth as a new state vision for the next 60 years and is making efforts to solve these environmental problems. Daegu Metropolitan City has faced various environmental problems including overpopulation of the city, traffic pollution, household waste accumulation and the green zone problem because of the increase of urbanization over the last few decades. As such urbanization continues, the quality of residential environments is rapidly deteriorating and the intensive use of the land leads to an increase of building area, raising the temperatures of cities. There have therefore been demands for healthy, pleasant and satisfying residential environments and for the improvement of existing residential environments, and this demand has been fully recognized by society. Nevertheless, current residential complex developments concentrate only on raising the efficiency of land use. In related laws of the past (Daegu Metropolitan City, Urban Planning Municipal Ordinance as of October 10, 2003) an attempt was made to impose a standard to segmentalize the building-to-land ratio, floor area ratio and regulations of number of floors vertically. However, these laws have now been abolished and the regulations are being eased. The purpose of this study was to analyze the characteristics of the floating wind before and after the vertical segmentation of residential areas (Daegu Metropolitan City, Urban Planning Municipal Ordinance as of October 10, 2003) by using KLAM_21, a model that enables analysis and prediction of the flow and generation of cold wind. The purpose is also to present a plan to improve the quality of residential areas when developing a building lot and redeveloping housing areas.

  • Various environmental problems due to the rapid industralization and urbanization have been worsened as much as to threaten the environmental restitution of globe and become a critical international issue. 효율성과 무지, 그리고 환경피해 - 석면 사용과 악성중피종 발생의 장기관계 - (Efficiency, Ignorance, and Environmental Effect - long-run Relationship between Asbestos Consumption and the Incidence of Mesothelioma -)

  • 경제성장과정에서 석면을 활용해왔지만, 석면이 치명적인 환경성질환을 유발하는 1급 발암물질로 지정되면서 전 세계적으로 엄격한 석면사용규제 조치를 실시하고 있다. 석면노출과 환경성질환의 발현 간에 수십 년에 걸친 장기 잠복기가 존재한다는 특성을 고려하여, 한국의 석면 소비량과 악성중피종 발병 간의 시차를 분석하고 장기관계를 추정한다. 이와 함께, 한국에 비해 상대적으로 석면규제가 오랜 기간 이루어지고 장기시계열 자료를 갖춘 영국과 미국을 대상으로 한 비교분석도 병행한다. 시차분석에서는, 3개 국가 모두에서 30년 이상의 장기시차가 존재할 때, 석면 소비와 악성중피종 발병 간의 교차상관성이 높은 것으로 나타난다. 또한 변수간 장기시차가 존재할 경우 석면 소비량과 악성중피종 발병 간에 장기균형관계가 존재한다. 그리고 시차분포모형을 활용한 결과, 석면 소비량이 장기시차를 두고 악성중피종에 유의한 정의 영향을 미치고 있다.

중국의 지역별 전통적 생산성과 환경조정생산성의 비교 (Comparison of Traditional Productivity and the Environmentally-Adjusted Productivity in the Chinese Regions)

  • 본 연구의 목적은 중국의 28개 성과 자치주를 대상으로 성장회계분석에 기초하여 전통적 생산성 성장과 환경조정 생산성 성장을 비교함으로써 각 지역의 생산성에 미치는 환경요소의 효과와 경제성장의 주된 요소를 실증적으로 계측하고자 함이다. 추가적으로 환경조정 생산성 변화를 측정하기 위해서 중극 지역별 SOx의 존재가격을 측정할 것이다. 1997년~2005년 동안 중국은 장기적으로 10.06%인 고도의 경제성장률을 보였다. 지역별로 동부의 성장이 가장 빠르고 중부의 성장률이 가장 낮다. 전통적 총요소생산성은 평균적으로 3.56%로 나타났고 지역별로 동부가 가장 높았다. 환경조정된 생산성 증가율은 평균적으로 3.57%로서 전통적 생산성 증가율과 큰 차이는 나지 않았다. 이는 세 지역에서 오염저감활동이 적극적으로 이루어지지 못하고 있음을 보여준다. 따라서 정책적으로 중국 정부에서는 환경 규제를 부단히 강화시키거나 제정된 환경규제를 엄격히 집행할 필요가 있다.

염화벤잘코늄(Benzalkonium chloride) 살균제의 용도 및 건강 위험에 대한 고찰 - 가습기 살균제를 중심으로 (A Review on the Health Risks Associated with the Use of Products Containing Benzalkonium Chloride (BKC), Focusing on Humidifier Disinfectant Products)

  • Background: Benzalkonium chloride (BKC) has been extensively used as a preservative in industrial products and in hygiene, medical, and cosmetic applications. Humidifier disinfectant (HD) products containing BKC have been used in South Korea. Objectives: This study was aimed to review types of products containing BKC, to summarize the regulations in the US, EU, Japan, and South Korea, and to review the health effects associated with the use of HD. Methods: We reviewed and summarized documents which were searched through PubMed and Google Scholar with the key words: BKC and asthma/contact dermatitis, humidifier disinfectant-associated lung injury (HDLI), and more. Results: Regulations in most countries including South Korea do not allow its use as disinfectants in spray-type of products for medicine, cosmetics, and household products. Two types of HD containing BKC (800~1,270 ppm) were marketed in South Korea from 1996~2003. Health effects reported from people who used products containing BKC were allergic contact dermatitis, erythema, and respiratory disease, including asthma. Two people who responded as HD users containing BKC only were confirmed to have developed asthma. HD-associated lung injury (HDLI) was reported by consumers who used both HD containing polyhexamethylene guanidine (PHMG) and HD containing BKC. Conclusions: In conclusion, the use of BKC as a biocide has to be controlled considering the route and pattern of exposure. Products containing BKC as preservatives were reviewed with exposure routes and sites in the human body such as skin, eyes, and the respiratory tract. HD containing BKC was clinically evaluated to be associated with asthma.

The development of the seismic fragility curves of existing bridges in Indonesia (Case study: DKI Jakarta)

  • Seismic regulations have been updated from time to time to accommodate an increase in seismic hazards. Comparison of seismic fragility of the existing bridges in Indonesia from different historical periods since the era before 1990 will be the basis for seismic assessment of the bridge stock in Indonesia, most of which are located in earthquake-prone areas, especially those built many years ago with outdated regulations. In this study, seismic fragility curves were developed using incremental non-linear time history analysis and more holistically according to the actual strength of concrete and steel material in Indonesia to determine the uncertainty factor of structural capacity, βc. From the research that has been carried out, based on the current seismic load in SNI 2833:2016/Seismic Map 2017 (7% probability of exceedance in 75 years), the performance level of the bridge in the era before SNI 2833:2016 was Operational-Life Safety whereas the performance level of the bridge designed with SNI 2833:2016 was Elastic - Operational. The potential for more severe damage occurs in greater earthquake intensity. Collapse condition occurs at As = FPGA x PGA value of bridge Era I = 0.93 g; Era II = 1.03 g; Era III = 1.22 g; Era IV = 1.54 g. Furthermore, the fragility analysis was also developed with geometric variations in the same bridge class to see the effect of these variations on the fragility, which is the basis for making bridge risk maps in Indonesia.

폐기물을 이용한 고화처리토의 차수효과 (The Permeability Characteristics of Solidified Soil Using Wastes)

  • Seaweed waste(SWW) was used to improve the liner effect in recycling of dredged soil as the landfill liner. It was found that the compressive strength became somewhat lower when SWW was added than that was when Ordinary Port-land Cement(OPC) only was added. The permeability coefficient, however, became lower in this case which showed the lowest permeability coefficient when the addition of SWW was one percent. Hence, to comply with the regulations for the compression strength and permeability coefficient of landfill liner, the addition of OPC should be over eight percent and that of seaweed waste one percent. The results of leaching test showed that the solidified material was not against the laws of waste control, so it is possible to use as the landfill liner and to expect sufficient economic effects because wastes such as dredged soil and seaweed can be recycled.

환경영향평가 주민참여의 제도적 문제점과 내용분석 (A Study on Public Participation in Environmental Impact Statement: Focused on Systematic Aspects and Content Analysis)

  • This paper examined public participation in the final Environmental Impact Statement(EIS) in terms of institutional procedures and content analysis. By reviewing EIS Draft Manual and related laws and regulations, seven problems were identified in the system. The content of public participation in 14 EISs were analyzed by a developed protocol, most results of which were similar to the identified seven problems. In conclusion, this paper suggested that the systematic problems should be improved to activate more efficient public participation.
