  • The safety and health law, the basic regulation of occupational safety and health for industry, is overlappingly and unconsistently controled and by many non-profit organization or / and government organization. Because of above reasons, it is hard to investigate and suggest consistently. This study is proposed to remove inefficient and overlapping regulation and suggest how to manage the safety and health regulation in private industry. Safety and Health is the most important managed area under business environment. The safety and health regulation or law for Korean Private industry is compared with foreign country's law.

  • For many people, the digital domain is becoming as important as the real world. The virtual environment is no longer just a place for entertainment and leisure. Blockchain transactions are serious business. Digital assets are seen as investments, with as much real value as physical assets. Does the law protect rights in digital assets, such as cryptocurrencies and NFTs? This article discusses recent case law that expands the common law concept of property to digital assets.

  • This paper introduces experimental investigates of an accident pattern for the distributing cross linking-polyethylene(XLPE) cable terminations considering product liability(PL) law environment. The influence of defects such as thickness and length decrease of XLPE, an impurity on XLPE and the gap between stress-con of housing and semi-conductor on insulating properties of the termination have been studied. The thickness and length decrease of XLPE decrease ac breakdown strengths. Breakdown traces of XLPE that is damaged by knife displayed ellipse shape. The gap of between stress-con and semiconductor deteriorates dielectric strength of XLPE seriously.

  • 1994년 "유엔해양법협약" 의 발효로 새로운 국제해양법제도가 확립되면서 세계 각국은 통일적인 해상집법체제를 구축함으로써 관할해역에 대한 종합적인 관리를 강화하고 있다. 그러나 중국은 아직 전통적인 분산형 산업관리체제를 유지하고 있어 기존의 해상집법역량은 날로 확대되는 국가주권과 해양권익의 수호요구를 충족시키지 못하고 있다. 따라서 본 연구에서는 한 중 일 3국의 해상집법체제를 비교 고찰하고 중국해상집법체제의 주요 문제점을 분석한 후, 해경을 중심으로 한 통일적인 해상집법체제의 개선방안을 제시하였다.

Freedom of contract in the digital age and its implementation in modern technologies: theory and practice

  • Scientific and technical development, as well as the emergence of new types of contracts, which do not have their expression in current legislation, force us to explore the issues of contract law to adapt to change. In this context, the principle of freedom of contract is fundamental, which states that each person has the right to enter into a contractual relationship at his discretion. However, such freedom is not absolute, because the freedom of one person should not violate the freedom of another. Together with the conflict of private and public interests, these phenomena are a field for the study of topical issues of theory and application of the principle of freedom of contract in practice. Research methods are philosophical, general scientific, and special scientific methods, in particular, system-structural, formal-legal, hermeneutic; methods of analysis, synthesis, etc. As a result of the research, the main characteristics of the principle of freedom of contract, its role for private law regulation of contract law are given; approaches to understanding the restriction of contract freedom are analyzed; typical examples and means of such restrictions are identified; demonstrated how contract freedom is embodied in the use of IT tools, which types of contracts are most common in the digital environment.

  • This study was conducted to confirm the research trend related to law librarians abroad. To this end, we collected articles about law librarians from abroad and analyzed the author's keywords and abstracts. As a result, it was confirmed that the primary roles of law librarians are legal research service, legal information service, and education service, and discussed topics on the changed roles of law librarians according to changes in the legal research environment and strengthening their expertise. Based on the results, the issues and directions for research about law librarians in Korea were proposed.

  • In this digital environment, license contracting and technical protection measure are being used by copyright holders as a means to restrict the rights of information users. The study reviewed the conflicting relationship between the copyright law and the contract law for digital resources the use of which is based on license contracting, and investigated the legal interpretations of the conflicting relationship between the two. And then based on the analysis of IF LA's position on copyright in the digital environment, the study suggested the expected role of librarians to cope with the technological overrides of copyright rules and to expand the rights of information users.

  • The document delivery service has been influenced by the changing digital information environment and the copyright law. This paper proposes the key points for the improved documents delivery service through trend analysis of BL(The Great Britain), NLA(Australia), subito(German speaking countries), JST(Japan), KISTI(Korea) and KERIS(Korea) and copyright law in each country. The purpose of this study is providing with the clues for developing strategies that can satisfy the users' needs in document delivery service for libraries and information centers.

  • This paper deals with design procedure of online guidance and control law for future missiles that requires agile maneuverability. For the purpose, the missile with high powered side thruster is proposed. The guidance and control law for such missiles is discussed from a point of view of optimal control theory in this paper. Minimum time problem is solved for the approximated system. It is derived that bang- bang control is optimal input from the necessary conditions of optimal solution. Feedback guidance without iterative calculation is useful for actual systems. In this paper. multiple design point method is applied to design feedback gains and feed forward inputs of the guidance and control law. The numerical results show that the proposed guidance and control law has a high -performance for wide-ranging boundary conditions.
