  • Traditional analyses of patent system have considered innovations in isolation and precluded the technological interrelationships between innovations. Common feature of cumulativeness during the process of technological change, however, brings the scope of patent protection into the major policy concern and currently occupies the central position in recent patent reform controversy. This study surveys the recent developments in the economic analysis of patent scope with corresponding introduction to the legal perspectives regarding patent scope. Although the issue of patent scope is complex in nature and depends crucially upon technological environment and the nature of innovations, this study can enlarge the understanding of the pros and cons of patent scope policy, which will become increasingly disputable in the forth-coming era of specialized patent court in Korea.

  • The first thing to be prioritized is to set the scope of the management system when establishing an information security management system for systematic and effective information security management. It is important to set the scope for an organization's information security goals due to the scope affects the organization's overall information security activities. If the scope is set incorrectly, it might become impossible to protect important services and therefore, the scope of the management system should be determined in consideration of the core business services of the organization. We propose a core service selection model based on the organization's mission-critical service and high risk service in order to determine the effective information security management system scope in this paper. Core service selection criteria include the type of service, contribution to sales, socio-economic impact, and linkage with other services.

The main findings out of the analysis are as follows the stage of quality control is concentrated in appraisal phase, the company standard is equiped gradually in non-KS marked company and the need of economic evaluation about quality control is increased gradually. With a view to analysing of relationship between quality control and it's effect factors (company standard, KS mark, computer based information system), the methods of $\chi$$^2$ test are used. The company standard have a significant difference in top manager's altitude to duality control, operation stage of quality control. operation scope of qualify control and quality budgeting system but is insignificant with economic evaluation about duality control. Otherwise, KS mark is insignificant with the equality control activity except for operation scope. The quality information system based in computer have a significant difference in operation stage, operation scope and economic evaluation. Therefor, for the purpose of attaining effectiveness of quality control through the economic evaluation about quality control, the company standard and computer based duality information system must be utilized in quality control activity.

  • Economic evaluation methodologies for railway investments of China and Korea are comparatively analyzed. Chinese procedures specified in the new economic evaluation manual of 1997 were compared with those of Korea based on the economic evaluation manual of 1982. As expected those procedures reflect general economic requirements of the respective countries. Several differences in the specification are also noted. Details of the specification of Chinese procedure far exceed Korean specification, while Korean manual is rich of explanation on the fundamental theory. Differences in the procedure of calculating benefits of investments are most conspicuous, and specific requirements of carrying out a optimum opening year analysis in Korean procedure is notable. Despite of these differences in the procedure, two methodologies share same objective of ensuring selection of economically and financially sound railway projects. Both procedures of China and Korea, however, limit their evaluation scope on railways alone. Therefore, they are needed to expand scope of evaluation to encompass the idea of multi-modal or inter-modal evaluation, which will eventually contribute to build truly efficient national comprehensive transportation system.

  • Recently, major public owner and general contractors in Korea are actively preparing and improving BIM manuals and guidelines to effectively apply BIM technology in construction projects. These guideline has a purpose to define the scope of the applying BIM technology to each construction phase and to explain the minimum technology guidance required for the initial stage. In situations where BIM data are to be submitted within a limited time and cost at the design stage, a BIM data preparing process should be carried out in advance to meet the BIM interoperability between the pre and post of construction precess. In this research, we propose the scope of the BIM guidelines to meet and to be considered for the BIM based review of constructability and economic evaluation of Apartment.

  • The Scope of Application of North Korea's Foreign Economic Arbitration Act and Foreign Investment Act This article examines whether the Foreign Economic Arbitration Act and the Foreign Investment Act of North Korea apply to South Korean parties or companies. This article analyzes laws and agreements related to economic cooperation between South Korea and North Korea. Furthermore, this article compares and evaluates laws related to foreign investment and enacted in North Korea. Now, North Korea's door is closed due to economic sanctions against it, but it will be opened soon. Thus, this article prepares for the future opening of North Korea's markets. Is there a rule of laws in North Korea or just a ruler? Are there laws in North Korea? North Korea has enacted a number of legislation to attract foreign investors, referring to those Chinese laws. For example, North Korea enacted the Foreigner Investment Act, the Foreigner Company Act, the Foreign Investment Bank Act, the Foreign Economic Arbitration Act, the Foreign Economic Contract Act, the International Trade Act, and the Free Economy and Trade Zone Act, among others. Article 2 (2) of the Foreign Investment Law of North Korea states, "Foreign investors are corporations and individuals from other countries investing in our country." It is interpreted that South Korea is not included in the "other countries" of this definition. According to many mutual agreements signed by South Korea and North Korea, the relationship between the two Koreas is a special relation inside the Korean ethnic group. An arbitration between a South Korean party and a North Korean party has the characteristics of both domestic arbitrations and international arbitrations. If the South Korea and North Korea Commercial Arbitration Commission or the Kaesong Industrial Complex Arbitration Commission is not established, the possibility of arbitration by the Chosun International Trade Arbitration Commission, established under North Korea's Foreign Economic Arbitration Act, should be examined. There have been no cases where the Foreign Economic Arbitration Act is applied to disputes between parties of South Korea and North Korea. It might be possible to apply the Foreign Economic Arbitration Act by recognizing the "foreign factor" of a dispute between the South Korean party and North Korean party. It is necessary to raise legislative clarifications by revising the North Korea's Foreign Economic Arbitration Act as to whether Korean parties or companies are included in the scope of this Act's application. Even if it is interpreted that South Korean parties or companies are not included in the scope of North Korea's Foreign Economic Arbitration Act, disputes between South Korean companies and North Korean companies can be resolved by foreign arbitration institutes such as CIETAC in China, HKIAC in Hong Kong, or SIAC in Singapore. Such arbitration awards could be enforced in North Korea pursuant to Article 64 of North Korea's Foreign Economic Arbitration Act. This is because the arbitration awards of foreign arbitration institutes are included in the scope of North Korea's Foreign Economic Arbitration Act. The matter is how to enforce the North Korean laws when a North Korean party or North Korean government does not abide by the laws or their contracts. It is essential for North Korea to join the New York Convention (Convention on the Recognition and Enforcement of Foreign Arbitral Awards) and the ICSID Convention (Convention on the Settlement of Investment Disputes Between States and Nationals of Other States).

  • Despite competing strategical interests over Southeast Asia that have emerged in the last decade, with the launch of wide scope geopolitical strategies Chinese and Japanese initiatives have been characterized by a certain degree of implicit coordination, particularly in offering support to the Myanmar state's territorializing strategies for economic development. The case of the Thilawa Special Economic Zones (SEZ) is exemplary, as it was a Japan-led project which became a model and benchmark example for similar development initiatives supported by the People's Republic of China.
