Analysis of the Global Data Law & Policy and its Implications: Focusing on the cases of the United States, the United Kingdom, and the European Union (국내외 데이터법·정책 분석 및 시사점: 미국, 영국, EU의 사례를 중심으로)

  • This study presents implications of the Global Data Law & Policy by comparing national data strategies, data regulations and policies, and governance in South Korea, the United States, the United Kingdom, and the European Union. According to the result of the comparative analysis, the biggest difference is in data governance, in other words, the management and coordination of policies at the pan-government level and data ethics. Therefore, this study proposes the establishment of a presidential special committee on data policy or the creation of a 'National Digital Innovation Office' at the Presidential Secretariat as a national CDO for the governance of data policies. Furthermore, this paper suggests a) to enact 'the Framework Act on the Development of Data Industry' that can regulate data practices in the private sector, b) to institutionalize the data-centric security and data protection, c) to settle the public ethics and personnel management based on data expertise and professional ethics, including explainability and responsibility, and d) the education and training systems.

  • Global warming has become one of the most important social responsibilities. After Kyoto protocol for greenhouse gas reduction by climatic change convention came into effect, developed countries are presenting various policies to reduce greenhouse gas that is produced in transport field. One of those policies is modal shift that change from road freight to sea, inland waterway and railway transportation that is eco-friendly. Because increase of road freight brings about road congestion and accident, logistics cost, air pollution and green house gases. Railways are superior to all other modes of transport in mass transportability, high speed, timeliness, safety and environmental-friendliness, but the railway industry has been pushed behind in competition. In developed country's government actively promoted relevant legislation, policies, and countermeasures known as modal shift policies to shift freight transport from road to large volume mode such as railway and ship. In this paper, we discuss the current situation in modal shift, compare it with cases in other countries EU and Japan, identify problems in Korea, and propose the following ways to enhance competitiveness of rail freight.

  • Since the recent COVID-19 pandemic, Internet usage has increased rapidly and companies have shifted to telecommuting. In addition, as more time at home increases and network traffic through streaming services such as games, the Internet, and Netflix increases, cyberattacks and threats are also increasing. Many countries around the world, including Korea, the US, China, and Japan, have various cloud security policies, but they continue to suffer from various vulnerabilities and cyberattacks. This paper analyzes the current cloud security policies of each country and presents a plan to strengthen the cloud security policies in Korea.

A Comparative Study on the NSDI Assessment

  • United States of America started NSDI in 1994 for the first time in the world. EU and other many countries invested lots of budget on NSDI due to necessity to manage countries and social economy. As skepticism for effect of such investment has risen, developed countries predicted higher effect compared to investment using ROI and other methods. FGDC clarified that geospatial information is a critical national assets. USA has managed NSDI by introducing portfolio concept for it recognizing NSDI as financial assets from fixed assets. Currently directions of NSDI and its advancement has been proceeded variably depending on corresponding organizations, human resources, budget and national policies. This study analyzed recent trends regarding NSDI assessment methods from developed countries and researchers. Assessment of NSDI is introduced only by some countries such as EU, USA and Canada. This study analyzed USA's assessment model and indicator that assess NSDI in a way that various external organizations (COGO, URISA) participate, EU INSPIRE Directives, monitoring and Canada's CGDI assessment methods. Besides these, this study analyzed STIG that adopted Financial Infrastructure from European studies and Korea's NSDI monitoring assessment indicator research. Further this study suggested assessment directions for future NSDI through implications of NSDI assessment method analysis.

  • This study reviews maritime transport policy regarding liner conference and the changes in the liner market over the decades. Liner shipping industry has long been protected from competition by block exemption. To prevent excessive competition in punctual operation and its inelastic market structure, liner shipping companies formed conferences that are protected to fix the prices under the law. In the US, deregulation in transport sector began from 80's and continuing with OSRA 1998, conferences were dissolving. On the other hand, the EU with close conference system, Regulation 4056/86 contained block exemption remained in force for unlimited time without review clause. However, in Oct 2008, the EU has announced its removal, and conferences were no longer permitted to fix the price nor exchange information. Although OSRA 1998 has already broken up conferences by allowing individual service contracts, but the repeal of the immunity for price fixing will alter significantly the rule on cooperation in the industry since it is a unilateral move by the EU, especially in transatlantic lane. There are rapid changes in shipping market getting much more complicated, and with removal of 4056/86 allowing the market to be more competitive, opening up the industry with far more diverse strategic options. Hence this paper reviews on liner shipping industry and its changes of policies over the years from protected market to open competition market of today.

A Case Study on the Competitive System of EU Railway Transport Market (유럽 철도교통시장의 경쟁체제 도입사례 연구)

  • This paper examines the situation and tasks of competitive systems of EU transport market focusing on railways. Recently, the EU transport market has changed radically, thanks to an increasingly competitive rail market. The European Commission has stimulated the creation of a competitive environment that will enhance the position of rail. Some scholars have insisted that the rail market is more monopolistic than competitive. However, the case of UK rail privatization suggests this is not the case. Moreover, some countries have a rail market that is more competitive. We draw on a wide range of sources including statistics and analyses of recent phenomena. These demonstrate the emergence of competitive markets in EU rail and the difficulty of developing a competitive market. With regard to the adoption of the competitive market, we examine three things. First, we observe recent cases and trends in competitive markets. Second, we compare the result of competitive markets and non-competitive markets within EU nations. Third, we demonstrate factors of formation of competitive markets and the possible expansion. We identified differences within open market policies amongst EU nations. Although a competitive EU rail market may have some difficulties, it will steadily begin to overcome technological differences and a lack of funds, because EU countries have a common goal, which is to develop the railways, solving, wherever possible both environmental and energy problems. Through this analysis, we found that the free market in EU rail will be extended to deliver efficiency and quality service.

A Study of Policy Conversion in the EU Member States: with Special References to Minimum Income Guarantee (유럽연합의 정책 수렴에 대한 연구: 기초소득 보장을 중심으로)

  • This paper aims to apply the convergence theory into the minimum income guarantee which forms the moral foundation of the welfare state. The research question of this paper is if the level of minimum income guarantee among EU member states (EU-15) gradually converging into a certain level. For this purpose, Chapter 2 describes the convergence and diversion of welfare states since the Second World War, and chapter 3 explains the historical development of the EU social policies since the Rome Treaty (1957). Chapter 4, which is the main body of this paper, analyzes if the level of minimum income guarantees of EU member states is converging by the coefficient of variation analysis and regression analysis. However, converging trend of the level of basic income guarantee among EU member states has not been proved. In other words, social policy arena still remains strongly in the realm of national sovereign states, irrespective of growing pressure from the supra-national governing body like the EU. It is in line with the Abram de Swaan's argument that "welfare states is nation states" (1994: 110).

Assessing the Impacts of EU's Carbon Border Adjustment Mechanisms and Its Policy Implications: An Environmentally Extended Input-Output Analysis (환경산업연관분석을 활용한 탄소국경조정 메커니즘 도입에 따른 국내 산업계 영향 분석과 대응전략)

  • This paper aims to quantify the potential economic burdens of EU's carbon border adjustment mechanisms faced by Korean domestic industries. In addition, this study tries to compare and analyzes changes in the burden of each industry resulted from the implementation of the domestic low-carbon policy. Based on the quantitative findings, we intend to suggest policy implications for establishing mid- to long-term strategies in response to climate change risks. Based on the environmentally extended input-output analysis, the total economic burdens of the domestic industries due to the EU's carbon border adjustment mechanisms are estimated to be approximately KRW 8,245.6 billion in 2030. Looking at the impacts by industry, it is found that major industries such as petrochemicals, petroleum refining, transportation equipment, steel, automobiles, and electric/electronic equipment industries are expected to account for 84.3% of the total potential burdens. In addition, in multiple policy scenarios assuming technological developments and energy transition following the implementation of domestic low-carbon policies, the total economic burden of carbon border adjustment is expected to decrease by about 11.7% to 15.0%. The main result of this study suggests that we should not view EU EU's carbon border adjustment mechanism as a trade regulation, but to use it as a momentum for more effective implementation of the low-carbon and energy transition strategies in the global carbon neural era.

Analysis of the Validity of the China's Resource Export-Quota Restrictive Measures under the GATT/WTO (중국의 자원수출제한조치와 WTO 규칙 부합성에 관한 분석)

  • China's "Foreign Trade law" 16.4 revised in 2004 like "Foreign Trade law" 16.2 in 1994 is still stipulated resource restriction to protect domestic resources and it does not satisfy the introduction of article 20 and section (g) of GATT 1994. Through an interpretation of related regulations and China-EU cokes dispute, the paper points out that China's "Foreign Trade law" 16.4 has no validity of the introduction of article 20 and section (g) of GATT 1994. Comparing China's "Foreign Trade law" 16.4 to GATT 1994 20(g), China's "Foreign Trade law" 16.4 does not include important conditions of GATT 1994 20 introduction such as not being arbitrary or unjustifiable discrimination and disguised restriction on international trade. For example, based upon China's "Foreign Trade law" , if she restricts or prohibits important natural resources that Korea mainly relies on China, it will effects not only trade between two countries but also our lives and securities. Hence, it is highly time to analyze China's the Validity of the China's Resource Export-Quota Restrictive Measures under the GATT/WTO. In the process of resolving China-EU cokes dispute in 2004, ministry of Commerce of China shows well its characteristics of dispute settlement and also we can find out EU's logical countermeasures. Therefore, because of the high possibility of disputes between Korea and China in the area of natural resources, Korea needs to pay attention to the China's resource protecting policies, and if it violates GATT 1994 20 introduction and (g), we should consider to sue China to WTO. The paper believes that it will play an important role as an aggressive demand and effect on amendment of China's "Foreign Trade law" in the long term.

The Role of Early Action for the Effective Introduction of National Allocation Plan (국가할당계획의 효율화를 위한 조기행동 전략 추진 방향)

  • In order to solve problems of global warming, many policies and measures has been implemented in various countries. In January 2005, the European Union Emission Trading Scheme officially started. In order to take it into action, the EU ETS stated that all members must submit the national allocation plan including the national's total allowances, allowances for installations, reserve for new entrants, etc. In the process of this decision-making, it was also stated that problems related with early action should be solved by each member state at its option. This paper is a study on necessity of compensation for early action and its limitation of its practices. With a comparative study on dealing with early action in the key nations including Germany, the Netherlands and United Kingdom, we can get insights and strategies for effective processes of dealing with early action and the direction for harmonizing data collection and allocation rules.
