전자 계약시스템에서의 디지털 다중서명 방식 (Digital Multisignature Schemes in Electronic Contract Systems)

  • We analyze risks andd present the requirements of digital multisignature in electronic contract systems where several persons contract a digital document electronically. We also apply a few digital multisignature schemes that have been developed so far, to the electronic contract system and propose a new digital multisignature scheme based on the Fiat-Shamir scheme. We investigate how these schemes satisfy with the requirements and evaluate their efficiency in terms of processing speed. communication complexity, and message length Owing to the high processing speed and the high degree of satisfaction to the requirements, the proposed scheme is suitable for electronic contract systems.

  • Although digital contents markets grow very rapidly and are known as a higher value added industry, there is also potential risk in producing digital contents. Thus, many firms have begun to produce a firm's digital contents by outsourcing from other companies in order to catch-up new technologies and to make stable profits. However, since contracts are decided mostly based on bidding price and also standard contract are not available, there is a limit on the benefit from the contents outsourcing. Thus, this study argues that if both contract factors such as contract concreteness and flexibility are well managed, the on-line digital contents will increase the performance of a firm. This study deals with the influence on the firm's performance by the outsourcing in contract factors based on the empirical analysis. Using regression analysis with these two dependent variables, the findings showed that the contract concreteness had positive effects on both cost improvement performance and efficiency improvement performance, but the contract feasibility only had positive effect on efficiency improvement performance. In addition, the result of the study showed that the contract performance of outsourcing the digital contents have a positive impact on the partnership intention.

모바일 환경에서 전자 계약 시스템의 설계 및 구현 : M-XContract (Design and Implementation of Digital Contract System on the Mobile Environment : M-XContract)

  • 모바일 단말기의 하드웨어 한계, 단말기에 탑재된 시스템의 비호환성, 무선의 낮은 대역폭 등으로 인해 유선 환경의 전자 계약 시스템을 M-Commerce에 그대로 적용하기에는 무리가 있다. 본 논문은 이러한 문제점들을 해결하기 위해 XML 기반의 전자 계약서를 정의하고 이를 바탕으로 모바일 환경에 적합한 전자 계약 시스템 M-XContract를 설계 구현한 내용을 다룬다. M-Xcontract 시스템은 전자 계약 서버, PDA 상에서 고객과 계약하고 전자 서명된 계약서를 서버에 전송하는 M-ESign 모듈, 서명된 전자 계약서를 서버로부터 수신한 후 고객에게 보여주는 M-EDecoder 모듈, 그리고 전자 계약서 저작 도구 X-Auth로 구성된다 M-XContract 시스템의 성능을 분석하기 위해 PDA 상에서 전자 서명 생성 시간, 서버로 전송 시간을 측정하였다. 성능 분석 결과 M-XContract 시스템은 모바일 전자 계약 시스템을 위한 효과적인 모델이라는 결론을 얻었다.

공공 IT 프로젝트 수발주 제도의 개선방안 연구 (A Study on the Innovative Scheme of the Public IT Project Ordering and Receiving Systems)

  • The purpose of this study is to generate a proper regulation improvement direction of the public If project contract law through the current four contract methods and three methods of the awarding party of a contract method. The research method for this paper is derived from the written materials of the present public IT project contract law. Two problems have been processed in order to produce the results: the current contract methods and the awarding party of a contract method. The current contract methods consist of a competition contract, a private contract, and a supply methodology contract, The methods of the awarding party of a contract display a qualified evaluation regulation, the 2nd step competition bid, a standard cost separation tender, and a contract by a negotiation. The results exhibit that the general competition contract consists of four improvement items. The contract by a negotiation contains five improvement items. The group private contract has one improvement item. And the private contract includes one improvement item. These results implicate that the current public IT project contract law demands better improvement work for the ubiquitous Korea.

전자계약서비스의 문제점과 해결방안 (A Study on the Adoption of Electronic Contract Service)

  • The purpose of this thesis is to contribute to the activation of e-contract service for one stop e-trade by analyzing the problems and its solutions in e-contract service at home and abroad. In order to achieve the purpose of this thesis, case studies are done on e-contract service providers such as CECTRUST service of NTT DATA in Japan and HanCM.com of Haansoft in Korea and user companies such as Taisei Corporation using CECTRUST service and Hyundai Card using HanCM.com. The problems in the e-contract service are the lack of e-contract service providers, rare publicity of e-contract service, limited use of e-contract service at only home, higher pricing for e-contract service, short time management of e-contract documents by service providers, no application of newly developed security technology to e-contract service, unsatisfaction of requirements of e-contract service provider as trusted third party, absence of lower pricing e-contract service by service provider, authorizing key error in electronic signature under recognized authentication system in case of fail in renewal of digital certificate and reproduction of digital certificate. The solutions of these problems are the upbringing of e-contract service providers, broad publicity of e-contract service, development of e-contract service on a global basis, establishment of lower pricing for e-contract service, long time management of e-contract documents by service providers, application of newly developed security technology such as bio technology to e-contract service, satisfaction of requirements of e-contract service provider as trusted third party by designation of recognized e-document repository, development of lower e-contract service by way of application service provider(ASP), introduction of time stamping of e-contract document and signature key value. The limitation of this thesis is that the problems and its solutions could not meet with the broad recognition as they are conferred by intuition because of few e-contract service provider.

  • Scientific and technical development, as well as the emergence of new types of contracts, which do not have their expression in current legislation, force us to explore the issues of contract law to adapt to change. In this context, the principle of freedom of contract is fundamental, which states that each person has the right to enter into a contractual relationship at his discretion. However, such freedom is not absolute, because the freedom of one person should not violate the freedom of another. Together with the conflict of private and public interests, these phenomena are a field for the study of topical issues of theory and application of the principle of freedom of contract in practice. Research methods are philosophical, general scientific, and special scientific methods, in particular, system-structural, formal-legal, hermeneutic; methods of analysis, synthesis, etc. As a result of the research, the main characteristics of the principle of freedom of contract, its role for private law regulation of contract law are given; approaches to understanding the restriction of contract freedom are analyzed; typical examples and means of such restrictions are identified; demonstrated how contract freedom is embodied in the use of IT tools, which types of contracts are most common in the digital environment.

  • Digital goods are defined as intangible and non-physical goods, composed of a combination of digital signals, electronically represented as 0 and 1. They are also called as digital products, electronic transmissions, information goods, digital contents, computer information, etc. Digital goods are now traded both domestically and internationally as well as on-line and off-line. Korean government revised the Basic Law on Foreign Trade to include digital goods and services as the scope of foreign trade in 2001. Trade volume of digital goods are increasing in Korea. The supply chains of digital goods from producing the components to selling globally to consumers are different from conventional physical goods. Mostly, digital goods are traded on the license basis rather than ownership contract. End User License Agreements(EULAs), such as shrink-wrap, click- wrap, or browser-wrap licenses are very popular in online transactions. Unlike conventional physical goods. the breach of license contract is closely linked with the infringement of intellectual property rights. Digitalized intellectual property is easy to copy and transmit in the cyber space. In cases of legal disputes from the breach of license contract, commercial arbitration or on-line alternative dispute resolutions(ADRs) are regarded as better approach to solve them rather than court sues. For promoting more secure and reliable international trade of digital goods. arbitration clauses should be included in most of license contracts.

  • 본 논문에서는 날로 정보화 되는 사회 환경 하에서 다수의 계약자가 계약올 처리할 수 있는 전자계약시스템 에서의 위험요소를 분석하고 그에 따르는 디지털 다중 서명의 요구조건을 제시하였으며 지금까지 개발된 기존의 디지털 다중 서명 방식들을 전자계약시스템에 효율적으로 적용하고 새로운 다중 서명 방식을 제안하 였다 또한 제안 방식의 실제 예를 통해 전자 계약 시스템에 적용시켜 보았고, 각 방식별 요구조건 만족도를 검토하여 그 적용성과 효율성을 비교평가 하였다.

  • 오늘날의 디지털 환경에서는 라이선스 계약 및 기술적 보호조치가 이용자의 권리를 제한하는 수단으로 이용되고 있다는 비난이 제기되고 있다. 이에 본 연구에서는 계약을 통해 그 이용이 이루어지는 디지털 자원에 대한 저작권법과 계약법간의 충돌 관계를 고찰하였고, 이러한 충돌 관계에 대한 법률적 해석 방법들을 고찰하였다. 그리고 IFLA가 밝힌 디지털 환경에서의 저자권에 대한 입장 고찰을 통해 이러한 충돌관계와 관련하여 도서관이 저작권법의 공동화를 방지하는 동시에 이용자의 권익을 확대하기 위한 대응방안을 제시하였다.

  • The purpose of this research is to explore the necessity of utilizing IPD methods along BIM based project operation in domestic construction market. IPD is relatively new project delivery methods focused on the collaboration of stockholders based on BIM technology. IPD is focused on the multiparty contract process rather than multiple bilateral contracts under Traditional Project Delivery Methods. The research method is to investigate the IPD standard contract documents, successful IPD project cases in the U.S. The research results are as follows. The model for an IPD standard contract needs to be developed for the application to a real construction projects. Various types of IPD model contract need to be developed to accommodate the requirements of industry and stockholders in Korea.
