A Study on the Contractor's Liability for the Defects in the Public Construction Works (공공건설사업의 하자에 대한 수급인의 책임에 관한 연구)

  • Although Public Construction Works in Korea have been executed according to Government Contract Act, and nature of contract is very complicated. So it is difficult to define liability for the defects. Therefore the studies on the defective performance and contractor's defects liability were remained one of the non-cultivated virgin land. As a result, contract privy waive the right to claim or generally resolve the problems. Therefore domestic and overseas liability for the defects was investigated and liability for the defects, under and after construction, on the defective performance and defects, was analysed. With a literature research, contractor's defect liability was systematically analyzed, problems were defined and resolution of the problem were suggested item by item in this study.

A Study on the Improvement Plan through Analyzing the Perception of Expert Group about Landscape Construction Defects (조경공사 하자에 관한 전문가 집단간 인식분석을 통한 개선방안 연구)

  • This study aimed to find out the improvement plan through analyzing the perception of the expert group engaged in landscape architectural construction and to focus on analyzing the expert groups' experience on Landscape Construction Defects (LCD), defect liability, warranty period, and implementation of the defect liability. The results are as follows: 1. Regarding the experience on the LCD, landscape construction contractors were an awareness of the LCD issue at a serious level, while public-sector clients recognize moderately the LCD issue; and on the first priority in defect implementation, landscape construction contractors considered repair cost while public-sector clients value the identifying causes of defects. 2. In disagreement on the defect liability, landscape construction contractors attributed it to client's lack of responsibility for maintenance while public-sector clients ascribed it to the absence of dealing a criteria with LCD, and regarding the appropriate defect implementation, public-sector clients preferred the following objective by dealing the criteria with LCD while landscape construction contractors advocates by sharing the responsibilities for dealing with LCD based on the identified causes of construction defects. 3. Regarding the warranty period, the public-sector clients considered the 2-year warranty period as appropriate while landscape construction contractors considered it comparatively long, and concerning the commencement of defect warranty period, the public-sector clients viewed it as it should commence to cover the overall completion of the construction while landscape construction contractors perceived it to start on the completion of each work. 4. As for the improvement of the defect implementation system, public-sector clients considered it necessary to establish the objective dealing the criteria with LCD while landscape construction contractors viewed the legislation of maintenance duty. Also, with regard to the important value in establishing and dealing the criteria with LCD, public-sector clients pointed out the objective of the criteria for determining the defects per work type while landscape construction contractors suggested client (user)'s maintenance duty. Because of research, because the system in dealing with LCD is an absence of LCD management agency and dealing the criteria with LCD, it is needed to establish an LCD management agency and make the system in dealing with LCD.

The Frontiers of Product Liability for Adverse Reactions to the Contrast Medium (조영제부작용에 대한 제조물책임의 한계)

  • The Korean Product Liability Act established the principle that a manufacturer has a duty to take care of a person who is not the customer who bought the product for him. In this instance, there is a duty to the patient for whom the product was purchased by the hospital from the pharmaceutical company. Therefore, the pharmaceutical company has the product liability for adverse reactions to the contrast medium. But the possibility for the patient to successfully sue the pharmaceutical company is quite low, because the patient needs to prove that a "defect" in the unsafe product was the cause of his injuries. And the physician or the radiological technologist can not reduce his liability risks based on the Product Liability Act. On the contrary, The has the product liability because diluting contrast medium belongs to the product category.

- A Study on Safety in Articles of Food conform to the Product Liability Act Introduction : The Metropolitan Area - (제조물책임(PL)법 도입에 식품부문의 따른 안전성 사례 연구 : 수도권을 중심으로)

  • What is the most important in articles of food is hygienic safety. Because food Is the most common thing in our everyday life, however, the importance of its hygienic safety and other many problems caused by food may be easily neglected. What is more, food is can be dangerous as much as it is directly related to human life and accidents from the same cause may have different effects on the victims according to physical and environmental differences of individuals. Thus PL action for food requires more thorough prevention and measure. Korea has been enforcing 'the Product Liability Act' since the 1/sup 1st/ of July 2002. Product Liability (PL) is liability of the manufacturer or the seller of a product to compensate for the death or injury of consumers or the loss of properties caused by the defect of the product. This study surveyed consumers' response to and the effects of the enforcement of the Product Liability Act, investigated how consumers perceived the importance of food safety and the risk of defective food based on PL standards and their experience in damage by food through a questionnaire survey, and analyzed collected data through empirical analyses (reliability analysis, factorial analysis, regression analysis and ANOVA t-test) using SPSS 10.0. Based on the results of analysis, the researcher proposed strategies for coping with the Product Liability Act in the food industry.

  • This study proposes a stepwise approach to product safety management(PSM), of which roadmap consists of five phases. ISO 9001 QM model is assumed as the first-phase model and each higher-phase model is built by adding a corresponding module to the lower one. In the phase order, those modules are CCMS, a failure to warn, manufacturing defect and design defect. The progress in PSM of a domestic food company is discussed.

  • Apartment building, which has been accompanied by economic growth in Korea, is a home of life and has the value overlapping as housing and assets. The improvement of consumer's eye level and development of related technology and related service development have positive function that enriches society and creates economic wealth. On the other hand, the clash and conflict between stakeholders increase social unrest and waste our competitiveness by economic loss. The term of warranty liability of apartment building is an important issue of defect lawsuits and is only a few quantitative standards. However, in this study, we examined the revision history of the law and ordinances for the reinforced concrete construction. As a result, establishing and revising the relevant standard, there is no definite basis system to support it. To improve this, the efforts to provide the standard for term of warranty liability and quantitative and objective basis to support it should be accompanied continuously.

A Liability for Damage caused by Drug (의약품 부작용과 손해배상)

  • The use of drugs that reflect the experiences and achievements of modern science has given human being the benefits of treating diseases and improving health conditions. However, in addition to the benefits of those, medicines have inherently inevitable adverse reactions. Many countries are taking measures such as market entry regulations or post-marketing surveillance to minimize damage caused by drug side effects, but the occurrence of side effects cannot be eliminated. Although the damage is force majeure, in some cases, the doctor who prescribed the drug or the pharmacist who administered the drug may have to compensate for the damage. The liability depends on whether the side effects were known in advance, the type of medicine, etc. On the other hand, in some cases, drug manufacturer may have to take liability for the side effect itself. As it is not easy for victims to be compensated for damages in those cases, many countries, including Korea, are setting to protect victims through the Product Liability Act. Drugs are also one of the product, so liability set by the Product Liability Act may apply. Even before the enactment and enforcement of the Product Liability Act, damage caused by drug has occurred. To resolve them, precedents have developed case law, which have many similarities with the Product Liability Act, but also have differences. Damage caused by drug manufactured prior to the enforcement of the Product Liability Act may occur in the future. In this context, the legal principles of the case laws will remain valid and be applied. This is an important reason to review the case law of precedents.

A Study on the coverage of e-commerce insurance (전자상거래 보험의 담보범위에 관한 고찰)

  • Todays, computers in business world are potent facilitators that most companies could not without them, while they are only tools. They offer extremely efficient means of communication, particularly when connected to Internet. What I stress in this article is the risks accompanied by e-commerce rather than the advantages of Internet or e-commerce. The management of e-commerce companies, therefore, should keep in mind that the benefit of e-commerce through the Internet are accompanied by enhanced and new risks, cyber risks or e-commerce risks. For example, companies are exposed to computer system breakdown and business interruption risks owing to traditional and physical risks such as theft and fire etc, computer programming errors and defect softwares and outsider's attack such as hacking and virus. E-commerce companies are also exposed to tort liabilities owing to defamation, the infringement of intellectual property such as copyright, trademark and patent right, negligent misrepresent and breach of confidential information or privacy infringement. In this article, I would like to suggest e-commerce insurance or cyber liability insurance as a means of risk management rather than some technical devices, because there is not technically perfect defence against cyber risks. But e-commerce insurance has some gaps between risks confronted by companies and coverage needed by them, because it is at most 6 or 7 years since it has been introduced to market. Nevertheless, in my opinion, e-commerce insurance has offered the most perfect defence against cyber risks to e-commerce companies up to now.

  • Product Liability(PL) is a legal policy to deal with global competition by improving domestic industrial competitive power and to reduce the cost of defect products. The purpose of this paper is to address the state of the art solutions to dispute on PL, in reality of a frequent occurrence of global product exchange focussing on product safety that is one of the most important functions of PL and to improve solution of the product safety and reliability responsive to PL. To minimize PL exposure, manufacturers should reflect comprehensive product safety and reliability concepts in establishing PL prevention policies. PL prevention policies are composed of administration system, product safety management system, and total quality management system in respect of prevention, safety, and defence.
