연명치료 중단의 입법화 방안에 관한 연구 - 성년후견제도의 도입과 관련하여 - (A Study on the Method of Legislation on Withholding or Withdrawing of LST -In relation to the introduction of adult guardianship-)

  • It is the so-called Shinchon Severance Hospital Case brought to an end by the decision of the Supreme Court that opened the real discourse of withholding or withdrawing of LST (Life-Sustaining Treatment) in the legal profession as well as medical profession in Korea. Everyone has sympathy with the validity and necessity of legal regulation on withdrawing-including withholding-of LST save the requirements & procedure of withdrawing of LST. In this situation, the legislative bill of amendment to the Korean Civil Law introducing of adult guardianship was pre-announced by the Ministry of Justice on September 18th 2009. The adult guardianship is a guardianship system that supports an mentally handicapped adult to deal with his affairs by support of a guardian. The object of adult guardianship includes affairs of body or well-being as well as property of adult wards. In particular, affairs of medical matters are of importance in the duty and authority of adult guardians. So, the introduction of adult guardianship is of much importance de lege lata as well as de lege ferena in the discussion of withdrawing of LST as a medical treatment. Since the legislation on withdrawing of LST intents to protect the right of death with dignity on the basis of patients' autonomy, the ratio legis of withdrawing of LST is variant from that of adult guardianship. In this context, it seems reasonable to legislate the withdrawing of LST separately from the adultguardianship. In the meantime, the adult guardianship of the legislative bill of amendment to the Korean Civil Law is related to the withdrawing of LST, since the main purpose of adult guardianship is to protect patients' quality of lives and to regulate guardianship contracts based on patients' autonomy. In that context, it seems reasonable to incorporate the legislation of withdrawing of LST into the adult guardianship system. In the latter case, it is not easy to adopt the withdrawing of LST into the legislative bill of the Korean Civil Law for the bill is pre-announced already as previously stated. However, the legislation of withdrawing of LST is not inferior to the legislation of adult guardianship as a matter of urgency. Moreover, it is likely that the legislative bill of Amendment to the Korean Civil Law generates discrepancies in interpretation of the requirements & procedure of withdrawing of LST as the amended German Civil Law did. In short, it is desirable for the legislator to revise the legislative bill despite delay.

말기암 환자의 호스피스 수용 경험: 현상학적 연구 (Experience in Acceptance of Hospice by Patients with Terminal Cancer : A Phenomenological Research)

  • Purpose: The purpose of this study was to further understanding of the experience in acceptance of hospice by patients with terminal cancer and to explore the structure of this experience. Methods: A phenomenological methodology was used for the study. Participants were nine patients who were admitted to the hospice unit of a university hospital. In-depth interviews were done for data collection and the data were analyzed using Colaizzi's method. Results: Four categories, eight theme clusters and 18 themes were identified for the experience in acceptance of hospice by patients with terminal cancer. The three categories were 'Hope for a comfortable death', 'Overcoming barrier of prejudice about hospice', 'Incessant craving for life', 'The last consideration for self and family' Conclusion: While accepting the hospice care, participants experienced inner conflict between giving up medical treatments that prolong life and choosing a comfortable death, and also experienced an incessant craving for life. By accepting hospice care, they showed a human dignity that entails careful concerns for both self and family members.

한국 성인의 품위 있는 죽음 측정도구 개발 및 평가 (Development and Evaluation of a Dignified Dying Scale for Korean Adults)

  • Purpose: The study was done to develop a dignified dying scale for Korean adults. Methods: The process included construction of a conceptual framework, generation of initial items, verification of content validity, selection of secondary items, preliminary study, and extraction of final items. The participants were 428 adults who lived in one of 3 Korean metropolitan cities: Seoul, Daegu, and Busan. Item analysis, factor analysis, criterion related validity, and internal consistency were used to analyze the data. Data collection was done from March to June 2010. Results: Thirty items were selected for the final scale, and categorized into 5 factors explaining 54.5% of the total variance. The factors were labeled as maintaining emotional comfort (10 items), arranging social relationship (9 items), avoiding suffering (3 items), maintaining autonomous decision making (4 items), and role preservation (4 items). The scores for the scale were significantly correlated with personal meanings of death scale. Cronbach's alpha coefficient for the 30 items was .92. Conclusion: The above findings indicate that the dignified dying scale has a good validity and reliability when used with Korean adults.

국내외 뇌사, 존엄사와 안락사에 대한 인식의 변화와 윤리 - 소아를 중심으로 (The change of perspective on brain death, euthanasia and withdrawal of the life supporting medical treatments in Korea for pediatric patients)

  • A recent High Court's decision regarding the withdrawal of life supporting medical treatment (artificial ventilator) from an elderly female patient in the terminal stage has opened up a new era of the "euthanasia dispute" in Korea. With this decision, the legitimate withdrawal of life supporting treatment became possible under certain conditions and the Korean Medical Association is working toward the establishment of practical guidelines for the terminal-stage patients. However, there are still very few debates on the cases of pediatric patients in the terminal stage or suffering from fatal diseases. For pediatric patients, the core principle of autonomy and following procedure of "advance directives" are hardly kept due to the immaturity of the patients themselves. Decisions for their lives usually are in the hands of the parents, which may often bring out tragic disputes around "child abuse", especially in Korea where parents have exclusive control of the destiny of their children. Some developed countries such as the U.S.A., the U.K. and Canada have already established guidelines or a legal framework for ensuring the rights of the healthcare system regarding children suffering from severe illness, permitting the withdrawal of Life supporting medical treatment (LSMT) in very specific conditions when the quality of life of the children is severely threatened. For the protection of the welfare and interest of the children, we should discuss this issue and develop guidelines for the daily practice of pediatricians.

장례문화 인식과 웰엔딩의 실천과제 연구 - 서울특별시를 중심으로 - (Awareness of Funeral Culture and Well-Ending and Policy Implications -Focusing on Seoul Metropolitan City-)

  • 장례문화는 화장위주의 장례방법 개선에서 죽은 자의 복지적 차원의 접근이 필요하다. 장례문화는 미래지향적으로 재조명해 보고, 웰엔딩(well-ending)과 연계한 발전방향을 모색할 필요성이 있다. 본고에서는 장례문화 변화과정과 서울시 장례문화의 문제점 진단을 통해 웰엔딩의 실천과제를 모색하는 것을 목적으로 하고 있다. 이를 위해 서울 시민 500명을 대상으로 조사한 장례문화 의식조사 결과를 활용하였다. 웰엔딩은 생의 마지막 순간까지 인간의 존엄성을 보장해 주고 죽음문화를 질적으로 향상시키는 과정이다. 웰엔딩 문화의 체계적인 접근은 죽음의 질적 개선을 달성할 수 있을 것으로 판단된다. 고령사회에 부응하는 장례문화 정착을 위해서는 장례문화에 대한 패라다임의 전환이 필요하다. 웰엔딩 준비 교육은 죽음을 맞이하는 당사자 뿐 만 아니라 살아있는 가족들에도 삶의 의미를 깨달을 수 있다. 그리고 장사시설은 모든 세대가 공유할 수 있는 문화 복지시설로 확충될 수 있도록 우리의 지혜를 모아야 한다.

품위 있는 죽음과 호스피스.완화의료에 대한 일반 국민들의 태도 (Public Attitudes Toward Dying with Dignity and Hospice.Palliative Care)

  • 목적: 말기 환자의 품위 있는 죽음과 가족들의 삶의 질을 향상하기 위해 호스피스 완화의료의 제도화를 위한 노력이 집중되고 있는지만 소비자인 일반 국민이 품위 있는 죽음과 호스피스 완화의료를 어떻게 인식하고 있느냐에 대한 조사가 없었다. 방법: 2004년 2월, 16개 시도의 20세 이상 성인남녀를 대상으로 성별, 연령별, 시도별 인구분포에 의한 할당추출 인구구성비와 동일하게 대상자를 추출하였으며 전문조사기관의 면접원 30명에게 설문내용에 대해 교육한 후 조사를 실시하였다. 품위 있는 죽음의 조간 선호하는 임종장소 및 그 이유, 무의미한 치료 중단에 대한 인식 및 태도, 호스피스 서비스 인식 및 이용의향, 그리고 국민들의 품위있는 죽음을 위한 정부의 역할에 대한 구조화된 설문지를 사용하여 전화면접조사를 실시하였다. 결과: 환자의 입장에서 품위 있는 죽음을 맞이하기 위해서는 '다른 사람에게 부담 주지 않음'(27.8%) 및 '가족이나 의미 있는 사람과 함께 있는 것'(26.0%)이 가장 중요하다고 응답하였다. 이상적인 임종장소는 응답자의 과반수(54.8%)가 자택을 선택했으며, 병원(28.0%), 호스피스 기관(7.9%), 요양원(6.5%) 순으로 나타났다. '무의미한 치료의 중단'에 응답자의 과반수인 51.7%가 '들어본 적이 없다'고 응답하였으며, 의학적으로 무의미한 생명연장치료에 대해서는, 대다수의 응답자(82.3%)가 '중단하는 것이 좋다'라고 응답하였다. 응답한 대상자의 59.4%가 '호스피스'에 대해 들어본 적이 있다고 하였으며, 말기 상황인 경우 응답자의 57.4%가 '호스피스를 이용할 의향이 있다'고 응답했다. 응답자의 79.6%가 '호스피스 서비스를 건강보험으로 인정할 필요가 있다'고 응답하였으며, 사전의사결정에 대해서는 응답자의 80.9%가 '필요하다'고 응답하였다. 품위 있는 죽음을 위해 필요한 정부의 역할 중 '말기 환자에 대한 재정지원'(29.8%), '호스피스 서비스에 대한 보험인정'(16.5%), '바람직한 임종문화 호스피스 제도 정착을 위한 교육과 홍보 강화'(15.9%)를 강조하였다. 결론: 일반 국민을 대상으로 한 본 연구를 통해 환자의 품위 있는 죽음과 가족의 고통을 줄이기 위한 호스피스 완화의료의 제도화에 대한 국민적 공감대를 이끌어 낼 수 있는 가능성과 방안을 확인할 수 있었다. 이 결과는 향후 제도화를 위한 정책 방향 결정에 활용될 수 있을 것이다.

Postmodern Animality and Spectrality: Ted Hughes's Wodwo and Crow

  • Tinted with ontological concern, Ted Hughes passes through an existential climate, eventually confirms death( or nothingness) as the new foundation of his poetry, and explores the various paradoxical effects of nothingness. Nihilism, fraught with rather negative and traumatic themes such as death, melancholy, and despair can, however, generate being (even in multiple modes), animalistic vitality, and insubstantial specters. Among these new functions of nothingness animality and spectrality are the most notable in Hughes's poetry. A considerable number of animals and bioorganisms that Hughes introduces exhibit the enormous energy derived from the dignity of death, from subversive challenges against the established hierarchy, and from new and dynamic multifaceted sources of nothingness. In other words, Hughes's animals, yield surplus power beyond themselves, as if they are demi-gods; in short, they feature the sublime as unidentified terrifying effects of nothingness. In a sense, animality means allowing some level of violence without legal sanction. Hughes inaugurates this kind of all bigotry-eradicating violence and attempts to subvert higher beings such as humans and gods, and existing doctrines: thrushes rise up against the animal and human worlds; a rush of ghostly crabs at night press through the human world. Hughes also resists the highest being, God, employing the technique of rewriting God's theology. Dirty, anomalous crows attack, subvert, and dismember the delicate, indurate, and thorough system of logos. Hughes, of course, does not place the animals merely in lofty regard, aware of the ulterior deprivation of the sublime animality, the trace of existential negativity. Thus, a seemingly omnipotent crow can become a mere beggar guzzling ice cream from the garbage bin on the beach. In addition, the violent and dignified aspects of nothingness can be transformed to reveal the thin and trivial traits as unreliable specters. Dark, heavy, and terrible nullity lessens its own volume and mass, and exposes the airy waves of shadows or specters. However, owing to nullity's untraceable track, the scarcity and unfamiliarity of the phantoms inversely display their foreign gigantic effects such as fantasy and violence.

조선시대 상례행렬복식에 나타난 상징성에 관한 연구 (A Study on Meanings of Funeral ceremony costumes in Chosun Dynasty)

  • this study was designed to discuss the pattern of Confucian funeral ceremony and its costumes in Chosun dynasty thereby exploring the ideas and symbolic meanings expressed on them. 1. Male's official mourning dresses were composed of Choieui symbolizing sadness Choisang(최상), Dukun Sangkwan Sujil Yojil Kyodai and mourning stick Female's official mourning dresses consisted of Daersoojangkon and Kaedoo which were of simple kinds as compared to those of males. Duration of wearing mourning dreses was the longest to the death of father husband and eldest son The forms of mouring dresses were one and the same irrespective of the noble and the mean which expressed the sameness of the sorrow full of losting blood relative. Symbol expressed on funeral ceremony costumes were something like "eldestson-oriented" "male-centered" "distinction of the sexes" and "principle of yin and yang" to reinforce vitality to the costumes. 2. In the other funeral ceremony costumes in a royal fami8ly were those Euijangsu in red and blue colors Yeosakon in purple and white colors. Bandsman in Danryung and Guards in Kukonbok Changeui and Hoeui with five colors while the generally of people woere white dress in the ceremony Hoeui with five colors symbolized the principle of Yin and Yang costumes of military uniforms the dignity of the royal family: white dresses grife symbolizing the dignity of a royal family and Confucian sorrow as well 3. Unlike the mouring dresses there were great differences relative to socio-ecpmpomic status in funeral goods for dercoration Soyeo and daeyeo Among the goods the instrument to drive out evil spirites symbolized shamanism the distinction of Soyeo and Daeyeo separation of body and soul; the sculpture of the Lord of Hades and messenger philosophy of buddhistic netherworld: the engraving of blue and yellow dragons in bier and Juksanma the principles of Yin and Yang : elaborate burial accesaries realistic viewpoint of the hereafter.

간호사의 환자죽음 수용에 대한 개념분석 (Concept Analysis of Nurses' Acceptance of Patient Deaths)

  • 목적: 본 연구의 목적은 간호사의 환자죽음 수용 개념의 속성을 규명하여 임종간호에 대한 이론적 근거를 마련하는 것이다. 방법: 본 연구는 Walker와 Avant의 개념분석 과정을 따랐다. 간호사의 환자죽음 수용 개념의 사용 범위를 확인하기 위해 국내외 문헌을 고찰하였다. 간호사의 환자죽음 수용 개념의 속성을 찾고 조작적 정의를 내리기 위해 국내 논문 중 1999년부터 2015년까지 국내 학술지에 발표된 간호사의 환자죽음 경험에 대한 질적 연구 16편을 분석하였다. 결과: 본 연구에서 간호사의 환자죽음 수용의 선행요인은 간호사의 환자죽음 경험, 혼돈과 갈등, 부정적 감정, 수동적 대처, 환자죽음 회피로 확인되었다. 간호사의 환자죽음 수용 속성은 애도를 통해 도달, 삶을 반추하며 삶과 죽음의 통찰력 획득, 의연하게 바라보기, 인간 존엄 실천하기로 나타났다. 간호사의 환자죽음 수용정의는 '환자죽음을 경험한 간호사가 애도를 통해 도달하는 단계로써 자신의 삶을 반추해서 삶과 죽음에 대한 통찰력을 얻고 환자죽음을 의연하게 바라보며 인간 존엄을 간호 현장에서 실천하는 것'이다. 간호사의 환자죽음 수용의 결과는 전인적인 임종간호, 적극적인 삶 추구로 확인되었다. 결론: 간호사의 환자죽음 수용 개념의 속성과 조작적 정의는 실무 적용 가능한 임종간호 중재 방안 마련과 이론 개발의 기초 자료를 제공할 것이다.

현대 일본패션에 내재한 꾸밈 미학 (Decoration Culture resident in Contemporary Japanese Fashion)

  • The purpose of this study is to search the spiritual root of decoration and anti-decoration culture in contemporary Japanese fashion and find the aesthetic meanings of the decoration culture inside contemporary Japanese fashion. The contents of this study are 1. surveying the historical change about the aesthetic sense of Japan. decoration culture 2. deducing the distinctive aesthetic ideology from the decoration culture 3. finding esthetically the inside meaning of 1.2. in contemporary Japanese fashion. First, the origin of decoration culture was concerned with the belief in the life after death of the Buddhism culture to represent the noble society of the Heian(평안) period and the religion of paradise after the Middle Ages. Second. this decoration culture based on two aesthetic ideologies, beautiful(염) aesthetics and lofty(숭고) aesthetics. The beautiful aesthetics implies words, such as bewitchment, elegance, dignity and brilliance which stand for the sensual pleasure and the eroticism. The lofty aesthetics that was introduced by TakeTakasi(장고) during the Heian period, had the meaning of magnificence, greatness and dignity. This could be recognized as the Confucianism ideas. Third, as the beautiful aesthetics that was the representative aesthetic ideology of the decoration culture, it was related to splendid and decorative designs, and was recognized as the beauty of brilliance and coquetry. The beauty of brilliance, as a decorative element, appeared in patterns of the traditional costume and dyeing as well as the beauty of coquetry indicated that the women's fashion in Japan had soft, feminine, and cute images, called Hawaii, by using various decorations, such as feminine details, flower patterns. ruffles. ribbons and so on. TakeTakasi's lofty aesthetics applied the beauty of exaggeration to every art form. It has influenced the form exaggeration by overlapping in traditional costumes as well as the 1970s big look and layered look in Europe fashion. Issey Miyake and Takeda Kenzo introduced the decorative play, such as transformation and a distortion, which considered refinement, bluff, and oddity of the Japanese decoration art.
