텍스트 마이닝을 활용한 해양수산부 법률 관련 연구동향 분석연구 (Using Text Mining for the Analysis of Research Trends Related to Laws Under the Ministry of Oceans and Fisheries)

  • 최근 인공지능(AI) 기술이 급격하게 발전되고 있으며, 이를 활용한 산업이 점차 확대되고 있다. 또한 사회과학 연구분야에서도 인공지능기술의 텍스트 마이닝을 활용한 분석연구가 활발하게 전개되고 있다. 해양수산부에서 소관하는 법률은 125여개로 해양환경, 수산, 선박, 어촌, 항만 등 다양한 분야에서 제정되었다. 해양수산부 법률을 대상으로 한 연구가 활발히 진행되고 있으며, 양적으로 꾸준하게 증가하고 있다. 이 연구는 해양수산부 법률 관련 연구논문을 대상으로 텍스트 마이닝을 적용하여 국내 연구동향을 분석하였다. 연구방법으로 첫째 텍스트 마이닝의 일종인 토픽 모델링을 수행하여 잠재된 토픽을 파악하였다. 둘째 특정 법률을 주제로 다룬 연구논문의 동시출현 네트워크 분석을 수행하여 주요 주제를 도출하였다. 마지막으로 저자 네트워크 분석을 수행하여 저자 간 사회 연결망을 탐색하였다. 분석결과 시기에 따라 핵심 토픽의 변화를 확인하였으며, 선박안전법, 해양환경관리법 등 법률별 주요 주제를 탐색하였다. 또한 저자 네트워크 분석하여 핵심 연구자를 도출하고, 저자 간 공동연구 성향을 파악하였다. 이를 통해 해양수산부 법률 관련 연구주제의 변화를 탐색하였으며, 향후 연구주제의 다양화와 해양수산 분야 연구의 양적 증가와 질적 성장을 기대한다.

지상제삼자(地上第三者)의 손해(損害)에 대한 공중운송인(空中運送人)의 책임(責任)에 관한 고찰(考察) (A Study on the Liability of Air Carrier for Damages of the Third Parties)

  • The accident of the midair collision, passengers' falling or goods' dropping occurs or supersonic aircraft make a sonic boom during their conveying passengers or goods to the destination. The accident in transmit damages the their parties on the surface or their properties. In these cases, the third parties who were harmed to their lives or properties have the right to claim damages against the air carrier who caused them. These matters have become one of the important things since aircraft conveyed passengers and goods. Therefore, it is a great concern to settle these matters by law. But the Safety of the present aircraft has been much increased and the aircraft have become larger in size. Its flight altitude became higher than before. So the relationship of the aircraft to the third parties is much different from that of the earlier aircraft. The air transport is now indispensable to our life. It is not so easy to control these matters. In the early part of 20th century, when the third parties suffered the damage, many European countries made laws on the basis of the principle of liability without fault. But each country had a variety of its own law, and different kinds of difficulties have been brought about. Accordingly, the Rome Convention on Surface Damage (1933, 1952, 1978) has been made and revised. In spite of being revised, it contains many problems, and is not carried into effect world-wide. On the other hand, there are no regulations about the compensation of the third parties damaged in Korean existing laws. In case the damage is brought about to them, it is obviously true that the settlement of the liability of compensation for damage should be made by the general principle on the tort in domestic laws. At this point, it is urgent that we make a special law though the domestic legislation as a preliminary measure before we sign the international convention to save third damaged. It is desirable that we should, for the responsibility of the air carriage for the demage of the third parties on the surface, bring in the theory of the absolute liability in view of the legislation of many conutries. As the aircraft fly in the sky, their flight always contains some danger. It is very difficult to prove the fault, and the operator should suffer the principle of liability without fault or the similiar one. In case the liability without fault will be imposed upon the operator for the damage of the third parties, it is necessary to bring in the liability protection system for the protection and up upbringing of the air carriage. The Burden of danger of the air carriage will be reduced by introducing the system. A domestic legislation measure should be necessarily taken as soon as possible as a legal security measure on these matters.

제로레이팅 사후규제 방안에 대한 연구 - 국내 및 해외 주요국 법령 및 심결의 비교법적 고찰 - (A Study on Ex-post Regulation of Zero-rating Service - Comparative Legal Study on Relevant Laws and NRA's Decisions Between Domestic and Overseas Countries -)

  • 본 연구는 국내 제로레이팅 행위의 사후규제 정책 마련을 지원하기 위해 제로레이팅 규제 관련한 국내 외 법령 및 심결을 비교법적 접근법으로 분석하였다. 전 세계적으로 확산되고 있는 제로레이팅 행위에 대하여 대부분의 국가는 사후규제 접근법을 채택하고 있지만, 모바일 ISP의 제로레이팅 행위를 시장 내 허용할지 여부에 대한 판단 과정에서 고려해야 하는 통일된 기준이 없는 상황이다. 그러나 최근 몇 년 사이 각국은 관련 법령 제 개정, 심결 양산을 통해 제로레이팅에 대한 정책 투명성을 높여가고 있다. 비교분석 결과 각국 규제기관은 모바일 생태계 내 제로레이팅 행위로 인한 이용자이익 저해 여부를 판단하고자 이용자 선택권 제한 및 ISP의 비차별 의무 준수 여부를, 공정경쟁 훼손 여부를 판단하고자 ISP-CP의 시장지위, ISP의 수직적 결합을 이용한 이윤압착 행위 여부를 조사하여 판단하고 있었다. 본 연구는 비교분석 결과를 바탕으로 국내 입법 현황 하에서 바람직한 제로레이팅 행위 규제 방향에 대한 제언을 하고 있다.

독점규제법 관련분쟁의 중재의 대상적격 (The Arbitrability of the Subject-matter of a Dispute on the Antitrust Law)

  • It is a matter for debate that which types of dispute may be resolved by arbitration. This problem is concerning the arbitrability of the subject-matter of a dispute. National laws establish the domain of arbitration. Each state decides which matters may or may not be resolved by arbitration in accordance with its own political, social and economic policy. In response to complexity and diversity of a social phenomenon, the dispute also is various, therefore can not be settled efficiently by means of court adjudication to which applies a law strictly. To overcome such problems we are going to seek to make use of arbitration. According to Korean Arbitration Act Art. 3 (1), any dispute in private laws would be the object of arbitral proceedings. For the promotion of fair and free competition, it is increasingly wide-ranging antitrust legislation across the world. It is matter for debate what can an arbitral tribunal do when confronted with an allegation that the contract under which the arbitration is brought is itself an illegal restraint of trade or in some other way a breach of antitrust law. The underlying question is how to accommodate the conflicting congressional policies favoring resolution of private controversies by arbitration and encouraging private suits to protect the public interests served by the antitrust laws. It is necessary to inquire into the arbitrability of antitrust issues on case-by-case basis, because the types of them are quite diverse. If antitrust issues are the dispute in private laws and the contracting parties agreed to submit to arbitration disputes which have arisen or which may arise between them in the antitrust issues, the antitrust disputes are arbitrable. Not only international antitrust disputes but also domestic antitrust disputes are capable of being resolved by arbitration. When the public interests in the enforcement of antitrust legislation are asserted, it is possible to justify the annulment or the refusal of the recognition or the enforcement of an arbitral award that ignores public policy as a matter of it.

  • Safety of residents could be considered and then increased when we plan, design, and operate a city. In Korea, CPTED (Crime Prevention through Environmental Design) is currently being applied to new towns. However, it is not systemized and neither efficient, for there are no constraint provisions, and the foreign cases are not specifically customized to the current situation of the country. This means, the introduction of CPTED is an indispensable fact, but there are limits to the budget aids and actual application, for there is no legal base to support it. This study, therefore, aims to find the limits from analyzing related laws and regimes, administrative regulations, and applied cases, and to deduct improvement plans based on examined foreign cases. In this Study, the supporting system of foreign CPTED related laws and regulations was analyzed around the cases of England and U.S.A, and based on that information, the present condition and limits of CPTED related laws and regulations of Korea were deducted. As a result of this study, there were no constraint provisions to apply the design guidelines to actual planning, and there were limits on backup aid and actual application due to the lacking of analyzing the relevant area. Also, an acceptable framework must be arranged by the revision of laws and ordinances to compel the system, and link it with the CPTED certification system which will revitalize the whole system.

국내 블록체인 법제 및 정책 분석과 한계점 도출 및 향상점 제시 -산업 활성화와 정보보호 중심으로- (Domastic Blockchain Legislation and Policy Analysis and the Limitations Deriving and Present Improvement Points)

  • 4차 산업혁명이 화두로 등장하면서 블록체인에 대한 관심과 함께 블록체인을 활용한 다양한 플랫폼이 등장하고 있다. 블록체인 기술의 발전을 위해 관련 법률과 제도의 정비가 요구되고 있다. 이러한 측면에서 국내 블록체인 관련 법률 및 제도를 분석하여, 한계점을 도출하고 개선방향을 제시하였다. 연구방법은 문헌연구를 통하여 연구문헌과 관련 법령들을 분석하였다. 전체적인 법률과 제도를 한 번에 분석하기는 어려운 일이어서 블록체인 산업 활성화와 정보보호를 중심으로 우선적으로 필요한 법률과 제도를 살펴보았다. 분석 결과 전자거래 및 전자금융거래의 범위, 전자상거래, 전자서명, 수출입, 정보보호, 블록체인 산업진흥 및 연구 등에 관한 법률적 개선이 필요하다는 것을 확인하였다. 이를 통해 효과적인 블록체인 산업 활성화와 정보보호의 균형 있는 발전을 기대한다. 향후 각 항목에 대한 법조항과 제도에 대한 개별적인 연구가 진행될 수 있다.

  • 본 논문에서는 최근 급격하게 증가하고 있는 해킹, 컴퓨터바이러스 유포 등 각종 전자적 침해행위, 개인정보의 광범위한 수집과 오·남용, 음란·폭력정보의 범람, 익명성· 비대면성을 악용한 인권 침해행위 및 신종 사이버범죄 등의 정보화 역기능에 대처하기 위한 국내 컴퓨터범죄관린 처벌법규가 제·개정시 강화되어 어느 정도 효과적으로 대응할 수 있게 되었으나 국내외 컴퓨터범죄관련 처벌법규 체계를 조사·분석하여 관련 법·제도의 개선방향을 제시한다.

  • Fields of domestic construction supervision are divided into architecture, electricity, information and communication and fire by the individual laws. Between each supervision are lack of relationship. So it bring about performance degradation, supervision fee increasing and dispute.   • In order to prospect current recycling status in Korea, wastes generation and recycling rate were reviewed. Approximately 188,600 ton/day of wastes was generated in 1998; 44,600 ton/day of domestic waste and 144,000 ton/day of industrial waste. During the last five years, waste management laws such as recycling law and environment friendly industry law were prepared. In this article, concerning over waste generation and recycling, the problems and technological developments associated with recycling were summarized.

  • Legal sources of fraud rule in documentary letter of credit, which have their origin in Sztejn Case can be traced to various rules or laws of international or domestic level ; URCG, URDG and ISP98 as ICC Rules, and UNCITRAL Convention as an international uniform law, and UCC as a domestic law and U.K. cases. Among them the combination of "material fraud" in UCC ${\S}5-109$ and the detailed list of the types of misconduct in UNCITRAL Convention may provide the best solution or standard in real application of the fraud rule in letter of credit transaction.
