Conflicts of interest and independent agenda of the parties brought together for implementation of a construction project often leads to dispute in Contract and claim situations. Construction Industry is notorious for claim that is managed on its arising and there lacks an endeavor to minimize the breeding grounds through efficient planning and alignment to purpose, of all contract-documents. There failure of a concerted effort entails wastage of resources, delayed completion of facilities and stained relationships of parties when collide in mistrust in contract to win over the other. There needs a focus on the claim breeding issue and establish an effective mechanism to deal with disputes in urgency. Claim occurs mostly during the construction phase. But the seeds of claim and nutrients essential for development are contained in the contract documentation and the information supplied or not in pre-contract phase. Opportunity to prevent nutrients for seed of Claim comes to an end once tender-documents are finalized, the contract is awarded and established or not a mechanism for dealing with claim situation. The processes presented here would help in minimizing the breeding grounds and emergence of disputes during progression of works and dealing with eventualities in forceful manners for finding a resolution most effectively in relevant time.

The purpose of this study is to investigate the current status of claim management process of general contractors in South Korea. As the claim management becomes more important nowadays, maintaining the process for claim management systematically and consistently becomes more important as well. To improve the claim management process, it is necessary to diagnose the current status of claim management process so companies establish their targets for improvement. This study develops a survey to identify the current status of claim management process that major general contractors in South Korea have. Questions in the survey are classified into four categories including entitlement check, potential claim event check, time bar check, and tasks for substantiation. By conducting a series of statistical analyses with 94 survey data collected from employees working in the general contractor companies in South Korea, this study examines and analyzes their claim management process in terms of the several categories. It is expected that the results contribute to diagnosing how practitioners maintain their claim management, which will help them establish the direction of management enhancement.

클레임의 발생원인과 예방에 대하여 많은 연구들이 수행되어 왔으나, 개선방안 혹은 제도개선, 대응방안 등에 대한 연구가 대부분이었다. 특히, 잠재되어 있는 클레임에 대한 구체적인 내용들을 정리하고, 예방을 위한 실무적인 연구는 미흡한 실정이다. 그러므로 향후 발생할 수 있는 클레임에 대해, 그 중 설계단계에서 잠재될 가능성이 큰 원인들을 사전에 검토 및 재확인하여 클레임을 예방할 수 있는 수단이 부족하다. 본 연구에서는, 클레임이 발생되는 시기가 대부분 시공단계이지만 클레임의 원인은 설계단계에서 발생하는 점에 착안하여, 설계단계에서 잠재된 클레임 예방을 위하여 설계단계의 설계서 등을 포함한 계약문서를 중심으로 연구를 수행하였다. 클레임의 근거서류를 준비하고, 관련법규의 적용규정을 확인하면서 클레임 발생원인을 짚어볼 수 있는 체크리스트를 개발하였다.

건설공사 클레임 중에서 공기지연 클레임의 발생빈도가 높다. 공기지연 클레임은 발주자와 원도급자 모두에게 프로젝트 자체의 경제적 문제 뿐 만 아니라 회사의 존폐와 관련이 된다. 체계적인 증빙자료의 부재로 인하여 산정방법이 정량적이지 못하기 때문에 공기지연 클레임을 공평하게 해결하는 데 어려움이 많다. 따라서, 건설공사 단계에서 공사정보 또는 증빙자료를 체계적으로 구축할 수 있어야 한다. 본 연구는 예비적 고찰로 공기지연 클레임 데이터베이스의 기존 연구와 문제점을 고찰하였다. 단계별 공정표와 데이터베이스 연계구축 방안을 제시하였고, 건설생산성 데이터베이스 구축을 위한 요구정보에 근거하여 개념적 데이터모델링과 논리적 데이터모델링을 통한 건설공사 생산성 관리를 위한 데이터 모델링을 구축하였다. 이에 본 연구는 손실생산성을 고려한 공기지연일수 산정을 위해 건설공사 생산성 관리를 위한 데이터모델의 구축을 목적으로 한다.

과거 사례로 볼 때 건설시공사는 클레임 시스템이 없이 발주자에게 클레임을 제기하여 미 승인 또는 감액 등을 받아 손실을 입는 경우가 종종 발생하고 있어 기존의 클레임 프로세스 개선이 필요하다. 이를 개선하기 위하여 건설시공사는 클레임 프로세스 개선을 위하여 조직구성의 강화, 클레임 담당자에 대한 정확한 업무부여, 담당자에 대한 주기적 클레임 교육실시, 공기관리 및 공정관리 기법 개선과 철저한 문서관리가 필요하다. 또한 정기적인 클레임 회의가 필요하다. 본 연구에서는 발주자 잘못으로 인한 관급자재 조달의 지연, 구두 작업지시, 작업진행상 필요한 정보지연 및 과다 설계변경 등이 발생한 'A' 프로젝트에 대하여 개선된 프로세스를 적용하여 초기 공사기간 62개월에서 34개월의 공기연장을 받아 96개월에 완공하여 이를 입증하였다. 개선된 클레임 프로세스 시스템이 대규모 건설사업장은 물론 소규모 건설사업장에도 적용하여 도움이 될 것으로 기대한다.

건설 프로젝트는 다양한 이해관계자들이 참여하기 때문에 당사자들 간의 분쟁이 발생하기 쉬우며, 이러한 분쟁은 프로젝트 참여자들에게 있어 매우 중요한 사안이다. 최근 클레임의 제기가 증가하고 있지만, 클레임의 상당수가 청구한 금액에 대한 보상을 제대로 받지 못하고 있다. 이처럼 제기된 클레임이 목적을 달성하지 못하는 가장 큰 원인에는 건설 프로세스 진행 중 클레임에 대비한 관리가 제대로 이루어지지 않는 점이다. 불가피한 클레임에 대해서는 부당하게 피래를 입은 이해관계자가 적절한 보상을 받도록 미리 대비책을 마련하는 것이 필요하다. 그러므로 현장에서 실무자들에 의해 수행되는 관리 업무들이 어떤 것들이 있고 그 업무들이 클레임과 어떤 관련이 있는지를 파악하는 것은 매우 중요하다. 본 연구의 목적은 클레임 핵심관리요인과 관련 있는 관리 업무의 분석을 통해 효과적인 클레임관리방안을 제안하는 것이다.

In recent years, the accidents in construction projects are continuously increasing due to their complexity and variety. However, few studies have been conducted regarding the risk prediction model and the database of risk assessment in construction projects. To address of these issues, the objective of this study is to analyze the accident causes by using insured claim payouts of insurance companies. First, the descriptive analysis of accidents causes is conducted according to scheduling rate, season, and total construction costs. Second, the correlation analysis is conducted between accidents causes and total construction costs. In the future, the risk assessment model can be developed to quantify the accident causes in construction projects to estimate claim payouts of insurance companies.

건설 프로젝트의 특성 상, 예측하기 어려운 리스크 인자에 노출되기 쉽고, 다양한 이해관계자들이 함께 동일 프로젝트를 수행하는 과정에서 발생하는 분쟁이 주요 리스크 인자로 인식된다. 다양한 분쟁은 주로 클레임 제기, 조정, 중재, 그리고 소송으로 나타나며 막대한 비용과 시간의 손실을 초래할 수 있다. 따라서 국내 건설기업의 건설 프로젝트 수행과정에서 발생하는 클레임, 분쟁의 유형과 원인을 도출하고, 각 원인의 영향도 분석을 통해 클레임, 분쟁관리에 대한 적극적인 대비가 필요하다. 본 연구는 국내 건설프로젝트에서 발생한 클레임, 분쟁 판례를 수집하여 유형과 원인에 따른 빈도와 영향도를 정량화 하고, 중요도 분석을 통해 주요 클레임 원인을 도출하였다. 도출된 주요 클레임 원인은 공사변경, 상대방의 부당한 행위, 공사 지연에 관한 클레임으로 해당 클레임 원인이 발생할 경우 클레임 비용에 대한 예측을 회귀 모형화 하였다. 주요 클레임 원인별 영향도 예측 결과 공사변경의 경우 전체공사비의 16.1%, 상대방의 부당한 행위는 전체공사비의 5.7%, 공사 지연은 전체공사비의 2.7%로 발생하는 것으로 분석되었다. 본 연구결과를 통해 국내 건설산업의 주요 클레임 요인을 도출하고, 클레임 비용을 예측함으로써 보다 적극적인 클레임 대비에 활용 될 수 있도록 하였고, 더 나아가 국내 건설기업의 프로젝트 관리 역량 평가 및 향상에 기여하고자 하였다.

Although the order of Design-Build is being expanded by increasing construction scale and demanding hybrid function, the suitable regulation of the contracts is not settled. Design-Build is way by government because there are big construction of much government leading in contract relation high position occupy. So, case that prebendary's claim institution develops by litigation is very rare. But, recently Design-Build is magnified. So, these dispute factors is becoming visualization gradually. The contract system is needed to be consistent by international standard to deal with the problem. This study suggests the useful solutions in detail concerned with the main factor of change order claim by each Design-Build phases through practical sorting and analysis of the causes of Change Order-Claim.

Dispute related to construction projects involving numerous persons is one of the biggest challenges faced by contractors today. It costs a substantial amount of money and time in resolving these kinds of claims. Recently, with the changes in the construction environment and thought of relation with owner, the number of construction claims has increased. But, a majority of these claims do not prevail, and in fact, frequently get dismissed in its entirety. The reasons for such dismissals include the ignorance about the claims, lack of clear and convincing evidence, and so on. But most of reasons are the claims are not managed well on construction process. This paper analyzes the failure causes by relying on past claim failure cases, and then drew works that have connection with failure causes through interview. It also presented importance degree of construction management works.
