유럽연합 법제상 해상보험계약의 준거법에 관한 연구 (EC's Recent Developments of Legal Regime in Governing Law for Marine Insurance Contracts)

  • The Korean Conflict of Laws Act recently incorporated much of the European Union's recent revision in "EC Convention on the Law Applicable to Contractual Obligations (Rome 1980)"(hereinafter Rome Convention). With the revision of Rome Convention applied to contractual obligations,"Regulation (EC) No 593/2008 of the European Parliament and of the Council of 17 June 2008 on the law applicable to contractual obligations (Rome I)"(hereinafter Rome I) has taken effect on December 2009. Before the effectivation of Rome I, "Regulation (EC) No 864/2007 of the European Parliament and of the Council of 11 July 2007 on the law applicable to non-contractual obligations (Rome II)"(hereinafter Rome II) has come into effect on January 2009. This means the revision of certain rules and its practical implications need an in-depth study on governing law rules under Rome I which provides newly effected governing laws applicable to contractual obligations. Moreover, uniform choice of law rules on non-contractual obligations needs to focus especially on marine insurance contract. Where policy assignment and subrogation causes, how to decide the governing law which will be applied to the insurer as a third party? This article attempts to analyze emerging legal issues in legal regimes determining choice of law, especially those in international marine insurance contracts. This will help Korean practitioners to be dialed in legal affairs under English Law as the governing law in their contracts.

  • This research was aimed at finding clues of improving residential quality of the Urbanistic Housing which was introduced for the small household of 1-2 residents. It was the laws on communal amenity in multi-family housing that this research concentrated on. Looking into the multi-family housing standards for small household of Korea, Japan and UK, Japanese One-room housing Ordinance of Tokyo-do laid stress on avoiding conflict among residents and getting people mixed together. And UK's concentrated on every individual rooms inside HMO and suggested certain level of qualified life through the careful standards. On the other hand, Korea's just suggested minimum housing with unit households and nearly no amenity except for parking lots. There should be more than a physical space with some area which satisfies basic physiological needs in a residence. To become a quality residence filled with relationship, it is necessary that Urbanistic Housing are also required to provide communal amenities, not as much as regular housing for regular household but much more than Quasi-housing, the minimum residence. And it should be ensured by the legal system to make it more effective.

독일의 대체적 소비자분쟁해결법상 분쟁해결 절차에 관한 연구 -분쟁조정인의 법적 지위와 역할을 중심으로- (A Study on Dispute Resolution Procedures under the German Consumer Alternative Dispute Resolution Act)

  • The legal integration in the European Union that seeks a unified system in consumer disputes and the German Consumer Dispute Mediation Act based on this pursues the procedural fairness of consumer disputes and the equality of results. The role and legal status of the dispute mediator, who plays a very important role in this process, and the stable operation of the dispute resolution system and the guarantee of reasonable results through the guarantee of fairness and independence are very important values. In particular, the dispute mediator under the Act is conceptually different from the existing mediator or mediator, and through this distinction, the duties and contents of the dispute mediator are also distinguished. For this reason, the qualifications of dispute mediators that affect the outcome of dispute mediation are strictly stipulated. There have been some criticisms of this strictness, and such strictness is also seen as an excessive limitation. However, these standards can be understood as one of the efforts to make the dispute mediation procedure more systematic and to operate objectively in accordance with laws and procedures. In addition, in relation to the issue of independence and impartiality of the dispute mediator, the status of the dispute mediator is guaranteed in various aspects. In economic terms, it is not influenced by external factors, and furthermore, in order to guarantee job stability, the results of job security and dispute resolution are not linked. By examining the appropriate level of discipline for these dispute mediators, we expect the developmental growth of the consumer dispute resolution system under our Act.

  • 최근 챗 GPT 인공지능(AI)은 전 세계 모든 정부 및 기업, 군 분야까지 초미의 관심사이다. 기존의 읽고 쓰는 AI시대에서 말과 글과 그림을 만들어 내는 생성형 AI로 인간과의 소통까지도 가능한 시대에 진입했다. 최근 우리나라 국가 위기시 발령하는 국가기관의 현행 법·령의 복잡성과 전·평시 법률적용 시기의 모호성으로 인해 상황조치의 골든타임을 놓치는 경우가 많았다. 이러한 이유들로 대형 참사 및 북한과의 군사적 충돌 때마다 제대로 된 대응을 하지 못했다. 따라서 본 연구의 목적은 이러한 상황을 극복하기 위한 제언으로 국가 위기시 컨트럴타워 역할을 수행 할 수 있는 "국가위기 관리 기본모법" 과 이를 활용하는 "인공지능 관련법" 개정과 현재 인공지능 기술을 민·관·군·경과 상호 연동하는 "인공지능 거버넌스 활성화 방안" 및 전국 지자체 통합방위 종합상황실내 "MIDS 인공지능반"을 신설하여 인공지능을 활용한 미래의 통합방위체계 발전방안을 제시하였다.

국제상사중재에서 실체의 주관적 준거법 (Choice of Law Governing Substance of Dispute in International Commercial Arbitration)

  • In international commercial arbitrations that arise from an international commercial contract, arbitral tribunals ruling on the merits of the arbitration apply the law governing the contract. The parties to contract are free to designate the law under the principle of parties autonomy. This paper examines this principle under the Korean Arbitration Act, and makes some legislative suggestions. For this purpose, this paper first discusses what is the scope of matters covered by the law governing the contract, what are the rules of conflict-of-laws for determining the law governing the contract, and what happens when the arbitral tribunal incorrectly applies the law governing the contract? Then, this paper further goes to examine issues such as the form of choice-of-law agreement, the explicit or implicit choice of law, the parties' ability to choose the rules of law including lex mercatoria, the change of choice-of-law agreement, the independence of choice-of-law clause.

  • 데이터, AI 등 정보기술 기반의 초연결 사회인 4차 산업혁명 시대의 데이터 중요성이 증가하고 있으며 이에 발맞추어 정부도 데이터경제 활성화를 위한 법률 제정 및 개정이 활발히 진행되고 있으나 규제 법률인 개인정보보법과 데이터 활성화 법률(데이터기반행정 활성화에 관한 법률, 데이터 산업진흥 및 이용촉진에 관한 기본법, 산업디지털 전환 촉진법) 간 충돌 가능성, 결합전문기관 유형별 입장차, 데이터전문기관과 결합전문기관의 수행 범위 등 데이터산업 활성화의 발목을 잡거나 잘못된 방향 설정 등의 문제를 예방하고 개선할 필요가 있다. 이에 결합전문기관의 역할 및 현황, 활용 사례를 분석하고 현장의견을 청취하여 데이터경제 활성화를 위한 결합전문기관 역할 확대 방안과 개선방안을 도출하여 소개하고자 합니다.

말기의료에 관한 미국 법제의 연구 - 말기의료결정 제도를 중심으로 (Legislative Approaches to Terminal Care Issue in the U.S.A. - Acts on Terminal Health-Care Decision)

  • The first legislation for terminal health-care decision was California's Natural Death Act (NDA) of 1976 that permitted any adult person to execute a directive directing the withholding or withdrawal of life-sustaining procedures. Advance directive legislation has subsequently progressed on a state-by-state basis. By 1992, all 50 states, as well as the District of Columbia, had passed legislation to legalize some form of advance directive. This state legislation, however, has resulted in an often fragmented, incomplete, and sometimes inconsistent set of rules. Statutes enacted within a state often conflict and conflicts between statutes of different states are common. In an increasingly mobile society where an advance health-care directive given in one state must frequently be implemented in another, there is a need for greater uniformity. In 1993, the Uniform Law Commissioners approved the Uniform Health-Care Decisions Act (UHCDA) in order to bring order to the existing chaos. Unfortunately, the Commissioners waited too long to act. By the time the UHCDA was approved, nearly all states had passed legislation governing advance directives. Consequently, the UHCDA has achieved only a limited success, picking up but one or two enactments a year. The UHCDA is currently in effect in around 10 states: Alabama, Alaska, California, Delaware, Hawaii, Kansas, Maine, Mississippi, New Mexico, Tennessee, Wyoming. In these states the previous laws related to the subjects have been all repealed. The overall objective of the UHCDA is to encourage the making and enforcement of advance health care directives including living will or individual instruction, power of health-care attorney and to provide a means for making health care decisions for those who have failed to plan. The U. S. House of Representatives in 1991 enacted the Patient Self-Determination Act (PSDA). The Act stipulates that all hospitals receiving Medicaid or Medicare reimbursement must ascertain whether patients have or wish to have advance directives. The Patient Self- Determination Act does not create or legalize advance directives; rather it validates their existence in each of the states. Now in America, terminal health-care decision or advance directive for health care is common and universal system. The problem, however, is how to let more people use these good tools to make their lives more beautiful and honorable.

신탁법 개정 제안 (Proposal for Revision of Trust Act)

  • 전면 개정된 신탁법(2011. 7. 25. 법률 제10924호)이 2012. 7. 26. 시행된 이래, 신탁법리는 그 어느 때보다 관심의 대상이 되고 있다. 최근 실무에서 신탁의 이용이 확대되고 관련 판결이 대폭 증가한 현상이 이를 대변한다. 그러나 제한된 기간에 종래 논의가 충분하지 못한 상태로 전면 개정이 이루어지면서, 그리고 법 개정 과정에서 세심한 검토가 미흡했던 까닭에, 여러 문제점들도 드러났다. 법규의 단순한 오류뿐만 아니라 규정의 불분명함을 바로잡고 관련 법률을 보완할 필요성과 함께, 새로운 규율을 위한 과제에 직면해 있다. 이에 본고는 우리법 체계에 상응하는 신탁관계의 합리적 규율을 위하여, 신탁법의 주요 규정을 중심으로 그 개정을 위한 근거와 방안을 제시하고, 이를 통해 신탁법의 개정을 촉구함과 동시에 가시적인 논의의 계기를 마련하고자 한다. 신탁법리에 상응하는 개념을 정비하고(제3조 제2항, 제36조, 제59조), 오류를 바로잡을 것이다(제18조 제1항, 제21조 제3항, 제22조 제1항, 제66조 제3항). 다른 법률과의 관계에서 개정이 시급한 규정(제11조, 제67조 제2항) 또는 일반 법리에 비추어 문제가 제기되는 규정(제8조 제4항, 제67조 제3항)을 재고하여야 한다. 그리고 신탁법의 체계에 상응하여 규정의 위치를 조정할 필요가 있으며(제3조 제3항), 보다 상세한 명시적 기준을 제시함으로써 해석상의 의문이 제기되지 않도록 하여야 한다(제8조 제1항, 제8조 제5항, 제18조 제3항, 제34조, 제56조, 제75조, 제98조, 제100조). 이와 더불어 보다 합리적인 규율을 위해(제42조 제3항, 제50조 제1항) 또는 신탁 관계인의 이익교량의 관점에서 조정이 필요하다(제8조 제4항, 제101조 제5항). 그밖에 신탁법상 제도의 활용을 위해서는 관련 법규의 보완이 절실하다.

A Study on the Institutional Improvements in the Operation and Management of Underground Shopping Malls

  • Purpose: The purpose of this study is to analyze the method of calculating the usage fee, rent, and lease rights of public goods necessary for the operation and management of the underground shopping mall, and to suggest systematic improvement points for the operation of the underground shopping mall. Data and Methodology: First, ordinances and regulations related to common property were investigated. Second, previous studies were analyzed. A survey was conducted with five questions that conflict with the interests of underground shopping mall merchants among the ordinances and operating systems related to the current underground shopping malls' common property. Results: Underpass merchants wanted monthly payment for the use of common property, and merchant organizations wanted to limit the increase rate with the right to use. They asked for the property value due to donation to be excluded from the loan fee, they wanted to revise the Common Property Act on the transfer of lease rights, and they wanted to revise the loan contract renewal period. Conclusion: There is a need to improve the laws and systems for underground shopping malls, and it will have to be negotiated according to the opinions of the merchants gathered among them, and it will have to be implemented in stages in the long term.

해상풍력 입지 선정 과정에서 복합적 갈등의 제도적 해결방안 - 다층적 거버넌스 관점에서 (Institutional Solution to Complex Conflicts in the Site Selection Process of Offshore Wind Power - from a Multi-level Governance Perspective)

  • Several offshore wind power conflicts occur due to the problems in which the site selection process led by private operators is improperly managed. To review the institutional improvement measures that solve this problem, domestic and foreign institutions and operational cases were comparatively analyzed, focusing on key actors from the multi-level governance perspective. First, the status of the site selection process in the Republic of Korea, major issues in stakeholder conflicts, and discussions on the planned site system-related laws (draft) were reviewed. Next, the site selection process and relevant cases in Germany, the Netherlands, and Japan were analyzed. In all these countries, site selection is done by the central government. In Germany and the Netherlands, maritime-related ministries establish overall offshore wind power site plans and conduct strategic environmental assessments for these plans. Futhermore, in the process of determining each individual site, extensive site investigation including environmental assessments are conducted. This aspect needs to be supplemented in the discussion on the direction of institutional improvement in the Republic of Korea.
