Coronavirus disease 2019 (COVID-19), which is a newly emerging infectious disease worldwide, can be categorized as an occupational disease, because employees, particularly in the healthcare system, can be infected at the workplace. As of December 15, 2020, we summarized the occupational safety and health practices in selected countries on the recognition of COVID-19 as one of the occupational risks. The situation has differed among countries, including the recognition status and whether a specific regulation existed. International organizations, namely the International Labour Organization, World Health Organization, and European Union, should plan and conduct studies on the work-relatedness of COVID-19, propose criteria for recognition, and add the infection to the occupational disease list to provide a basis for specific country regulations. Stakeholders should also act to adjust country-level legislation.
In the original licensing application for the prototype fast-breeder reactor, MONJU, the event progression during an unprotected loss of flow (ULOF), which is one of the technically inconceivable events postulated beyond design basis, was evaluated. Through this evaluation, it was confirmed that radiological consequences could be suitably limited even if mechanical energy was released. Following the Fukushima-Daiichi accident, a new nuclear safety regulation has become effective in Japan. The conformity of MONJU to this new regulation should hence be investigated. The objectives of the present study are to conduct a preliminary evaluation of ULOF for MONJU, reflecting the knowledge obtained after the original licensing application through CABRI experiments and EAGLE projects, and to gain the prospect of in-vessel retention for the conformity of MONJU to the new regulation. The preliminary evaluation in the present study showed that no significant mechanical energy release would take place, and that thermal failure of the reactor vessel could be avoided by the stable cooling of disrupted-core materials. This result suggests that the prospect of in-vessel retention against ULOF, which lies within the bounds of the original licensing evaluation and conforms to the new nuclear safety regulation, will be gained.
Some Contracting States of the Chicago Convention issue FAOC(Foreign Air Operator Certificate) and conduct various safety assessments for the safety of the foreign operators which operate to their state. These FAOC and safety audits on the foreign operators are being expanded to other parts of the world. While this trend is the strengthening measure of aviation safety resulting in the reduction of aircraft accident. FAOC also burdens the other contracting States to the Chicago Convention due to additional requirements and late permission. EASA(European Aviation Safety Agency) is a body governed by European Basic Regulation. EASA was set up in 2003 and conduct specific regulatory and executive tasks in the field of civil aviation safety and environmental protection. EASA's mission is to promote the highest common standards of safety and environmental protection in civil aviation. The task of the EASA has been expanded from airworthiness to air operations and currently includes the rulemaking and standardization of airworthiness, air crew, air operations, TCO, ATM/ANS safety oversight, aerodromes, etc. According to Implementing Rule, Commission Regulation(EU) No 452/2014, EASA has the mandate to issue safety authorizations to commercial air carriers from outside the EU as from 26 May 2014. Third country operators (TCO) flying to any of the 28 EU Member States and/or to 4 EFTA States (Iceland, Norway, Liechtenstein, Switzerland) must apply to EASA for a so called TCO authorization. EASA will only take over the safety-related part of foreign operator assessment. Operating permits will continue to be issued by the national authorities. A 30-month transition period ensures smooth implementation without interrupting international air operations of foreign air carriers to the EU/EASA. Operators who are currently flying to Europe can continue to do so, but must submit an application for a TCO authorization before 26 November 2014. After the transition period, which lasts until 26 November 2016, a valid TCO authorization will be a mandatory prerequisite, in the absence of which an operating permit cannot be issued by a Member State. The European TCO authorization regime does not differentiate between scheduled and non-scheduled commercial air transport operations in principle. All TCO with commercial air transport need to apply for a TCO authorization. Operators with a potential need of operating to the EU at some time in the near future are advised to apply for a TCO authorization in due course, even when the date of operations is unknown. For all the issue mentioned above, I have studied the function of EASA and EU Regulation including TCO Implementing Rule newly introduced, and suggested some proposals. I hope that this paper is 1) to help preparation of TCO authorization, 2) to help understanding about the international issue, 3) to help the improvement of korean aviation regulations and government organizations, 4) to help compliance with international standards and to contribute to the promotion of aviation safety, in addition.
International Seabed Authority (ISA) is currently developing rules with regard to exploitation of manganese nodules which will be contained in its first regulations governing the exploitation of deep seabed mineral resources. A stakeholder survey was conducted in the early 2014 by ISA with the aim of facilitating participation of interested entities in the development process of the rules. The stakeholders who had replied to the survey included existing contractors, sponsoring States, environmentalists, academics, and nongovernmental organizations. Opinions given by them largely reflect their own interests. This paper aims to clarify the scope of the obligations regarding the environmental protection which may be imposed on contractors under the new regulations for the exploitation of manganese nodules. To do so, it first analyses the express provisions on environmental protection applicable to deep seabed mining included in the Law of the Sea Convention, its agreement on implementation of Part XI, and the regulations on exploration for manganese nodules. Secondly, it categorizes these obligations based on the categories of international obligations suggested by Combacau and Alland. Based on the categorizations this paper concludes that, in addition to the existing duties to protect deep seabed environment within the Law of the Sea Convention system, the following new obligations could be added: conservation of exploitation sites for a limited time after the contract is ceased; taking all necessary measures for rehabilitation of destroyed ecosystems that occurredas a result of mining activities; monitoring exploitation sites for a limited period time after the contract is ceased; observing rules and standards on safety of ships and environmental protection adopted under IMO instruments; regulation on the discharge of mine tailings from the facilities used for exploitation of deep sea minerals. Lastly, this paper attempts to provide ways of reflecting national interests in terms of potential obligations which may be included in the new regulations.
In mathematics education we have focused on how to improve the problem-solving ability, which makes its way to the new direction with the introduction of meta-cognition. As meta-cognition is based on cognitive activity of learners and concerned about internal properties, we may find a more effective way to generate learners problem-solving power. Its means that learners can regulate cognitive process according to their gorls of learning by themselves. Moreover, they are expected to make active participation through this process. If specific meta problems designed to develop meta-cognition are offered, learners are able to work alone by means of their own cognition and regulation while solving problems. They can transfer meta-cognition to the other subjects as well as mathematics. The studies on meta-cognition conducted so far may be divided into these three types. First in Flavell([3]) meta-cognition is defined as the matter of being conscious of one's own cognition, that is, recognizing cognition. He conducted an experiment with presschoolers and children who just entered primary school and concluded that their cognition may be described as general stage that can not link to specific situation in line with Piaget. Second, Brown([1], [2]) and others argued that meta-cognition means control and regulation of one's own cognition and tried to apply such concept to classrooms. He tried to fined out the strategies used by intelligent students and teach such types of activity to other students. Third, Merleary-Ponty (1962) claimed that meta-cognition is children's way of understanding phenomena or objects. They worked on what would come out in children's cognition responding to their surrounding world. In this paper following the model of meta-cognition produced by Lester ([7]) based on such ideas, we develop types of meta-cognition. In the process of meta-cognition, the meta-cognition working for it is to be intentionally developed and to help unskilled students conduct meta-cognition. When meta-cognition is disciplined through meta problems, their problem-solving power will provide more refined methods for the given problems through autonomous meta-cognitive activity without any further meta problems.
This article explores the risk governance of nanotechnology in Korea in light of a regulatory law approach, a soft law approach, and a participatory governance approach. The risk governance of nanotechnology in Korea has three characteristics. First, there are many existing regulatory laws that can be applied to the regulation of nanotechnology. However, these laws have exemptions, the extent of which are larger than that of the Europe and the United States. Second, the soft law approach is the most prevalent risk policy in Korea at present, but is limited because it is being driven by the government without active, voluntary participation of relevant companies. Third, no case of participatory governance took place when it comes to nanotechnology technology assessment. As policy recommendations to improve Korean nanotechnology risk governance, this article suggests pre-market screening, mandatory governmental registration of nanomaterials, transition management of code of conduct, and the design of interdisciplinary research and development project for real-time technology assessment.
Purpose Based on the development of artificial intelligence and big data technologies, the RegTech has been emerged to reduce regulatory costs and to enable efficient supervision by regulatory bodies. The word RegTech is a combination of regulation and technology, which means using the technological methods to facilitate the implementation of regulations and to make efficient surveillance and supervision of regulations. The purpose of this study is to describe the recent adoption of RegTech and to provide basic examples of applying RegTech to capital market regulations. Design/methodology/approach English-based ontology and deep learning technologies are quite developed in practice, and it will not be difficult to expand it to European or Latin American languages that are grammatically similar to English. However, it is not easy to use it in most Asian languages such as Korean, which have different grammatical rules. In addition, in the early stages of adoption, companies, financial institutions and regulators will not be familiar with this machine-based reporting system. There is a need to establish an ecosystem which facilitates the adoption of RegTech by consulting and supporting the stakeholders. In this paper, we provide a simple example that shows a procedure of applying RegTech to recognize and interpret Korean language-based capital market regulations. Specifically, we present the process of converting sentences in regulations into a meta-language through the morpheme analyses. We next conduct deep learning analyses to determine whether a regulatory sentence exists in each regulatory paragraph. Findings This study illustrates the applicability of RegTech-based ontology and deep learning technologies in Korean-based capital market regulations.
Rapid increase of aging population and progressed migration from rural areas to urban areas have caused deficit of bus routes in local cities. This increasing burden of operation deficit affects the movement strategy of the transportation vulnerable who are using buses. Along with dramatically increased aging in Korea, there is an urgent need to implement a new method which can guarantee mobility rights of public transportation especially for the elderly. This study focuses on the case of Demand Responsive Transit(DRT) system that has been operating in America, Europe, Japan, etc. Kimhae(Sangdong-myeon and Saengnim-myeon) is selected as a study area. This study investigated the possibility of adopting DRT system on the perspectives of the consumer and provider by the analysis of traffic condition such as the number of transportation vehicles, present bus service and regulation and conduct of questionnaire survey which includes present bus service and DRT system and so on. In conclusion, DRT system in Kimhae city will reduce transport cost, increase affordability through the betterment of service level and secure mobility rights for the transportation vulnerable.
Objectives: To characterize the usage patterns of new types of tobacco products (NTTPs) to develop effective strategies for the regulation of NTTPs in Korea. Methods: We conducted focus group interviews to identify the NTTP usage patterns of research subjects. The NTTPs were limited to electronic cigarettes (e-cigarettes), waterpipe tobacco, and rolling tobacco. We categorized 30 research subjects into 4 groups. The ecigarette group was divided into adult and adolescent groups. Each group contained 7-8 subjects. An interview lasting approximately 2 hours was conducted with each group. Results: Ninety percent of NTTP users used an NTTP in combination with conventional cigarettes. Subjects mostly bought NTTPs online, unlike how they bought cigarettes. Additionally, a great deal of information, such as how to use NTTPs and descriptions of NTTP products, was exchanged through online or offline societies. The primary reason why the subjects used NTTPs was that NTTPs offer a greater range of flavors and aromas than cigarettes. Moreover, NTTPs were felt to be less repulsive than cigarettes. NTTPs were not used as a cigarette substitute; rather, they were mostly used in places and situations where traditional cigarette smoking was not allowed. Conclusions: Based on the results of this study, the government should conduct studies on the effects of the combined use of NTTPs and cigarettes on the human body, obtain and provide accurate data regarding NTTP use, and develop and implement polices to ban NTTP advertising, which may arouse adolescents' curiosity, and the addition of flavoring substances to tobacco products.
Purpose - Social welfare is a social insurance system that provides funds and services for all citizens to maximize their life quality. Its ultimate goal is to alleviate social contradictions. Therefore, this paper explores the determinants of social welfare in terms of macroeconomics. Research design, data, and methodology - Based on the vector error correction model, the annual time series from 1990 to 2017 will be used to conduct an empirical analysis. The real GDP, the real income, the inflation and the degree of openness will be treated as independent variables. The input of social welfare will be treated as a dependent variable. These variables will be used to perform the cointegration test and the vector error correction model to explore how the macroeconomic variables affect social welfare both in long run and short run. Result - Via the empirical analysis, it can be summarized that the real GDP, the real income and the degree of openness are the driving determinants to enlarge the social welfare. Conversely, the inflation is the obstructive determinant to reduce the social welfare. Conclusion - The positive and negative determinants of social welfare exist simultaneously, China's government should take macroeconomic regulation and control to balance them to enlarge social welfare.
