  • On July 23th, 2009, the newly-revised copyright law was reflected the free trade agreement which occurred between the United States and the Republic of Korea. The agreement is expected to have positive effects such as competition as well as the social efficiency in the field of intellectual property. Nevertheless, Korean government should pay much costs, Therefore, we should minimize the cost in a short run and maximize the benefits we could obtain out of the agreement in a long run. However, we are not prepared to improve economic value of the intellectual property rights. Specifically, it should be noted that the aspects of law execution to protect not only the intellectual property rights. If we manage to get the utmost out of the agreement, we could be going through the transition from a consumer nation of intellectual properties to a producer nation.

  • Number Portability means that one can use his original telephone number when he change telephone service provider, region and the kind of service. Number portability is not necessary when only one telephone service provider exist in korea. But it is necessary to guarantee pair competition among the service providers as new communication service provider comes. The law which is related number portability is established by government as number portability is considered a tool to guarantee pair competition between old service provider and new service provider. A national standard on number portability with which all service provider can agree is needed. We developed functional standard for that purpose. Functional standard includes call processing structure, network requirement. This paper handle functional standards.

  • For a library to be run more efficiently, its internal strengths and weaknesses, external opportunities and threats must be determined for forecasting on the basis of the diagnosis of the internal and external environment and situations, and optimum strategies and measures responsively deducted and utilized. Therefore, I had analyzed the strategic competition of university A's library using SWOT analysis, which has recently been spotlighted as an effective strategic competition analysis method. The conclusions thus obtained are as explained below. Firstly. the strengths of university A's library are the professional qualifications of the employees. work efficiency based on systematic operative plans and division of work load, and provision of high quality service following the establishment of the digital library. Secondly, its weaknesses are the insufficiency and limits of the usable resources, the lack of progressive future operation plans and systems, and the deficiency of a positive service mind. Thirdly, the opportunities are the possibility for new developments in accordance with the digital information environment. reinforcement of the operative efficiency throughout expanding its cooperation with external organizations and other libraries, and its transformation as the local library hub by opening up to the public. Fourthly, the threats are the lack of the school authorities' acknowledgement. and the degradation of the library's status in accordance, the users' various requests for information and advanced professional service according to the rapidly changing information environment. and the restriction of the library service based on the copyright law. Fifthly, as a result of analyzing the strategic competition of university A's library, measures such as the reinforcement of digital service by acquiring digital specialists. provision of extended service through active cooperation with external institutes and libraries. development and provision of differentiated service in accordance with the reinforced copyright law were proposed to improve the library's future competitiveness.

Market Definition and System Analysis of Paid Broadcasting Services (유료방송서비스의 시장 획정과 제도 분석)

  • This paper defines markets relating to each paid broadcasting service by applying the test method of critical sales loss to the results of survey to the paid service subscribers. The result confirms the existence of a meaningful competitive relationship--in terms of the Competition Law--among all paid broadcasting services included in this study, or at least analog cable broadcasting, digital cable broadcasting, and real time IPTV(Internet Protocol TV) service. This indicates that current regulations which are being applied to cable TV, satellite broadcasting, and IPTV are actually discriminatory. Based on these analysis results, this paper suggests that the main attention for the improvement of regulations should be focused on regulations which are differently applied to different paid service providers. In particular, Article 20 in the Internet Multimedia Broadcasting Law is interpreted as defining the real-time IPTV as an independent market, thereby having leeway to harm fair competition among different paid service providers. Therefore, that article needs to change to give the right of equal access to contents to all the competing paid service providers. Furthermore, to put teeth in the contents equal access rule, most popular pay channels need to be designated as target contents of the rule. As for the market-share limitation regulations, the paper suggests that an upper limit on the market share should be set based on the total number of subscribers of all the competing paid services and the same limit applied to all the competing paid service providers.

The Study of Determinants of Tax Compliance (국가간 조세순응의 결정요인에 관한 연구)

  • This study examines the international differences in tax compliance and relates these differences to selected determinants of tax morale and Hofstede's Cultural dimensions. The findings of the empirical investigation of data from 38 countries during 5 years(2000-2004) indicate that tax compliance is highest in countries characterized by high economic freedom, high effective competition laws, high government transparency, low shadow Economy, and low power distance. It shows that a powerful deterrent to tax evasion is the creation of a tax morale. Where individuals can exercise their economic rights in terms of economic freedom, important equity market and effective competition laws, in a safe environment that improves their quality of life, they are more prone to view tax compliance as less of a burden and more of a citizenship duty. Our results indicate that policymakers should consider cultural values when designing tax compliance legislation and investigating possible behavior irregularities.

  • As broadcasting contents are recognized as a key competition means, there are issues raised such as improvement of terrestrial retransmission system, introduction of PAR in broadcasting market and so forth. Especially, in pay broadcasting market, strategic partership between SP and PP leads to contents exclusivity for competitors, which causes to hinder normal competition and limit viewers' right of access. Consequently, not only is it claimed that essential facilities doctrine should be adopted in broadcasting market, but also clause of content equal access in IP TV law and adoption of prohibited acts regulation can be viewed in the same context. However, adoption of essential facilities doctrine in broadcasting market is likely to be counterproductive because of the differences of philosophies, economies and legal systems on which general facilities and contents are based. Therefore, it is time for a essential facilities concept, a fundamental concept of a refusal to dealing of essential facilities, and basic works to review specific cases and precedents implemented in competition laws market This study aims to review and propose beforehand if adoption of essential facilities doctrine is appropriate for broadcasting contents.

Changes in China's Rare Earth Industry Policy and their Implications (중국 희토류산업정책의 변화와 정책적 함의)

  • China not only has the largest amount of rare earth reserves, but it also produces the most rare earth products. However, China lacks appropriate supervision and management systems of its rare earth industry. The Chinese government's inappropriate mechanisms have been cause for reckless development by national rare earth providers characterized by excessive competition, environmental pollution, and smuggling. In response to the problems, China implemented regulatory measures to restructure the rare earth industry. The Chinese central government intensifies its efforts to control the total quantity of rare earth products and tackle environmental pollution. Six leading conglomerates have been selected to promote the Chinese central government's policy. A new environmental guideline has been drawn up to reduce the discharging of wastewater and air pollution substance. Huge transition and a great influence of its policy changes are expected. These policy changes are bound to entail huge transitions, and the policy is expected to have a great influence in the future structure of the rare earth industry. In consideration of these changes, the Korean government, in collaboration with private enterprises needs to take appropriate measures, such as overseas resources development, R&D expansion, tactical stockpiling, professional manpower training and so on.

  • This paper discusses the qualification criteria for international hub airport and suggests the strategies for Inchon International Airport (IIA) to be the hub airport in the East Asia. Recently, many East and Southeast Asia countries have invested on large scale international airports like Chap Lak Kok airport, Pudong airport etc.. as Korea have done on IIA. IIA to be open in 2001 will face a serious competition with these airport. Being a hub airport requires geographic proximity. sufficient volume of local traffic. uncongested infrastructure, a good accessibility to surrounding industrial centers. high quality of service to the airline. In order to promote airlines to land at IIA. Korea Government need to establish Open Sky Policy to many countries and national flag carriers of Korea need to be involved in a global alliance. Developing vicinity of IIA as free trade zone will generated more local traffic which makes IIA as more attractive candidate for airlines. The Korea airspace is one of the most restricted area in the world becuase of the national security. which limits civil aircraft maneuvers. The airspace need to be re-structured to exploit the full capacity of IIA.

How to Enhance International Competitiveness of Korean Pharmaceutical Industry with CEPA as a momentum?

  • CEPA(Comprehensive Economic Partnership Agreement, hereinafter CEPA) between India and Korea may influence some changes on Korean pharmaceutical industry which shows less competitive advantages than Indian industry in many regards. So the purpose of this paper remains on suggesting the way of enhancing international competitiveness for Korean industry on the basis of double diamond model. Through the comprehensive and deep analysis, our findings on recommendable business strategies for Korea are as follows ; in terms of factor conditions, first, cooperative strategy in R&D for developing generics will be required. Second, Introduction of CMO business can be considered. In terms of demand condition, Korean firms should find out the chance for demand creation in Indian market which has future market potential and American market exploration, as soon as possible. With regards to strategy, structure and competition, trying M&A with leading Indian companies and utilizing well organized medical professionals in India will be considered. In the points of related and supportive parts, lastly, Korean government should try to make so called "National Strategic R&D committee" for pharmaceuticals and bring u-healthcare service to Korea in the first place. If Korean pharmaceutical industry implement above-mentioned strategies, CEPA can be turned into business opportunities from the crisis. As a result, Korean firms shall have more powerful global competitiveness eventually.
