N-ary Information Markets: Money, Attention, and Personal Data as Means of Payment

  • On information markets, we can identify different relations between sellers and their customers, with some users paying with money, some paying with attention, and others paying with their personal data. For the description of these different market relations, this article introduces the notion of arity into the scientific discussion. On unary information markets, customers pay with their money; examples include commercial information suppliers. Binary information markets are characterized by one market side paying with attention (e.g., on the search engine Google) or with personal data (e.g., on most social media services) and the other market side (mainly advertisers) paying with money. Our example of a ternary market is a social media market with the additional market side of influencers. If customers buy on unary markets, they know what to pay (in terms of money). If they pay with attention or with their personal data, they do not know what they have to pay exactly in the end. On n-ary markets (n greater than 1), laws should regulate company's abuse of money and-which is new-abuse of data streams with the aid of competition (or anti-trust) laws, and by modified data protection laws, which are guided by fair use of end users' attention and data.

Review for Innovation and Patent System in the Pharmaceutical Sector

  • This study analyzes patenting practices in the pharmaceutical industry and the impacts of sequential innovation. The main argument of the research is that strategic patenting is common in the pharmaceutical sector and it is legal within the context of patent law. However, when these practices have negative effects on the competition process post-grant, the practices that are legal under patent law may come into conflict with antitrust laws, which are not applied. The study brings into question whether sequential patenting practices characteristic of the pharmaceutical industry encourage or discourage innovation, and moreover, the overall functionality of the patent system. Ultimately, the functionality of the patent system creates market incentives that neglect consumer, i.e., patient, welfare; potential solutions to deal with the shortcomings are discussed.

델파이 분석을 통한 조경설계공모 과정의 문제점 분석 (An Analysis on the Problems of Design Competition Process of Landscape Architecture by the Delphi Analysis Method)

  • 본 연구는 1983년 설계공모 제도가 한국 조경계에 도입되고 30년이 지난 현 시점에서 조경 설계공모 과정에서 발생되고 있는 문제점을 분석 고찰함으로써 향후 조경 설계공모 과정 개선에 기여할 수 있는 기초자료를 제공하기 위한 목적으로 수행하였다. 연구를 수행하기 위해 조경 설계공모에 관여하는 전문가를 대상으로 델파이 조사를 실시하여 문제점을 도출하였으며, 그 결과는 다음과 같다. 첫째, 조경설계 공모 관련 이론과 선행연구를 분석한 결과, '설계공모 방식', '설계공모 지침', '당선작 선정과정', '당선작 이후 설계변화' 등 4가지 관점에서 문제점이 있는 것으로 나타났다. 둘째, 전문가 델파이 분석을 통하여 전문가들의 의견을 합의하는 과정을 이끌었고, 그 결과 총 12개의 항목으로 조경설계 공모 과정의 문제점이 도출되었는바, '설계공모 방식'에서는 '설계공모 기간의 문제', '설계공모 방식' 등 2가지의 항목, '설계공모 지침'에서는 '비위계적이고 혼란스러운 지침', '규정적으로 정해지는 지침', '지침의 분량의 과다' 등 3개 항목, '당선작 선정과정'에서는 '심사위원 전문성 결여', '비조경전문가 참여', '심사배점 방식에 문제점' 등 3개 항목, '당선작 이후 설계변화'에서는 '발주처 설계담당자의 잦은 인사이동', '설계기간의 기약 없는 과다연장', '발주처의견이 과다하게 반영되는 풍토', '원설계의 창의성을 저감시키는 발주처 의견' 등 4가지 항목이 문제점으로 나타났다.

한국소비자원 의료분쟁 조정제도의 개선방안 (Improvement in the Medical Dispute Mediation System of Korea Consumer Agency)

  • 의료사고는 환자의 생명, 건강과 직결되는 경우가 많기 때문에 사전에 예방하는 것이 바람직하다. 그러나 의료사고가 발생한 경우에는 당사자 간의 감정이 첨예하게 대립되기 전에 조정을 통해 신속하고도 원만하게 해결할 필요가 있다. 한국소비자원은 신속 공정하고 효율적인 해결을 목적으로 의료분쟁 조정업무를 수행하고 있고, 이는 동일한 업무를 수행하고 있는 한국의료분쟁조정중재원 역시 마찬가지이다. 그런데 한국소비자원과 의료분쟁조정중재원은 업무중복 및 그로 인한 비효율을 이유로 통폐합에 대한 논의가 끊임없이 제기되어 오고 있지만, 소비자의 선택권 보장, 경쟁을 통한 상호 발전을 위해 두 기구가 공존하는 것이 바람직하다. 그러므로 소비자원이 조정중재원과 공정한 경쟁을 할 수 있도록 법적, 제도적 뒷받침을 해주어야 한다. 그것은 소비자원을 위 한 것이 아니라 궁극적으로 소비자를 위한 것이다.

우주(宇宙) 상업활동(商業活動) 규율(規律)에 있어서의 우주법(宇宙法)의 발전적(發展的) 위상(位相) (Developments in Space Law in regulating commercial space activities)

  • This paper examines current developing status of space law as defined in terms of its unique principle that "the utilization of outer space for all mankind's interest". As commercialization of space activities has brought about heated debate on its legitimacy with respect to that principle, space law has come to witness a dual situation. One is the realization of that principle in establishing commercial space activities system where all mankind's interest is respected through the non-discriminatory distribution mode of space benefit. In satellite telecommunication system, the INTELSAT Organization assures its public service policy while protecting itself against a competition from separate systems. For remote sensing, commercialization of LANDSAT Systems promoted since 1984 seems not to affect present non-discriminatory distribution of data and information obtained. On the other hand, active participation of private entity aiming at commercial profit enables national government to manage more effective control and supervision of those activities with a view to promoting national interests. Also, newly developed private rules and regulations are emerging in business relations about commercial space activities. Extended capacity of national government assuring its national interest in production and distribution of international resources that is outer space, and regulation of space activities by newly developed rules and customs provoke a concern about a identity problem of space law. The best way to summarize this perspective might consist in saying that non space law regulations, which are not assumed as aiming at the promotion of all mankind's interest, are confirming their role about space related activities. For those reasous, we are now facing a developing status of space law as developments of commercial space activities continues.

전파법 개정에 따른 기술·사회적 중요성 (Technological and Social Significance of the Revision of the Radio Law)

  • 전파법은 2000년 전면 개정 이후 12차례의 개정을 통해 전파자원의 확보, 전파자원의 분배 및 할당, 전파자원의 이용, 전파자원의 보호, 전파의 진흥을 중심으로 규정하고 있는 현재의 모습을 갖추게 되었으며, 이로써 전파자원의 단순한 관리법적 성격을 벗어나, 전파자원의 확보 및 전파의 진흥법적 성격을 포함하는 것으로 평가될 수 있다. 통신 분야의 법제도도 함께 정비되어 가고 있으며, 전파법도 2차례의 개정을 통해 그간의 미비점들을 보완하고 있다. 국내 전파법은 전파이용 환경 변화에 따라 자원의 효율적 배분 및 이용을 촉진하기 위한 법체계를 형성한 것으로 평가되며, 기존의 단순한 관리법적 성격에서 전파진흥 및 경쟁 관련 법적 성격을 갖게 된 것으로 평가할 수 있으며, 전파이용 유형별 세부 규정에 대한 조정은 필요한 것으로 판단된다.

  • 2001.2.3.자 부정경쟁방지법의 개정으로 신설된 제2조 제1호 (다)목에서는 부정경쟁행위의 한 종류로서 저명상표 희석행위에 대해 정의하고 이를 규제하고 있다. 저명상표는 세계 각국에서 보편적으로 보호되고 있는데 우리나라도 이와 같은 국제적인 조류에 맞추어 부정경쟁방지법에서 저명상표를 보호하고 있다. 저명상표 희석범죄가 성립하기 위해서는 (1)표지의 저명성 (2)표장의 동일 유사 (3)식별력 약화 또는 명성 손상을 요건으로 하는데, 특히 저명상표 희석범죄의 구성요건적 결과인 '식별력 약화 또는 명성손상'의 입증정도와 관련하여 저명상표 희석범죄는 침해범이나 추상적 위험범이 아닌 구체적 위험범이라고 해석함이 타당한 바, 식별력 약화 또는 명성 손상의 구체적 현실적 위험이 발생하면 본 죄가 성립하는 것으로 보아야 한다. 나아가 '식별력 약화 또는 명성 손상'의 구체적 판단 기준과 관련하여, 일반 대중의 사회 심리적 관점뿐만 아니라 구체적 사안에서의 개별 행위태양의 반(反) 가치정도를 규범적 요소로서 고려하여 종합적으로 판단함이 상당하다.

국제판매점계약(國際販賣店契約)의 주요조항(主要條項) (ICC Model Distributorship Contract(Pub.518)을 중심(中心)으로) (A Study on the Several Important Clauses in ICC Model Distributorship Contract)

  • International distributorship contract(IDC), as well as international agency contract is a type of contract which is most frequently used in international trade. But one of the main difficulties faced by parties of IDC is the lack of uniform rules for this type of contract. This means that both parties should be careful about each clause of the contract when they draw up it. The ICC prepared model form which incorporates the prevailing practice in international trade, and which aims at protecting and balancing the legitimate interests of both parties. This author examined the several important clauses in this model contract. The purpose of this examination is to help the contracting parties for better understanding and applying them in their actual contracting practice, which based on this model contract. When the supplier and the distributor execute their contract or use ICC Model Contract, they should be careful about the following points: First, some terminologies(like, "territory", "product", "competing products" and "exclusivity") should be clearly defined in their contract. Second, regarding the supplier's functions including "supplying products" and the distributor's responsibility including "undertaking not to compete", and "attaining guaranteed minimum targets", both parties should make clear about each party's right and obligation as well as one party's remedies available when other party makes breach of its obligation. Third, both parties should examine the relationship between the "exclusivity" or "sole" and competition law which is regarded as a mandatory rule in the territory. Forth, when both parties lay down "termination clause" in the contract, they should make clear about the indemnity in case of termination. Fifth, as there is not uniform law for the distributorship contract, it is inevitable to choose any local law as an applicable law in case of litigation. So both parties should keep in mind to insert arbitration clause to avoid the application of the local law. Besides, both parties should consider their individual and specific circumstances and try to reflect them in their contract by Annex I to XI attached to the end of model contract.

지적재산의 취득과 실시에 관한 경쟁정책 : 기술혁신 시장 이론

  • Because global innovation-based competition is increasing and the amount of R&D expenditures becomes severely large, it is more likely that mergers and collaborative ventures tend to affect adversely to R&D competition Against this trend, enforcing agency of advanced countries including U.S.A are reassessing certain aspects of competition policy toward mergers and acquisition to ensure that procompetitive, efficiency-enhancing transactions are permitted. The role of competition policy is developing and appropriating new technology and protects the risks involved in the licensing contract of technologies. The role of intellectual property rights is also contrived to promote technological innovation and to increase consumer welfare. That is to say, dynamic efficiency of intellectual property rights includes (l) increase in social welfare and (2) promotion of growth by improvement of quality through invention and commercialization of new product as well as enhanced productive efficiency thorough appropriating new process. Because intellectual property rights are licensed to make use of complementary inputs, the rule of reason approach seems proper when applying antitrust law. To analyze the "Antitrust Guidelines for the Licensing and Acquisition of Intellectual Property"by DOJ and FTC in U.S.A, the author surveyed pros and cons on innovation market approach. This approach will only be used in a narrow range of situations when the evidence is solid, concentration numbers are extremely high, and the agencies can predict with a high degree of certainty that the merger will likely lead either to a slowing in the pace of innovation or the loss of an alternative research track that is likely to lead to a product beneficial to consumers. The author introduces the studies on licensing contract of intellectual property rights and competition polices on behalf of potential inquirers. Also the author invites the interdisciplinary researchers to analyze further with a model on the aspects of the "Notice 1995-10 for Types and Criteria on Unfair Transaction Behavior in International Contracts" by Fair Trade Committee of Korea.

An Unsuccessful Reform on the Local Public Contracts Law in Korea

  • In Korea, local governments and local agencies had to apply a version of the first price auction augmented by an ex-post screening process when they procure construction contracts. However, this first price auction had been criticized because it was felt that too much price competition could lead to poor ex-post performance in construction. In response, the existing auction method was recently replaced by a version of the average price auction with a similar screening process. This paper empirically examines the effectiveness of this reform and finds that the replacement only increases the fiscal burden of local governmental bodies without making any improvement in the ex-post performance.
