공무원의 불법행위와 국가배상책임의 고찰 (A Study on the Tort of Public Servant and Liability in State Compensation)

  • 현대 국가는 과학기술의 발달에 따른 산업화와 정보화 추세 속에서 다양한 위험이 항상 따르게 된다. 이러한 환경하에서, 공무원의 직무수행 중 불법행위로 인하여 국민이 손해를 입은 경우에, 이를 구제해 주기 위해 우리 헌법은 국가배상청구권을 보장하고 있다. 국가배상의 문제는 법치국가의 원리에 따른 피해자의 권리구제, 공무원의 불법행위의 억제, 안정된 공무수행의 보장, 국고의 안정 등의 다양한 가치들을 조화롭게 고려하여야 한다. 그런데 현대 법치국가에서 공무원이 한 행위를 국가가 책임을 지는 이상, 반드시 고의와 과실을 요건으로 하여야만 국가가 책임을 진다는 것에는 의문이 있을 수 있다. 또한 헌법에 합치되는 자기책임설의 이론에 의하게 되면 국가배상법상 과실책임주의는 배제되어야 한다. 국가배상법상 공무원의 배상책임과 관련하여 고의와 과실과 같은 주관적 책임요건은 필요하지 않다고 보아야 한다. 따라서 현행 국가배상법의 개정을 통하여서 국가배상법의 원리를 과실책임주의로부터 무과실책임주의로 전환하여야 할 필요성이 있다.

불가항력적 의료사고에 대한 국가보상의 공법적 검토 (A Study on Irresistible Medical Accidents Victims Relief System in the Perspective of Public Law)

  • Medical practice is characterized by various physiological response and uncapacity of prediction, therefore when medical accident occur it's hard to prove medical professionals' mistake. Though medical accident by medical professionals' mistake will be compensated anyhow, about irresistible medical accidents, no one should be not bound to compensate, victims get into very difficult situation. So, the nation don't negligent irresistible medical accidents but compensate anyway. As in the past, to the legal principle's constitution of irresistible medical accidents, theory of liability without fault was adapted, and it was said this theory was illogical in theory of liability with fault. But the subject of compensation to irresistible medical accidents is nation, nation don't participate in medical treatment therefore there is no room to occur mistake. And it is not reasonable to regard medical agency as a truster of public service, to cast to it responsibility of medical accidents. The problem of compensation to irresistible medical accidents is understood under the theory of social compensation. Social compensation is consisted of compensation to sacrifice and contribution to nation and society and compensation to sacrifice revealed under danger, the compensation to irresistible medical accidents belongs to the latter. This is near to concept of relief, is applied to national compensation system supplementarily, and compensation have no option but to compensate minimum. And there are not relation between national compensation system of irresistible medical accidents and proof liability transposition and theory of liability with out fault, merely in side of sharing responsibility burden between medical treater and victim, it is reasonable to discuss transportation of proof liability and compulsive liability insurance together.

  • 국가배상법 제5조 영조물책임법리에 적용되는 대표적인 영조물에는 인공공물인 도로와 자연공물인 하천이 있다. 최근 하천범람과 수재로 인한 국민들의 피해가 빈번하게 발생하고 있고, 국민들도 더 이상 천재로 보지 않고 인재로 보고 국가배상을 청구하는 경향이 있다. 특히 하천의 범람, 하천제방의 붕괴로 인한 수해가 빈번히 발생하였고, 개수중인 하천에서 다시 수해가 발생하는 경우도 일어나고 있다. 그리하여 국가는 하천관리상의 하자로 인한 손해발생에 대한 책임을 떠맡아야 하며, 하천관리시설의 확충과 내실화를 기울여야 함과 아울러 책임범위를 확대해야 하는 시점에 왔다고 본다. 따라서 본 연구의 범위는 국가배상법 제5조 영조물의 설치 관리상의 하자로 인한 손해배상 중 하천관리상의 국가배상에 한정하기로 한다. 이러한 범위내에서 자연공물에 해당하는 하천관리상의 하자로 인한 손해배상에 관한 제반 법리와 판례를 분석 검토함에 따라 하천관리를 둘러싼 국가배상책임에 관한 문제점과 대처방안을 모색하는데 연구의 목적이 있다.

무인항공기 운영자의 법적책임과 보험 (The legal responsibility of the unmanned aircraft operators and insurance)

  • 항공에 있어서 안전이 가장 중요한 것처럼 무인항공기 운영에 있어서도 안전이 가장 중요하고 무인항공기 운영자의 법적책임에 있어서도 안전운영책임이 가장 중요하다고 할 수 있다. 본 논문에서는 무인항공기 운영자의 안전운영 책임을 중심으로 무인항공기 운영자가 지게 되는 법적책임 문제를 사고 발생 시 피해를 보상해주는 보험 문제와 함께 심도있게 고찰하였다. 우선 무인항공기 운영자의 법적책임 문제는 가장 기본적인 무인항공기 운영자의 정의, 범위, 자격요건을 살펴보고 규제동향으로 국제민간항공협약, ICAO 부속서와 RPAS Manual, 로마협약 등 주요 국제협약, 항공안전법 등 국내 관련 법률상의 운영자의 책임규정을 고찰하였다. ICAO에서는 무인항공기도 궁극적으로는 유인항공기와 동등한 수준의 기술상 및 운항상의 안전성을 확보할 것을 요구하고 있으며 무인항공기 운영의 대원칙으로 사람, 재산 및 다른 항공기에 대한 위험을 최소화 하는 방법으로 운영 되어야 한다고 규정하고 있다. 이와 관련 무인항공기 사고의 경우는 대부분이 지상에 추락하여 제3자의 인명이나 재산에 피해를 입히는 사고가 대부분인 점을 감안 관련 국제협약인 로마 협약상의 운영자의 책임과 국내 상법 항공운송편의 제3자 책임 관련 규정을 중점적으로 살펴보았으며 사고 발생에 따른 배상책임 문제도 살펴보았다. 로마협약과 관련하여서는 1952년 로마협약이 운영자의 책임을 상세히 규정하고 있다. 배상책임과 관련하여서는 아직 발효는 되지 않았지만 EU 일부국가에서는 2009년 로마협약상의 책임한도액을 따르고 있는 점이 특징이다. 아직 우리나라는 어떠한 로마협약에도 가입하지 않고 있으나 상법 항공운송편은 배상책임에 있어 1978년 로마협약을 모델로 하고 있다. 이들 이외에 무인항공기 운영에 따르는 관련 법적책임으로 가장 많이 문제가 되고 있는 보안관련 책임과 사생활 침해에 대한 책임도 살펴보았다. 보험과 관련하여서는 전 세계적으로 항공보험의 가입 의무화 경향과 이에 따른 주요 각국의 규제현황을 살펴보고 무인항공기에의 적용 가능성을 살펴보았다. 또한 현행 국내 항공사업법상의 보험가입 의무화 조항과 초경량 비행장치 보험 규정과 문제점을 살펴보았다. 요컨대 무인항공기 운영자는 무인항공기를 인명이나 재산 또는 다른 항공기에 위험을 주지 않도록 안전하게 운영할 법적책임이 있으며 사고 발생 시는 적절한 보상책임이 있다고 할 것이며 이를 위한 보험제도 등 법제도적 장치가 마련되어야 한다.

Who has to take legal responsibility for retailer brand foods, manufacturers or retailers?

  • As a marketing vehicle to survive in intensified retailing competition, retailer brand development has been adopted by retailers in Korea. As evidence, the retailer brand share of a major retailer, Tesco Korea, has grown from 20% in 2007 to 22.8% in the first half of 2008. It means that retailers have provided more and more retailer brand foods for customers. With the growing accessibility to retailer brand foods, it would be expected that the number of retailer brand food claims will increase. Customers have increasingly exposed to a variety of marketing activities conducted by retailers. When buying the retailer brand foods, customers tend to be affected by marketing activities of retailers. Despite the fact that customers trust retailers and then, buy their brand foods, in case of food accidents caused by production process, customers have to seek compensation from a retailer brand supplier. Of course, a retailer tends to shift its responsibility to its suppliers. Accordingly, it is not easy for customers to solve food claims. The research, therefore, aims at exploring the relationship between the buying-decision processes of retailer brand customers and which side takes legal responsibility for food claims. To effectively achieve the research aim, the author adopted a quantitative and a qualitative research technique, in order to supplement the disadvantages of each method. Before field research, based on the developed research model, the author pre-tested questionnaire with 10 samples, amended, and handed out to 400 samples. Amongst them, 316 questionnaires are available. For a focus group interview, 9 participants were recruited, who are students, housewives, and full-time workers, aged from 20s to 40s. Through the focus group interview as well as the questionnaire results, it was found that most customers were influenced by a retailer or store image in a customer's mind, retailer reputation and promotional activities. Surprisingly, customers think that the name of a retailer is a more important factor than who produces retailer brand foods, even though many customers check a retailer brand supplier, when making a buying-decision. Rather than retailer brand suppliers, customers trust retailers. That is why they purchase retailer brands. Nevertheless, production-related food claims is not involved with retailers. In fact, it would be difficult for customers to distinguish whether a food claim is related to selling or manufacturing processes. Based on research results, from a customer perspective, the research suggests that the government should require retailers to take the whole responsibility for retailer brand food claims, preventing retailers from passing the buck to retailer brand suppliers. In case of food claims, in order for customers to easily get the compensation, it is necessary to reconsider the current system. If so, retailers have to fully get involved in retailer brand production stage, and further, the customer awareness of retailer brands will be improved than ever before. Retailers cannot help taking care of the whole processes of retailer brand development, because of responsibility. As a result, the process to seek compensation for food claims might become easier, and further, the protection of customer right might be improved.

기업의 사회적 책임이 경영자 성과-보상민감도에 미치는 영향 (Corporate Social Responsibility and Executive Performance -Impact on Compensation Sensitivity)

  • 기업들은 CSR을 다양한 측면의 경영전략으로 통합시키기 위해 큰 노력을 기울이고 있다. 기업 경영의 주요 목적이 CSR 활동이 아님에도 경영자가 CSR에 직간접적으로 참여하고 수행하는 의도가 무엇인지에 대해서 많은 연구가 수행됐다. 본 연구에서는 경영자가 CSR에 참여하는 동기를 나타내는 지표로 경영자 보상을 추가로 고려하여 연구를 수행하였다. 본 연구의 주요 목적은 CSR 활동을 하는 기업 경영자에게 성과에 따른 보상을 제공할 때 회계성과측정치와 시장성과측정치 중에서 어느 쪽에 더 가중치를 두고 보상을 제공하는지 분석하였다. CSR과 경영자 성과-보상민감도의 관련성을 분석한 결과 CSR을 적극적으로 수행하는 기업 경영자는 회계성과측정치 보다는 시장성과측정치에 더 가중치를 두고 보상을 제공하는 것으로 나타났다. 경영자 보상을 지급할 때에 CSR의 성과가 장기적으로 나타남을 고려하여 회계적 성과보다는 시장성과(주식성과)에 더 가중치를 두고 보상을 지급하는 것으로 나타났다. 본 연구를 통해 경영자가 CSR수행을 적극적으로 유도하기 위한 보상계약설계 설계에 유용할 것으로 판단된다.

무효전력 보상여유를 고려한 SVC와 ULTC의 협조제어 (Coordinated Control of SVC and ULTC Considering Reactive Power Compensation Margin)

  • This paper proposes the coordinated control of SVC and UTLC at the distribution substation to get larger operating margin of SVC for the voltage stability control by reactive power compensation. In the conventional method, ULTC doesn't respond to the variation of source voltage, so SVC has the entire responsibility for it. It could cause the lack of operating margin of SVC in some condition. It, however, is important to secure an operating margin for the dynamic stability control in emergancy. This paper proposes the coordinated control method that SVC controls the supply voltage and ULTC respond to the SVC compensation valve based on the relation between SVC compensation and ULTC tap position. The numerical simulation verifies that the proposed system could increase the operating margin of SVC compared with the conventional system.

A Conceptual Approach to Green Human Resource Management and Corporate Environmental Responsibility in the Hospitality Industry

  • Substantial growth in the economy and extensive use of natural resources has become a major issue in the modern world. Organizations have started to worry about the environment and are beginning to invest in and practice green strategies. Companies should be responsible for the environment and use sustainable methods to run their businesses. The main purpose of this study is to explore the conceptual approach to Green Human Resource Management (GHRM) practices and Corporate Environmental Responsibility (CER) in the hospitality industry. The theoretical framework of GHRM practices such as green recruitment, green selection, green training and development, green performance appraisal, green reward and compensation, and corporate environmental responsibility have been comprehensively studied for this purpose. Green Human Resource Management in the hospitality sector is a less studied and rarely implemented phenomenon. The integration of GHRM and CER along with green competitive advantage and green supply chain management in hospitality is new concept in hospitality industry. Study suggests that Corporate environmental responsibility (CER) and Green Human Resource Management (GHRM) have a significant role in the hospitality industry. However, for sustainable development of tourism and hospitality, this concept should be capitalized with necessary research and development.

연안어업의 어업손실보상시 어선대체로 인한 톤수변경의 경우 타당한 톤수적용 방안에 관한 연구 (Study on the Appropriate Method Applying Gross Tons for Compensation for Damage of Coastal Fisheries in Case of Boat Change)

  • Costal fisheries use small boat. The boats are frequently substituted with newly made boat or proper boat. When the boat which is substituted with another one after the fixed date for compensation is estimated for fisheries loss by public project, it is matter that which boat is the object for estimating average catch of fish. There are three ways in practical business. They are based on the date of spot probe, the date of conference for compensation and fixed date for compensation. In case of applying the first and the second ways, as the object of compensation is not fixed, there is problem that estimated result can be changed depending on changing boat tons even after the date of spot probe and the fixed date for compensation. Most of all, these ways are against Attached Form No.4 of the Enforcement Ordinance of Fisheries Law which regulate to calculate average catch of fish applying result of fishery for retroactively counted 3 years from the year before the year in which administrative measure day is. The other side, in applying boat tons based on the fixed date for compensation, estimated result of compensation will not change even boat substituted after the fixed date for compensation. Even though applying tons based on the fixed date for compensation, a problem still remains. If the boat get bigger after the fixed date for compensation, the then boat size must be applied for calculating average catch. But the boat get smaller, the changed boat size must be applied. Because changed small boat would be damaged less than the previous boat. And decrease in catch by changing boat into small one is not due to the project but due to the personal responsibility. This will help to increase objectivity and reliance on the compensation result. As the other objects are fixed based on the fixed date for compensation in the Act on Acquisition and Compensation of Land and Others for Public Project, it can be balanced with other object.

Corporate Social Responsibility and the Pricing of Seasoned Equity Offerings: Does Executive Firm-Related Wealth Matter?

  • This study exemines the roles of corporate social activity (CSR) and executive compensation structure on the pricing of seasoned equity offerings (SEOs) with special focus on the role of CSR in reducing the level of information asymmetry between managers and future shareholders of issuing firms through SEOs. This study also investigates the interaction between executive compensation structure and CSR on the discounting of SEOs. We use a sample of 2,102 seasoned equity offerings of U.S. firms with CSR scores from 1995 to 2015 in our OLS fixed effect regression analysis. The results show that issuing firms with high CSR are more likely to expericence a lower degree of the SEO discount. The results also document a positive association between CSR and a high proportion of equity-based compensation of issuing firms' executives. The findings of this paper confirm that CSR attenuates the impact of information asymmetry and the pre-SEO price uncertainty on the pricing of the offers and hence the SEO discount. Furthermore, CSR reinforces the impact of executive firm-related wealth on the discounting of seasoned equity offerings. It appears that firm-related wealth motivates managers to actively engage in reducing information asymmetry activities before SEOs, thereby decreasing the SEO discount.
