  • U. N. Convention on Contracts for the International Sale of Goods (hereinafter the 'CISG' or the 'Convention') has been in force more than 37 years. The CISG responds to the need for uniform sales law. First of all, the biggest barrier against the uniformity in sales law is so-called "homeward trend". Professor Honnold, who served as secretary of UNCITRAL during the time in which the CISG was developed, pointed out the danger of "homeward trend" like this in his Article. "One threat to international uniformity in interpretation is a natural tendency to read the international text through the lenses of domestic law." CISG Article 79 is the principal provision governing the extent to which a party is exempt from liability for a failure to perform any of his obligations due to an impediment beyond his control. So-called 'Manfred Forberich' decision regarding the article 79 represents the most extreme example of what is likely the most dangerous error that tribunals applying the CISG can make. CISG Article 79 only governs impossibility of performance, and there is a controversy whether a disturbance which does not fully exclude performance, but it considerably more difficult or onerous(hardship, change of circumstances, economic impossibility) can be considered as an impediment. Unlike PICC and PECL, the CISG governs contract of sale. Therefore, events such as a sudden increase in the price of raw materials or a dramatic devaluation of currency, will not allow the seller to avoid his liability for non-delivery of the goods or to require renegotiation of the terms of the contract of sale. We should bear in mind that the CISG should be interpreted and applied in the context of the CISG itself.

  • Contemporary society is a digital and information-oriented society and a change by digital and information-oriented has made a new society principle and creature. The principle and creature has made society changed having influence on office space. The 21st century business space attachs great importance to the public space as the value of work place, namely, the place of gathering and client meeting which is society space and a thing which grants it with the biggest investment worth is a new order. This kind of society change has been making an appearance in contemporary office space as features of Narrative, Nodal, Neighbourly, Nomadic. These kinds of trends which are not exclusive mutually are stipulated as new trials to business space holding a lot of overriding features in common. These kinds of features brought into relief according to society change can be seen as key words speaking for contemporary office space and have a significance to contemplate and study for the office space of a new concept made an appearance together with society change. It is expected to contribute to revitalization programs with the far-reaching effect of understanding about ideal office work circumstances and work shape which the 21st century wants standing on the features of these new concepts.

Sound change of /o/ in modern Seoul Korean: Focused on relations with acoustic characteristics and perception

  • This article represents a first step in a large study aimed at elucidating the relationship between production and perception involved in sound change of /o/ in (Seoul) Korean. In this paper we present the results of a production study and a perception experiment. For the production study we examined vowel production data of 20 young adult speakers, measuring the first and second formants, then conducted a discriminant analysis based on those values. In terms of their F1-F2 values, the distribution of /o/ and /u/ were close, and even overlapping in some circumstances, which is consistent with the literature. This tendency was more apparent among the female speakers than the males. Moreover, with the females' distributions, /o/ was frequently categorized as /u/, suggesting that the direction of the sound change is indeed increasing from /o/ to /u/. Next, to investigate the effects of this proximity on perception, we used the production data of five randomly selected speakers from the production study as stimuli for a perception experiment in which 21 young adult native speakers of (Seoul) Korean performed a vowel identification task and provided a Goodness rating on a 5-point scale. We found that while rates of correctness were high, when these correctness scores were weighted by the Goodness rating, these "weighted correctness" scores were lower in some cases, indicating a degree of confusion in distinguishing between the two vowels.

  • Most urban water management systems are becoming vulnerable to flooding and drought due to the climate change (CC), urbanization and energy shortage. Despite of poor water management circumstances caused by extremely uneven annual rainfall and hilly terrain, traditionally we have made a sound and sustainable life based on our own philosophy and technologies which copes with our rigid environment. In this study a new paradigm of rainwater management is suggested and multipurpose and creative rainwater harvesting and management (RWHM) systems are introduced providing several case studies such as rainfall storage drainage (RSD) system, rainwater infiltration facilities and star city RWHM system. This new RWHM paradigm leads Seoul Metropolitan Government (SMG) in the Republic of Korea to change regulations and politics for the integrated RWHM. Finally, RWHM is expected to improve the safety, efficiency, energy consumption of urban water infrastructure, to reduce urban heat island phenomenon and, furthermore, to contribute in finding solutions for worldwide water issues and to adapt CC.

A Study on Autonomous Vehicle Lane Change Method Using Cooperative Maneuver (협조운용을 적용한 자율주행 차선변경에 관한 연구)

  • Ahead of the commercialization of autonomous vehicles, it's application should be considered into the current transportation infrastructure. Under limited traffic circumstances, effective set of lane change rules alone could bring benefits to the autonomous driving system. In this study, a cooperative movement (local platooning) plan with limited vehicles associated as pocket driving, aiming at effective movement between vehicles in urban environment was proposed. Under congested roadway condition, the gaussian gap between vehicles was introduced to secure gap acceptance for safe lane change maneuver. Proposed lane change method showed 86.6% delay reduction along with traffic volume improvement. This result could be considered as a crucial factor in designing a next-generation roadway infrastructure with autonomous driving.

  • The research studies the classic beer game simulation model from a new perspective. It does so by providing each agent with two ordering policies, and creating a set of rules that allow an agent to change its policy. Such a change is triggered based on an agent's confidence in their own performance, and on the relative confidence of their nearest neighbour. The overall effect is that policy diffusion can occur, where, under certain circumstances, an agent will mimic the behaviour of its neighbour, if it believes that its neighbour is performing better. The motivation behind this research is to provide an experimental base upon which the decision making strategies of business agent can be studied.

Development of Wave Overtopping-Overflow Transition Model Based on Full-scale Experiments

  • When high waves and storm surge strike simultaneously, the characteristics of the fluid field change drastically from overtopping according to the wave runup height to overflow through a transition state that combines overtopping and overflows. However, an estimation model or evaluation method has not yet been established because there is not enough engineering data. This study developed a wave overtopping-overflow transition model based on a full-scale experiment involving wave overtopping and overflow transition, which appropriately reproduced the effect of waves or the temporal change in inundation flow. Using this model to perform a calculation for the wave overtopping and overflow transition process under typical circumstances, this study determined the wave runup height and features of the inundation flow under time series changes as an example.

  • 'Interaction' here means an action that reciprocally affects each other. In this action each change and movement does not exist independently but acts upon each other. The interaction of fashion design has undergone a lot of changing experiences. Besides it assumes the role of an appreciator that participates in the formation of work. This interaction breaks down the distinction between the designer as the maker and presenter of dress and the passive dresser and appreciator as its passive receivers.. Finally, it integrates the creator, receiver and technology altogether. The interaction tendencies of fashion design treated in this study are classified into four types. First, the mechanism that is included as a part of work and the cognitive response that the observer experiences. Second, the response that fashion design displays towards the stimulus of circumstances. Third, the changeability of manipulation of fashion design. Fourth, the control that mechanism acts upon dynamic status by technology. As in may other fields of our life, interaction in fashion design reflects the change and interactivity of our thinking and ideas.

Directions of Military Structure Improvement Preparing for Future Warfare (미래전쟁에 대비한 군 구조 개선방향)

  • Development of science technology, computer network and software technology has not only changed various areas of the society, but also brought rapid change in the condition and the way of performing war. Historical lessons learned from the war in Iraq tells that military capabilities corresponding to the new paradigms of war needs to be assured in order to preserve national interest and take victory in future warfare. Thus, the performance in the latest war in Iraq, the estimated performance in future war and the performance of war in the Korean Peninsula has been put together and analyzed to indicate the direction our force should be built and the structure to be improved. Under all circumstances and threats the military must defend our nation and territory. When war breaks out the military must perform it's basic duty to end war by decisive operations. As the saying is "To preserve peace, prepare for war," continuous increase of military strength and improvement of military structure corresponding to the change of national security environment and weapon system is necessary.
