The Bidding System of the public IT project in Korea is fallen behind, because of the ordering habitual practice based old system, overcompetition based sealed bid and subcontract practice. To innovate this old-fashioned practice for public IT project bidding, this paper wants to generate a proper improvement direction of the public IT project contract law and the related policy through the literature review about the ordering and receiving system in Korea, the practical survey about bidding marketplace in Korea, and competition between bidding system and/or policy of major countries: USA, UK, France and Japan. As a result of practical survey, many problems of the current public IT project bidding system came out and improvement ideas toward future situation turned up. These outputs implicate that the current law and system related public IT project demands better improvement work for the future ubiquitous Korea. Therefore, this paper, to solve these problems about bidding systems and practice, propose the new public IT project contract law and the related policy, reflecting these improvement ideas by the practical survey and the literature review, and benchmarking points from bidding system of other countries.

The aim of this paper is to investigate how the public procurement policy exerts an effect upon the technology innovation of the firm and to make alternative proposals how to reinforce the effect. Although the pubic procurement process based on its monopsonic idiosyncrasy implies the means to lead the firms' supply function, the present system has contributed a little to accelerate the technology innovation. In fact, the system is lacking of the evaluation capability referring to the technological computer among the bidding films. So as to reinforce the function of technology innovation of the public procurement policy, it is necessary to improve the procurement institutions, in particular bidding and contract system. Finally, the paper propose, on the on hand, to enlarge the application range of the total bidding system in order to apply more strictly the technology evaluation standards on bidding, and on the other hand, to multiply the competitive proposal and the incentive contract type.

Existing internet auction systems have adopted the form which gives a win to the auction bidder who proposes the top bid price for the goods posted on the auction board. But they haven't been satisfying the automatical one-step processing for user's convenience because they must require continuous care of user for bidding and checking as well as neglecting the convenience of user interface while participating in the electronic bidding system. The AuctionBot system of Michigan Univ. is known as the representative internet auction system. It has merit allowing the various kids of bidding. But it does not support automatic a process which can replaces what user has to do using an agent. To improve this kind of user interface, we propose an automatic bidding price strategy algorithm which composes the auction system using agent and design for auto-bidding system using agent so that I can replace user's bidding activity. This mechanism gives an auction system the efficient bidding price strategy.

Contractor's opportunistic bidding behavior refers to contractor's deliberate low-bid, which cannot accord with the cost, and expectation for beyond-contractual reward (BCR), the compensation earned through cutting corners or claims after undertaking the construction project. This research applies System Dynamics to develop a model of contractor's pricing with consideration for dimensions of "cost", "market competition", and "BCR". Iterative computer simulations were performed to analyze the effects of contractor's pricing on the market price. The results were then examined by statistical analysis on data collected from 44 highway projects in Taiwan. It is found that the critical force driving the contractors to bid opportunistically is their excessive expectations in BCR under the current environment. Within the price competition mechanism, if the problem of BCR exists, even if the bidding system is further improved, contractors would still prefer opportunistic bidding behavior, and eventually make the whole construction industry operate ineffectively. Therefore, it is crucial to remedy the aforementioned BCR problem by more effective management policy.

건설시장에서 경쟁력을 강화하고 국제정책에 대응하기 위하여 설계업체와 시공업체의 협력을 장려하는 설계시공 일관입찰방식이 대두되었다. 설계시공일괄입찰방식은 공기단축, 사업비 절약, 품질 향상을 위한 전도 유망한 입찰방식이지만 국내 건설산업에서는 제도의 미비, 관계자들의 경험 및 인식부족 등으로 이러한 장점을 살리지 못하고 있다. 이에 따라 본 연구에서는 국내 공공공사 설계시공일괄입찰방식에서의 문제점을 사업비, 품질, 사업기간의 측면에서 분석하여 개선방안을 제안하고자 한다.

본 연구에서 전문가 집단을 대상으로 조사하여 실증 분석한 결과는 다음과 같다. 첫째, 직급과 수의계약 입찰 방식 문제점 간에는 분포의 차이가 없는 것으로 나타났다. 둘째, 직급과 현행 설계VE 발주 방식 적절성 간에는 분포의 차이가 있는 것으로 나타나, 현행 설계VE 발주방식 적절성이 직급 간에는 관련성이 있어 인식을 다르게 하는것으로 분석 되었다. 셋째, 소속기관과 현행 설계VE 발주방식 적절성간에는 분포의 차이가 없는것으로 나타났다. 넷째, 소속기관과 용역대가 적절성간에는 분포의 차이가 있는것으로 나타났으며, 소속기관들이 용역대가 적절성을 상호 인식하는데는 소속기관별로 인식의 차이가 있는 것으로 분석되었다. 다섯째, 경력과 참여업체 자격 필요성간에는 분포의 차이가 있는것으로 나타났다. 여섯째, 경력과 참여업체 제한조건 적절성은 분포의 차이가 있는것으로 나타났다. 따라서 수의계약 입찰방식과 용역적정 수행기간에서는 문제점이 나타나지 않았으나, 용역대가 적절성, 참여업체 자격 필요성, 참여업체 제한조건은 구체적으로 관련성이 있는것으로 나타났다.

본 연구에서는 전국 80여 중소기업 관리자 및 임원과의 인터뷰를 바탕으로 중소기업의 '인력'과 '기술' 두 부문으로 나누어 현장 이해를 시도하고, 일자리 창출 대안을 분석하였다. 인력 부문에서 가장 핵심 사안은 '저임금' 및 '대기업과의 임금격차'로 나타났다. 임금 지원정책과 관련, 현장에서는 "지속가능한" 지원책을 주문하고 있었다. 기술 부문에서는 R&D지원에 초점을 맞추어 논의를 진행하였다. 신규 시장을 창출할 수 있는 기술 혹은 제품을 발굴하고 이를 적극 지원하여 관련 주변 산업의 고용효과를 기대하는 것이 R&D지원을 통한 기대이다. 본 연구 논의를 통해 크게 세 가지의 일자리 정책 지원방안을 제시하였다. 첫째, "중소기업 우수 기술자의 국가 관리"제도이다. 둘째, "기술입찰제"를 제시하였다. 셋째, 대기업과 중소기업 협력사업 시, "상호 적정이익 명시제"이다.

장기화되어가는 세계 경제위기와 더불어 내수시장은 침체의 덫을 벗어나지 못하고 있고 따라서 필연적으로 국내 건설업계는 대규모 사업이 지속적으로 발주되고 있는 해외 건설시장에 눈을 돌리고 있다. 시공을 중심으로 한 대규모의 기업들은 그나마 해외시장의 개척에 성과를 얻어가고 있으나, 중소 규모의 업체 특히 규모가 영세하고 해외 실적이 부족한 엔지니어링 업계는 해외시장 진출에 큰 어려움을 겪고 있다. 이에 본 연구에서는 해외 시장에 기진출한 경험이 매우 적거나 앞으로의 진출을 희망하고 있는 업체들을 위하여 해외시장 진출의 기초 정보 분석을 수행하였다. 해외 건설시장 진출을 위해 관련기관 및 유관단체의 선행연구와 건설 엔지니어링 업체들의 건설통계자료를 수집하고, 그 진출 개선방안 도출을 위한 기초자료로써 분석을 수행했다. 해외시장을 중동, 아시아, 아프리카, 기타(유럽, 북미 태평양, 중남미)지역 등으로 구분하고 각 권역별로 진출 유망국가를 선정하여 최종 선정된 국가의 입낙찰 관련 제도 정보를 중심으로 개괄적인 조사와 분석을 수행하였다. 또한, 국내외 해당국가들의 사업 입찰시 자격요건 충족 및 입 낙찰절차의 차이점을 비교 분석하여 국내 입 낙찰제도의 개선방안을 제시하였다. 본 연구를 통하여 제시된 분석은 해외 진출을 원하는 기업들의 기초정보 확보에 합리적인 기여를 할 것으로 기대된다.

The purpose of this study is to suggest policies to improve the price escalation system in a construction contract through a Policy Delphi technique. The Delphi, including two times questionnaires and a group discussion, was conducted by joining 14 experts. Also, the escalation provisions of various countries were examined. Results of the Delphi showed that the minimum fluctuation rate for price escalation was desirable at a level of 3%. To compute the fluctuation rate, calculating the price fluctuation of overall articles was more desirable than using price indices. A bidding date was more reasonable as the initial date of change in price. Losses caused by price change should be shared between contractor and owner; therefore a deduction rate should be introduced in price escalation. Meanwhile, overhead and profit should be adjusted in proportion to the fluctuation rate; but advance payment or the delayed construction amount should be deducted from the adjusted amount.

발주방식은 프로젝트 참여자들의 관계, 역할, 의무 등을 정하는 것으로, 프로젝트를 성공적으로 수행하기 위해서는 적정 발주 방식을 선정하여 적용하여야 한다. 현재까지 국내에서는 주로 설계시공분리방식에 의해 대형공공공사를 수행해 왔지만, 정부에서는 일괄입찰이나 대안입찰방식을 점차 확대하려는 정책을 추진하고 있다. 그러나 발주방식은 정책에 의해 결정하기보다는 사업목적 당해 프로젝트의 물리적인 특성, 사업수행환경 등을 종합적으로 고려하여 결정하여야 한다. 본 연구에서는 사업결과에 상당한 영향을 미치는 적정 발주방식을 결정하기 위한 객관적인 발주방식 선정기준과 더불어 정량적으로 발주방식별 성능을 비교ㆍ평가할 수 있는 적정 발주방식 선정절차모델을 제안하였다. 발주방식 선정기준은 프로젝트 특성, 발주자 특성, 사업수행환경으로 구성되어 있으며, 발주방식 선정모델은 발주방식 선정 체크리스트, 발주방식 선정 매트릭스, 발주방식의 적정성 판단의 3단계로 구성되어 있다.
