The Improvement Measurement on Dispute Resolution System for Air Service Customer (항공서비스 소비자 분쟁해결제도의 개선방안)

  • In 2017, 1,252 cases of damages relief related to air passenger transport service were received by the Korea Consumer Agency, a 0.8% drop from 1,262 cases in 2016, the first decline since 2013. In 2017, 444 cases (35.4%) out of received cases of damages relief in the field of air passenger service received by the Korea Consumer Agency were agreed on, and out of cases that were not agreed on, the most number of 588 cases (47.0%) were concluded due to information provision and counseling, and 186 cases (14.9%) were applied to the mediation of the Consumer Dispute Mediation Committee. Major legislations that contain regulations for the damages relief and disputes resolution of air service consumers include the Aviation Business Act and the Consumer Fundamental Act, etc. The Aviation Business Act provides the establishment and implementation of damage relief procedure and handling plan, and the receiving and handling of request of damage relief by air transport businessman, and the notice of protection standard for air traffic users. The Consumer Fundamental Act provides the establishment and management of the consumer counseling organization, the damage relief by the Korea Consumer Agency, the consumer dispute mediation, and the enactment of the criteria for resolving consumer disputes. The procedures for damages relief of air service consumers include the receiving and handling of damages relief by air transport businessman, the counseling, and receiving and handling of damages relief by the Consumer Counseling Center, the advice of mutual agreement by the Korea Consumer Agency, and the dispute mediation system by the Consumer Dispute Mediation Committee. The current system of damage relief and dispute mediation for air service consumer have the problem in the exemption from obligation of establishment and implementation of damage relief plan by air transport businessman under the Aviation Business Act, the problem in the exemption from liability in case of nonfulfillment and delay of transport by aviation businessman under the criteria for resolving consumer disputes in the aviation sector, and the uppermost limit in procedure progress and completion of consumer dispute mediation under the Consumer Fundamental Act. Therefore, the improvement measurements of the relevant system for proper damage relief and smooth dispute mediation for air service consumer are to be suggested as follows: First is the maintenance of the relevant laws for damage relief of air service consumer. The exemption regulation from obligation of establishment and implementation of damage relief plan by air transport businessman under the Aviation Business Act shall be revised. To enhance the structualization and expertise of the relevant regulation for protection and damage relief of air service consumer, it will be necessary to prepare the separate legislation similar to the US Federal Regulation 14 CFR and EU Regulation EC Regulation 261/2004. Second is the improvement of criteria for resolving air service consumer disputes. For this, it will be necessary to investigate whether the cause of occurrence of exemption reason was force majeure, and distinguish the exemption from liability in case of nonfulfillment and delay of transport by aviation businessman under the criteria for resolving consumer disputes in the aviation sector, and revise the same as exemption reasons regulated under the air transport chapter of the Commercial Act and Montreal Convention 1999, and unify the compensation criteria for the nonfulfillment of transport that the substitute flight was provided and the delay of transport. Third is the reinforcement of information provision for damage relief of air service consumer. Aviation-related government agencies and concerned agencies should cooperate with airlines and airports to provide rapidly and clearly diverse information to the air traffic users, including laws and policies for damages relief of air service consumers. Fourth is the supplement to the effectiveness, etc. of consumer dispute mediation. If there is no sign of acceptance for dispute mediation, it is not fair to regard it as acceptance, therefore it will be necessary to add objection system. And if a dispute resolution is requested to another dispute settlement agency in addition to the Consumer Dispute Mediation Committee, it is excluded from the damage relief package, but it should be allowed for the party to choose a mediation agency. It will be necessary to devise the institutional measures to increase the completion rate of mediation so that the consumer dispute can be resolved efficiently through the mediation. Fifth is the introduction of the air service consumer arbitration system. A measure to supplement the limitations of the consumer dispute mediation system is to introduce the consumer arbitration system, but there are two measurements which are the introduction of the consumer arbitration under the Consumer Fundamental Act and the introduction of the consumer arbitration under the Arbitration Act. The latter measurement is considered to be appropriate. In conclusion, as a policy task, the government should prepare laws and system to enhance the prevention and relief of damages and protection of the rights and interests of air service consumers, and establish and implement the consumer-centric policy for the advancement of air service.

Organizational-Economic Mechanism of Providing Sustainability of the Region's Development Based on the Impact of the Potential-Forming Space in the Conditions of the Creative Economy Formation

  • The article is devoted to substantiation of theoretical and methodical bases of formation of the organizational-economic mechanism of maintenance of stability of development of region on the bases of influence of potential-forming space in the conditions of formation of creative economy. It was found that the organizational-economic mechanism due to its multifaceted nature does not have a single generally accepted definition, and its acceptable scale and complexity is reflected in the structure, which is very dependent on the scope and conditions of its application, can be very different and contain different elements. In view of this, in order to highlight the characteristics that are inherent in the organizational-economic mechanism of sustainable development of the region on the basis of potential-forming space in the formation of creative economy, the article examines the properties and characteristics of direct organizational and economic mechanism. The necessity of basing the process of formation of any organizational-economic mechanism, including the organizational-economic mechanism of ensuring the sustainability of the region on the basis of the potential-forming space in the conditions of creative economy on the system of principles. In this context, the author's vision is proposed and a set of principles for the formation of organizational-economic mechanism for sustainable development of the region on the basis of the potential of the potential-forming space in the creative economy, as well as revealed the essence of each. According to the structural aspect, the organizational-economic mechanism of ensuring the sustainability of the region's development on the basis of the potential-forming space is proposed to be presented as a set of seven stages, which are implemented in a certain sequence. Within the limits of this research the sequence of realization of the stages making process of formation of the organizational-economic mechanism of maintenance of stability of development of region on the basis of influence of potential-forming space in the conditions of formation of creative economy is defined and their maintenance and essence is presented.

The Definition and Regulations of Drone in Korea (韓国におけるドロ?ンの定義と法規制)

  • Under the Aviation Safety Act of Korea, any person who intends to operate a drone is required to follow the operational conditions listed below, unless approved by the Minister of Land, Infrastructure, Transport and Tourism; (i) Operation of drones in the daytime, (ii) Operation of drones within Visual Line of Sight, (iii) Maintenance of a certain operating distance between drones and persons or properties on the ground/ water surface, (iv) Do not operate drones over event sites where many people gather, (v) Do not transport hazardous materials such as explosives by drone, (vi) Do not drop any objects from drones. Requirements stated in "Airspace in which Flights are Prohibited" and "Operational Limitations" are not applied to flights for search and rescue operations by public organizations in case of accidents and disasters. This paper analyzes legal issues as to definition and regulations of drones in Korean Aviation Safety Act. This paper, also, offers some implications and suggestions for regulations of drones under Korean Aviation Safety Act by comparing the regulations of drones in Japanese Civil Aeronautics Act.

  • To develop a crisis management for aviation safety, this study has defined crisis management includes risk management which is eliminates or lowers risks prior to accidents and emergency response after the accidents. This study takes a look at different kinds of crisis managements, risk managements and statistical methods of other nations and fields in order to develop a risk management model. Through surveys which have 102 risk factors that include air traffic control, maintenance and airport sectors, the weight of each risk factor was calculated and the probability was divided to develop a model for risk management. The risk management model of this study is conducted using four steps (risk management plan, risk factor identification, weight and probability analysis, decision making) and 4 standards of weight along with 5 standards of probability This study takes a look at Predictions through a quantitative method using a risk index for the risk management model An effective risk management model should have a wide and continuous collection of data and adopt various methods using this model. The crisis management could not be very effective only using a pre-active risk management. So it should also be conducted by using a pro-active response system to protect additional damage and to prevent accidents of the same nature. From the results, the most important points were the establishment of command and control accountabilities, and cooperation of related organizations.

  • It introduces the contents of establishing a geostationary satellite-based forest fire monitoring system that can monitor areas of the Korean Peninsula 24 hours a day for forest fire monitoring, and describes how to establish a forest fire monitoring system and use it in various ways. In order to establish a satellite-utilized forest fire monitoring system, we will describe and draw conclusions on literature research, technical principles, forest fire monitoring means, and satellite forest fire monitoring system. The satellite-utilized forest fire monitoring system can consist of one geostationary satellite equipped with infrared detection optical sensors and a ground processing station that processes data received from satellites to spread surveillance information. Forest fire monitoring satellites are located in the country's geostationary orbit and should be operated 24 hours a day, 365 days a day. Forest fire monitoring technology is an infrared detection technology that can be used in national public interests such as forest fire monitoring and national security. It should be operated 24 hours a day, and to satisfy this, it is efficient to establish a geostationary satellite-based forest fire monitoring satellite system.

The Air Space System and UVA's Regulation in Japanese Civil Aeronautics Act (일본 항공법상의 공역체계와 무인항공기 규제)

  • An amendment to Japanese Civil Aeronautics Act came into effect December 10, 2015. The Act prohibits flying drones over residential areas or areas surrounding an airport without permission from the Minister of Land, Infrastructure and Transportation. Flying drones during night time and during an event is also prohibited. The term "UAV" or "UA" means any aeroplane, rotorcraft, glider or airship which cannot accommodate any person on board and can be remotely or automatically piloted (Excluding those lighter than a certain weight (200 grams). Any person who intends to operate a UAV is required to follow the operational conditions listed below, unless approved by the Minister of Land, Infrastructure, Transport and Tourism; (i) Operation of UAVs in the daytime, (ii) Operation of UAVs within Visual Line of Sight (VLOS), (iii) Maintenance of a certain operating distance between UAVs and persons or properties on the ground/water surface, (iv) Do not operate UAVs over event sites where many people gather, (v) Do not transport hazardous materials such as explosives by UAV, (vi) Do not drop any objects from UAVs.   • The purpose of this study is to broaden the understanding of the Security Services Industry Act, and also to examine the meanings of various phenomena by analyzing the media report big data rather than the researchers' perspective on the Security Services Industry Act. In the research method, this study searched for a keyword 「Security Services Industry Act」 that prescribes the security work as an important subject of crime prevention and maintenance of public order in Korea. The data was searched from 1990 to 2021 the BIG KINDS could provide. Also, for the concrete analysis during the period of data search, it was divided into settlement period(1976~2001), growth period-quantitative(2002~2012), and growth period-qualitative(2013~2021). In the results of this study, the media report perception of the Security Services Industry Act is continuously emphasizing the social roles and importance of private security according to the flow of time. The consequent marketability of private security will play great roles in the protection of people's lives and properties in the combination with various other industries in the future. However, the private security industry that provides public peace service together with the police, could be rising as an element that hinders the development of private security industry because of various social issues caused by legal regulations and illegal problems, so it would be necessary to more strengthen its responsibility and roles accordingly.

Development of Algorithm for Vibration Analysis Automation of Rotating Equipments Based on ISO 20816 (ISO 20816 기반 회전기기 진동분석 자동화 알고리즘 개발)

  • Facility diagnosis is essential for the smooth operation and life extension of rotating equipment used in industrial sites. Compared to other diagnostic methods, vibration diagnosis can find most of the initial defects, such as unbalance, alignment failure, bearing defects and resonance, compared to other diagnostic methods. Therefore, vibration analysis is the most commonly used facility diagnosis method in industrial sites, and is usefully used as a predictive preservation (PdM) technology to manage the condition of the facility. However, since the vibration diagnosis method is performed based on experience based on the standard, it is carried out by experts. Therefore, it is intended to contribute to the reliability of the facility by establishing a system that anyone can easily judge defects by establishing a vibration diagnosis method performed based on experience as a knowledgeable code system. An algorithm was developed based on the ISO-20816 standard for vibration measurement, and the reliability was verified by comparing the results of vibration measurement at various demonstration sites such as petrochemical plant compressors, hydrogen charging stations, and industrial machinery with the results of analysis using a development system. The developed algorithm can contribute to predictive maintenance (PdM) technology that anyone can diagnose the condition of the rotating machine at industrial sites and identify defects early to replace parts at the exact time of replacement. Furthermore, it is expected that it will contribute to reducing maintenance costs and downtime due to the failure of rotating machines when applied to various industrial sites such as oil refining facilities, transportation, production facilities, and aviation facilities.

Stress and Life Evaluation of Universal Joint of Cardan Shaft for Waterjet System of Special-Purpose Vehicle (특수 목적 차량의 수상 추진체용 카단 샤프트의 유니버셜 조인트에 대한 응력 및 수명 평가)

  • The powertrain of the waterjet system of a special-purpose vehicle makes use of the cardan shaft, which is composed of universal joints and shafts. These universal joints, composed of spiders and needle roller bearings, have to be designed with consideration for the bending and compressive stresses of the spiders and needle roller bearings, and the rating lives of the bearings. The bending and compressive stresses of the spider and bearing of a universal joint have been studied by many researchers. However, to design a universal joint effectively, overall consideration of the different specifications of needle roller bearings is necessary. In this study, the bending stresses of spiders and compressive stresses of needle roller bearings are calculated to design universal joints for powertrain cardan shafts with different roller diameters of bearing. Furthermore, the rating lives of the needle roller bearings are predicted using the calculated basic dynamic load ratings of the bearings. As a result, roller diameters less than 𝜙2.5 mm are found suitable through an analysis of the bending stress of the spider. All compressive stresses between spider and bearing, regardless of roller diameter, satisfy the requirements. Moreover, roller diameters of more than 𝜙2 mm are found suitable for the required rating life.

Development of Automatic Dependent Surveillance System with Java on Web Environment (자바를 이용한 인터넷 웹 방식의 항공기 자동감시시스템의 개발)

  • This paper describes the development of an automatic dependent surveillance system(ADS) with Java on Web environment. The ADS consists of a server module and a client one. The server module performs a database server for gathering GPS data from airplanes. It also dose an Web server function for sending Java applet to clients. The applet enables each client to obtain the current flight information from the server via the Internet without a special client software. This client-server based ADS with Java environment has several advantages over other systems. One is not to need for installing special client software on each client system. The other is its simplicity on system maintenance. The reason why it has simplicity is to require only server program modification including the applet without updating client software. After testing the ADS system with the flight information of a Mooney, we can show that the prototype system can be a candidate for developing commercial products.
