A Study on the Direction for Revision of the Assembly and Demonstration Act - 'around the Article 6 and Article 8 of 2016 Revised Assembly and Demonstration Act' - (집회 및 시위에 관한 법률 개정 방향에 관한 연구 - '2016 개정 집시법 제6조·제8조를 중심으로 -)

  • After its decision of 'constitutional nonconformity' about a night assembly on September 24th, 2009, then the Korean Constitutional Court decided the 'limited violation of constitution' saying, 'Even a night demonstration should be allowed to be held up to the midnight' on March 27th, 20104. Since such a decision, the revision of Assembly and Demonstration Act has not been done, and the revised act is currently pending on the National Assembly on October, 2016. Amid the controversy about the 'Legislative Deficiency', some articles of the Assembly and Demonstration Act are revised and created like the imposition of the fine about a ghost assembly and the notice duty of fact to hold an assembly, the police superintendent's recommendation about the assembly place and partitioned assembly holding by time in order to protect the people's basic rights and convenience. However, this revised bill of Assembly & Demonstration Act limits the duty of assembly withdrawal report only to overlapping assemblies and a police superintendent can only recommend about the partition of assembly place and time, but has not a certain authority to forcibly enforce, so it is expected that the recommendation will be eventually ended to a formal procedure. And as this revised act has no punishment article concerning the violation of the notice duty within 1 hour before holding an assembly in this revised act, so there is a problem that the police can't force an assembly to follow the article. This study proposed some political suggestions concerning the articles to be supplemented and corrected in the Assembly & Demonstration Act after analyzing its articles around its 2016 revised Act. The Assembly & Demonstration Act has several problems to be continually corrected and supplemented further including the matter of 'Night Assembly & Demonstration' which is in the condition of 'Legislative Deficiency' since 2009.

A Legislative consideration on protection and regulation of Assembly and Demonstration at sea (해상 집회 및 시위의 보호와 규율을 위한 입법정책적 고찰)

  • In this study, I present solutions to properly regulate assembly and demonstration at sea which has not been relatively secured and regulated compared to that of on land and inland waters so it may not violate public safety and order, and at the same time to secure it as a basic human right. Firstly, to protect and regulate in the same way with assembly and demonstration on land, I suggest to make amendments to "Law on Assembly and Demonstration" so that Korea Coast Guard Station can accept applications and administrator maritime assembly and demonstration. Secondly, in special cases where there are difficulties in the application of "Law on Assembly and Demonstration" due to the special maritime environment, following the example of Japan, America and England who have regulations in related special laws, I suggest an legislative alternative to add regulations on maritime assembly and demonstration in "Law on Maritime Guard" so that we can administer maritime assembly and demonstration in a way which there should be no conflict between basic human right of people and conservation of public safety.

A Study on the Application of Private Security in Assembly and Demonstration Sites Using SNS Emotional Language Analysis

  • The purpose of this study is to review the appropriateness of deploying private security guards using SMS emotional language analysis at the current assembly and demonstration sites, which rely only on the police force, and to suggest a plan. Therefore, it is intended to contribute to suppressing the problems at the assembly and demonstration sites and present a new paradigm for responding to the assembly and demonstration sites based on the study's results. First, it is necessary to prepare a legal basis for the deployment of private security guards in the 'Security Services Industry Act' and 'Assembly and a Demonstration Act'. Second, there is a need for a 'security company selection criteria' for selecting security companies with a lot of experience, such as collective civil petition sites and security for national critical facilities (special security services). Third, it is necessary to prepare financial resources for the deployment of private security guards. This study is expected to serve as a new cornerstone for effective management of assembly and demonstration sites through mutual complementation of the police and private security.

Characteristics and Regulations of Assembly and Demonstration on the Sea (해상 집회 및 시위의 특성과 법적 규율)

  • This study discusses characteristics and regulations of assembly and demonstration on the Sea. One of the characteristics of assembly and demonstration on the sea is danger caused by vessels and nature of the sea. Thus, Korea Coast Guard prefers to regulate demonstration on the sea more strictly by applying sea related laws such as Maritime Safety Act and Public Order in Open Ports Act. However, assembly and demonstration on the sea is one of the fundamental rights which is guaranteed by the Constitution and should be regulated and protected by the Assembly and Demonstrations Law. The purpose of this article is to properly regulate and protect assembly and demonstration on the Sea based on proper interpretation of the Assembly and Demonstrations Law.

Change of Regional Clusters on Assembly and Demonstration (집회시위 군집변화에 대한 연구)

  • The purpose of this study is to analyze the changes of regional clusters of national 16 areas on the assembly & demonstration in 2010 and 2015. The results of this study were as follows by using hierarchical cluster analysis. First, the regional clusters on the assembly & demonstration in 2010 were divided into three clusters in the first step: (1) Gwangju, Chungnam, Incheon, Chungbuk, Gyeongbuk, Daegu, Gangwon, Jeju, Daejeon, (2) Jeonnam, Gyeongnam, Busan, Jeonbuk, Ulsan, Gyeonggi, (3) Seoul. Second, the regional clusters on the assembly & demonstration in 2015 were divided into three clusters in the first step: (1) Ulsan, Gangwon, Chungbuk, Chungnam, Incheon, Gyeongbuk, Jeonnam, Gwangju, Jeju, Daegu, Daejeon, (2) Busan, Jeonbuk, Gyeongnam, (3) Seoul, Gyunggi. Third, The regional clusters on the assembly & demonstration were Busan, Jeonbuk, Gyeongnam of 'assembly & demonstration management area(labor related)', and Seoul, Gyeonggi of 'assembly & demonstration frequency areas' in 2015. This suggests that policing policies related to assembly & demonstration can be established and implemented flexibly in consideration of the degree of increase and decrease in assembly & demonstration by districts. Furthermore, it will be helpful to manage assembly & demonstration based on the 'police for human rights'.

The Legal Study on the Demonstration-on-sea (해상시위의 기본권성과 집시법적용가능성 고찰)

  • A new type qf demonstrations in the temporal and spacial aspects, such as accidental and unprepared demonstration, urgent assembly, demonstration-on-sea, demonstration-on-highway, and etc., which are not intended in the Law of Assembly and Demonstration, are becoming a social problem Especially, the law on demonstration-on-sea needs to be discussed further because it is not clear if the Law of Assembly and Demonstration is applicable here. If so, how can it be explained logically? Or, if not so, which law should be applied to this context? So far, various theories on demonstration-on-sea have been opposed aggressively vs. submissively. However, it should be guaranteed that the demonstration on sea is one of the constitutional rights based on the self-decision right of demonstration's place. Accordingly, these contents have to be interpreted with a concept of demonstration in Demonstration's law in coordination with the Constitution. Therefore, it is not persuasive that Demonstration's law is analogized, or general police law is applied, to such untypical demonstrations. In addition, taking into consideration a demonstrative function for minority under modem situation of demonstration, it is right to apply the Law of Assembly and Demonstration to the demonstration-upon-sea directly.

A Study on Legal Limitations of Teachers' Right for Expression (초.중.고교 교원의 정치적 표현과 제한법리에 관한 탐색적 연구: '시국선언' 관련 판례를 중심으로)

  • This study examined how the Korean courts have made a balance between rights of school teachers' expression and the public interests derived from regulating their rights for expression in related cases. Under the Korean laws such as National Public Service Law and the Law on Assembly and Demonstration, school teachers are considered as civil servants and basically not allowed to assemble to demonstrate for their own interests. The analysis revealed that in 24 cases from a total of 31 teacher-related court cases, teachers were found guilty in violation of related laws. In deciding whether the teachers' participation on anti-government assembly was guilty or not, the courts put an emphasis on public purpose of their expression, the degree to which their expressions affect the society, and specific contents of their expression. Conclusively, it was found out that in applying the related law, Korean courts tend to overweigh the public interests, rather than the teachers' right to express.

A One-Step System for Convenient and Flexible Assembly of Transcription Activator-Like Effector Nucleases (TALENs)

  • Transcription activator-like effector nucleases (TALENs) are powerful tools for targeted genome editing in diverse cell types and organisms. However, the highly identical TALE repeat sequences make it challenging to assemble TALEs using conventional cloning approaches, and multiple repeats in one plasmid are easily catalyzed for homologous recombination in bacteria. Although the methods for TALE assembly are constantly improving, these methods are not convenient because of laborious assembly steps or large module libraries, limiting their broad utility. To overcome the barrier of multiple assembly steps, we report a one-step system for the convenient and flexible assembly of a 180 TALE module library. This study is the first demonstration to ligate 9 mono-/dimer modules and one circular TALEN backbone vector in a one step process, generating 9.5 to 18.5 repeat sequences with an overall assembly rate higher than 50%. This system makes TALEN assembly much simpler than the conventional cloning of two DNA fragments because this strategy combines digestion and ligation into one step using circular vectors and different modules to avoid gel extraction. Therefore, this system provides a convenient tool for the application of TALEN-mediated genome editing in scientific studies and clinical trials.

Si-Containing Nanostructures for Energy-Storage, Sub-10 nm Lithography, and Nonvolatile Memory Applications

  • This talk will begin with the demonstration of facile synthesis of silicon nanostructures using the magnesiothermic reduction on silica nanostructures prepared via self-assembly, which will be followed by the characterization results of their performance for energy storage. This talk will also report the fabrication and characterization of highly porous, stretchable, and conductive polymer nanocomposites embedded with carbon nanotubes (CNTs) for application in flexible lithium-ion batteries. It will be presented that the porous CNT-embedded PDMS nanocomposites are capable of good electrochemical performance with mechanical flexibility, suggesting these nanocomposites could be outstanding anode candidates for use in flexible lithium-ion batteries. Directed self-assembly (DSA) of block copolymers (BCPs) can generate uniform and periodic patterns within guiding templates, and has been one of the promising nanofabrication methodologies for resolving the resolution limit of optical lithography. BCP self-assembly processing is scalable and of low cost, and is well-suited for integration with existing semiconductor manufacturing techniques. This talk will introduce recent research results (of my research group) on the self-assembly of Si-containing block copolymers for the achievement of sub-10 nm resolution, fast pattern generation, transfer-printing capability onto nonplanar substrates, and device applications for nonvolatile memories. An extraordinarily facile nanofabrication approach that enables sub-10 nm resolutions through the synergic combination of nanotransfer printing (nTP) and DSA of block copolymers is also introduced. This simple printing method can be applied on oxides, metals, polymers, and non-planar substrates without pretreatments. This talk will also report the direct formation of ordered memristor nanostructures on metal and graphene electrodes by the self-assembly of Si-containing BCPs. This approach offers a practical pathway to fabricate high-density resistive memory devices without using high-cost lithography and pattern-transfer processes. Finally, this talk will present a novel approach that can relieve the power consumption issue of phase-change memories by incorporating a thin $SiO_x$ layer formed by BCP self-assembly, which locally blocks the contact between a heater electrode and a phase-change material and reduces the phase-change volume. The writing current decreases by 5 times (corresponding to a power reduction of 1/20) as the occupying area fraction of $SiO_x$ nanostructures varies.

Numerical simulation of localization of a sub-assembly with failed fuel pins in the prototype fast breeder reactor

  • The early localization of a fuel subassembly with a failed (wet rupture) fuel pin is very important in reactors to limit the associated radiological and operational consequences. This requires a fast and reliable system for failure detection and their localization in the core. In the Prototype Fast Breeder Reactor, the system specially designed for this purpose is Failed Fuel Location Modules (FFLM) housed in the control plug region. It identifies a failed sub-assembly by detecting the presence of delayed neutrons in the sodium from a failed sub-assembly. During the commissioning phase of PFBR, it is mandatory to demonstrate the FFLM effectiveness. The paper highlights the engineering and physics design aspects of FFLM and the integrated simulation towards its function demonstration with a source assembly containing a perforated metallic fuel pin. This test pin mimics a MOX pin of 1 cm2 of geometrical defect area. At 10% power and 20% sodium flow rate, the counts rate in the BCCs of FFLM system range from 75 cps to 145 cps depending upon the position of DN source assembly. The model developed for the counts simulation is applicable to both metal and MOX pins with proper values of k-factor and escape coefficient.
