The International Arbitration System for the Settlement of Investor-State Disputes in the FTA (FTA(자유무역협정)에서 투자자 대 국가간 분쟁해결을 위한 국제중재제도)

  • The purpose of this paper is to describe the settling procedures of the investor-state disputes in the FTA Investment Chapter, and to research on the international arbitration system for the settlement of the investor-state disputes under the ICSID Convention and UNCITRAL Arbitration Rules. The UNCTAD reports that the cumulative number of arbitration cases for the investor-state dispute settlement is 290 cases by March 2008. 182 cases of them have been brought before the ICSID, and 80 cases of them have been submitted under the UNCITRAL Arbitration Rules. The ICSID reports that the cumulative 263 cases of investor-state dispute settlement have been brought before the ICSID by March 2008. 136 cases of them have been concluded, but 127 cases of them have been pending up to now. The Chapter 11 Section B of the Korea-U.S. FTA provides for the Investor_State Dispute Settlement. Under the provisions of Section B, the claimant may submit to arbitration a claim that the respondent has breached and obligation under Section A, an investment authorization or an investment agreement and that the claimant has incurred loss or damage by reason of that breach. Provided that six months have elapsed since the events giving rise to the claim, a claimant may submit a claim referred to under the ICSID Convention and the ICSID Rules of Procedure for Arbitration Proceedings; under the ICSID Additional Facility Rules; or under the UNCITRAL Arbitration Rules. The ICSID Convention provides for the jurisdiction of the ICSID(Chapter 2), arbitration(Chapter 3), and replacement and disqualification of arbitrators(Chapter 5) as follows. The jurisdiction of the ICSID shall extend to any legal dispute arising directly out of an investment, between a Contracting State and a national of another Contracting State, which the parties to the dispute consent in writing to submit to the ICSID. Any Contracting State or any national of a Contracting State wishing to institute arbitration proceedings shall address a request to that effect in writing to the Secretary General who shall send a copy of the request to the other party. The tribunal shall consist of a sole arbitrator or any uneven number of arbitrators appointed as the parties shall agree. The tribunal shall be the judge of its own competence. The tribunal shall decide a dispute in accordance with such rules of law as may be agreed by the parties. Any arbitration proceeding shall be conducted in accordance with the provisions of the Convention Section 3 and in accordance with the Arbitration Rules in effect on the date on which the parties consented to arbitration. The award of the tribunal shall be in writing and shall be signed by members of the tribunal who voted for it. The award shall deal with every question submitted to the tribunal, and shall state the reason upon which it is based. Either party may request annulment of the award by an application in writing addressed to the Secretary General on one or more of the grounds under Article 52 of the ICSID Convention. The award shall be binding on the parties and shall not be subject to any appeal or to any other remedy except those provided for in this Convention. Each Contracting State shall recognize an award rendered pursuant to this convention as binding and enforce the pecuniary obligations imposed by that award within its territories as if it were a final judgment of a court in that State. In conclusion, there may be some issues on the international arbitration for the settlement of the investor-state disputes: for example, abuse of litigation, lack of an appeals process, and problem of transparency. Therefore, there have been active discussions to address such issues by the ICSID and UNCITRAL up to now.

  • Various kind of disasters happens in our society. Most of them require immediate treatment to save life or to protect valuable products. When an accident happens in a place, it is reported to the headquarter of emergency measures system. According to the nature of accident several treatments orders are transmitted to the related authorities. In this paper, we introduce an intelligent emergency measures system that uses trigger mechanism of active databases. The system responds to various events spontaneously without intervention of mankind by triggering proper rules. The most important part of an action in the system is the capability of searching places to apply adequate treatments quickly. We have developed a new method for range queries and nearest neighbor queries which utilize the z-ordering technique to get fast responses. Those new methods are further extended to handle more realistic actual distance of road among positions.

  • Recently, various types of three-dimensional cameras have been used to analyze surrounding environments. In this paper, we suggest a mechanism of adaptively switching active and passive cameras of hybrid cameras, which can extract 3D image information more accurately. The suggested method first obtains brightness and texture features representing the environment from input images. It then adaptively selects active and passive cameras by generating rules that reflect the extracted features. In experimental results, we show that a hybrid 3D camera consisting of passive and active cameras is set up and the proposed method can effectively choose appropriate cameras in the hybrid camera and make it possible to extract three dimensional information more accurately.

  • A polysilicon self-aligned bipolar n-p-n transistor structure is described, which can be used in high speed and high packing density LSI circuits The emitter of this transistor is separated less than $0.4\mum$ with base contact by polysilicon self-align technology. Through all the process, the active region of this device is not damaged. therefore a high performance device is obtained. Using the transistor with $3.0\mum$ design rules, a CML ring oscillator has per-gate minimum propagation delay time of 400 ps at 2.7 mW power consumption condition.

  • On CELP type Vocoders G.723.1 6.3kbps/5.3kbps Dual Rate Speech Codec, which is developed for Internet Phone and videoconferencing, uses VAD(Voice Activity Detection)/CNG (Comfort Noise Generator) in order to reduce the bit rate in a silence period. In order to reduce the bit rate effectively in this paper, we first set the boundary condition of the energy threshold to prevent the consumption of unnecessary processing time, and use three decision rules to detect an active frame by energy, pitch gain and LSP distance. To evaluate the performance of the proposed algorithm we use silence-inserted speech data with 0, 5, 10, 20dB of SNR. As a result when SNR is over 5dB, the bit rate is reduced up to about 40% without speech degradation and the processing time is additionally decreased.

  • n active control for the swing of crane systems is very important for increasing the productivity. This article introduces the control for the position and the swing of a crane using the fuzzy learning method. Because the crane is a multi-variable system, learning is done to control both position and swing of the crane. Also the fuzzy control rules are separately acquired with the loading and unloading situation of the crane for more accurate control. The result of simulations shows that the crane is just controlled for a very large swing angle of 1 radian within nearly one cycle.

  • An active control for the swing of crane systems is very important for increasing the productivity. This article introduces the control for the position and the swing of a crane using the fuzzy learning method. Because the crane is a multi-variable system, learning is done to control both position and swing of the crane. Also the fuzzy control rules are separately acquired with the loading and unloading situation of the crane for more accurate control. And We designed controller by fuzzy learning method, and then compare fuzzy learning method with LQR. The result of simulations shows that the crane is controlled better than LQR for a very large swing angle of 1 radian within nearly one cycle.

Restoring force model for circular RC columns strengthened by pre-stressed CFRP strips

  • This paper presents a tri-linear restoring force model based on the test results of 12 circular RC columns strengthened by CFRP strips under low cyclic loading. The pre-stress of CFRP strips and axial load ratio of specimens are considered as the affect parameters of the proposed model. All essential characteristics of the hysteretic behavior of the proposed model, including the hysteretic rules, main performance points, strength degradation, stiffness degradation and confinement effects are explicitly analyzed. The calculated results from the proposed model are in good agreement with the experimental results, which shows that the recommended model can be reliably used for seismic behavior predictions of circular RC columns strengthened by pre-stressed CFRP strips.

  • Policy base management system that can satisfy various user's request in distributed system environment recently and manage network resources efficiently is required. Described policy base management information consisted of ECA(Event-Condition-Action) rules so that efficient management of various communication network and consistent management policy may be available in this paper. Policy is consisted of Event, Condition and Actions to achieve when condition is satisfied. And we can present formality of dynamic function of management object as applying policy to ATM congestion control model been applying in real environment.

A Study on the Practices of Online Arbitration System of Guangzhou Arbitration Commission in China (중국 광저우(廣州)중재위원회의 온라인중재 운용에 관한 연구)

  • There are more than two hundred arbitral institutions in China. Some of them are active in the development of online arbitration system, such as CIETAC and Guangzhou Arbitration Commission(GAC). GAC, founded in 1995, is the second largest arbitral institution in China which accepts more than 4,000 cases a year. With extensive experiences in arbitration, GAC has conducted online arbitration procedures since 2007. Moreover it opened the whole process of online hearing to the public through the Internet. With this background, this article aims to support the development of online arbitration through the analysis of GAC practices. To meet the purpose, status quo, rules and procedure of online arbitration of GAC are outlined, followed by introducing nine cases conducted by GAC. The scope of GAC online arbitration is comparatively narrow and the institution is still under the government supervision. But the practices of GAC proved that online arbitration is fully admissible and effective under the current legal framework.
