Research on Advanced Electronic Records Management Technology Using Digital Forensics (디지털 포렌식 기법을 적용한 전자기록물 관리기술 고도화 연구)

  • Recently, according with a sudden increase of records produced and stored by digital way, it becomes more important to maintain reliability and authenticity and to ensure legal effect when digital records are collected, preserved and managed. On the basis of domestic legal procedure law and record management-related legislation, this paper considered judicial admissibility of evidence on electronic records managed by National Archives of Korea and drew potential problems when these are submitted to court as a evidence. Also, this paper suggested a plan applying digital forensics technique to electronic records management to ensure admissibility of evidence about electronic records stored in National Archives of Korea.

A Study on the Crime Investigation of Anonymity-Driven Blockchain Forensics (익명 네트워크 기반 블록체인 범죄 수사방안 연구)

  • With the widespread use of digital devices, anonymous communication technologies such as the dark web and deep web are becoming increasingly popular for criminal activity. Because these technologies leave little local data on the device, they are difficult to track using conventional crime investigation techniques. The United States and the United Kingdom have enacted laws and developed systems to address this issue, but South Korea has not yet taken any significant steps. This paper proposes a new blockchain-based crime investigation method that uses physical memory data analysis to track the behavior of anonymous network users. The proposed method minimizes infringement of basic rights by only collecting physical memory data from the device of the suspected user and storing the tracking information on a blockchain, which is tamper-proof and transparent. The paper evaluates the effectiveness of the proposed method using a simulation environment and finds that it can track the behavior of dark website users with a residual rate of 77.2%.

  • According to the Annex 17 to the Convention on International Civil Aviation, an appropriate authority of each contracting state has to define and allocate tasks and coordinate activities between the departments, agencies and other organizations of the State, airport and aircraft operators and other entities concerned with or responsible for the implementation of various aspects of the national civil aviation security programme. The airport has to take leading role in implementing security tasks at airport area because the airport operator is the provider of airport facilities and services to its customer and the security activities belong to its services. So Republic of Korea Government enact the Law, Aviation Safety and Security. The Purpose of this Act is to prevent any unlawful act in airport facilities with international conventions, including the ICAO to provide for standards, procedures and mandatory matters needed to ensure the safety and security of civil aviation. But the Act has some error. So is this paper to review the revision of aviation security regulation and the changes of aviation security responsibilities and task assignment. There is the term "aviation security personnel", who are charged with the task of preventing any act of disrupting the order and safety in airport. But there is no term "security screening personnel" who performs to detect or search for dangerous object, such as weapons or explosives, which may be used for the unlawful obstruction.

An Empirical Study on the Possibility of Duplicated Sanctions in Bid-rigging on Construction Projects (건설공사 입찰담합의 중복제재 가능성에 관한 실증연구)

  • Bid-rigging is a common issue in public construction projects, and appropriate sanctions are required from the relevant authorities. This study analyzes the need for an optimal enforcement model to prevent bid-rigging by considering both civil and criminal aspects. Recently, there have been overlapping sanctions under the Fair Trade Act, such as fines imposed by the Fair Trade Commission and civil lawsuits filed by the client for damages. The purpose of this study is to evaluate the effectiveness of penalty surcharges and compensation systems for preventing bid-rigging, and to consider the possibility of overlapping sanctions in public construction projects. It was found that overlapping sanctions under the Fair Trade Act can be helpful in improving the system. However, in cases where the state is the plaintiff for damages in a lawsuit, it is necessary to consider the penalty surcharge and sentence, reduce the penalty surcharge for joint acts, refund the surcharge after a final judgment, and consider the damage compensation system when imposing a surcharge. This study contributes to the development of an efficient enforcement model to suppress bid-rigging in public construction projects by analyzing the improvement effects of sanctions and compensation.

  • Generally the aircraft accident caused a great loss of lives, severe property damages including aircraft's total loss and thus, affect enormous emotional and economic damages to the public. We, therefore, should try every efforts to prevent the re-occurrence of aircraft accident by examining the cause of accident closely and discovering it through aircraft accident investigation. Though the object of an accident investigation is not to apportion blame but to discover a cause or causes of an accident to prevent future accidents, the cause of an accident would play a vital role in determining the liability of the carrier, legal relationship with the third party and jurisdiction, etc. in the aviation litigation. Therefore, it is very important that aircraft accident investigation are carried out by a professional and independent agency. Also, it needs for us to be careful in applying investigation results in the courts not to be deterrent to discovering the cause of accident. Korea now has the Aviation Accident Investigation Agency Board under the Korean Ministry of Construction and Transportation, but unfortunately it is often pointed out that it lacks professionalism and independency due to the bureaucratism of the Government. We, therefore, should establish a professional and independent aircraft accident investigation agency like United States' NTSB and reflect the issues mentioned-above on the new Act.

Medical Certificate as an Evidence of Personal Injury (진단서의 증명력: 상해진단서를 중심으로)

  • Medical certificate is a document to demonstrate a patient's health status, made up and signed by a physician, dentist, or oriental physician who attended the patient. It serves as an evidence in many official process including civil or criminal law suit, especially for one's personal injury. The Korean legal system also acknowledges and protects the evidentiary function of medical certificate by mandating physicians etc. to issue medical certificate in good faith and only when they personally attended the patient, and by criminally punishing them when they do not comply with these legal requirements. There are some reasons, however, that medical certificates often do not reflect the true health status of the patient: When physicians attend the patient and collect information regarding the health status of the patient, their priority is and should be the most cost-effective way to meet the health needs of the patient. It does not necessarily correspond to the accurate examination of the health status of the patient. Even when the patient's report on the history of the illness or the injury seems suspicious, physicians might have to avoid disproving it because that kind of attitude might harm the rapport between the physician and the patient. All these can distort the perception of the physicians and this distortion can be reproduced in the medical certificate they made up. Some of these problems might be resolved or at least enhanced by introducing new form of medical certificate which would guide physicians to reveal the nature, factual and theoretical grounds, and the limit of their findings more accurately. Others, however, would not be able to address, because it stems from the conflict between the physician's primary duty, duty to be loyal to the patient's life and health, and his secondary duty to serve as a public or neutral witness on the health status of the patient, and when both values or duties conflict with each other, they should choose the duty to the patient sacrificing the duty to the public or the court.

Dies gilt selbstverst${\ddot{a}}$ndlich auch fur die Unternehmen der Bewachungsbranche. Allerdings ist es bei der Aus${\ddot{u}}$bung der Bewachungsaufgabe typisch, mit Strafe oder zumindest Schadensersatzpflicht sanktionierte Tatbest${\ddot{a}}$nde zum Nachteil Dritter zu verwirklichen. F${\ddot{u}}$r solche F${\ddot{a}}$lle stehen den Bewachungspersonen m${\ddot{o}}$glicherweise Rechtfertigungsgr${\ddot{u}}$nde zur Seite. Dadurch wird ein ansonsten rechtswidriges Handeln rechtm${\ddot{a}}$${\ss}$ig und so wird im Ergebnis eine Strafbarkeit (wie auch eine Schadensersatzpflicht) ausgeschlossen. Dabei wird klargestellt, dass dem Sicherheitsgewerbe au${\ss}$er in den F${\ddot{a}}$llen der gesetzlichen ${\ddot{U}}$bertragung der hoheitlichen Befugnisse nur die vom Auftraggeber vertraglich ${\ddot{u}}$bertragenen privatrechtlichen Befugnisse sowie die Jedermannsrechte zustehen Au${\ss}$erdem soll im Rahmen der Privatisierung der Gefahrenabwehraufgaben auf solche spezialgesetzlichen Regelungen hingewiesen werden, bei denen Bewachungspersonen mit der hoheitlichen Wahrnehmung bestimmter Sicherheitsaufgaben betraut, d.h. dazu befugt sind, Sicherheitsaufgaben in den Handlungsformen des ${\ddot{O}}$ffentlichen Rechts 면켜${\ddot{u}}$ben. In der koeranischen Literatur ist die Handlungsgrundlage des Bewachungspersonals bis jetzt kaum n${\ddot{a}}$her untersucht. Im allgemeinen werden strafrechtliche Rechtferigungsgr${\ddot{u}}$nde, z.B. Notwehr, Notstand und Selbsthilfe, als dabei anwendbare Normen anerkannt. In dieser Arbeit wird festgestellt, dass die privaten Sicherheitsdienstleister in beiden L${\ddot{a}}$ndern durch die Gewerbegenehmigung au${\ss}$er in den F${\ddot{a}}$llen der Beleihung keine hoheitlichen Befugnisse erhalten. Als Handlungsgrundlage kommen nur die allgemeinen Not- und Jedermannsrechte im Rahmen von Straf-Strafprozess- bzw. Zivilrecht in Betracht.

Challenges in Accordance with Current Law by the Enforcement of the Medical Dispute Adjustment Act (의료분쟁조정법의 시행에 따르는 현행법상의 해결과제)

  • Medical disputes the problem that occurs essentially among the rapidly increasing of the demand for health care and the attention of the public health. The subject of dispute is mostly criminal penalties and civil redress due to a physician's medical malpractice, resolved by agreement was prioritized. They trying to solve through the litigation and exercise the skills. But, the lack of clear standards and related legislation make difficult to solve the problem. for this, "The Act of Medical Malpractice Damage's Relief and Mediation for Medical Dispute Resolution" (Medical Disputes Adjustment Act) was enacted in April 7, 2011 and performed in Apr. 8, 2012. To solve the problem autonomously between the parties. It is the legislative intent such as mediation or arbitration to solve the conflict between the parties. But there are some problems that examined from the perspective of constitutional review with the criminal and civil problems. Therefore, this paper will find out the legal issues about Medical Dispute Adjustment Act and the constitutional and civil issues. And want to expect to be prepared the more stable and efficient solution of medical disputes.

Research for the Security Studies in the Universities of U. S. A. (미국 대학 시큐리티 교육내용에 관한 연구 -한국 대학교육과 비교를 중심으로-)

  • In the universities of U.S.A., Criminal Justice is the interdisciplinary study of the institutions and policies that constitute the criminal justice system, as well as theories of human behavior and philosophies of justice related to the maintenance of social order, the control of crime, and the achievement of a just society. There are 103 American Universities have Criminal Justice department and they provide about 180 differents courses as a pre-requisition or optional subject in the major. The most 10 courses that those colleges adopted are Introduction to Criminal Justice, Criminal Law, Criminology, Criminal Procedures, Research Methods in Criminal Justice, Criminal Investigation, Juvenile Justice, Terrorism, Ethical Issues in Criminal Justice, Introduction to Psychology or Introduction to Sociology. Also, 10 fields more important in the major if we group together similar courses those are Criminal Justice and Procedures Sequences, Law, Justice and corrections, Theory and Methods Sequences, Homelend Security and Security Operations, Forensics and Cybercrime, Management and Administration, Police, Race and Ethnicity, General Requirements, Other Social Science Fields. The combined degree program leading to Bachelor of Arts Degree in Criminal Justice and Master in Public Administration provides a concentration in criminal justice, management, administration, and leadership. They have big different courses between USA and Korea event though they have similar educative goal and way of approach to the target in the major.

Application of Police Video Equipment for Fighting Crime and Legal Trends (범죄 대응을 위한 경찰 영상장비의 활용과 법 동향)

  • With the introduction of video cameras into law enforcement, a great deal of police organizations have adopted the technology in their routine crime prevention activities. The up-to-date systems of ambient surveillance energized by CCTV, police wearable cameras, drones, and thermal imaging devices enable the police to thoroughly monitor public spaces as well as to rigorously arrest on-scene criminals. These efforts to improve the level of surveillance are often met with public resistance raising concerns over citizens' rights to privacy. Recent studies on the use of police video equipment have constantly raised the issues related to the lack of applicable legal provisions, risk of personal information and privacy infringement as well as security vulnerabilities. In this regard, the present study attempted to review the public surveillance methods currently used by law enforcement agencies worldwide within the context of public safety and individual rights to privacy. Furthermore, the present study also discussed the legal boundaries of police use of video equipment to address public concerns over privacy issues.
