A Study on Regulations and Strategies for Increasing the Chinese Construction Market Share post the FTA between Korea and China (한중FTA 이후 중국 해외건설업의 규제실태와 진출 활성화 방안 연구)

  • This study analyzes difficulties of enterprise activities in Chinese construction market by surveys on early entrants and interviews with experts. This study also suggests future strategy to enter the market by using inducement coefficient model. Korean construction companies in China are under heavy pressure to maintain requirement of licenses, despite recent deregulation. They are in dire predicament for market entry due to the Foreign Direct Investment System. It is almost impossible to participate in public projects and also it is not easy to do PPP projects. Therefore, Korean government should make more efforts to solve those issues through negotiations in FTA and GPA. For future expansion in Chinese construction market, it is highly recommended to boost cooperation models between Korea and China according to the empirical results of inducement coefficient model. Korean companies should collaborate with Chinese companies in some fields: smart city, environment and water treatment. Also, Korean government should support Korean companies by diplomatic means such as requesting for further opening of China's market. In GPA or GATS negotiation, Korean government should ask Chinese government that Korean companies can obtain order independently (without joint venture with Chinese companies) in China. Lastly, Korean construction companies should participate in construction projects ordered by international organizations such as ADB, AIIB.

A Study on the first inventor defense in the US patent law (미국에서의 선발명자 항변에 관한 연구)

  • The successive round of talks oil Korea-USA Free Trade Agreement (FTA) has continued, and it also has the Intellectual property(IPR) unit. Until now, tile one of most disputing concerns in IPR unit through talks is the limitation of compulsory license of claimed invention. The US is urging to establish a safeguard for IPR, as similar measure of the US, to protecting the profit of the US enterprises through these on-going talks, it is more likely expected to take the offensive about infringement of the patent seriously. Based on the current circumstances, the provision strategy study is needed to obtain Korea inventors the first inventor defense under the US patent law system as well as understand the current Korea's patent law and its revision against that in the US. In patent Law, both nations with first to file system and first to invent system permit a prior user of an invention to continue to use the invention notwithstanding its subsequent patenting by another under being subject to certain qualifications and limitations, even though a patent by a later inventor is granted. Normally, the first inventor defense has been used to compensate the drawbacks of the first to file system. The US patent Law, however, adopting the first to invent system admits the first inventor defense. Therefore, pursuing counteract provision under consideration with Korean patent Law system and research environment along with investigating the reason why the US adopted its patent law system, the scope of right, and the new reform of Act. 2005 of the institute, which promotes the first Korean inventor to possess the defense right of the US, provides certain preparations for Korean companies against the expected offensive from the US ones under the US patent Law system.

  • 2015년 5월 수중발사 탄도미사일(SLBM) 발사시험을 통해 북한은 전 세계의 이목을 또 다시 집중시켰다. 북한은 2013년 제3차 핵실험을 감행한 이후 최근까지도 탄도미사일과 로켓 발사 등의 무력도발을 지속해 왔다. 이와 같은 북한의 무력도발은 한반도의 안정뿐만 아니라 미국 본토의 안보에도 매우 부정적인 영향을 미치고 있다. 지금까지 미국은 북한의 핵미사일 개발 저지를 위해 경제적 또는 군사적 방안들을 선별적으로 적용해 왔다. 그러나, 이러한 미국의 노력에도 불구하고 북한은 여전히 핵미사일을 개발하겠다는 꿈을 포기하지 않고 있는 것이 사실이다. 본 논문은 북한의 핵미사일 개발에 대한 미국의 대안적 전략(Alternative Strategy)을 제시하는데 그 목적이 있다. 필자는 대안적 전략 제시에 앞서 북한의 핵과 탄도미사일 개발현황을 내용(Contents)과 맥락(Context) 차원에서 분석하고 미 오바마 행정부의 대북전략을 비판적으로 검토하였다. 그리고 대안적 전략으로 동맹국과 함께 경제적(Sticky Power), 군사적(Sharp Power) 수단의 동기화(Synchronizing)를 통해 북한이 감당하기 힘든 전략적 환경을 조성(Shaping the Strategic Environment)하는 것이 '북한의 핵개발 포기' 라는 전략목표를 달성하는 방안 임을 강조하고 있다. 미국이 대안적 전략목표를 달성하기 위해서는 경제적 수단으로 ① 북한의 자금세탁 및 위조지폐 발행국 지정, ② 북한을 지원하는 모든 해외자산에 대한 제재조치, ③ 북한의 테러지원국 재지정, ④ 북한 제재를 위한 미국의 입법추진, ⑤ 대량살상무기 관련 금수품목의 확대를 적용함과 동시에 군사적 수단으로 ① 대량살상무기 비확산 활동 강화, ② 대탄도미사일 전략 개발 및 정보(ISR: Intelligence Surveillance and Reconnaissance) 공유, 맞춤형 억제전략(TDS: Tailored Deterrence Strategy)의 구체화 등을 통한 한·미 군사 억제방안의 강화, 그리고 ③ SM-3, THAAD(Terminal High Altitude Area Defense) 등 한·미·일 3자간 MD(Missile Defense)체제의 구축 등을 동기화하여 적용해야만 할 것이다. 미국의 대안적 전략은 ① 북한의 핵미사일 개발에 대한 중국의 협력방지, ② 한·중간 경제관계의 악화, ③ 한·일간의 역사적 긴장관계라는 위험요소를 내포하고 있는 것 또한 사실이다. 따라서 미국이 대안적 전략목표인 '북한의 비핵화' 달성을 위해서는 이와 같은 위험요소를 완화시키는 노력도 병행되어야 할 것이다. 끝으로, 미국은 북한의 김정은이 핵미사일 개발 포기라는 상이한 방향의 전략적 결정을 할 경우에 대비하여 한·미 연합훈련의 보류, 북한에 대한 경제제재조치 해제 등 북한과의 협상 가능성도 열어두고 이에 대해서도 철저하게 준비해 나가야 할 것이다.

  • The purpose of this study is to analyze the strategic behaviors of the Broadcasting advocacy coalition and IT advocacy coalition in the process of establishing the Korea Communications Commission(KCC) in 2008. Broadcasting and telecommunications convergence policy has been confronted with long-term conflicts because of ideological clashes between public interest and industrialism and stakeholder relations. Under this circumstance, the two advocacy coalitions sought to bring out the favorable outcomes through strategic behavior. However, the strategic behaviors were limited, and the establishment of the Korea Communications Commission was decided by political negotiation. Since then, KCC has been buried in political issues and has produced policy failure cases. In order to reduce these adverse effects, it is necessary to establish institutional devices in the reorganization process. Above all, efforts are needed to overcome the practice of using organizational restructuring as a political tool.

An Analysis of the Development Strategy of Academic Libraries in the U.S., U.K., Australia and Canada (미국, 영국, 호주 및 캐나다 대학도서관의 발전전략의 분석)

  • The purpose of this study is to analyze the development strategy of academic libraries in the U.S., U.K., Australia, and Canada which have been established in response to the problems faced since the 1990s. Major problems, which academic libraries in various countries have commonly experienced include continuing decrease in library expenditures, changing role of libraries themselves, changing nature of library collections, development of information technology and technological intrastructure on campus, steep increase in prices of scholarly journals, and relative decrease in purchasing powers of libraries. In this study, discussed are the strategic planning and solutions carried out at the national or government level, rather than by individual libraries. Their efforts commonly focus on such measures as resource sharing, shared catalog and storage facilities, cooperative purchasing and negotiation for scholarly journals, etc.

Beamforming Games with Quantized CSI in Two-user MISO ICs (두 유저 MISO 간섭 채널에서 불완전한 채널 정보에 기반한 빔포밍 게임)

  • In this paper, we consider a beamforming game between the transmitters in a two-user multiple-input single-output interference channel using limited feedback and investigate how each transmitter is able to find a modified strategy from the quantized channel state information (CSI). In the beamforming game, each of the transmitters (i.e., a player) tries to maximize the achievable rate (i.e., a payoff function) via a proper beamforming strategy. In our case, each transmitter's beamforming strategy is represented by a linear combining factor between the maximum ratio transmission (MRT) and the zero forcing (ZF) beamforming vectors, which is the Pareto optimal achieving strategy. With the quantized CSI, the transmitters' strategies may not be valid because of the quantization errors. We propose a modified solution, which takes into account the effects of the quantization errors.

  • In this paper, after defining the requirements to improve the processing of Internet auction, we design and implement Internet Auction Agent System (IAAS) based on the requirements. IAAS consists of a multi - agent system with buying/selling/negotiation agents for auction processing in accordance with the given price strategy, a graphic interface for supporting price strategies, an information agent for supplying real time information and remote control of agents, and DB. For the mobility, scalability, functionality and communication efficiency of agents, IAAS is implemented by using Java JDK1.3, Servlet, RMI and socket. Through the comparative analysis, we show that IAAS fulfills the requirements defined. IAAS can improve the convenience of users and the efficiency of auction processing, and thus increase the utilization of Internet auction.

Effect of Concept Learning Strategy Emphasizing Social Consensus during Discussion (토론 과정에서 사회적 합의 형성을 강조한 개념 학습 전략의 효과)

  • In this study, a concept learning strategy emphasizing social consensus during discussion (SCS) was developed. The instructional effects of this strategy were compared with those of cognitive conflict strategy (CCS) and traditional instruction in the aspects of students' achievement, conceptions, communication apprehension, perceptions of science learning environment, and perceptions of small group discussion. There were no significant differences in the scores of an achievement test. For the students of low communication competency, however, the scores of the CCS group were significantly higher than those of the traditional group. The adjusted mean of the SCS group was higher than those of the other groups in a conceptions test. The social consensus strategy was also found to be more effective in learning concept for those who were more competent in communicating. No significant differences were found in the communication apprehension. The scores of three groups did not differ significantly in the subcategories of 'personal relevance' and 'students' negotiation' of the test of the perceptions of science learning environment. However, the students in the SCS group scored higher in 'participation'. The students in the SCS group perceived small group discussions more positively.

A Study on the Concept and Protection System for the Geographical Indication (지리적 표시제도의 의의 및 보호체제 연구)

  • This study reviews the concept and protection system for the geographical Indication(GI) to support the Korea-EU FTA. A geographical indication(GI) is a name or sign used on certain products or which corresponds to a specific geographical indication or origin (eg. a town, region, or country). The use of a GI may act as a certification that the product possesses certain qualities, or enjoys a certain reputation, due to its geographical origin. In the WTO Agreement on Trade-Related Aspects of Intellectual property Rights("TRIPS"). There are, in effect, two basic obligations from Article 22 to article 23 on WTO member governments relating to GIs in the TRIPS agreement. Geographical Indications have long been associated with Europe as an entity, where there is a tradition of associating certain food products with particular regions, Under European Union Law, the protected designation of origin system which came into effect in 1992 and 2003 regulates the following geographical indications: Protected designation of origin(PDO) and protected geographical indication(PGI) and Traditional Specialty Guaranteed(TSG). They have 5,000 articles for GI. We have the GI system and 40 articles rotating to registration by the law for quality management of production in agriculture. Cinclusinally, geographical indications could potentially serve as tools to helf holders of trade benefit more equitable through the mutual Acceptance for Korea-EU FTA.

Laying the Siting of High-Level Radioactive Waste in Public Opinion (고준위 방폐장 입지 선정의 공론화 기초 연구)

  • Local opposition and protest constitute single greatest hurdle to the siting of locally unwanted land uses(LULUs), especially siting of high-level radioactive disposal not only throughout Korea but also throughout the industrialized world. It can be attributed mainly to the NIMBYism, equity problem, and lack of participation. These problems are arisen from rational planning process which emphasizes instrumental rationality. But planning is a value-laden political activity, in which substantive rationality is central. To achieve this goals, we need a sound planning process for siting LULUs, which should improve the ability of citizens to influence the decisions that affects them. By a sound planning process, we mean one that is open to citizen input and contains accurate and complete information. In other word, the public is also part of the goal setting process and, as the information and analyses developed by the planners are evaluated by the public, strategies for solutions can be developed through consensus-building. This method is called as a co-operative siting process, and must be structured in order to arrive at publicly acceptable decisions. The followings are decided by consensus-building method. 1. Negotiation will be held? 2. What is the benefits and risks of negotiation? 3. What are solutions when collisions between national interests and local ones come into? 4. What are the agendas? 5. What is the community' role in site selection? 6. Are there incentives to negotiation. 7. Who are the parties to the negotiation? 8. Who will represent the community? 9. What groundwork of negotiation is set up? 10. How do we assure that the community access to information and expert? 11. What happens if negotiation is failed? 12. Is it necessary to trust each other in negotiations? 13. Is a mediator needed in negotiations?
