  • 수리권(水利權, Water Right)은 특정인이 하천의 물을 계속적, 배타적으로 사용하는 권리로서, 국내에서는 민법 제231조 "공유하천의 연안에서 농, 공업을 경영하는 자는 이에 이용하기 위하여 타인의 용수를 방해하지 아니하는 범위 내에서 필요한 인수를 할 수 있다." 라는 규정을 통해 공유하천 용수권을 인정하면서, 동법 제234조 "전 3조의 규정은 다른 관습이 있으면 그 관습에 의한다." 라는 조항을 통해 관습에 의한 즉, 관행 수리권을 인정하고 있다. 또한, 하천법 제50조 "생활·공업·농업·환경개선·발전·주운(舟運) 등의 용도로 하천수를 사용하려는 자는 대통령령으로 정하는 바에 따라 환경부장관의 허가를 받아야 한다." 라는 규정을 통해 허가 수리권을 규정하고 있다. 이와 같이 국내의 경우 수리권에 대하여 공용하천 용수권, 관행수리권 및 허가수리권이 혼재되어 있어 지역 간의 물 분쟁이 심화되어 가고 있는 상황에서 수리권의 정립 필요성이 절실해지고 있지만, 제도적 연구와 더불어 이를 뒷받침 해줄 수문학적 연구가 상대적으로 부족한 실정이다. 본 연구는 동진강 유역을 대상으로 수정 3단 TANK 모형을 적용하여 자연하천유량 산정하였고, 수리권 분석모형인 WRAP(Water Rights Analysis Package, WRAP)을 이용하여 수리권 분석을 수행하였다. 또한 섬진강댐의 방류조건 및 유역내 물 이용조건에 따른 시나리오를 구성하여 하천유지유량의 변화를 모의하였다. 시나리오 적용에 따른 대표지점의 조절하천유량을 모의한 결과 시나리오3, 시나리오4, 시나리오5(비관개기기간 동안 용수 추가확보를 통한 증가방류)에서 하천유지유량이 상대적으로 많아지는 것으로 모의되었다. 또한, 시나리오1, 시나리오2(유역내 저수지 방류량을 연중 일정량 공급)방안도 관개기와·비관개기 기간에 대표지점의 하천유지유량 증가에 효과가 있는 것으로 평가되었다. 연구 대상기간의 대부분은 수리권 목표량을 만족하였지만, 갈수년에 해당하는 2017년의 경우에는 용수 확보량이 가장 많은 시나리오5를 적용한 경우에도 수리권 전환량 및 하천유지유량의 부족이 발생하는 것으로 모의되었다. 유역내 수리권 우선순위의 변경을 통한 유량의 변화를 모의하기 위하여 2017년을 대상년도로 모의해본 결과 연구대상지역의 하류에 위치하고 있는 농업용보에서의 수리권을 후순위로 두었을 때, 대표지점에서 가장 많은 양의 유량을 확보하는 것으로 분석되었다.

  • 국가경쟁력강화위원회에서 확정(2011. 1. 19. 제24차 회의)된 하위법령 특별정비 추진에 따라 행정제재처분기준을 경감할 수 있는 사유를 명확히 마련함으로써 행정제재처분을 합리화하는 한편, 액화석유가스 총전사업 등의 허가요건에 관한 세부적인 사항을 조례로 정하도록 하는 내용으로 "액화석유가스의 안전관리 및 사업법"이 개정(법률 제10350호, 2010. 6. 8. 공포, 9. 9. 시행)됨에 따라 종전에 고시로 정하고 있던 액화석유가스 충전사업 및 액화석유가스 판매사업의 시설기준 중 안전거리, 도로의 폭, 용기보관실 사무실 주차장의 면적에 대하여 일반 기준의 2배 이내의 범위에서 강화된 기준을 조례로 정하려는 것임.

Spatial Designation of Impact Fee Zone Using the Parcel Development Permit Information (기반시설설치구역 지정을 위한 공간정보 적용방안 연구)

  • In September, 2008, the government has amended the National Territory Planning Act" by adding criteria to designate the Impact Fee Zone on the basis of the increase rate of the development permit. Since the permits are issued to scattered parcels on the individual basis, however, it renders significant difficulties in accurately figuring out the finite local areas that exceed such legal criteria. This study, in this context, tries to join the development permit time-series data with the Korea Land Information System (KLIS) so that, with the aid of the landform layer and existing infrastructure layer, it could pinpoint the local area where the development activities are concentrating. Taking a sector in Yangpyong County as the case, the study practically demonstrates as to how the designation process is geospatially processed.

A Study on Aviation Safety and Third Country Operator of EU Regulation in light of the Convention on international Civil Aviation (시카고협약체계에서의 EU의 항공법규체계 연구 - TCO 규정을 중심으로 -)

  • Some Contracting States of the Chicago Convention issue FAOC(Foreign Air Operator Certificate) and conduct various safety assessments for the safety of the foreign operators which operate to their state. These FAOC and safety audits on the foreign operators are being expanded to other parts of the world. While this trend is the strengthening measure of aviation safety resulting in the reduction of aircraft accident. FAOC also burdens the other contracting States to the Chicago Convention due to additional requirements and late permission. EASA(European Aviation Safety Agency) is a body governed by European Basic Regulation. EASA was set up in 2003 and conduct specific regulatory and executive tasks in the field of civil aviation safety and environmental protection. EASA's mission is to promote the highest common standards of safety and environmental protection in civil aviation. The task of the EASA has been expanded from airworthiness to air operations and currently includes the rulemaking and standardization of airworthiness, air crew, air operations, TCO, ATM/ANS safety oversight, aerodromes, etc. According to Implementing Rule, Commission Regulation(EU) No 452/2014, EASA has the mandate to issue safety authorizations to commercial air carriers from outside the EU as from 26 May 2014. Third country operators (TCO) flying to any of the 28 EU Member States and/or to 4 EFTA States (Iceland, Norway, Liechtenstein, Switzerland) must apply to EASA for a so called TCO authorization. EASA will only take over the safety-related part of foreign operator assessment. Operating permits will continue to be issued by the national authorities. A 30-month transition period ensures smooth implementation without interrupting international air operations of foreign air carriers to the EU/EASA. Operators who are currently flying to Europe can continue to do so, but must submit an application for a TCO authorization before 26 November 2014. After the transition period, which lasts until 26 November 2016, a valid TCO authorization will be a mandatory prerequisite, in the absence of which an operating permit cannot be issued by a Member State. The European TCO authorization regime does not differentiate between scheduled and non-scheduled commercial air transport operations in principle. All TCO with commercial air transport need to apply for a TCO authorization. Operators with a potential need of operating to the EU at some time in the near future are advised to apply for a TCO authorization in due course, even when the date of operations is unknown. For all the issue mentioned above, I have studied the function of EASA and EU Regulation including TCO Implementing Rule newly introduced, and suggested some proposals. I hope that this paper is 1) to help preparation of TCO authorization, 2) to help understanding about the international issue, 3) to help the improvement of korean aviation regulations and government organizations, 4) to help compliance with international standards and to contribute to the promotion of aviation safety, in addition.

A Status Analysis for the Standards on Permission of Altering Cultural Heritage's Current State Focusing on the Results of Handling Application Cases on Permission of State-Designated Cultural Heritage (Historic Site) for the Last Five Years (2015~2019) (문화재 현상변경 인·허가 검토기준 마련을 위한 실태분석 연구 - 최근 5년(2015~2019)간 국가지정문화재(사적)의 허가신청 안건 처리결과를 중심으로 -)

  • Since June 2006, there have been active efforts to systematize the permission system including the amendment of [Cultural Heritage Protection Act]. Cultural Heritage Administration prepared standards on reviewing each type of cultural heritages(CH) in 2015, promoted a project on the modification of permission standards and showed remarkable performances in quantitative aspects. But as there has been little change for the cases applied for permission, additional studies on policy are required to improve the management efficiency and reduce the citizens'inconvenience. In response, this study aims to identify the actual management status on the current state alteration permission system, and establish practically utilizable reference materials at permission review. While historic sites(HS) constitute a relatively small proportion in state-designated CHs, they are subject to the designation of permission standards. Also, with their location in the downtown area, the application rate is high (51.4%) and the results are commonly utilizable to other types of CH. We constructed a DB based on the minutes of Cultural Heritage Committee(CHC) on HS and categorized similar features in permission handling results. The result of the analysis is as follows. Out of a total of 5,243 cases for permission applied for HS, 1,734 cases of cultural heritage areas(CHA) and 3,509 cases of historic and cultural environment preservation areas(HCEPA) have been applied. CHA has a great proportion of the applications for events and festivals, which are highly related to CHs or representing the local area. There is a high permission rate on applications for the purpose of public service by local governments. Meanwhile, HCEPA has a high proportion of applying for the installation and extension of buildings and facilities at the private level. Thus, negative decisions were made for tall buildings, massed facilities, or suspected scattering of similar acts. Our actual condition analysis has identified a total of 78 types of harmful acts which may influence the preservation of CHs. 31 types in CHA and 37 types in HCEPA are categorized. Especially, 10 common types of permission have been confirmed in both sectors. As a result, it is expected to secure consistency in the permission administration, enhance the management efficiency and improve the public's satisfaction over the regulatory administration by providing practically utilizable reference materials for altering the current state of CH and for decision making on the part of CHC.

Questionnaire Concerning the Actual State of the Burning for Farming and Recognition of Forest Fire Prevention Policy (영농인들의 영농소각 실태 및 산불예방정책에 대한 의식조사 연구)

  • Korea was experienced more forest fire occurrence compared to an area. As a forest fire occurrence from man caused burning for a farming increased and was one of the main reasons of forest fire occurrence in Korea, agriculturist-was a main reason of forest fire occurrence-opinion analysis was needed for forest fire prevention from this reason. Therefore, we asked agriculturist who live in province frequently experienced a forest fire from the burning for farming to answer questions. In result, a half of the respondents have a burning experience for farming and the main reason of the burning was the clearance around farmlands. In result of survey about recognition rate of forest fire prevention policy (forest fire season, incineration inhibition within 100 m from forest, license system for burning, joint burning system by a rural community, imposing a fine for burning) was almost high except license system for the burning, In the result about analysis according to ages and provinces, the recognition rate was high in province experienced severe forest fire damage and low in below 40 years group. So, the direction of forest fire prevention policy would need to be mediated in the view of agriculturist who need to use a fire because of farming labor shortage and higher age. And a consolidated education of forest fire prevention would be needed to agriculturist who live in province experienced rarely forest fire and in below 40 years group.

Study on Policies for Integrated Pollution Prevention and Control (통합적 환경관리의 정책적 도입방안에 관한 연구)

  • Integrated Pollution Prevention and Control(IPPC) has become an idealistic environmental prevention concept in developed countries and corresponds with principles of Industrial Ecology. The concept of emissions regulatory integration is a key factor for an integrated environmental management system. While most EU member countries have a cross-media regulatory system, Korea has a media-specific regulatory system which was found to have significant environmental management problems. The purpose of this study is to integrate the emissions regulatory system by resolving difficulties through procedural, organizational, and substantive analysis of integration. To this end, the following research was performed: The first task was to determine the target of the integrated emissions regulatory system. In connection with this, the "IPPC directive" of the EU and the "PPCA 2000" schedule 1 of the UK, as well as environmental laws in Korea were compared and analyzed. The second was to design a regulatory system model. This model was divided into three groups after considerations were made regarding the time it would take for the pre-application,application, and permission stages. Lastly, on the basis of this research, a revised bill for an integrated emissions regulatory system was suggested. Nevertheless, substantive analysis of integration focused on BAT requires supplementation in order to make the integrated emissions regulation system operate normally as an environmental management policy and regulation method. To this end, the specific characteristics of Korean society, culture, and law should be actively considered.

The Legal Issues and Improvements Surrounding Wages of Foreign Workers (외국인근로자의 임금을 둘러싼 법적 문제점과 개선방안)

  • The wages of migrant workers about the rational discrimination and equal treatment have been treated partially. Foreign workers are also discussed in terms of the productivity and rational discrimination, but it is very limited. The Business community has been persisting that the minimum wage system for foreign workers should be excluded. Unlike local workers, migrant workers are relatively in that position with limited work place, a limited period of time to provide labor for the purpose of wage, in that points, the gap of the reality and the laws surrounding wages can be identified. This is expressed the conflicts and distress between employers and workers. Meanwhile, wages and equal treatment on the part of the study have been discussed, but it is hard to be organized clearly. Be related to this study, it will have a limitation. In this paper, since the employment permit system was enforced, the status of wages and distress and the factor of conflicts between the employer and the foreign worker examine and suggest the improvement plan for the law regarding wage.
