Based upon the provision of limitation of copyrights, libraries may provide the document delivery service which supplies copies of journal articles and book chapters owned at other libraries by request of users. However, more proactive information service is required as more users want to use the digital delivery of documents published overseas. This study reviews copyright law of Korea and international conventions related to the document delivery service. It then examines foreign cases to see how overseas information centers clear copyrights. Finally this study suggests that copyright clearance methods be adopted to make a proactive information service. Through those methods, a new information service model may be planned, which meets various information needs while protecting copyright.

The global popularity of K-content(Korean Wave) has led to a continuous increase in copyright infringement cases involving domestic works, not only within the country but also overseas. In response to this trend, there is active research on technologies for detecting illegal distribution sites of domestic copyrighted materials, with recent studies utilizing the characteristics of domestic illegal distribution sites that often include a significant number of advertising banners. However, the application of detection techniques similar to those used domestically is limited for overseas illegal distribution sites. These sites may not include advertising banners or may have significantly fewer ads compared to domestic sites, making the application of detection technologies used domestically challenging. In this study, we propose a detection technique based on the similarity comparison of links and text trees, leveraging the characteristic of including illegal sharing posts and images of copyrighted materials in a similar hierarchical structure. Additionally, to accurately compare the similarity of large-scale trees composed of a massive number of links, we utilize Graph Neural Network (GNN). The experiments conducted in this study demonstrated a high accuracy rate of over 95% in classifying regular sites and sites involved in the illegal distribution of copyrighted materials. Applying this algorithm to automate the detection of illegal distribution sites is expected to enable swift responses to copyright infringements.

현대사회에서 인터넷 이용은 인간으로서 기본적인 삶의 문제가 되어 매일 인터넷을 이용하지 않는 경우는 것의 없으며, SNS를 사용하면서 거의 매일 하이퍼링크를 하고 있다. 그러나 이러한 하이퍼링크가 합법적으로 업로드된 저작물에 연결되는 것에 대해서는 별로 문제가 되지 않지만, 불법적으로 업로드된 저작물에 링크를 하고, 이러한 링크를 관리하여 수익모델을 가지고 있는 개인 및 기업의 증가로 대한민국뿐만 아니라, 전세계적으로 저작권법적인 문제가 되고 있다. 본 논문에서는 미국, EU, 대한민국의 판례를 간략하게 정리하고, 현재까지 판례를 비판하며, 입법론을 제안해 보고자 한다.

This paper aims to develope the technology for monitoring and identifying webtoon works that are being illegally distributed through the web-hard, torrent and overseas websites. The technology is to effectively prevent the illegal distribution and protect the copyrights of the webtoon works, leading to create a healthy market. This paper deals with the technology for (a) automatic collection of webtoon works from the webtoon service sites, (b) extraction of the features from the images of the collected webtoon works, and (c) registers them in the feature database. For these purposes, the required system performance and features were analyzed and the structures of webtoon service sites were examined, through which the system for automatic registration of webtoon works and features was developed. The system can work for the early stage blockage of illegal distributions of webtoon works which occur during the period from webtoon posting to feature registration.

1987년 새 저작권법이 발효됨에 따라 정식으로 선을 보이기 시작한 국내 저작권에이전시들이 활동이 아직까지 유명무실한 것으로 드러났다. 수적으로는 매년 성장세를 보이고 있으면서도, 구체적인 실적에 있어서는 두세개 에이전시를 빼고 나면 아예 개점휴업 상태에 놓여 있어, 앞으로 더욱 늘어날 해외 저작물 이용에 능동적으로 대처하기 어려우리라는 우려를 낳고 있다.

Recently the government has succeeded in shutting down the Illegal Copyrighted Websites by cracking down on the operators of the websites. But this only caused 'the Balloon Effect', similar websites were created and users shifted to the new websites. 'Follow the money' is drawing attention as a way to complement the effect of policies. It tracks the commercialization scheme and fund flows of the Illegal Copyrighted Websites and blocks the supply and publication of advertisements, which are the main source of revenue. This approach aims at self-closure of Illegal websites by blocking the revenue source. In this study, we have selected and analyzed overseas cases that adopted these measures. Many countries had different policies and campaigns, but three things are common: non-punishment measures, partnership based on voluntary participation, pursuing a variety of purposes other than protecting the copyright industry. In Korea, the reason public-private Partnerships was not properly established had been caused by the difference of views between them. Advertisers and agencies need to expand their awareness that illegal advertisements can have adverse effects such as brand image damage and enormous economic losses. Also campaigns and conferences related with the policy should be held to prevent copyright infringement through mutual understanding and cooperation.

IT 기술에 의해 정보유통 환경이 진화하면서, 정보 획득의 방법에 있어서 웹과 디지털 기술을 활용하는 전자원문서비스가 활성화되고 있다. 그러나 국내 저작권법상 저작권자의 개별적인 허락없이는 해외 학술자료의 전자원문서비스가 불가능한 실정이다. 이 연구에서는 저작권법 조항의 문제점을 지적하고, 전자원문서비스의 실현을 위한 방안으로 확대된 저작권 집중관리제도의 도입을 검토한다. 확대된 저작권 집중관리제도(ECL)는 집중관리단체가 대리하지 않는 권리자에게로 이용허락계약을 확대시키는 것이다. ECL을 통해 국내 어문저작물의 복제 전송에 대한 저작자의 권리를 신탁관리하는 (사)한국복사전송권협회가 해외 학술자료의 이용에 대해서도 사용승인 및 사용료 징수 등의 역할을 수행하며, 이를 통해 도서관은 진정한 전자원문서비스를 실현할 수 있을 것이다. 전자원문서비스를 통해 저작권의 합리적인 준수는 물론, 학술정보 유통 활성화에 기여함으로써 궁극적으로 국가 경쟁력 제고를 도모할 수 있을 것이다.

정보통신 및 인터넷의 급속한 발전으로 디지털 콘텐츠의 유통이 활발해지고 있으나 디지털, 콘텐츠에 대한 서비스 방식이 위치정보를 가지고 서비스하는 URL(Uniform Resource Locator)방식의 문제점과 기존의 물리적인 저작물r이 디지털 콘텐츠로 전환되면서 기존의 식별자로는 디지털 콘텐츠의 특성을 충족시키는 식별이 미흡하고 한계가 있다. 따라서, 해외 주요 디지털 콘텐츠 서비스기관의 식별체계 활용사례를 분석하고 그 결과를 토대로 한국과학기술정보연구원(KISTI) 고유 식별자인 KOI(Kisti Object Identifier)를 개발하고 개발된 KOI를 기반으로 과학기술분야 전자원문 연계시스템을 설계 및 구현하였다.
