해양사고는 많은 인명과 재산의 피해를 초래하고, 특히 유조선과 같은 위험물운반선의 사고는 대형오염사고를 수반하게 되어 연안국에 막대한 해양환경 피해를 주게 된다. 이러한 외국적 기준 미달선에 의한 해양사고 예방을 위한 항만국 PSC 점검 시 해당선박에 대한 PSC 결함항목 Checklist와 결함항목과 관련된 국제협약 근거를 즉시 제공함으로써 PSC 점검율 제고를 통한 우리 항만에서의 해양사고 예방 및 해양환경을 보호하기 위한 PSC 점검지원 서비스에 대한 연구를 하였다.

ECDIS(Electronic Chart Display and Information System 전자해도정보시스템)와 같이 진보된 IT 기술을 적용한 항해장비는 단순히 항해의 목적으로 사용하는 것 이상으로, 해양환경의 보호와 감시에 응용하는 등의 방법으로 그 활용범위를 직접적이고 적극적으로 확대할 수 있다. 종이해도와 달리, ECDIS는 '시간'이라는 4차원적 요소를 도입함으로써 동적시스템(Dynamic System)으로 전환이 용이하다. 이것은 조석, 조류, 바람과 파도와 같은 시간변수(Time Variables) 데이터를 적용함으로써 가능하다. 이 시간변수들을 어군이동위치, 계절변화에 따른 해저지형, ballast water의 취수를 위한 청수지역 등과 함께 활용을 한다면, green ECDIS를 활용한 green navigation은 현실화가 가능하다. 이에 따라 해상종사자의 환경인식은 뚜렷하게 그리고 유용하게 증가할 것이다. 본 논문에서는 green ECDIS의 개념과 모형의 설계 그리고 프로토타입의 개발을 제안하고자 한다.

In the field of environmental protection, close co-operation between Contracting Parties is strongly required and the reporting obligation under MARPOL 73/78 is playing an important role as a part of international co-operation for the environmental protection. In this paper, I review the meaning of reporting obligation under MARPOL 73/78 from the perspective of the international law, and investigate the status of implementation for the reporting obligation. For this purpose, I analyze status of implementation for last 10 years from 2001 to 2010 regarding reporting obligations under MARPOL 73/78 in accordance with MEPC/Circ.318. Finally, I suggest the way forward to improve Contracting Parties' compliance with reporting obligations through this analysis.

국제간 정보통신전달 수단으로 인공위성과 해저케이블이 상호보안적으로 사용되어 왔다. 특히 최근에 와서는 해저 광케이블의 등장으로 국가간 정보통신전달 수단으로 케이블의 역할이 급격히 증대되고 있다. 해저케이블은 열악한 해양환경에 노출되어 있으므로 건설시나 운용중에 손상 받을 가능성이 아주 크며 그로 인한 파급효과가 엄청나다. 또한 해저케이블 사고시 복구에 많은 시간과 어려움이 뒤따르며 비용도 막대하다. 따라서 해저케이블의 안전성을 확보하는 것은 매우 중요하며 이에 대한 보호대책이 절실하다. 본 논문에서는 해저케이블의 건설 및 운용상에 발생할 수 있는 여러 불안전 요인들을 찾아 그에 대한 대책방안을 고찰해 보고자 한다.

해양환경문제는 지역적으로 시작하여 광역적으로 확산되기 때문에 지방정부에서 사고 시에 신속하게 대응하고 상시에 사전예방적으로 관리하는 것이 중요하다. 현행 해양환경관리는 대부분 중앙정부가 담당하고 있기 때문에 지방정부의 역할을 보다 강화할 필요가 있다고 본다. 본고는 역대 부산광역시의회 안건처리일람을 분석함으로써 해양환경관리 부문에 있어서 지방의회의 역할을 분석하고자 하였다. 이는 지방정부 정책형성과정의 공식적 참여자로서, 또한 지역주민의 의견을 수렴하는 대표기관으로서 지방분권 시대에 그 중요성이 점차 높아지고 있는 지방의회의 역할을 되짚어 본다는 측면에서 의미가 있다고 하겠다.

In this study, I present solutions to properly regulate assembly and demonstration at sea which has not been relatively secured and regulated compared to that of on land and inland waters so it may not violate public safety and order, and at the same time to secure it as a basic human right. Firstly, to protect and regulate in the same way with assembly and demonstration on land, I suggest to make amendments to "Law on Assembly and Demonstration" so that Korea Coast Guard Station can accept applications and administrator maritime assembly and demonstration. Secondly, in special cases where there are difficulties in the application of "Law on Assembly and Demonstration" due to the special maritime environment, following the example of Japan, America and England who have regulations in related special laws, I suggest an legislative alternative to add regulations on maritime assembly and demonstration in "Law on Maritime Guard" so that we can administer maritime assembly and demonstration in a way which there should be no conflict between basic human right of people and conservation of public safety.
