Application Range of "Temporary Alteration" in the Article 10 of Ship Safety Act (항만건설작업선의 선박안전법 제10조제3항(임시변경) 적용범위에 관한 연구)

  • The Ship Safety Act prescribes matters necessary for the maintenance of seaworthiness and safe navigation of ships. In this regard, Article 10 of this Act requires shipowner to undergo occasional survey if he/she wants to temporarily change intends to modify the details entered in a ship survey certificate. Such measures are in accordance with the maintenance of the state of the ship after the ship inspection under Article 15 of this Act, and this Act includes "harbor construction work ship" under Article 39 Paragraph (1) of the Harbor Act. However, although the harbor construction work ship originally showed the same operating system as the barge, it was not applied to the Ship Safety Act and was registered and surveyed under the Construction Machinery Management Act. Then "Seokjeong No. 36" sinking accident in Ulsan on December 14, 2012, led to the amendment of the Harbor Act in 2016, and considering the fact that it was added to the Ship Safety Act and applied, there is a realistic limit to applying all the regulations stipulated in the Ship Safety Act to the harbor construction work ship. Accordingly, this study discusses the work characteristics through concept, registration, work area, survey regulations, application case of temporary alteration etc. of harbor construction work ships and controversial issues related to the scope of application of the Ship Safety Act of actual harbor construction work ships, and also the appropriate scope of "temporary alteration" among temporary inspections prescribed in Article 10 of the Ship Safety Act in consideration of the legislative purpose of incorporating harbor construction work ships into the survey subject to the Ship Safety Act in accordance with the revision of the Harbor Act.

Private Finance under the Port Authority System in Korea (항만공사체제하의 민간자본 활용방식)

  • Korean port developments have been mostly made by the central government. With the introduction of the Port Authority system, however, roles and function assignments of the central government in port development have been in change and the Port Authority has to find a solution for inducement of private investment in port development. This paper has examined the current legal system of port developments and then sought the way for inducement of private capital to improve specialty and efficiency of harbor facilities management and development under Port Authority. As the Ministry of Maritime Affairs and fisheries(MMAF) has two types of legal system for inducement of private investment on port developments, the Port Authorities can also have two types of private finance. Private finances by the Port Authorities has some more critical advantages than the one by the central government. It is also required to change the the administrative permissions and concession agreements which MMAF conveyed to private participants in port developments into the concession agreements between Port Authorities and private participants.

  • 당해 항만의 장기개발방향을 제시하는 항만종합개발계획(Port Master Planning; PMP)은 향후 해당 항만의 확충 정비 개발을 위한 기본계획이나, 계획의 실행단계에서 많은 한계에 봉착하게 된다. 이 연구에서는 전통적인 PMP의 한계점을 분석한 후, 미래의 불확실성에 대응하기 위한 적응계획(adaptive planning) 방법론을 검토하고, 로테르담항만의 적응계획법 적용 사례 소개 및 시사점을 도출하여, 우리나라 항만개발계획의 견실성과 적응성을 제고할 수 있는 방안을 제시하였다.

  • A Port Authority system has been regarded as one of the efficient ways of port management. The Korean government is thus now planning to set up such a system into the Busan Port. Busan New Port is located in Kadok Island but divided Busan and Kyongnam administrative district, so complicated in the appropriate selection to Busan New Port Administration. The research method which was used in this study accounted for overlapping between attributes, and introduced the HFP( Hierarchical Fuzzy Process) method that can perform an operation.

Overall Analysis of Competitiveness of Asian Major Ports Using the Hybrid Mechanism of FCM and AHP (FCM법과 AHP법을 융합한 아시아 주요항만의 경쟁력에 관한 종합적 분석에 관한 연구)

  • The aim of this research is to overall analyze/classify characteristics of Asian major ports. To achieve this aim, we firstly pointed out critical problems on research methodology and research scope which most of previous research have, from related literature review. In order to overcome those problems, major ports in A냠 were selected by the objective indicators, and both algorithms of AHP(Analytic Hierarchical Process) and FCM(Fuzzy C-Means) that revise weakness in previous clustering method were used. Through these hybrid approach, it were found that only 10 ports of 16 major Asian ports had their own phases in Asian major ports. Those 10 ports were classified into 6 port groups, and also membership degree of each port within the 4 port groups and ranking of each ports seer analyzed. Finally, based on results of these analysis, present status and future direction of Busan port were discussed.

  • 항만법 제92조 및 항만법 시행령 제91조에 따라 항만관리에 관한 권한을 지방청 및 지자체에 위임하고 있으나, 연안항의 경우 관리주체인 지자체가 지역민들의 이해관계, 항만관리 인력 및 전문지식 부족 등에 따라 적극적인 항만관리를 수행하지 못하고 있는 형편이다. 본 연구에서는 해상교통안전진단 사례연구를 통해 우리나라 연안항 항만관리 실태와 문제점을 분석하고 제도개선 등 해결방안을 제시하였다.

  • This paper proposes an evaluation to Target Factor Values of Port State Control Inspections(PSCITFV) using AHP because PSCITFV is very simple methode, This AHP is the more rational and objective methode than existing TFV methode. AHP is relative measurement., but, weights should be re-calculation whenever alternative plan add. To this solve, therefore, this paper, used an absolute measurement and involved an marine casualty factor in PSCITFV, that IMO go ahead with it., Also, accomplished with evaluation some ships for the practice.

An Application of FCM(Fuzzy C-Means) for Clustering of Asian Ports Competitiveness Level and Status of Busan Port (FCM법을 이용한 아시아 항만의 경쟁력 수준 분류와 부산항의 위상)

  • Due to the changes of shipping and logistic environment, Asian ports today face severe competition. To be a mega-hub port, Asian ports have achieved a big scale development. For these reasons, it has been widely recognized as an important study to analyze and evaluate characteristics of Asian ports, from the standpoint of Korea where Busan Port is located. Although some previous studies have been reported, most of them have been beyond the scope of Asian ports and analyzed the world's major ports; moreover, the studied ports have been about the ports which are well known from the previous research and reports. So, most studies is unlikely to be used as substantial indicators from the perspective of Busan Port. In addition. most of the existing studies have used hierarchical evaluation algorithm for port ranking, such as AHP (analytical hierarchy process) and clustering analysis. However, these two methods have fundamental weaknesses from the algorithm perspective. The aim of this study is to classify major Asian ports based on competitiveness level. Especially. in order to overcome serious problem of the existing studies, major Asian ports were analyzed by using objective indicators. and Fuzzy C-Means algorithm, which alleviates the weakness of the clustering method. It was found that 10 ports of 16 major Asian ports have their own phases and were classified into 4 port groups. This result implies that some ports have higher potential as ports to lead some zones in Asia. Based on those results. present status and future direction of Busan port were discussed as well.

선진 항만공사 모델을 고려한 국내 항만관련법령 개선방안 기초연구

  • 항만공사의 운영 효율성과 자율성을 강화를 통해 국가 및 지역발전 기여 요구가 꾸준히 제기되고 있다. 이 연구는 선진 항만공사 도델(미국 PANYNJ, 싱가포르 PSA)을 살펴보고, 국내 항만관련법령 상의 항만공사의 역할과 한계를 분석하였다. 이를 통해 항만공사의 자율성을 강화하고, 글로벌 항만기업으로 육성하기 위한 제도개선 및 정책제언을 위한 기초연구의 토대를 제공코자 한다.
