The Improvement Measurement on Dispute Resolution System for Air Service Customer (항공서비스 소비자 분쟁해결제도의 개선방안)

  • In 2017, 1,252 cases of damages relief related to air passenger transport service were received by the Korea Consumer Agency, a 0.8% drop from 1,262 cases in 2016, the first decline since 2013. In 2017, 444 cases (35.4%) out of received cases of damages relief in the field of air passenger service received by the Korea Consumer Agency were agreed on, and out of cases that were not agreed on, the most number of 588 cases (47.0%) were concluded due to information provision and counseling, and 186 cases (14.9%) were applied to the mediation of the Consumer Dispute Mediation Committee. Major legislations that contain regulations for the damages relief and disputes resolution of air service consumers include the Aviation Business Act and the Consumer Fundamental Act, etc. The Aviation Business Act provides the establishment and implementation of damage relief procedure and handling plan, and the receiving and handling of request of damage relief by air transport businessman, and the notice of protection standard for air traffic users. The Consumer Fundamental Act provides the establishment and management of the consumer counseling organization, the damage relief by the Korea Consumer Agency, the consumer dispute mediation, and the enactment of the criteria for resolving consumer disputes. The procedures for damages relief of air service consumers include the receiving and handling of damages relief by air transport businessman, the counseling, and receiving and handling of damages relief by the Consumer Counseling Center, the advice of mutual agreement by the Korea Consumer Agency, and the dispute mediation system by the Consumer Dispute Mediation Committee. The current system of damage relief and dispute mediation for air service consumer have the problem in the exemption from obligation of establishment and implementation of damage relief plan by air transport businessman under the Aviation Business Act, the problem in the exemption from liability in case of nonfulfillment and delay of transport by aviation businessman under the criteria for resolving consumer disputes in the aviation sector, and the uppermost limit in procedure progress and completion of consumer dispute mediation under the Consumer Fundamental Act. Therefore, the improvement measurements of the relevant system for proper damage relief and smooth dispute mediation for air service consumer are to be suggested as follows: First is the maintenance of the relevant laws for damage relief of air service consumer. The exemption regulation from obligation of establishment and implementation of damage relief plan by air transport businessman under the Aviation Business Act shall be revised. To enhance the structualization and expertise of the relevant regulation for protection and damage relief of air service consumer, it will be necessary to prepare the separate legislation similar to the US Federal Regulation 14 CFR and EU Regulation EC Regulation 261/2004. Second is the improvement of criteria for resolving air service consumer disputes. For this, it will be necessary to investigate whether the cause of occurrence of exemption reason was force majeure, and distinguish the exemption from liability in case of nonfulfillment and delay of transport by aviation businessman under the criteria for resolving consumer disputes in the aviation sector, and revise the same as exemption reasons regulated under the air transport chapter of the Commercial Act and Montreal Convention 1999, and unify the compensation criteria for the nonfulfillment of transport that the substitute flight was provided and the delay of transport. Third is the reinforcement of information provision for damage relief of air service consumer. Aviation-related government agencies and concerned agencies should cooperate with airlines and airports to provide rapidly and clearly diverse information to the air traffic users, including laws and policies for damages relief of air service consumers. Fourth is the supplement to the effectiveness, etc. of consumer dispute mediation. If there is no sign of acceptance for dispute mediation, it is not fair to regard it as acceptance, therefore it will be necessary to add objection system. And if a dispute resolution is requested to another dispute settlement agency in addition to the Consumer Dispute Mediation Committee, it is excluded from the damage relief package, but it should be allowed for the party to choose a mediation agency. It will be necessary to devise the institutional measures to increase the completion rate of mediation so that the consumer dispute can be resolved efficiently through the mediation. Fifth is the introduction of the air service consumer arbitration system. A measure to supplement the limitations of the consumer dispute mediation system is to introduce the consumer arbitration system, but there are two measurements which are the introduction of the consumer arbitration under the Consumer Fundamental Act and the introduction of the consumer arbitration under the Arbitration Act. The latter measurement is considered to be appropriate. In conclusion, as a policy task, the government should prepare laws and system to enhance the prevention and relief of damages and protection of the rights and interests of air service consumers, and establish and implement the consumer-centric policy for the advancement of air service.

  • The immigration procedure at airports is vital to making passenger and cargo transport faster. The rapid procedure of immigration could be an important determining factor when passengers select an air transport company, one that should have high satisfactory in terms of their service level and efficiency. Therefore, the advanced airport makes it easy for customers and their cargo to proceed. The coordination between authorities related to the Korean international airport is not satisfactory for customers. This paper analyzes the factors necessary to enhance the airport immigration procedure with the movement of aircrafts, passengers, cargo, and post, using the CK(Cook and Kress) model of DEA(Data Envelopment Analysis). From this study, the author found that research and development will be needed to improve the immigration procedure, especially on facilities and their operating systems. There are needed, also, performance indicators and a continuous monitoring system.

  • IATA is playing a central role in the process of changing the international technical standards of common-use system which supports the airport check-in and boarding business in conjunction with the airline systems from CUTE to CUPPS. IATA expects that if the airport common-use system is changed to CUPPS, the development and maintenance costs related to the airline's common-use system can be reduced by the implementation of the standard interface about check-in and boarding business-related equipment and the certification of airline applications. Incheon International Airport is in the face of stiff competition with major Northeast Asian Airports to attract more airlines. To be more competitive than other airports, switching over to CUPPS is vital for airline's cost-saving effect. This study builds on CUPPS international technical standards and suggests design and implementation plans of Incheon International Airport's component-based next-generation common use passenger processing systems to support the various functions of user's requirements.

  • Gwangju Airport and Muan International Airport are planned to merge in 2021 while the aviation market is suffering an unprecedented prolonged crisis due to COVID-19 and therefore it is necessary to revitalize the airport to keep up with the passenger's demands. The study conducts an empirical research survey on the passengers of both airports regarding the importance, satisfaction, and overall satisfaction to derive a strategic marketing direction. The results show that to establish a strategic marketing direction, an urgent improvement is required for all "Commercial Facility and Diversity," "Rest Facility and Comfort," "Facilities for the Transportation Vulnerable," "Latest Facility" factors, and "Air Route Diversity." On the other hand, it is required to stop further investing and improving in "Publicity and Marketing" and "Flight Schedule". The results of this study demonstrate academic and practical importance through the comparison of two IPA models, based on Gwangju Airport and Muan International Airport before their integration, to provide substantive and meaningful marketing strategies.

  • The basis for planning airport development is the specific demand at peak hour among various aviation demands. The demand at peak hour is regarded to be the source which enables us to estimate the size requirement and capacity of an airport facility. The distribution type of peak hour-operation depends on the difference of aircraft route, geographical location of airport, passengers and cargo. The demand at peak hour is calculated with peak hour factor. So far, the features of peak hour adopted for domestic airport construction plan have been based on the foreign research results. However, it is officially unconfirmed whether the various peak hour characteristics or peak hour factor suggested from foreign studies can be compatible with Korean state or not. In this study, the aircraft operation pattern and the peak hour characteristics are analyzed with hourly data using the operation schedule of an airport for the last 5 years and the actual result statistics of Korean air transportation by airport through the recent 10 Years. After the peak hour factor of the airports is calculated and compared with existing research results, peak hour factor by annual operation frequency is suggested for Korean airports.

  • In developing avionics systems, safety analysis and evaluation specified in SAE ARP4761 (Methods and Guidelines for Civil Aviation System and Equipment Safety Assessment Process) are carried out to prevent air accidents. Safety analysis requires knowledge of the abnormal state of the system, not its normal state, and its interrelationships with other standards. Therefore, a tool that automatically outputs data which proves compliance with safety certification standards is required. In this study,In this study, Schematized the safety analysis procedure of the specification and studied the method of applying the safety analysis CAD tools to individual procedure. As an example study, ARP4761 analysis was performed on the wheel brake system (WBS) of the ARP4761 appendix.

Effects of Customer Satisfaction by Airline e-Services (항공사 e-서비스가 고객 만족도에 미치는 영향)

  • With the development and generalization of internet and information technology, airlines has tried to reduce their business expenses and commissions to travel agencies and enhance service qualities through service automation and simplification, such as internet booking and ticketing, self check-in, in-flight internet and RFID for checked baggage. The statistical techniques conducted for this empirical analysis are frequency analysis, reliability analysis, factor analysis, confirmatory factor analysis and multiple regression analysis. This research has tried to examine factors of airline e-services that influence on recommendation re-purchase intention and satisfaction. Results has found that only on-line reservation and ticketing factor had significant effect for recommendation and re-purchase intention and all e-service factors produced significant effect to total satisfaction. It was also recommend that airlines have to provide easy and more familiar e-service system to their passengers to deliver better services.

  • There are keen competitions among the air operators to recruit competent pilots, which could be adversely affect the safe operation of aircraft. This study is aimed to identify the correlation between the flight experience of the pilot of the air transport operator and competency on visual approach operation. About 2,400 sets of flight training data of several pilots of an air transport operator was analysed for this study. The analysis showed that most captains were able to make stabilized visual approach regardless of his/her flight experience of any type of aircraft, while the first officers were able to make a stabilized visual approach with more than 1,500 hours of flight experience for each rated type of aircraft. This should be considered during making policies for the supply and demand of pilots for the safe operation of air transport.

Study on the Legal Issues of New Draft of Civil Aviation Law in China (중국 민용항공법 개정 최근 동향과 주요 법적쟁점)

  • During more than 20 years of practice, Civil Aviation Law has experienced three times of amendments since it was enacted in 1995. But these revisions are limited to the technical level. The problems and limitations have become increasingly prominent in its implementation. Firstly, the civil aviation law is the result of interests game among several departments and some legal issues was left behind and the regulation was very vague as a result. Secondly, the process of aviation legislation is the process that the country has undergone profound changes and social transformation. The 20 years is long enough for the society to undergo tremendous changes and 1995 version of civil aviation law does not keep pace of development of economy. There was a serious lag between reality and the law. In order to actively promote the development of the aviation industry and overcome implementation issues of the Civil Aviation Law, Civil Aviation Administration of China (CAAC) initiated modification procedure the law and published new draft of Civil Aviation Law in August 2016. The spirit of this modification is to learn and absorb new achievements of domestic and foreign legislation and the International Convention on civil aviation. Furthermore, the purpose of the revision is to provide favorable policy for the development of civil aviation industry and improve aviation safety and supervision, strengthen and protection of consumer rights and interests, to enhance the safety of civil aviation activities, and promote the development of general aviation. This revision concerned to the 78 articles which are revised or deleted and 24 articles added. The highlights of the draft include but not limited to the enhancement of security management, clarification of the main responsibility for production safety. And also it added the provisions related to the construction of effective tracking capability of public air transport enterprises and license system on the transport of dangerous goods. Compared with the existing civil aviation law, the draft has made a great improvements. But there are several deficiencies and limitations in the drafts. These problems need to be supplemented and perfected through further amendments in near future.

KTX Impact on the Inter-Regional Transportation System (고속철도 개통후 지역간 교통체계의 변화)

  • To relieve congestion in the current system of intercity transportation, the Korea decided in 1990 to construct a high-speed railroad between Seoul and Busan and it is now in operation. This new mode of transportation significantly cut travel time between major cities and a trip from Seoul to the southeastern port of Busan. Since the KTX opening, average daily passenger numbers on both the Gyeongbu and Honam lines have increased about 1.3 fold over 2003 levels. As of December 2004, the KTX trains are carrying about 81,000 people a day. On KTX routes, the daily number of airline passengers dropped. Express long-distance bus traffic also dropped by 20% to 30%, while that on short-distance routes (100km or less) increased by about 20%. These figures clearly indicate that the Korean transportation network is becoming railroad-centric. However, the number of KTX passengers is fewer than anticipated possibly due to the Korean economic downturn and the operation of the KTX will leave many existing Saemaul and Mugunghwa train sets idle, which will be put into operation for areas, not covered by the KTX. When all the existing major lines have been electrified, more high-speed rail services will be phased in using direct connections to maximize operational efficiency. And also, the dual management by KTX and conventional rail will be regarded as the promotion of the benefit of the public.
