IT 와 비즈니스가 융합화 되고 정보가 디지털화 됨에 따라 그에 대한 저장매체도 점점 더 다양해지고 있다. 그 중 이동성이 편리하고 휴대하기 간편한 스마트폰을 활용하여 개인 정보를 주고 받고 이를 이용한 비즈니스가 현재 활발히 진행되고 있다. 이러한 소셜 네트워크 서비스 이용이 급격히 증가함에 따라 개인 정보 보안에 대한 중요성은 점점 더 강조 되고 있는 실정이다. 본 연구에서 제안하는 디지털 포렌식 분석 방법을 이용하면 스마트폰에서 지원하는 서비스 형태에 따라 텍스트, 이미지, 동영상 등의 개인 정보를 수집 및 분석이 가능하다. 또한 디지털 포렌식의 관점에 따라 스마트폰 에서 사용되고 있는 애플리케이션의 로그 정보를 수집 및 분석함으로써 스마트폰의 저장 장치에 남겨진 기록들을 훼손 없이 그대로 보존시키고 디지털 증거 자료로 활용이 가능해 사이버 범죄에 대한 신속한 해결이 가능하다.

Smartphones along with the development of crime evidence has been using smartphones. Phone's internal storage medium can be used as evidence in the case of images, video, phone, GPS information, there are Internet access and other data records. Therefore, these data to collect evidence of a systematic procedure for collecting and analyzing evidence is needed. In this paper, the target mobile phone forensics forensic evidence collection, evidence analysis, and reporting results to the procedures and how to draw. Through this paper, phone forensics and will serve as a basis for the investigation.

The fact of smoking is prohibited in elevators. Smoking in elevators that contrary to business ethics, and it can be fatal to our children and women. In this paper, people who smoke in elevators is submitted to forensic evidence. Method is to extract the white bar at the mouth, biting people that smoke. ${\chi}^2$ histogram of scene change detection method is extracted.

본 논문에서는 그동안 축적된 디지털 증거 관련 판례를 분석하여 디지털 증거가 법정에서 유효하게 사용될 수 있는 증거 능력 요건을 검토하였다. 법정에 제출된 디지털 증거가 증거능력을 인정받기 위해서는 다음과 같은 요건을 충족해야 한다. 첫 번째 요건으로서 적법하게 수집된 증거이어야 한다. 영장주의에 위반하거나, 압수수색절차에 피압수자의 참여권을 보장하지 않은 경우에는 증거의 증거능력이 인정되지 않는다. 또한 그동안 논란이 되었던 별건정보도 앞서 살펴본바와 같이 대법원이 제시한 요건을 충족해야 한다. 두 번째 요건으로는 법정에 제출된 디지털 증거의 진정성이 인정되어야 한다. 대법원은 디지털 증거의 진정성이 인정되기 위해서는 무결성과 동일성, 신뢰성이 인정되어야 한다고 판시한바 있다. 세 번째 요건으로 법정에 제출된 증거가 전문증거인 경우에는 당사자의 동의가 없는 한 전문법칙의 예외에 해당되어야 한다. 2016년 5월 형사소송법 제313조가 개정되기 전에는 법정에 제출된 디지털 증거를 진술자가 진정성립을 부인하는 경우, 해당 문서가 업무상 필요로 작성한 통상문서나 기타 특히 신용할 만한 정황에 의하여 작성된 문서에 해당되지 않는 한 증거능력을 인정받을 수 없었다. 그러나 형사소송법 제313조 제2항의 개정으로 인하여 이제는 진술자가 진정성립을 부인하는 경우에도 "과학적 분석결과에 기초한 디지털 포렌식 자료, 감정 등 객관적 방법"에 의해 성립의 진정을 인정받을 수 있다. 과학적 분석결과에 기초한 디지털 포렌식 자료, 감정 등 객관적 방법에 대한 구체적인 내용은 앞으로 판례를 통해 정립해 나아가야 할 것이다.

The proof of a cellular phone used to a crime important data of a criminal investigation and legal judgment become. The results of investigations into marine incidents have become an important basis in determining not only possible causes, but also the extent of negligence between the perpetrator and victim. However, marine incidents occur under special circumstances i.e. the marine environment, and this leads to difficulties in identifying causes due to problems in scene preservation, reenactment and acquisition of witnesses. Given the aforementioned characteristic of marine incidents, the International Convention for the Safety of Life at Sea (SOLAS) has adopted mandatory regulations on the carriage of Voyage Data Recorders (VDRs) and Automatic Identification Systems (AIS) for ships of a certain gross tonnage and upwards, so as to reflect recent developments in radio communication and marine technology. Adopted to provide an international standard for investigations and to promote cooperation, the Code of the International Standards and Recommended Practices for a Safety Investigation into a Marine Casualty or Marine Incident (Casualty Investigation Code) recommends member states to build capacity for analysis of VDR data. Against this backdrop, this paper presents methods for efficient investigations into the causes behind marine incidents based on data analysis of VDR, which serves as the black box of ships, as well as digital forensic techniques.

Korea's seas have the potentials of dispute against China or Japan due to the overlap of the territorial waters and EEZ. In case of marine accidents, the nature of the sea tends to eliminate much of the track, making it another hardship in evidence adoption in case of an international dispute along with the false entries of fishing vessels' journals. Marine Digital Forensics Protects the functions of computers and IT appliance on vessels and extracts evidence of voyage and accidents to resolve international dispute. The digital evidence, if tampered with its integrity, my lead to the rejection to a critical claim or may even fail to make a case. As a solution, this thesis suggests Marine Digital Forensics as a way to extract evidence and prove a claim. This may be utilized as means of scientific investigation on sea as overseas exchange increases and the vessels digitalize, leading to a solution in international disputes that may occur in the future.

With the rapid development of information and communication technology, mobile devices have become an essential tool in our lives. Mobile devices are used as important evidence in criminal proof, as they accumulate data simultaneously with PIM functions while working with users most of the time. The mobile forensics is a procedure for obtaining digital evidence from mobile devices and should be collected and analyzed in accordance with due process, just like other evidence, and the integrity of the evidence is essential because it has aspects that are easy to manipulate and delete. Also, the adoption of evidence relies on the judges' liberalism, which necessitates the presentation of generalized procedures. In this paper, a mobile forensics model is presented to ensure integrity through the generalization of procedures. It is expected that the proposed mobile forensics model will contribute to the formation of judges by ensuring the reliability and authenticity of evidence.
