위탁증거금(委託證據金)의 변경(變更)이 주가변동율(株價變動率) 및 주가(株價)의 잠정적(暫定的) 구성부분(構成部分)에 미치는 영향(影響)에 대한 실증적(實證的) 고찰(考察)

  • 증권거래소(證券去來所)는 시황에 따라 위탁증거금율(委託證據金率)을 탄력적으로 변경 운용함으로써 시장의 수급을 조절하는 등의 시장관리수단의 하나로 이용하여 공정한 시세형성을 기하고자 설립시부터 증권회사로 하여금 매매의 위탁시 위탁증거금을 징수하도록 규정하고 증거금율을 상황에 따라 신축적으로 운용하여 1962년 이후에만도 무려 32회이상 변경하였다. 따라서 문제의 핵심은 위탁증거금징수가 주식시장에서의 과잉투기행위를 근절시키고 주가변동율(株價變動率)(stock volatility)을 감소시켜 공정거래질서(公正去來秩序)를 확보하는데 기여하고 있는지의 여부가 된다. 이 점은 특히 미국(美國)에서 1987년 10월 소위 '검은 월요일(Black Monday)'당시 갑작스러운 주가폭락과 시장체계의 붕괴사태이후 금융시장의 발전을 모색하는 정책당국자들과 학자들사이에 새로운 주목을 받기 시작하였다. Salinger(1989)와 Schwert(1989)는 위탁증거금율(委託證據金率)의 변경과 주가변동율(株價變動率)의 감소와는 아무런 인과관계가 없다고 결론을 내리고 있다. 특히 Schwert는 거래일시중단시책마저도 주가변동율에 별 효과가 없다고 주장하면서 금융공황과 관련된 거래일시중단은 주가변동을 큰 폭으로 증가시켜왔으나 금융공황을 동반하지 않은 기래일시중단은 높은 주가변동율과 무관함을 밝히고 있다. Hardouvelis(1991)는 그러나 위탁증거금율을 상승시키면 주가변동율이 낮아지며, 결과적으로 주가가 본원적가치(本源的價値)로부터 일탈하는 현상도 줄어든다는 사실을 통계적으로 입증하고, 위탁증거금의 징수가 시장을 교란하는 악성투기행위를 억제시키는데 매우 효과적인 정책수단이라고 주장하고 있다. 본 연구는 우리나라 주식시장에서 과잉투기현상을 억제하여 시장의 안정을 확보하는 기능으로서의 위탁증거금제도에 대해 그 경제적 효과여부를 규명하는 실증분석을 행하였다. 이 논문에서는 Schwert(1989)와 Hardouvelis(1991)의 방법을 원용하여 두가지 서로 다른 방법으로 주가변동율을 측정하여 비교하였다. 통계적 기법은 기본적으로 다변량(多變量) 회귀분석법(回歸分析法)을 택하였다. 분석의 결과로 매우 흥미로운 실증상(實證上)의 규칙성(規則性)을 발견하였다. 즉 현금시장(cash market)의 위탁증거금율이 높아지면 실제주가변동율(實際株價變動率)과 초과주가변동율(超過株價變動率)이 감소되고, 또한 유행(流行)의 경우와 마찬가지로 본원적 가치로부터의 괴리가 작아진다. 이 결과에 따르면 위탁증거금의 징수는 그 제도의 취지에 부합되고 있다. 다만 제도운용상의 이유이거나 혹은 우리나라 주식시장의 투자자들이 비합리적인 투자형태를 보임에 따라 그 정책적 효과는 때로 역기능적인 결과로 초래하였다. 그럼에도 불구하고 이 연구결과를 통하여 최소한 주식시장(株式市場)에서 위탁증거금제도는 그 제도적 의의가 여전히 있다는 사실이 확인되었다. 또한 우리나라 주식시장에서 통상 과열투기 행위가 빈번히 일어나 주식시장을 교란시킴으로써 건전한 투자풍토조성에 저해된다는 저간의 우려가 매우 커왔으나 표본 기간동안에 대하여 실증분석을 한 결과 주식시장 전체적으로 볼 때 주가변동율(株價變動率), 특히 초과주가변동율(超過株價變動率)에 미치는 영향이 그다지 심각한 정도는 아니었으며 오히려 우리나라의 주식시장은 미국시장에 비해 주가가 비교적 안정적인 수준을 유지해 왔다고 볼 수 있다.

Tech Development - 컴퓨터 포렌식 도구를 이용해 가치있는 증거를 수집하자

  • 컴퓨터 포렌식은 사고와 관련된 시스템을 조사해 범죄에 이용된 증거를 수집해 입증하는 분야이다. 국내에서는 아직 증거수집에 대한 프로세스가 공개되지 않고 있는데, 그 이유는 일반기업에서 해당 업무를 수행할 권한이 없기 때문이다. 이에 반해 해외의 경우, 해당 프로세스에 대한 'Rfc3227(http://www.ietf.org/rfc/rfc3227.txt)' 지침이 마련돼 있으며, 이것은 IETF(The Internet Engineering Task Force)의 BCP(Best Current Practice)로 등록돼 있는 표준화 절차다. 이는 증거수집 및 보관이라는 업무가 반드시 사법적인 권한을 가지고 수행해야 하는 업무가 아니라, 사고가 발생한 시스템에 대한 원인을 파악하고 재발 방지를 위한 목적을 가지고 있기 때문이다. 위와 같은 목적으로 국내에서는 딱딱한 컴퓨터 포렌식이 아닌 현업에게 활용 가능한 컴퓨터 포렌식에 대해 정리해 보고자 한다.

Students' Responses on the Supporting or Conflicting Evidences on Thier Preconception (학생 선개념을 지지하는 증거와 반증하는 증거에 대한 학생의 반응)

  • This study was to identify middle school and college of education students' preconceptions about dielectric polarization and explore the students' reponses on the supporting or conflictual evidences on their preconceptions by letting them observe the demonstrations using electroscope, charged material, six conductor rods and six insulator rods. Letting students select the demonstrations to be observed by themselves, students' evidence selection types were classified as two : to select the evidences to testify their uncertain preconceptions, and to obtain the confirmation evidences about their preconceptions. And each evidence selection types, again, could be subclassified as three and two respectively. When students observed the conflictual observations, all accepted the observation itself. For supporting observational evidences, almost of all students showed the error of 'acceptance of antecedent' in the syllogism, that is, they did not required the succeeding supporting observations. Students' reponses on the conflictual observational evidences were classified as two: to reject the hard core of preconceptions, and to modify the students' auxiliary ideas related to the hard core with preserving the hard core. The first type reponses were, again, could be classified as three subtypes but, in all cases, students introduced new concept to explain the conflictual evidences. This responses indicated that Lakatosian rather than Popperian view is more acceptable to understand the students' reponses on the conflictual evidences. The second type reponses also were classified as three subtypes, and it was found that more middle school students than college education students were involved in this second type. That is, students who did not have perfect understanding of auxiliary ideas related with the hard core of preconceptions were more apt to change or modify theses auxiliary ideas rather than reject the hard core, this means that the quality of understanding of auxiliary ideas also take an important role in the change of hard core concept.

Epistemological Implications of Scientific Reasoning Designed by Preservice Elementary Teachers during Their Simulation Teaching: Evidence-Explanation Continuum Perspective (초등 예비교사가 모의수업 시연에서 구성한 과학적 추론의 인식론적 의미 - 증거-설명 연속선의 관점 -)

  • In this study, I took the evidence-explanation (E-E) continuum perspective to examine the epistemological implications of scientific reasoning cases designed by preservice elementary teachers during their simulation teaching. The participants were four preservice teachers who conducted simulation instruction on the seasons and high/low air pressure and wind. The selected discourse episodes, which included cases of inductive, deductive, or abductive reasoning, were analyzed for their epistemological implications-specifically, the role played by the reasoning cases in the E-E continuum. The two preservice teachers conducting seasons classes used hypothetical-deductive reasoning when they identified evidence by comparing student-group data and tested a hypothesis by comparing the evidence with the hypothetical statement. However, they did not adopt explicit reasoning for creating the hypothesis or constructing a model from the evidence. The two preservice teachers conducting air pressure and wind classes applied inductive reasoning to find evidence by summarizing the student-group data and adopted linear logic-structured deductive reasoning to construct the final explanation. In teaching similar topics, the preservice teachers showed similar epistemic processes in their scientific reasoning cases. However, the epistemological implications of the instruction were not similar in terms of the E-E continuum. In addition, except in one case, the teachers were neither good at abductive reasoning for creating a hypothesis or an explanatory model, nor good at using reasoning to construct a model from the evidence. The E-E continuum helps in examining the epistemological implications of scientific reasoning and can be an alternative way of transmitting scientific reasoning.

  • Mixture is that DNA profiles of samples contain material from more than one contributor, especially common in rape cases. In this situation, first, the method based on enumerating a complete set of possible genotype that may have generated the mixed DNA profile have been studied for interpreting DNA mixtures. More recently, the methods utilizing peak area information to calculate likelihood ratios have been suggested. This study is concerned with the analysis and interpretation of mixed forensic stains using quantitative peak area information and the method of forensic inference for extension of material from more than or equal to three contributors. Finally, the numerical example will be outlined.

  • There are three ways how to extract forensic evidence from mobile phone, such as SYN, JTAG, Revolving. However, it should be a different way to extract forensic evidence due to the differences of their usage and technology between them(mobile phone and smart phone). Therefore, in this paper, I will come up with extraction method that forensics evidence by search and seizure of a smart phone. This study aims to analyze specifications and O.S., backup analysis, evidence in smart to analyze for search and seizure of a smart phone commonly used google android and windows mobile smart phone. This study also aim to extract forensics evidence related to google android and phone book, SMS, photos, video of window mobile smart phone to make legal evidence and forensics report. It is expected that this study on smart phone forensics technology will contribute to developing mobile forensics technology.

Bayesian concept of evidence (베이즈주의에서의 증거 개념)

  • The old evidence problem raises a profound problem to Bayesian theory of confirmation that evidence known prior to a hypothesis explaining it cannot give any empirical support to the hypothesis. The old evidence problem has resisted to a lot of trials to solve it. The purpose of the paper is to solve the old evidence problem by showing that the problem originated from a serious misunderstanding about the Bayesian concept of confirmation. First, I shall make a brief analysis of the problem, and examine critically two typical Bayesian strategies to solve it. Second, I shah point out a misunderstanding commonly found among Bayesian discussions about the old evidence problem, the ignorance of the asymmetry of confirmation in the context of explanation and prediction. Lastly, 1 shall suggest two different concepts of confirmations by using the asymmetry and argue that the concept of confirmation presupposed in the old evidence problem is not a genuine Bayesian concept of confirmation.

  • In digital computing environment, for the mal functions in appliances and system errors, the unaccepted intrusion should be occurred. The evidence collecting technology uses the system which was damaged by intruders and that system is used as evidence materials in the court of justice. However the collected evidences are easily modified and damaged in the gathering evidence process, the evidence analysis process and in the court. That’s why we have to prove the evidence’s integrity to be valuably used in the court. In this paper, we propose a mechanism for securing the reliability and the integrity of digital evidence that can properly support the Computer Forensics. The proposed mechanism shares and manages the digital evidence through mutual authenticating the damaged system, evidence collecting system, evidence managing system and the court(TTP: Trusted Third Party) and provides a secure access control model to establish the secure evidence management policy which assures that the collected evidence has the corresponded legal effect.

  • Organizations always face the risk of litigation; thus, they should actively prepare for it. In particular, public enterprises must respond to lawsuits carefully to avoid any management risk and possible damage of publicity. Given this, this study aims to identify the relationship between efficient litigation response and record management, determine problems related to record management while utilizing records as evidence, and propose measures to improve record management that uses records as legal evidence. For records to be deemed as legal evidence, RMS is essential to ensure authenticity. Moreover, the ability to secure potential evidence and awareness of the importance of records management needs to be validated. The Commission also stressed the importance of cooperation between archivists and the legal team to efficiently respond to lawsuits.
