재판 외 분쟁해결제도로서의 파트너링 도입에 관한 연구 (A Study of the Introduction and Application of Partnering to the Alternative Dispute Resolution(ADR))

  • 우리나라 건설분쟁에 대한 해결은 재판을 통한 소송을 비롯하여 재판 외 분쟁해결제도인 협상, 중재, 조정을 통해 해결하고 있다. 하지만 건설 분쟁 제기 수가 발주자와 시공자의 인식 변화와 시장 개방, 기업 여건 악화 등으로 계속해서 증가하는 추세에 있다. 이에 본 연구에서는 그 동안의 건설 분쟁에 대한 해결방안이 사후적인 대책에 머물러 있음을 감안하여 사전에 예방하는 방법으로 파트너링 도입안을 제시해 보고자 한다. 미국에서 시작된 파트너링은 현재 분쟁감소와 공기절감, 참여자 상호교류의 증진 등의 효과를 가져왔다. 이에 본 연구에서는 분쟁 감소 방안으로 파트너링에 대한 모델안을 제시하고자 한다.

수자원 사업분야의 갈등해결 방안 (The Settlement of Complication in Water Resources Project)

  • 수자원사업분야 특히, 댐건설사업은 사업시행지역이 유역의 상류인 반면 댐건설의 편익은 주로 하류지역에서 발생하기 때문에 상류지역을 중심으로 극심한 반대가 상존하고 있는 실정이다. 상 하류 지역 주민과 지자체 간에도 댐건설에 대한 입장이 상충되고, 이런 갈등을 정치적으로만 해결하려고 함으로써 갈등의 해결보다는 오히려 새로운 갈등의 원인이 되기도 한다. 또한, 갈등해결을 위한 사회적 합의와 그 합의 결과에 대한 승복의 문화가 정착되지 않은 우리나라에서 갈등해결은 매우 어려운 실정이다. 지난 7년 동안 사회적인 찬반 논란의 중심에 있었던 한탄강홍수조절댐건설에 따른 갈등의 전개과정과 해결노력을 평가 분석하여 봄으로써 향후 수자원사업 분야의 갈등해결에 많은 도움이 될 것으로 본다. 한탄강홍수조절댐은 지난 1999년 결정 이후 2004년 1월부터 11월까지 대통령자문 지속가능발전위원회와 이해 당사자가 참여하는 중재적 갈등조정과정을 거쳤으나, 조정 결과에 대해 승복하지 않음으로써 당사자 합의에 의한 최초의 갈등조정 시도가 무산되었으나 그 해결 노력은 정당하게 평가 받을 만하다. 이후 한탄강댐건설사업은 정부에서 국무총리를 위원장으로 하는 임진강유역홍수대책특별위원회를 구성하여 이해 당사자를 배제하고 관련학회의 전문가 등으로 1년 동안 검증평가한 결과 2006년 8월 한탄강홍수조절댐과 천변저류지로 최종 대안을 제시하였으나, 댐건설 반대지역에서는 아직도 완전히 승복하고 있지 않는 실정이다. 결국 갈등을 해결하기 위해서는 사업계획 수립단계부터 이해 당사자들이 참여하는 협의회 운영으로 절차적 정당성을 확보하고, 한탄강홍수조절댐 갈등해결에 있어서 부족했던 사회적 합의와 승복문화가 정착되도록 제도적인 장치보완과 함께 성숙된 시민의식의 전환이 있어야만 할 것으로 사료된다. 외적으로 하천 유사량 산정과 관련된 많은 경험식들이 제시되고 있다. 하지만, 외국의 충적하천에 기초하여 개발되어진 유사량 공식들을 우리나라 하천에 무분별하게 적용하는 것은 위험스러우며, 유사량 산정 결과의 신뢰성을 높이기 위해서는 무엇보다 우리나라 하천의 지형, 수리, 수문학적 요소들이 유사 특성에 미치는 영향을 알아야 한다. 그러므로, 본 연구에서는 실측을 통한 유사량 값을 하천의 지형, 수리, 수문학적 요소들과 비교 분석하여우리나라 하천에 맞는 유사특성을 알아보고, 기타 총유사량산정 공식을 이용하여 실측한 유사량과 비교 분석하고자 한다.호강유역의 급격한 수질개선을 알 수 있다.世宗實錄) $\ulcorner$지리지$\lrcorner$(地理志)와 동년대에 동일한 목적으로 찬술되었음을 알 수 있다. $\ulcorner$경상도실록지리지$\lrcorner$(慶尙道實錄地理志)에는 $\ulcorner$세종실록$\lrcorner$(世宗實錄) $\ulcorner$지리지$\lrcorner$(地理志)와의 비교를 해보면 상 중 하품의 통합 9개소가 삭제되어 있고, $\ulcorner$동국여지승람$\lrcorner$(東國與地勝覽) 에서는 자기소와 도기소의 위치가 완전히 삭제되어 있다. 이러한 현상은 첫째, 15세기 중엽 경제적 태평과 함께 백자의 수요 생산이 증가하자 군신의 변별(辨別)과 사치를 이유로 강력하게 규제하여 백자의 확대와 발전에 걸림돌이 되었다. 둘째, 동기(銅器)의 대체품으로 자기를 만들어 충당해야할 강제성 당위성 상실로 인한 자기수요 감소를 초래하였을 것으로 사료된

한미자유무역협정(FTA)에 따른 도메인이름 분쟁해결의 개선방안에 관한 연구 (A Study of Domain Name Disputes Resolution with the Korea-U.S. FTA Agreement)

  • As Korea has reached a free trade agreement with the United States of America, it is required to provide an appropriate procedure to ".kr" domain name disputes based on the principles established in the Uniform Domain Name Dispute Resolution Policy(UDRP). Currently, Internet address Dispute Resolution Committee(IDRC) established under Article 16 of the Act on Internet Address Resources provides the dispute resolution proceedings to resolve ".kr" domain name disputes. While the IDRC's proceeding is similar to the UDRP administrative proceeding in procedural aspects, the Domain Name Dispute Mediation Policy that is established by the IDRC and that applies to disputes involving ".kr" domain names is very different from the UDRP for generic Top Level Domain (gTLD) in substantial aspects. Under the Korea-U.S. Free Trade Agreement(KORUS FTA), it is expected that either the Domain Name Dispute Mediation Policy to be amended to adopt the UDRP or the IDRC to examine the Domain Name Dispute Mediation Policy in order to harmonize it with the principles established in the UDRP. It is a common practice of cybersquatters to warehouse a number of domain names without any active use of these domain names after their registration. The Domain Name Dispute Mediation Policy provides that the complainant may request to transfer or delete the registration of the disputed domain name if the registrant registered, holds or uses the disputed domain name in bad faith. This provision lifts the complainant's burden of proof to show the respondent's bad faith because the complainant is only required to prove one of the three bad faiths which are registration in bad faith, holding in bad faith, or use in bad faith. The aforementioned resolution procedure is different from the UDRP regime which requires the complainant, in compliance with paragraph 4(b) of the UDRP, to prove that the disputed domain name has been registered in bad faith and is being used in bad faith. Therefore, the complainant carries heavy burden of proof under the UDRP. The IDRC should deny the complaint if the respondent has legitimate rights or interests in the domain names. Under the UDRP, the complainant must show that the respondent has no rights or legitimate interests in the disputed domain name. The UDRP sets out three illustrative circumstances, any one of which if proved by the respondent, shall be evidence of the respondent's rights to or legitimate interests in the domain name. As the Domain Name Dispute Mediation Policy provides only a general provision regarding the respondent's legitimate rights or interests, the respondent can be placed in a very week foundation to be protected under the Policy. It is therefore recommended for the IDRC to adopt the three UDRP circumstances to guide how the respondent can demonstrate his/her legitimate rights or interests in the disputed domain name. In accordance with the KORUS FTA, the Korean Government is required to provide online publication to a reliable and accurate database of contact information concerning domain name registrants. Cybersquatters often provide inaccurate contact information or willfully conceal their identity to avoid objection by trademark owners. It may cause unnecessary and unwarranted delay of the administrative proceedings. The respondent may loss the opportunity to assert his/her rights or legitimate interests in the domain name due to inability to submit the response effectively and timely. The respondent could breach a registration agreement with a registrar which requires the registrant to submit and update accurate contact information. The respondent who is reluctant to disclose his/her contact information on the Internet citing for privacy rights and protection. This is however debatable as the respondent may use the proxy registration service provided by the registrar to protect the respondent's privacy.

국제상거래 분쟁해결을 위한 온라인 ADR 모델 구축방안 (The Building Plan of Online ADR Model related to the International Commercial Transaction Dispute Resolution)

  • The meaning of Online ADR lies in the prompt and economical resolution of disputes by applying the information/communication element (Internet) to existing ADR. However, if the promptness and economical efficiency are overemphasized, the fairness and appropriateness of dispute resolution may be compromised and consequently Online ADR will be belittled and criticized as second-class trials. In addition, as communication is mostly made using texts in Online ADR it is difficult to investigate cases and to create atmosphere and induce dynamic feelings, which are possible in the process of dispute resolution through face-to-face contact. Despite such difficulties, Online ADR is expanding its area not only in online but also in offline due to its advantages such as promptness, low expenses and improved resolution methods, and is expected to develop rapidly as the electronic government decided to adopt it in the future. Accordingly, the following points must be focused on for the continuous First, in the legal and institutional aspects for the development of Online ADR, it is necessary to establish a framework law on ADR. A framework law on ADR comprehending existing mediation and arbitration should be established and it must include contents of Online ADR, which utilizes electronic communication means. However, it is too early to establish a separate law for Online ADR because Online ADR must develop based on the theoretical system of ADR. Second, although Online ADR is expanding rapidly, it may take time to be settled as a tool of dispute resolution. As discussed earlier, additionally, if the amount of money in dispute is large or the dispute is complicated, Online ADR may have a negative effect on the resolution of the dispute. Thus, it is necessary to apply Online ADR to trifle cases or domestic cases in the early stage, accumulating experiences and correcting errors. Moreover, in order to settle numerous disputes effectively, Online ADR cases should be analyzed systematically and cases should be classified by type so that similar disputes may be settled automatically. What is more, these requirements should reflected in developing Online ADR system. Third, the application of Online ADR is being expanded to consumer disputes, domain name disputes, commercial disputes, legal disputes, etc., millions of cases are settled through Online ADR, and 115 Online ADR sites are in operation throughout the world. Thus Online ADR requires not temporary but continuous attention, and mediators and arbitrators participating in Online ADR should be more intensively educated on negotiation and information technologies. In particular, government-led research projects should be promoted to establish Online ADR model and these projects should be supported by comprehensive researches on mediation, arbitration and Online ADR. Fourth, what is most important in the continuous development and expansion of Online ADR is to secure confidence in Online ADR and advertise Online ADR to users. For this, incentives and rewards should be given to specialists such as lawyers when they participate in Online ADR as mediators and arbitrators in order to improve their expertise. What is more, from the early stage, the government and public institutions should have initiative in promoting Online ADR so that parties involved in disputes recognize the substantial contribution of Online ADR to dispute resolution. Lastly, dispute resolution through Online ADR is performed by organizations such as Korea Institute for Electronic Commerce and Korea Consumer Protection Board and partially by Korean Commercial Arbitration Board. Online ADR is expected to expand its area to commercial disputes in offline in the future. In response to this, Korean Commercial Arbitration Board, which is an organization for commercial dispute resolution, needs to be restructured.

국제상사조정 및 중재제도 개선에 관한 UNCITRAL 논의동향 (Discussion by UNCITRAL for Development of International Commercial Conciliation and Arbitration Systems)

  • At its thirty-second session in 1999, the UNCITRAL had before it the requested note entitled "Possible future work in the area of international commercial arbitration." After concluding the discussion on its future work in the area of international commercial arbitration, it was agreed that the priority items for the working group should be conciliation, requirement of written form for the arbitration and enforceability of interim measures of protection. the Commission entrusted the work to the Working Group on Arbitration which held its thirty-second session at Vienna from 20 to 31 March 2000. The Working Group discussed agenda item 3 on the basis of the report of Secretary General entitled "Possible uniform rules on certain issues concerning settlement of commercial disputes : conciliation, interim measures of protection, written form for arbitration agreement." At its thirty-three session in 2000, the UNCITRAL had before it the report of Secretary General on agenda item 3 discussed by the Working Group. The Working Group discussed the issues relating to certain aspects of conciliation proceedings ; (1) Admissibility of certain evidence in subsequent judicial or arbitral proceedings ; (2) Role of conciliatior in arbitration or court proceedings ; (3) Enforceability of settlement agreements reached in conciliation proceedings ; (4) Other possible items for harmonized treatment : a) Admissibility or desirability of conciliation by arbitrators b) Effect of an agreement to conciliate on judicial or arbitral proceedings c) Effect of conciliation on the running of limitation period d) Communication between the conciliator and parties ; disclosure of information e) Role of conciliator. It was generally considered that decisions as to the form of the text to be prepared should be made at a later stage when the substance of prepared solutions would become clearer. However, it was noted that model legislative provisions seemed to be appropriate form for a number of matters proposed to be discussed in the area conciliation. There was general support in the Working Group for the proposition to perpare a legislative regime governing the enforcement of interim measures of protection ordered by arbitral tribunals. It was generally considered that legislative regime should apply to enforcement of interim measures issued in arbitration taking place in State where enforcement was sought as well as outside that State. It was generally observed that there was a need for provisions which conformed to current practice in international trade with regard to requirements of written form for arbitration agreement. The view was adopted by the Working Group that the objective of ensuring a uniform interpretation of the form requirement that responded to the needs of international trade could be achieved by : preparing a model legislative provision clarifying, for avoidance of doubt, the scope of article 7(2) of the UNCITRAL Model Law on International Commercial Arbitration : and adopting a declaration, resolution or statement addressing the interpretation of the New York Convention that would reflect a broad understanding of the form requirement. There was general agreement in the Working Group that, in order to promote the use of electronic commerce for international trade and leave the parties free to agree to the use of arbitration in the electronic commerce sphere, article II(2) of the New York Convention should be interpreted to cover the use of electronic means of communication as defined un article 2 of the Model Law on Electronic Commerce and that it required no amendment to do that. The UNCITRAL may wish to consider to the desirability of preparing uniform provisions on any of those issues concerning conciliation and arbitration proceedings, possibly indicating whether future work should be towards a legislative text or non-legislative text.

2005년 해양플랜트 지원선박용 정기용선계약서에 관한 소고 - 분쟁해결약관을 중심으로 - (A Study on Time Charter Party For Offshore Service Vessels 2005 - Focusing the Dispute Resolution Clause -)

  • 국제 유가의 상승과 해양에너지 개발에 필요한 기술이 진보됨에 따라 시추선(drillship), 부유식 원유생산저장설비(FPSO) 등과 같은 해양플랜트의 수요가 꾸준히 증가하고 있는 추세이다. 더불어 이러한 해양에너지 개발사업이 원활하게 이행될 수 있도록 작업을 지원해주는 다양한 종류의 해양플랜트 지원선박과 관련된 건조, 매매, 용선 시장 역시 꾸준한 성장세를 유지하고 있다. 하지만, 국내의 경우 해양플랜트 지원선박과 관련된 정기용선계약 체결 건수가 전무하기 때문에 향후 이와 관련된 선박의 매매 또는 용선계약 시 발생할 수 있는 다양한 법적 분쟁과 준거법 적용에 대한 실무적인 연구가 적극적으로 진행될 필요가 있다. 따라서 이 논문은 "SUPPLYTIME 2005"라고 통칭되고 있는 해양플랜트 지원선박용 정기용선계약서식을 중심으로 기존의 정기용선계약과 다른 특징을 개요적으로 검토함과 동시에 당사자 간에 발생할 수 있는 법적 분쟁에 대한 준거법 지정과 중재의 적용에 대한 실무적인 내용과 절차에 대해 살펴보고자 한다.

투약적용의 임상적 의사결정을 위한 스마트폰 어플리케이션의 개발 (Development of a Smartphone Application for Clinical Decision Making of Medication Administration)

  • 본 연구는 고위험약물의 투약조정을 위한 스마트 폰 어플리케이션의 내용을 구축하고 개발된 어플리케이션의 만족도를 평가하기 위해 수행되었다. xcode 4.5와 ios 6.1 SDK(software development kit)을 이용하여 시스템을 구축하였다. 4주간의 중재 후 35명의 중환자실 간호사들에게 기능적, 내용적, 화용적 측면의 만족도를 물었다. 또한 하루의 사용횟수와 사용의 빈도에 따른 만족도의 차이를 평가하였다. 이를 위해서는 SPSS WIN 18.0을 활용하여 서술적 분석, ANOVA를 적용하였다. 약물계산 식을 개발하고 과다 혹은 과소 용량에 대한 알람을 주는 과정을 개발하였고, 고위험 약물에 대한 정보를 구축하였다. 만족도와 관련된 문항 중 이 어플리케이션은 약물계산을 수행하는데 도움이 된다는 문항이 3.14점이었으나 이 어플리케이션에 만족한다는 문항은 2.94에 그쳤다. 하루의 사용횟수와 사용빈도와 관련해서 만족도의 차이는 없었다. 이 연구의 결과에 근거할 때 추후 더욱 진보된 고위험약물을 위한 투약조정용 스마트폰 어플리케이션은 환자안전을 위한 중요한 기반을 제공해 줄 수 있을 것이다.

2020 단백질 섭취기준: 결핍과 만성질환 예방을 위한 한국인의 단백질 필요량 추정과 섭취현황 (2020 Korean Dietary Reference Intakes for Protein: Estimation of protein requirements and the status of dietary protein intake in the Korean population)

  • 2020 한국인 영양소 섭취기준 개정에서 단백질은 기본적으로 질소평형을 유지하는데 필요한 단백질 양 0.66 g/kg 체중/일에 이용효율 90%를 적용한 평균필요량 0.73 g/kg 체중/일과 변이계수 12.5%를 적용한 권장섭취량 0.91 g/kg 체중/일을 생애주기별 체위기준치 변화에 따라 제시하였다. 그러나 성장기의 단백질 섭취기준에서는 체중 기준을 2017년에 개정된 소아청소년 성장도표에 근거하고, 일본 DRI 자료를 참고로 단백질 식품 이용효율을 차등 적용하였으며, WHO/FAO/UNU 보고서상의 성장에 필요한 단백질량 오류를 수정·반영하여 기준값을 개정하였다. 그 결과 일부 연령구간에서 섭취기준의 상향조정이 있었으나 한국인의 연령대별 1일 평균 단백질 섭취량은 대부분의 연령대에서 단백질 평균필요량의 100%를 넘는 것으로 나타났고, 남자 75세 이상과 여자 65세 이상을 제외하고는 권장섭취량과 비교했을 때도 많은 것으로 나타나 단백질 섭취기준의 상향 조정은 국민의 평균 단백질 섭취기준을 반영하는 것으로 판단된다. 한편, 75세 이상의 단백질 섭취량은 근감소증 예방, 근력 강화 등을 위해 65-74세 단백질 섭취기준과 동일하게 설정하였다. 이번 개정에서 단백질 에너지 적정비율은 기존의 7-20%를 유지하였으나 향후 단백질의 적정한 섭취수준 및 만성질환예방을 위한 단백질 필요량 설정에 관한 과학적 근거마련을 위해 우리나라 국민을 대상으로 한 다양한 중재연구가 수행되어야 할 것이다.

투자자-국가간 분쟁해결제도의 문제점과 대응방안 (The Problems and Countermeasures of the Investor-State Dispute Settlement Mechanism)

  • Investor-State Dispute Settlement(ISDS) grants a foreign investor the right to access an international arbitrator, if he believes actions taken by a host government are in breach of commitments made in an investment agreement or an investment treaty. The arbitration procedure of ICSID is made specifically to resolve investment disputes, so most of investment disputes have been settled in accordance with the procedure. Owing to limitation of dispute settlements through the ICSID arbitration procedure, several investment dispute conciliation schemes have been emerged as alternatives. In the case of a conciliation, the conciliation procedure will be in progress based on arbitrary agreement between parties, and if both parties agree on a conciliation program, then the arbitrary execution rate is relatively higher than that of arbitration procedures. In addition, it is evaluated that the time duration of conducting a conciliation procedure is in general rather short in 8 to 24months, and its incumbent cost is also rather inexpensive. Most of all, through amicable settlement of a dispute between a foreign investor and a host state, the foreign investor may continue his investment activities without a hitch, while the host state may invite more investment without any risk of losing its external credibility. In conclusion, it is desirable to lead any investment dispute between a foreign investor and a host state settle in accordance with the dispute settlement procedure as specified in the relevant investment agreement. In addition, to make the foreign investor continue his investment activities, it will be necessary to provide a separate investment dispute conciliation system aside from such arbitration procedures to cope any unexpected incident flexibly.

중환자실 환자의 수면증진 중재가 수면의 질 및 섬망발생에 미치는 효과 (The Effects of Sleep Improvement Intervention on the Sleep Quality and Incidence of Delirium in the Intensive Care Unit Patients)

  • Purpose: The purpose of this study is to investigate the effect of eye-shields and sleep-inducing music application on sleep quality and incidence of delirium for intensive care unit (ICU) patients. Methods: This study was a untreated control group design with pretest and posttest. The data was collected in the ICU of D University Hospital in Busan, from June to September 2011. Thirteen subjects were assigned to eye-shields and sleep-inducing music intervention and 15 subjects were in the control group. Results: Eye-shields and sleep-inducing music application was effective for improving the quality of sleep in ICU patients. There was no statistically significant difference in the incidence of delirium between the two groups. Conclusion: The sleep improvement intervention with eye-shields and sleep-inducing music would be a meaningful part of nursing intervention programs to enhance the quality of sleep in ICU patients.
