Structural Features of Korean Legislative Communication: Focus on the U.S. Beef Imports Bill Evaluations from Legislative Expert Groups (국내 입법 커뮤니케이션의 구조적 특징: 쇠고기 수입 법안에 대한 입법 전문가 집단의 인식과 평가를 중심으로)

  • Legislation needs to be understood within a political, societal relationship among lawmaking bodies rather than by legal provision itself. In order to examine features and functions of communication in the process of legislation, this study conducted focus group interviews with experts as well as in-depth individual interviews. The result of this research as follows: First, the study found that although the domestic legislative process has been made by active interactions among lawmaking subjects, it was hard to conclude that this procedure is providing effective and productive legislative agenda because of chaotic communications made along the process. Second, the study found that national legislative process has been gradually moving, although restricted, to an open political space, the National Assembly, from a closed space, the executive branch. Third, the study found a remarkable feature including growing influence of experts groups and civic organizations in the legislative process. It is a significant change that legislative staff such as National Assembly aides, investigators, expert committeemen and deputy director generals played a role of "insiders," unnoticeably influencing the legislative process, and that civic organizations and NGOs, which have been excluded in the previous legislative processes, emerged as a new influencing circle in the process. Lastly, the study found that media organizations, in the process of developing agenda, had a strong impact on the National Assembly as a subject forming public issues and as a messenger of the legislative agenda while they played a limited role in affecting the government. This study discusses why communication in the domestic legislative process is important and what are some hindering and facilitating factors in the process.

  • Since May 23, 2014, the Construction Technology Promotion Act has been effect through the entire reform of the Act. Despite the extensive reform, the previous penalty articles remain intact. According to the article 85 (1), especially, if a service provider or an engineer has caused death or injury by violating the duty of good faith and by damaging the principal parts of facilities, the person should be sentenced for lifetime imprisonment or imprisonment for no less than three years. The article has been controversial in its clarity and adequacy. This study is to verify the characteristics and the scope of the article and to suggest the theoretical backgrounds by analyzing the article based on the principle of legality, which enables to set forth the possibility to improve the article. To achieve the goal, the provision has been analyzed in accordance with the basic laws in Korea including the constitutional law and the criminal law, the related cases have been collected, and the comparison of the relevant acts has been executed. The detailed discussion about the articles in laws and acts on construction and the long-term and integrated study are expected to vitalize through this research.

Study on Sampling Frame and Methods for Analyzing Political Attitudes : A Comparison of RDD and Direct Sampling (표집틀 설정과 표본추출방법에 따른 정치성향 분석의 문제점: 임의번호걸기(Random Digit Dialing)과 전화번호부 추출방법 비교)

  • This research aims to discuss the causes of inaccuracy in public opinion polls currently conducted in Korea. In particular, identifying the problems in sampling frame and sampling methods in political and social public opinion polls is an important question. Currently, most polling organizations operating in Korea are using phone number directories provided by Korea Telecom(KT) as its sampling frame for conducting most political polls. A critical problem of using a phone number directory as a sampling frame is that unlisted phone numbers can never be included in the sample. If a systematic difference in socio-demographic or politico-economic characteristics exists between the listed number using group and the unlisted group, using a phone number directory as a sampling frame cannot produce a sample that can represent the whole adult population in Korea. According to the poll result commissioned by the Asan Institute for Policy Studies in January 2011, there are statistically significant differences in socio-demographic and politico-economic characteristics between those two groups, and those differences led to the differences in the presidential job approval rating and party support. Our findings include that the listed number using group is more pro-Grand National Party and show stronger support for the president than the unlisted group.

Influence of Democracy on Social Policy : The Case of Defective Democracy in Korea (민주주의가 사회복지정책에 미치는 영향 : 한국의 결함 있는 민주주의를 중심으로)

  • In democracy basic rights such as political equality and participation through elections have been respected, opportunities of corporation and opposition have been guaranteed, and ability of self-learning and self-correction have been developed. These positive factors give preconditions for the welfare development in the democratic state. Because in this state adults get the suffrage and the open competition for official positions induces political parties use social policies as means to win the election. That is to say, political parties have an incentive to use various social policies to win the election. Democracy, therefore, has affinity with social policy. The affinity between democracy and social policy can be found also in Korea which was democratized in 1987. But, in Korea, the positive relationship between democracy and social policy is very weak due to the problem of constitutional structures. Korean Parliament usually enacts abstract social act and delegates the right to fill concrete contents of the social acts to the executive. Delegation itself has no problem, but excessive delegation is a problem since the executive can overuse its discretion as sacrificing the social rights of the citizen. In addition social consensus could not be achieved in this constitutional structures, which are a obstacle to establishing a political process in the Parliament to promote the welfare development through party competition. Excessive delegation should be reduced, and the Parliament should fill concrete contents of the social acts as exercising its legislative power more. Then a mechanism of welfare development can be launched in Korea.

Change and Continuity in Regionalism: A Comparison of 1988, 2003, and 2016 Survey Results (지역주의의 변화: 1988년, 2003년 및 2016년 조사결과 비교)

  • This study aims to identify the micro-level, social psychological foundation of regionalism and analyze its change and continuity by comparing 1988, 2003, and 2016 survey results. Drawing on the theory of prejudice and social identity, it clarifies the concept of regionalism and examines its affective, behavioral, cognitive implications. In the empirical analysis, where it takes advantage of relevant questions of the same or similar wording in three nationally representative surveys, the study identifies the changes in regionalism at the individual level focusing on anti-Honam prejudice and discrimination and attribution of regional conflict. First, anti-Honam prejudice has been in decline nationally as well as regardless of where one has grown up, except for Daegu/Kyungpook area. Second, anti-Honam prejudice has been weakened among younger generations while regional party identification now affects the sentiment in the direction of regional cleavage overlapped with ideological leanings. Third, while most respondents do not experience explicit discrimination, Honam natives are still more likely to experience discrimination, especially identity and self-esteem related, due to his or her home town. Fourth, Honam natives have been more likely to attribute regional conflict to an external, structural factor like government economic policy and less likely to a subjective one like regional sentiment, which seems to be consistent with attributional attitudes of the victims of prejudice. The study ends with the discussion of how to reduce further anti-Honam prejudice, which includes contact hypothesis, recategorization, cross-categorization, and de-categorization.

An exploratory study on the structure of elementary school teachers' perception of 'we-ness' (초등학교 교사가 인식하는 '우리성'의 구성요인 탐색)

  • This study examined the components of we-ness perceived by elementary school teachers. The results of this research can be used as a new indicator based on the essential relationship of Korea to explain and improve the teacher culture and organizational culture of school. The subjects were 206 elementary school teachers. The data were analyzed using correlation, ANOVA, and exploratory factor analyses with SPSS 23, and confirmatory factor analysis with Mplus 7.1. The results of this study are as follows. First, 'psychological wellbeing', 'caring relationship', 'ethical legitimacy', and 'sharing time' were derived as the factors of early childhood teachers' perception of we-ness. In addition, considering that we-ness can be spread not only to individual relations, but also to the class, and to the same organization as a school, it can be used to form a school culture based on Korean culture and suggest a teaching culture. On the other hand, this study examined elementary school teachers; hence, the results cannot be applied to all teachers. In addition, this study was a quantitative study exploring the sub-factors through statistical analysis. The results of the quantitative research should be elaborated through interviews with school members, and follow - up studies should be conducted through case studies.

Space Organization and Landscape Culture on Upper-class's House('Sauidang') in Late Period of the Joseon (조선 후기 상류주택 사의당(四宜堂)의 공간체계와 조경문화)

  • By studying 'Sauidangzi' written by Honggyungmo(1774~1851), this paper shows on the location, the space organization, and the landscape culture of 'Sauidang' which was upper class's house in late period of the Joseon. Sauidang was the residence of about 530 kan(about $1,750m^2$) which was given to Jeongmyunggongju(daughter of Sunzo) by Injo when she married with Hongjuwon, located at the good place where Mt. Mokmyuk, Mt. Dobong, Mt. Inwang, and Janwon peak are harmonized all together. The residence was on the foothill of Mt. Mokmyuk, facing to the northeast. The main house was facing to the east with the inner and back yards, and the separate house(Sauidang) was facing to the west with the garden, and a vegetable field was set in the outer yard where is connected with a main road where willow trees were lined up, 'Sauidang' was called as "the garden of princess", and a stair-shaped flower garden was made to the south, and one could look down the Hanyang castle as a whole. In the garden, there were trees and house plants enriching one's mind to wish an eternal life with oddly shaped stones or flowers, and symbolizing a fairly land. There were 38 types of trees that were planted either on the ground or in pots as various bundles like 1 tree, 2 trees, 3 trees, 4 trees, 5 trees, 8 trees, and 9 trees. Taehosuk, oddly shaped stones, stone panels, stone pillars, jade panels, sundial, walls and fences, stone stairs, steppingstones, and buildings were set for the landscape. Also, the residence had rare luxuries of landscaping culture like Wangheeji's Nanjungsoogyeseo, Sosik's Cheeongjeongi, Jomangboo's Jeokbyukboo, and Anpyungdaegoon's Behaedangcheop.

Unhappy Start but Happy Ending?: Three Conditions for the Success of the 21st National Assembly in the Era of Polarization (제21대 국회 개원 평가와 전망: 양극화 시대 국회 운영의 성공조건)

  • This article purposes to investigate opening process of the 21st National Assembly in the middle of severe conflicts between two major-parties, and predict the changes it will bring to the operation of the National Assembly. With incumbent party's taking all leadership positions of standing committees, it broke the practice since 13th National Assembly, that is, distribution of the standing committees based on the seat-ratio. It means that our National Assembly has entered a new phase in the decision-making process. While the incumbent party, with overwhelming victory in general election, emphasizes that it should dominate legislative process to support the government, the out-party claims that they should take leverage to check over government. Two opposing trends are characteristically observed in the operation of the Korean National Assembly. First of all, due to the experience under authoritarian regimes, the National Assembly has been institutionalizing decision-making processes in the direction of enforcing cooperation between parties. On the other hand, the polarization in political parties has been stronger, making it difficult to reach consensus between parties. This article claims strongly that the 21st National Assembly need to find a balance amid such two-conflicting trends. To do so, three necessary conditions are proposed: observing decision-making procedures, securing diversity within party and National Assembly, and deliberative legislative activities.

Report on the External Audits Conducted by Korean Society of Medical Physics (한국의학물리학회 선형가속기 외부 품질관리 실시 현황보고)

  • The aim of this work is to verify the self-quality assurances in medical institutions in Korea through the external audits by the group of experts and have a mutual discussion of the systematic problems. In order to validate the external audits 30 of 80 medical institutions across the nation were picked out considering the regional distribution and the final 25 institutions applied voluntarily to take part in this work. The basic rules were setup that any information of the participants be kept secrete and the measurements be performed with the dosimetry system already verified through intercomparision. The outputs for 2 or more photon beams, the accuracy of gantry rotation and collimator rotation and the poistional accuracy of MLC movement were measured. The findings for the output measurement showed the differences of -0.8%~4.5%, -0.79%~3.01%, and -0.7%~0.07% with respect to that of the verified dosimetry system for the 6MV, 10MV, and 15MV, respectively. For the reference absorbed dose 8 (16%) of 50 photon beams in 25 medical institutions differed 2.0% or greater from the reference value. The coincidences of Field size with x-ray beam and radiation isocenters of Gantry roration and collimator rotation gave the results of within ${\pm}2$ mm for every institute except 2 institutions. The positional accuracy of MLC movement agreed to within ${\pm}1$ mm for every institute. For the beam qualities of 6 MV photon beams kQ values showed the distribution within 0.4% between maximum and minimum. For the protocols 21 institutions (84%) used absorbed dose to water based protocol while 4 insitutions (16%) used air kerma based one. 22 institutions employed the SSD technique while 3 institutions did the SAD one. External audit plays an important role in discovering the systematic problems of self-performing Quality Assurances and having in depth discussion for mutual complementation. Training experts of international level as well as national support system are required so that both the group of experts of medical physicists and government laboratory could perform together periodical and constant external audits.

Review on the Implementation Process and Achievement of ICH Safeguarding System (무형문화재 보호제도의 이행과정과 그 성과에 관한 검토)

  • The Safeguarding of Intangible Cultural Heritage in Korea has begun since1962 when the Cultural Properties Protection Act was established. Korean ICH Safeguarding system is initially derived from Cultural Properties Protection Act in Japan. Japan has started Important ICH Designation System in 1954 to concede the skills and artistic talents holders, thus it could implement the multilateral system management for adopting different ICH protection systems such as Important Intangible Folklore Properties, Selection and Preservation Techniques, and Documenting Records. However, Korea has solely adopted Important ICH Designation System since Cultural Properties Protection Act was introduced. Korean ICH Safeguarding System represented by the Certification System of ICH Skill Holders is to ensure skills and artistic holders who perform the elements of Intangible Cultural Heritage, and manage the safeguarding of intangible cultural heritage in order to let the skills and artistic holders instruct inheritors. As a result, it could build up the internal foundation for the diffusion of inheritors and established the related organizations. However, the inheritor-centered protection system has caused many problems as it is being lasted for more than fifty years. Fragmented designation measures, the cultural power of skill holders, and the research and evaluation methods have pointed out the difficulties of safeguarding and preservation measures of ICH. Moreover,the legitimacy of safeguarding system related in the authenticity of transmission in ICH has emerged to review the safeguarding system of ICH with diverse viewpoints. Therefore, this paper will review the implementation process and achievement of ICH safeguarding system to examine the problem and causes of the safeguarding system. The conference records of Cultural Property Association and articles of cultural properties policies directors, Cultural Property Association members, and professional experts are being used for the initial materials of this paper, and it is examined for the contents of designation system of Important Cultural Heritage, rather than overall cases. Thus such problems the limitation of expansion in ICH lists as inheritor-centered designation system, hierarchical and exclusive transmission system, inappropriate concept of archetype as the principle of ICH transmission are derived from the root of Important ICH designation system. Thus this paper demonstrates that this system must be revised for the expansion of ICH safeguarding system in Korea and points out multilateral protection system should be established as well as Certification System of Important ICH skill holders.
