A Study on the Effective Guarantee of the Right to Portability of Personal Health Information (개인건강정보 이동권의 실효적 보장에 관한 연구)

  • As the amendment to the Personal Information Protection Act, which newly established the basis for the right to request transmission of personal information, was promulgated through the plenary session of the National Assembly, MyData, which was previously applied only to the financial sector, could spread to all fields. The right to request transmission of personal information is the right of the information subject to be guaranteed for the realization of MyData. However, since the right to request transmission of personal information stipulated in the Personal Information Protection Act is designed to be applied to all fields, not a special field such as the medical field, it has many shortcomings to act as a core basis for implementing MyData in Medicine. Based on this awareness of the problem, this paper compares and analyzes major legal trends related to the right to portability of personal health information at home and abroad, and examines the limitations of Korea's Personal Information Protection Act and Medical Act in realizing Medical MyData. Under the Personal Information Protection Act, the right to request transmission of personal information is insufficient to apply to the medical field, such as the scope of information to be transmitted, the transmission method, and the scope of the person obligated to perform the transmission, etc.. Regulations on the right to access medical information and transmission of medical records under the Medical Act also have limitations in implementing the full function of Medical My Data in that the target information and the leading institution are very limited. In order to overcome these limitations, this paper prepared a separate and independent special law to regulate matters related to the use and protection of personal health information as a measure to improve the legal system that can effectively guarantee the right to portability of personal health information, taking into account the specificity of the medical field. It was proposed to specifically regulate the contents of the movement and transmission system of personal health information.

A Case Study on the Development of Environment Friendly Citrus Farming in Jeju - Focusing on Graduate Farms of Korea National College of Agriculture and Fisheries (제주 친환경 감귤 농업 발전을 위한 사례연구 - 한농대 졸업생 농가를 중심으로 -)

  • The purpose of this research is to find what difficulties the agricultural successors, the Korea National College of Agriculture and Fisheries (KNCAF) graduates, face with in implementing eco-friendly agriculture in Jeju, and what solutions they can be provided with. This research, a case study on the basis of open-ended survey questions, has 6 cases out of 8 graduates who have or had implemented eco-friendly citrus farming. In Jeju, 24 graduates have involved in citrus farming. According to the case study, only one case was environment-friendly farming method at the pesticide-free level, and the others at organic farming level. All the cases have tried to alter main crops or to diversify management for coping with global climate change and market-opening. On analyzing operating cost to gain product of merchantable quality, it revealed that the environment-friendly farming method needs much more managing efforts than the conventional farming does. But to the contrary, the materials cost in the environment-friendly farming method was lower than in the conventional farming method. In the total production and the price, the environment-friendly farming was 20~50% lower and 10~50% higher than the conventional farming, respectively. Difficulties which the graduates confronted with in implementing the environment-friendly agriculture are as below. Firstly, many of the difficulties have resulted from lack of the environment-friendly farming techniques, and the high cost of farm scale improvement due to high price of land and topographical features of Jeju. Secondly, the agricultural successors, the KNCAF graduates, have trouble in obtaining approval of their parents to changeover from the conventional farming to the environment-friendly farming. Lastly, there is no advisory organizations and experts for environment-friendly farming in the given area. For shift to the environment-friendly farming, followings are needed. Agricultural Technology & Extension center, with cooperation of leading farms in environment-friendly farming, should have a key role in offering education and consults on the environment-friendly farming techniques. Also, this organization should inform rapidly the research results to the farmers, and their feed-back should be involved in the next research. Therefore, it is suggested that the forum called 'Environment-friendly Organic Farming Forum in Jeju' tentatively is organized.

  • This paper analyzes the research trends from 358 scholarly articles published in the Journal of Daesoon Academy of Sciences from the first published journal in 1996 to the most recent journal published on the 25th of 2015 and proposes ideas for improvement. First of all, "The Journal of Daesoon Academy of Sciences" does not meet the standards required by the National Research Foundation, falling short of the most important conditions for the registration such as the periodicity and punctuality expected from academic journals. Furthermore, in terms of the Bibliometrical analysis, the number of articles published by the journal is decreasing and the consistency, with regards to rules and principles regulating publication details and bibliography formats, is nonexistent. Although various authors seemed to be meeting these criteria on the surface, the ratio of co-authored articles is too small. Securing researchers specializing in Daesoon Thought for expanding the size of the journal is important, but it is also important to diversify the research topics through exchanging ideas among researchers from various organizations. Here are some ideas for the improvement of the Journal of Daesoon Academy of Sciences: First, in order to meet the standards for punctuality and periodicity, it would be best to publish the journal twice a year with 12 to 15 articles. Second, the journal must become searchable through the creation of a database. Third, the key words and abstracts of articles must be written in Korean and English to facilitate the sharing of articles among researchers. Fourth, the journal must have a diverse and outstanding editorial board which takes into account the geographical situations of its board members. Fifth, the Journal must include articles on relevant topics that reflect the core topics of the Daesoon Thought and other studies. Sixth, articles must have a front page that contains bibliographical items to convey information to the reader. Seventh, it is essential that the journal have a clear publication date detailing the year, month, and day as well as a standard numbering scheme (i.e, Vol. and no).

  • Experiments were conducted to determine effects of whole and processed corns on in situ disappearance rates of nutrients in the rumen and in vitro degradability of dry matter by rumen microorganisms. Whole corn(WC) was processed into four different types; ground corn(GC), cracked corn(CC), flaked corn(FC), and soaked corn(SC). In the in situ experiment, the rate of ruminal DM disappearance after 48 hour incubation was highest in GC(76.1%) and lowest in WC and SC(12% ; P<0.01). The rate of ruminal CP disappearance after 48 hour incubation was highest in GC and CC(48 and 38%, respectively; P<0.01). The rate of ruminal OM disappearance after 48 hour incubation was highest in GC(76.14%) and lowest in WC and SC(11.82 and 12.26%, respectively; P<0.01). In the in vitro experiment, the two-stage incubation technique was used to measure digestibilities of whole and processed corns. The digestibility of DM was higher in GC, CC and FC(86.95, 85.84 and 82.29%, respectively) than in WC(15.36%; P<0.01).

Study on the Physiology of Optimal reproductive age in Korean Native Cattle (한우의 최적 번식적령기의 생리적 현상에 관한 연구)

  • This study was conducted to investigate the physiology of optimal reproductive age in Hanwoo for protection to decrease of reproductivity and improvement of production of offspring. Thirty two cows were devided into 4 groups of treatments : T1(12 months of age and 0.5kg daily gain), T2(12 months of age and 0.8kg daily gain), T3(15 months of age and 0.5kg daily gain) and T4(18 months of age and 0.5kg daily gain). The days of the first heat of treated cows were 263.3±6.4 days and average weight was 181.1±11.3kg. The conception rates of first insemination were 25%(T1) and 75%(T4), and the number of insemination of T3 and T4(both 1.5) was lower than those of T1 and T2(2.3 and 2.4), respectively. With regard to estrus return after the first parturition, T1, T2, T3 and T4 showed 66.2,76.7, 62.4 and 68.5 days, respectively, indicating the average days of estrus return was 65.7. Plasma progesterone(P4) concentration was nearly the same during the observation periods of treated cows and P4 began to be detected after 12months. Only 5(15.6%) out of 32cows showed normal estrus cycle and ovulation before 12 months. During the peri-parturition period, P4 concentration was rapidly decreased and there was no detection of P4 from parturition to 40 days after milking. P4 would be released again on 45 day after parturition. The results imply that the optimal reproductive age of Hanwoo heifers would be around at the 14 months of age, 110cm height and 265kg weight.

Studies on the Evaluation of the Spent Composts of Selenium-Enriched Mushrooms as a Feed Selenium Source (셀레늄강화 버섯폐배지에 대한 사료 셀레늄공급원으로의 평가 연구)

  • This study was conducted to evaluate the spent composts of selenium-enriched mushrooms as a feed selenium Source. Total selenium (Se) contents and Se profiles in the spent mushroom composts (SMC) were determined. In addtion, we also investigated the metabolism in relation to Se accumulation in the mushroom. Mushrooms used in this study were Flammulina velutipes and Se enriched mushrooms were grown for 60 days by adding 2 mg of inorganic Se (Na2SeO3) per kg of mushroom composts (MC) on as-fed basis and it was compared with mushrooms not to add Se to the MC. Total Se contents for Se-treated mushrooms were significantly increased (P<0.0001) by 20-fold (4.51 ㎍/g of dry) compared to Se-untreated (0.23 ㎍/g of dry). On the contrary, organic Se proportion was significantly lower (P<0.0001) in the Se-treated mushroom (72.3%) than Se-untreated (100%, not analytically detected of inorganic Se). Se distribution upon a length in the Se-treated mushrooms was the highest in the bottom part (6.86 ㎍/g of dry) near to MC, and top and middle parts were significantly lower (3.71 and 3.01 ㎍/g of dry, respectively) than the bottom (P<0.001). In the SMC from Se-treated mushrooms, a high concentration of Se (5.04 ㎍/g of dry) was still remained, but that from Se-untreated mushrooms was significantly low (P<0.0001) as 0.08 ㎍/g of dry. Se-treated SMC showed a high rate of organic Se (65.67%), suggesting that most of inorganic Se in the SMC was converted to organic Se by mushroom mycelia, and Se-untreated SMC showed 100% of organic Se, not being detected of inorganic Se. Prior to mycelia inoculation in the mushroom culture, the sterilization of MC brought approximately 18% of Se loss in the MC. This result is in accordance with facts generally known that Se is weak in the high temperature and it is consequently volatilized under that condition. Apparent and net accumulation rates (%) for Se into mushrooms were 14.81 and 10.14%, respectively and their difference (4.67%) is considered that it is due to the volatilization into the air via metabolic process of mushroom itself. From the result of this study, inorganic Se addition to MC for mushroom improved the Se content in the mushroom and SMC from Se-enriched mushrooms contained a high concentration of Se. Mycelium and fruiting body from mushrooms converted inorganic Se in MC to organic Se, indicating a high proportion of organic Se in the mushroom and SMC. Therefore, Se in Se-enriched mushroom and SMC was recognized as Se sources of food for human as well as feed for livestock.

Trend Analysis of Barrier-free Academic Research using Text Mining and CONCOR (텍스트 마이닝과 CONCOR을 활용한 배리어 프리 학술연구 동향 분석)

  • The importance of barrier free is being highlighted worldwide. This study attempted to identify barrier-free research trends using text mining. Through this, it was intended to help with research and policies to create a barrier free environment. The analysis data is 227 papers published in domestic academic journals from 1996 when barrier free research began to 2022. The researcher converted the title, keywords, and abstract of an academic thesis into text, and then analyzed the pattern of the thesis and the meaning of the data. The summary of the research results is as follows. First, barrier-free research began to increase after 2009, with an annual average of 17.1 papers being published. This is related to the implementation guidelines for the barrier-free certification system that took effect on July 15, 2008. Second, results of barrier-free text mining i) As a result of word frequency analysis of top keywords, important keywords such as barrier free, disabled, design, universal design, access, elderly, certification, improvement, evaluation, and space, facility, and environment were searched. ii) As a result of TD-IDF analysis, the main keywords were universal design, design, certification, house, access, elderly, installation, disabled, park, evaluation, architecture, and space. iii) As a result of N-Ggam analysis, barrier free+certification, barrier free+design, barrier free+barrier free, elderly+disabled, disabled+elderly, disabled+convenience facilities, the disabled+the elderly, society+the elderly, convenience facilities+installation, certification+evaluation index, physical+environment, life+quality, etc. appeared in a related language. Third, as a result of the CONCOR analysis, cluster 1 was barrier-free issues and challenges, cluster 2 was universal design and space utilization, cluster 3 was Improving Accessibility for the Disabled, and cluster 4 was barrier free certification and evaluation. Based on the analysis results, this study presented policy implications for vitalizing barrier-free research and establishing a desirable barrier free environment.

Deriving Key Risk Sub-Clauses which the Engineer of FIDIC Red Book Shall Agree or Determine according to Sub-Clause 3.7 -based on FIDIC Conditions of Contract for Construction, Second Edition 2017- (FIDIC Red Book의 Engineer가 합의 또는 결정해야할 핵심 리스크 세부조항 도출 -FIDIC Red Book 2017년 개정판 기준으로-)

  • The FIDIC Red Book is an international standard contract condition in which the Employer designs and the Contractor performs the construction. The Engineer of FIDIC Red Book shall agree or determine any matter or Claim in accordance with Sub-Clause 3.7 neutrally, not as an agent of the Employer. This study aimed to derive Key Risk Sub-Clauses out of 49 Sub-Clauses that the Engineer of FIDIC Red Book recently revised in 18 years shall agree or determine according to Sub-Clause 3.7 using the Delphi method. A panel of 35 experts with more than 10 years of experience and expertise in international construction contracts was formed, and through total three Delphi surveys, errors and biases were prevented in the judgment process to improve reliability. As for the research method, 49 Sub-Clauses that engineers shall agree on or determine according to Sub-Clause 3.7 of the FIDIC Red Book were investigated through the analysis of contract conditions. In order to evaluate the probability and impact of contractual risk for each 49 Sub-Clause, the Delphi survey conducted repeatedly a closed-type survey three times on a Likert 10-point scale. The results of the first Delphi survey were delivered during the second survey, and the results of the second survey were delivered to the third survey, which was re-evaluated in the direction of increasing the consensus of experts' opinions. The reliability of the Delphi 3rd survey results was verified with the COV value of the coefficient of variation. The PI Risk Matrix was applied to the average value of risk probability and impact of each of the 49 Sub-Clauses and finally, 9 Key Risk Sub-Clauses that fell within the extreme risk range were derived.

  • FIDIC White Book is a Model Services Agreement between the Client and the Consultant. This study aimed to derive the Key Risk Sub-Clauses out of 63 Sub-Clauses of General Conditions of the FIDIC White Book by using the Delphi technique. A panel of 40 experts with more than 10 years of experience and expertise in overseas construction services agreements and FIDIC White Book was formed, and the reliability was improved in the direction of increasing the consensus of experts through a total of three Delphi survey processes. In the first Delphi survey, a closed-type survey was conducted on the impact of risk among 63 Sub-Clauses of General Conditions on a Likert 5-point scale, and 26 main risk Sub-Clauses were derived. The Content Validity of the results of the first Delphi survey was verified with the CVR value. In the 2nd and 3rd Delphi surveys, a closed-type survey was conducted on a Likert 10-point scale for 26 main risk Sub-Clauses and the risk possibility and impact of each main risk Sub-Clause were evaluated. The reliability of the 3rd Delphi survey result was verified with the COV value. Total 14 Key Risk Sub-Clauses were derived by applying the average risk possibility and impact of each of the 26 main risk Sub-Clauses to the PI Risk Matrix. The results of deriving Key Risk Sub-Clauses showed that agreement on specific scope of service, delay management, and change management were the most important. As a result of this study, from a practical point of view, consultants of consulting companies provide guidelines that should be reviewed to minimize contractual risks when signing service contracts with clients. From an academic point of view, the direction of research on deriving key risks related to service contracts for consultants participating in overseas construction is presented.

An Exploratory Study on Consumer Behavior of Digital Banking Deposits: Focusing on Bank Loyal Customers (디지털 뱅킹 정기예금의 소비자 행동 실태에 관한 탐색적 연구 -은행 충성고객을 중심으로-)

  • The digital transformation of finance is accelerating, and digital banking has already become a major banking channel. Banks have traditionally placed importance on CRM(Customer Relationship Management) and have tried to retain their loyal customers, who contribute significantly to the bank, such as long-term transactions, holding accounts with a certain balance or more, and holding loans. In this situation, this study exploratorily analyzed the consumer behavior of digital banking deposits in a major bank of Korea(1,145 samples). Statistical analysis was performed using SPSS. The main findings of the study are summarized as follows. It was found that there were differences of consumer behavior in digital banking deposits by generation, and the MZ generation used digital banking more on holidays than other generations. As a result of analyzing the behavior of existing loyal customers and regular customers of digital banking deposit, there was a significant difference in both the amount and period of the deposit. It was confirmed that the existing loyal customers of the bank also engage in consumer behavior that contributes to the bank in digital banking. In addition, the interaction between the customer type and the date of sign up for the deposit period, which is the goal setting of financial consumers, it was found that there was a significant effect. This study empirically analyzed the consumer behavior of digital banking in a situation where decrease of bank branches and encounters with digital banking. The major concepts of the consumer behavior theory are Loyal Customer, Goal Pursuit, and Habit, which were confirmed in an example of digital banking. The results of this study can suggest practical implications for existing banks and Internet-only banks, including the importance of customer management in digital banking.
