Determinants of Male Police Officers' Investigative Behavior(Active Investigation vs. Secondary Victimization) of Sexual Violence (남성경찰관의 성폭력 수사행동(적극적 수사와 이차폭력) 결정요인 - 성폭력에 대한 편견을 중심으로 -)

  • This study aims to find out the determinants of male police officers' investigative behavior(active investigation vs. secondary victimization) of sexual violence. For this purpose, a hypothetical model which explains the relationships among the 5 variables (knowledge of law about the investigative role, perception of the protective & connective role, prejudice against the sexual violence, active investigation, and secondary victimization) was developed. Using the data collected from 354 male police officers of 3 cities in Gyeongnam area, the hypothetical model was tested. For data analysis, a structural equation modeling was used, and the final model was found(CFI=0.947, IFI=0.948, RMSEA=0.048). As a result of analyzing the model, the followings were found: (1) Active investigation was increased by knowledge of law about the investigative role, and perception of the protective & connective role, while decreased by prejudice against the sexual violence. (2) Secondary vicimization was decreased by knowledge of law about the investigative role. (3) Prejudice against the sexual violence mediate the effects of knowledge of law about the investigative role, and perception of the protective & connective role on active investigation. (4) Prejudice against the sexual violence was found to have no significant effect on secondary victimization. Based on the findings, multi-educational programs, protocols on investigation of sexual violence, professionalization of the police, and changes in investigation environment as well as a system of collaboration and cooperation between police officer and social worker were suggested as a way to increase active investigation and to decrease secondary victimization.

  • A primary task of fire department is maintaining public safety, system maintenance and welfare improvement by protecting life, body and property of a people through prevent and extinguish of the fire in emergency. Rescue part of those affairs has supported by the people but affairs related to the fire examination and investigation could not get it. Although fire examination is a very important part of fire department administration, it has been understood indifferently due to lack of awareness and concern. There are no scientific fire examination because of lacking education study and the whole responsibility capacity about it. There are many things have to be improved at fire examination and investigation system in Korea. Especially, establishment of the whole responsibility post is urgent through assuring professionals to improve accuracy of fire examination and investigation. Equipment which can do scientific fire examination and investigation have to be fully furnished. Efficiency of fire examination and investigation has to be increased through improving law related to fire examination and investigation, giving rescuers investigation right. Through this, it systematically have to be good for fire prevent.

  • 현대는 인터넷과 컴퓨터 없이는 잠시도 운용될 수 없는 사회이지만 이를 불법적으로 이용한 범죄행위도 점차 증가하고 있다. 이들 컴퓨터 범죄는 익명성에 기반한 대담성을 보이고 있으며, 개인의 사회적 존재로써의 자각에 있어서도 탈개인화됨에 따라 더 많은 우려를 낳고 있다. 이에 따라 일반 컴퓨터 사용자들의 프라이버시 보호를 위한 방법으로 암호화 방법을 점점 더 많이 사용하고 있는데, 이에 비례해 범죄자들의 암호사용도 증가하고 있다. 그렇다면, 범죄자들이 암호를 사용해 자신들의 범죄증거를 숨기고 있는 경우, 이를 수사하기 위해 공권력 및 수사기관은 어떻게 해야 될 것인가\ulcorner 본 논문은 이러한 문제제기를 통해 새로운 환경에 의해 변화된 코드를 활용하는 새로운 법제도를 통한 적극적인 대비방안을 모색해 보고자 한다. KLS와 같은 신기술을 수사기관 및 법집행기관이 신중하게 사용하여 국가의 법 집행력과 프라이버시권이라는 두 가지 근본 가치의 균형을 이룰 수 있는 방안을 고려하여야 할 것이다. PRIVACY와 SECURITY라는 동전의 양면은 현실생활의 법제도를 그대로 옮겨놓는 것만으로는 한계가 있다. 현재 암호와 관련한 보든 논의는 공론화 되지 못하고있다. 좀 더 공개적으로 암호를 사용한 범죄 행위에 대한 현황과 또 이를 대처한 수사기관의 수사 활동에 대해 논의하고, 그 과정에서 어떤 문제점들이 발생되고 있으며, 이들 문제를 해결하기 위해 필요한 조치들이 무엇인지에 대해 논의하고, 해외 각 국은 이 문제를 해결하기 위해 어떠한 노력들을 기울이고 있는지 살펴본후 종합적인 안목으로 시의 적절한 대책을 세우는 시발점이 되었으면 한다.

  • Many of crimes are solved by the report of people. Therefore, countries pay compensation to crime reporter. However, the current system of compensation is focused on the report of criminal fact and criminals arrest, so that there is no compensation on the providing evidence. On the other hand, since the current judicial system adopted the principle of trial by evidence, all the facts are made by the evidence. But it is impossible to obtain all the evidence only by law enforcement agencies. Therefore, it is necessary for people to report the evidence positively. So it is necessary to positively take advantages of smart phones, vehicle black boxes and cctvs. Various incentives such as compensation would be needed to require the evidence of smartphone or black box, cctv. In order to strengthen evidence report, it will be needed the legislation of crime report compensation, smartphone apps development including the provision of various incentives.

  • As the capitalist society was launched, false has been increasing day by day for the personal profit. Study after study since a long time ago has concluded that today's polygraph developed in order to determine these false. In Korea the polygraph has been used actively in current investigation agency, and passively in a private enterprise by a former polygraph examinant from the investigation agency. Each investigation agency is recruiting polygraph examinants through the strict qualifications, training education. Decisions of Supreme Court precedents about the polygraph test results are denying admissibility of evidence in reliability on the efficiency of a test equipment, way to ask, qualities of polygraph examinant, etc. The most fundamental cause of the issues mentioned in the precedents is that examinants of each investigation agency are being trained by dual education not centralized. Because of each investigation agency has its own training and polygraph examinant, each agency can occur variations every agency or every examinant, therefore ensuring the centralized educational system is needed. In this way, ensuring the centralized educational system will contribute to improve the reliability of polygraph test results and make a retrenchment in the educational budget in accordance with examinant training of each agency.

Improvement of Police's Investigation System Against Gambling Crime (도박 범죄에 대한 경찰의 수사체제 개선 방안)

  • Our country is criticized that is gambling republic recently. It is shy, but do not refute through present actual conditions. Gambling had increased and generated much problems in our country. But, gambling permited socially. So, control system that do snow about gambling is insufficient. In the meantime, police's confrontation about gambling crime was not effective. Active confrontation about police's gambling crime must consist now. This research groped police's active confrontation way about gambling crime, police is improving crime information management system of gambling crime and utilize in investigation.

  • 미국 독점금지법 집행의 최근 동향을 살펴볼 때, 우리에게 주는 시사점으로 다음의 세 가지를 들 수 있다. 첫째, 공정거래위원회의 경제분석역량의 강화가 시급하다. 경제분석도구를 개발하고 이를 실제사건에 적용하기 위해서는 장기적인 관점에서 보다 과감한 투자가 요구된다고 여겨지며, 단기적으로는 민간의 전문가를 활용하는 방안도 적극적으로 고려할 필요가 있다 할 것이다. 둘째, 합병사건의 증가에 대비할 필요가 있다. 즉, 심사대상 기업의 부담을 최소화하는 보다 효율적인 사건처리절차의 마련과 조직의 보강을 시급히 검토할 필요가 있지 않을까 한다. 셋째, 매우 조심스럽게 법무부와의 공조를 검토할 필요가 있다. 특히 카르텔 등에 대한 국제적 수사 공조에 공정거래위원회와 법무부가 함께 참여한다면 더욱 바람직하지 않을까 생각된다.

  • 현대사회 환경의 변화와 개인생활의 복잡 다양화는 시민의 안전한 삶을 위협하는 요인들로 특히 범죄피해를 당하게 되면 피해당사자는 정신적 물질적으로 회복이 힘들고 피해의식과 두려운 기억에 의한 원만한 대인관계의 불가능이나 가족과 친지에게도 큰 상처를 남기게 된다. 경찰의 국민보호는 기본 임무이며, 주요 임무 중 하나인 수사도 국민보호의 차원에서 이루어지고 있는 활동임에도 이러한 경찰활동은 피해자의 신뢰와 협력 없이는 목적을 이룰 수 없으므로 이들 범죄피해자를 위하여 경찰에서도 적극적인 노력을 기울여야 한다. 본 연구에서는 경찰의 범죄피해자 보호 실태와 문제점의 주된 내용을 살펴보고, 그에 대한 대책을 살펴보도록 한다.

Criminal Investigators' Recognition of Judicial Autopsy and It's Implications - With the Case of P Police Station - (사법부검에 대한 수사경찰의 인식분석 및 함의 - P 경찰서의 사례를 중심으로 -)

  • Based on the analysis of criminal investigators' recognition of judicial autopsy, this study presented policy alternatives as follows. First, a procedure is needed that optometrists and investigators jointly make previous explanations to bereaved families the status of investigation and the results of examination to their satisfaction and collect their opinions, for the purpose of obtaining an agreement to autopsy from them. Second, the dignity of the dead should be kept. To this end, particular consideration should be given to women bodies. Also, we need to minimize the number of autopsy witnesses and obtain agreement from bereaved families when there is an on-the-spot study. Third, we need to establish a guideline that investigators could request a warrant later in certain cases of dead bodies. Also, if a bereaved family positively asks for autopsy, it should be allowed through tentatively named ‘Request for Autopsy.’ Finally, To make a careful decision on whether an autopsy should be made or not, we can form a joint investigation team of public prosecutors and criminal investigators; however, an autopsy should be done only if it is deemed inevitable, considering the bereaved family's opinion.

  • Today, the international community make every effort to suppress security crimes, to provide numerous institutional strategies and to prevent security crimes such as the terrorism and spy. Particularly, developed countries in the field of security are strengthening related legislation under new-security conditions. Things work a little differently about security crimes because the nation's benefit and protection of the law is the basis of individual benefit and protection of the law under investigation procedure of the security crimes. Therefore they have policy that permits major investigative agency under the arrest and detention procedure(e.g. security and communication monitoring ${\ldots}$). Criminal procedure's improvement and reinforcement are very important for events related security. But, The investigation procedure between criminal offense and security crimes makes no odds in the Korea. Continuance of such a national mood will accuse of not responding appropriately in preparation for new-security conditions recently. To revise with international best security legislation, We should institute a proper registration system in Korea's situation. This study have been discussing how to improve related legislation under new-security conditions through the cases analysis of the arrest and detention procedure in Korea.
