담합의 존재에 관한 경제적 증거 : 반독점법과 과점이론의 조화(1)

  • 최근 미국의 법원은 담합을 입증하려는 시도를 주로 경제적 증거에 입각하여 분석하는 추세를 보여 왔다. 하지만 담합의 존재를 입증하는데 있어서 경제분석의 역할에도 많은 이견이 날카롭게 표출되었다. 담합의 존재에 관한 경제적 증거를 분석하는 데에 있어 유일한 합리적 근거는 최신과점이론(Modern oligopoly theory)이다. 그런데 증인으로 나선 많은 경제학자들과 법원이 최신과점이론에 자신들의 분석을 뚜렷이 기초하지 않았기 때문에, 판례법의 현 상태가 불만족스럽다고 주장하는 것이 본 논문의 핵심적 내용이다. 셔먼법 제1조는 ''계약, 결합, 공모(contract, combination, or conspiracy)에 의해 초래되는 거래(즉 경쟁)의 불합리한 제한을 규제''하는데, 이러한 계약 결합, 공모의''용어들은 합의라는 하나의 개념으로 통합하여 이해''할 수 있다. 제 1조는 다수의 당사자가 ''단일한 목적, 공통된 의도와 의견의 일치, 혹은 의사의 합치(Meeting of minds)'', 즉 ''공통된 계획에 대한 의식적 참가(consious commitment to a common scheme)''를 합의한 모든 협약을 규제한다. 셔먼법 제 1조 위반을 입증하기 위해서는 일치된 행동이 합의 하에서 일어났음을 입증해야 한다. 미국 법원은 합의를 추론할 수 있는 증거력 있는 정황증거(admissible circumstantial evidence)의 원칙을 확립하였다. 독점가격에 가까운 수준의 과점가격 설정은 ''조정되었다(coordinated)''라고 칭해지는데, 이는 ''구두 합의''와 ''암묵적 합의''의 두 가지 형태로 나뉜다. 한편, 일회게임 과점 모형과 반복게임 모형은 과점이론의 핵심을 이룬다. 과점에 대한 Chamberlin의 견해는 본래 게임과 Stigler의 모형은 그와 같은 생각의 오류를 가르쳤다. 그러나 판례법은, Petroleum products antitrust litigation사건과 reserve supply사건에서 볼 수 있듯이 종종 그러한 교훈을 망각했다. 최신과정이론과 판례를 종합해 보면, 합의의 존재에 관해 경제학자가 이끌어내는 추론과 법원이 이끌어내는 추론을 포괄하는 다음의 네 가지 일반적 원칙이 도출된다. 1. 합의가 추론되기 위해서는 상호의존성을 넘는 무언가가 먼저 제시되어야 한다. 2. 합의의 존재는 일회게임 과점 모형에서의 비협조적 내쉬균형과 일치하는 행동으로부터는 추론될 수 없다. 3. 합의의 존재는, 비록 무한반복 과점게임에서의 비협조적 내쉬균형(혹은 Chamberlin-Fellner식의 과점)과 일치하더라도, 일회게임 과점 모형에서의 비협조적 내쉬균형과 일치하지 않는 행동으로부터 추론될 수 있다. 4. 증거는 구두합의의 존재를 뒷받침해야만 한다. 이러한 원칙에서 얻을 수 있는 가장 중요한 교훈은, 합의가 존재하지 않을 경우 과점상황으로부터는 독점가격이 예상될 수 없다는 사실을 법원이 인식하는 것만으로도 합의의 추론에서 범하기 쉬운 가장 큰 오류를 회피할 수 있다는 것이다.

Array Gain Improvement of Triple Line Array System Using Inverse Beamforming (역 빔형성기를 이용한 3중 선배열 시스템에서의 어레이 이득향상)

  • To detect the precise of arrival of target signal in real ocean environments, Inverse beamformnig(IBF) solutions to the Inverse beamforming integral equation are surveyed theoretically and the performance properties of the IBF are analyzed with simulations. IBF-Cardioid beamforming algorithm is proposed for port/starboard discrimination and the performance gains are studied with simulations. It is shown that IBF has a 3 dB array noise gain advantage over CBF under ideal conditions. This 3 dB array noise gain advantage is proven by theocratical studies and simulations. This array noise gain advantage leads to a minimum detectable level advantage for IBF output compared with CBF output. The fact that the IBF beamwidth is narrower than the CBF beamwidth by a factor of 0.68 proves the performance of detection and spatial resolution improvement. Comparing the simulation results of IBF-Cardioid beamforming and Conventional Cardioid beamforming, it is shown that IBF-Cardioid beamformer have performance enhancement in minimum detection level, detection accuracy and resolution.

  • The average probability of a lightning strike to transport aircraft operating in airline service has been estimated to be approximately one strike in every year (or one strike per 1,000 through 20,000 flight hours). The important thing is not the probability of a lightning strike to aircraft, but the fact that aircraft is struck by lightning. Therefore, lightning protection design for aircraft should be qualified and compliance with airworthiness standards related to lightning protection must be substantiated in the process of certification. In this paper, I studied means of compliance for lightning protection through analysis of some test cases, including the KC-100 airplane that firstly obtained civil type certificate in Korea. Based on this paper, it will be also necessary to study on the effect of lightning for space launch vehicles.

  • The aircraft fuel system performs a number of functions such as supplying fuel, transferring fuel between fuel tanks, and measuring the amount of residual fuel in each fuel tank. Since it is a direct cause of fire hazard in crash incident, it is a must to improve survivability of crew members by designing the airframe to tolerate expected crash impact. The civil aviation authority requires intensive verification of the fuel system design to determine precise application of the airworthiness requirement. Research activity on airworthiness certification criteria and verification scheme is still insufficient, although it has a significant importance. In this paper, as part of a study to improve flight safety by developing guidelines for demonstrating fuel system crash resistance, analysis results of fuel system crash-related airworthiness certification standards, verification scheme, and cases study applicable to military rotorcraft have been reviewed.

  • This study using a transaction cost approach perspective, this paper presents a model for understanding shopper's buying behavior. Finally, based on the results of these studies, this paper suggests practical implications to companies establishing their management strategy of the channels. In order to achieve the research purpose, it derived hypotheses from the literature studies and conducted questionnaire survey for the buyer who actually purchased by distribution channels. In this paper, 876 of the samples has been used in practice and with those samples it analyzes its empirical testing through reliability verification, validation, factor analysis, correlation analysis and covariance structure analysis.

In this respect, this study develop the OPT simulation model, and this OPT model are evaluated by using a simulation study. It has proved that the performances of OPT model are excellent.

  • For the purpose of objective and scientific inspection, traffic accidents should be appraised and inspected by righteous material evidences, computer simulation, and studies such as automobile engineering, traveling and collision accident dynamics, road and traffic engineering. In this paper, it displays the results of studying cases with the reasons of traffic accidents by analyzing and studying automobile kinetics, real traffic accidents and the results of in scientific and objective ways. In this paper, it is proved that with compared by dry and wet road surface condition, the transient brake time of wet condition is longer than dry road condition. Moreover, compared with unpacked road condition and packed road condition. unpacked road condition is shorter than packed road condition using computer simulation.

Static Test of a Composite Wing with Damage Tolerance Design (손상 허용 설계를 적용한 복합재 날개의 정하중 시험)

  • Static tests of the composite wing structure were performed to verify damage tolerance design. Both 5 cases of DLLT and 3 cases of DULT were completed to meet requirements for static strength. After inducing BVID and open hole damages on the critical areas of the composite wing based on associated regulations, the DULT and fracture test were performed. In major wing parts, the measured strains and displacements agreed well with those of structural analysis. The initial structural fracture occurred at the area having minimum margin of safety as expected by analysis. As a result, it was confirmed that results from analytic model and strength evaluation were similar to behaviors of the composite wing structure.

  • 차세대전동차는 직접구동모터(DDM : Direct Drive Motor) 방식으로 기존에 사용하던 기어박스를 없애는 등, 연결부품을 제거함으로써 고장률을 줄여 기존차량 대비 30% 이상 신뢰도를 향상하도록 개발하였다. 그러나, 단순히 모터 자체 만을 변경함으로써 신뢰도를 향상시켰다고 보기는 어렵고, 시스템 차원에서 전동차 내 타 구성품과의 인터페이스를 살펴보고, 정량적인 분석을 통해서 신뢰도가 어느 정도 향상되었는지 살펴볼 필요가 있다. 신규차량일 경우, 기존차량대비 어느 정도로 신뢰도가 향상되었는지를 입증하고자 주행시험을 실시하는데 전동차에 신뢰성 이론을 적용하기 위해서는 크게 목표설정, 신뢰도예측, 신뢰도입증의 3단계 작업이 진행되며, 신뢰도 예측은 주요장치를 구성하고 있는 부품단위의 고장률을 이용하여 시스템의 신뢰도를 예측하고, 신뢰도 목표치를 만족하는지를 분석하는 것이며, 신뢰도 입증은 예측한대로 시스템이 구축되었는지 확인하는 것이다. 본 논문에서는 차세대 전동차에서 설정한 목표신뢰도를 만족시키기 위해 수행한 업무에 대하여 논하고자 한다.

  • It is very important to set a reliability target and verify the requirement when procuring the rolling stock in the aspect of safety, availability and LCC. While there are a few different methods to verify the reliability target, it is required that the most appropriate method should be used considering the characteristics of rolling stock itself and the operation environment. Even though recently the quantitative reliability requirements are widely adopted in domestic market, there is no substantial contents in the various standards and guidelines. In this study we investigate the various reliability demonstration test plans and evaluate them for rolling stock application. And three test plans among them were applied to the real operation data.
