A Study About a Trial for Damage of the Right to Sunshine in Apartments (공동주택의 일조환경 피해 판정에 관한 연구)

  • This paper presents the results of a case study of a dispute for the damage of the right to sunshine between B and W Apartment Complex in the N city. Recently a number of disputes for the right to sunshine increase in urban areas because the residents' demand for pleasant residential environment is getting stronger. In particular, problems related to sunshine, which were not recognized during the construction, have come up to the surface over time as people's concern over residential environment is growing. According to a recent interpretation of the right to sunshine in urban areas, moreover, there have been a series of legal decisions starting that damage of the right to sunshine to neighboring apartments must be indemnified for even if the violating apartment was designed and constructed legitimately according to relevant construction laws applied when the building was constructed. Thus this study examined the effects and the scope of damage on the right to sunshine through a case study in order to provide basic materials necessary to rope with related civil affairs.

  • Recently, many troubles about the right of light have been arising ceaselessly as taller and more dense the buildings have been in the urban. The present time, the right of light is not stipulated legally. For solving above problems, there spend so too much lawsuit expenses and time on the damages about construction stopped and delayed, according to subjective decisions instead of scientific and rational solutions. The past studies of the right of light weren't based on the analytic data and depend on the simple view of point. So, those of studies gave trust to people hardly, only were treated as the ways on the decision about construction among non-engineers. Therefore, this paper studies the efficient solution of problems about the right of light through analysis about mass of sunlight according to season and the hour using a simulation technique on the civil construction.

  • Recently, construction of bridges in rural areas has been increased to preserve the natural environment. However this brings forth the disputes over rights of light in farmland. In urban areas, the disputes over rights of light have been settled on the authority of the national architectural law and only sunshine hours for winter solstice are considered. Basically, the point at issue is different between each case. The main issues of the dispute in rural area were the reduction of the crop cultivation and the increase of the heating cost in winter. The purpose of this study is to review the mediation process in national environmental dispute resolution commission to resolve these issues, and to set up the analysis method of rights of light and modelling equation of solar position. Furthermore, we aimed at analyzing the damaged hours of daylights in rural housing and the infringement rate of daylight in farmland through the case study. In conclusion, we estimated the sunshine hours during the whole damaged periods according to the elements of bridges, and presented the solution process of dispute over rights of light due to the construction of bridge in rural area.

Relationship between Yearly Fruit Growth and Climatic Factors in 'Niitaka' Pear (배 '신고'의 연차간 과실 생장과 기상 요인과의 상관성)

  • This research was conducted to investigate the effect of climatic factors on fruit growth in 'Niitaka' pear (Pyrus pyrifolia). For ten years from 2000 to 2010, average full bloom date was April 19th and standard deviation was 4.2 days. Average fruit diameter 160 days after full bloom (DAFB) was 102.4 mm and standard deviation was 7.5 mm. Variance coefficients among climatic factors were higher in rainfall amount and sunshine hours than temperature. Only sunshine hours of climatic factors accumulated during the 160 DAFB had significant positive relationship ($r=0.68^*$) with fruit diameter 160 DAFB. Between full bloom date and fruit diameter 160 DAFB had no significant relationship. Fruit growth in 2004, as continuous rain fall and short sunshine hours, showed opposite pattern compared to that in 2009. Therefore, fruit growth of 'Niitaka' pear was more influenced by the accumulated sunshine hours than accumulated temperature.

  • Urban logistics plan of the previous cargo distribution law has changed into city logistics plan of logistics policy law in which its contents adjusted into direction to improve logistics industries, economic well-being and lifestyle conditions of the city. But the city logistics planning didn't include yet a systematic backbone that plans a vision, performs propelled plan to realize it, and then gives feedback through scientific evaluation indexes. In this context, this paper reviews the previous logistics plans and helps operating and managing a efficient city logistics plan a mid-long term through representative index development required to establish city logistics plan.

  • The first case of the Central Environmental Dispute Mediation Committee, which recently decided to repay the builder for damaging the solar power plant due to the obstruction of the sunshine of new buildings, came out. Even if the Respondent complies with the provisions of the Building Act, the decision of the Complainant can be considered to have been made in light of the fact that the applicant's power plant has suffered from sunlight damage. However, since the extent of the damage may differ depending on the weather, the decision is reserved, and there is room for additional disputes on a regular basis because the loss of power generation to be continuously generated is not reflected in the future. Therefore, in this study, we try to find the direction of dispute adjustment by summarizing the issues related to the generation of power generation due to the influence of shading through the analysis of the case of dispute related to sunlight related to the PV system.

  • Recently software complexity will continue to increase dramatically in the coming decades because of the dynamic and distributed nature of both data and applications. Not only must software systems assist in coordinating tasks among humans, they must also help mannage cooperation among distributed programs. Software agent may properly respond to these requirements. This paper investigates the adaptive characteristics found in adaptive tutoring agents. To funcion effectively throughout the range of situations presented by such a dynamic and extremely-distributed information entities, an agent must be highly adaptive. Adaptivity exists in several key aspects of agent's behavior to its dynamic situation. My goal is to show the various aspects of internal adaptivity that could be applied to build comprehensive agents that function effectively in tutoring agent system.

  • The role and importance of VE have been enlarged since VE application was mandatory by law in public sector in March, 2000. Public organizations have widened the technological horizon through VE competitions and applied VE technique to private investment projects. Many studies have been carried out on function analysis and VE procedure. In practice it is common that clients make a decision one-sidedly on whether or not VE proposals are selected. The VE procedure itself is not smooth. This study gives some suggestions on VE appraisal procedure and criteria at the last phase on VE process in order to smooth the progress of VE. The results of this study can be used as a tool to improve efficiency in the management of VE.
