A Study on the Implications by the Introduction of TSU/BPO System as a Instrument of Trade Settlement (무역결제수단인 TSU/BPO 제도의 도입에 따른 시사점에 관한 연구)

  • The purpose of this study aims to the implications by the introduction of TSU/BPO system as a instrument of trade settlement. Jointly with financial messaging provider SWIFT, the ICC Banking Commission has developed the URBPO to take into account the legitimate expectations of all relevant sectors. Once the goods have been shipped, the seller's bank uploads the shipping and logistics data to the TSU to be checked against the baseline. URBPO is the first ever set of standards in supply chain finance that governs BPO transactions worldwide. BPO enables banks to reduce the risks associated with international trade to the benefit of both buyers and sellers. A BPO is an irrevocable undertaking given by an Obliger Bank to a Recipient Bank to pay a specified amount under the condition of a successful electronic matching of data or acceptance of mismatches. The BPO should be viewed as an exercise in collaboration between trading partners and their banks. Drawings upon global standards and incorporating the benefits offered by letters of credit, the new instrument has the potential to benefit all parties in a trade transaction-and bring trade settlement into the 21st century.

  • The certification scheme for best company has been implementing in order to stimulate the investment of private consulting company to reduce GHG emission. This study was conducted to set up the certification scheme, to suggest process, criterion, institute, committee which are necessary for the evaluation of certificate. Evaluation process for the introduction of the certification scheme is divided into 7 successive phases, (1) Certificate application(Applicant ${\rightarrow}$ Certification Institute), (2) Evaluation request(Certification Institute ${\rightarrow}$ Evaluation Institute), (3) Accept and document review(Evaluation Institute), (4) Site and document evaluation(Evaluation Institute ${\rightarrow}$ Evaluation committee), (5) Sending evaluation result(Evaluation Institute ${\rightarrow}$ Certification Institute), (6) Certification confirmation (Certification Institute), (7) Issue of certificate(Certification Institute ${\rightarrow}$ Applicant).

  • This article examines whether parties may agree to contractually waive the right to bring annulment proceedings. Alternately it looks at whether certain grounds of annulment may be waived. The ability for parties to resolve this issue contractually by waiving this element of Article 52(1)(b) ICSID offers a potentially powerful solution. For parties to agree beforehand to the circumstances where tribunals have not 'manifestly exceeded their power' could allow them to remove the unpredictability of annulment on this foundation. Even in the event that an ad hoc committee is against the validity of waiver, it may be possible for a party to frame this restriction as an interpretative agreement by the parties rather than strictly as waiver of a ground of annulment. Ultimately, the wish to enter into such an agreement would likely only be driven by a few exceptional commercial need or prior negative experience with the remedy of annulment. In that cases, and depending on the nature of the specific concern with annulment, a limited waiver or interpretative agreement on certain Article 52(1) ICSID grounds may certainly be appropriate.

  • 정보문화의 달이기도 했던 6월은 고도정보화사회를 앞당기는 일련의 획기적인 조치들이 취해져 관련업계의 관심을 크게 집중시키고 있다. 정부는 정보통신회선 사용상의 제한을 대폭 완화하여 민간기업이 실질적으로 VAN사업에 참여할 수 있는 길을 열어놨고 종래 규제일변도였던 전파정책을 권장행정으로 전환하는 전파관리법도 입법예고했다. 정부가 마련한 정보통신회선사용제도 개선조치는 DB, DP만 제공할 수 있도록 되어있는 정보통신역무제공업자의 사업범위를 불특정다수인을 대상으로 한 정보교환 및 타인통신매개행위를 허용했고 지금까지 9600bps급 이하의 저속회선에서만 접속이 허용되어온 다중화장치(MUX)의 사용범위를 대폭확대하여 64kbps급 이상의 고속회선에서도 접속사용할 수 있도록 허용했다. 또한 그룹 VAN의 경우에도 업무상 긴밀한 관계자 등만 이용할 수 있게 한 제한사항도 폐지해 국내 VAN시장에 대한 민간기업의 참여를 전면적으로 허용했다. 이외에도 정보통신역무제공업자가 DP.DB제공을 위해 필요한 경우 컴퓨터 본체에서의 부수적인 정보교환행위를 허용하여 DB내용 갱신(up-data) 등을 위한 중도컴퓨터의 접속도 가능토록 했다. 그런데 그룹 VAN의 경우 이용대상의 제한을 없앴으나 그룹망 중 타인사용특례를 받은 업체 이외의 망에는 이용자가 접속할 수 없도록 되어있기 때문에 각 업체에서는 시스템 통합화를 추진할 확률이 높다. 또한 고속회선에 대한 다중화장치(MUX) 사용을 허용하고 있으나 개방에 대비해 각 업체에서 이미 보유하고 있는 노드 프로세서(Node Processor)를 전용교환기로 간주, 이의 사용을 제한하고 있는 실정이다. 업계에서는 중도컴퓨터의 접속은 허용하고 있으면서 통신과 컴퓨터의 중간자적 기능을 갖고 있는 노드프로세서의 사용을제한한다는 데에 있어서는 의견을 달리하고 있다. 우리 협회에서는 이달 법제위원회를 개최하여 이번 조치에 대한 검토와 함께 전파관리법 입법예고안에 대한 업계의 의견을 수렴, 정부에 건의할 예정이다.

  • GIS has recognized as the Social Overhead Capital to improve national competition and to heighterl the productivity of adminstration in 1990's in Korea. As the size and the scope of the NGIS policy have drastically expanded, evaluation has become a critical process. Thus NGIS driving committee has adopted the GIS project evaluation scheme in NGIS law since 2000. But the HGIS evaluation scheme is not sufficient for the comprehensive appraisal on the GIS project in the Second National GIS Master Plan (2001-2005). This research aims to explore an the improved evaluation scheme of NGIS policy.

Recommendations for Revising the Arbitration Act of Korea regarding Interim Measures by the Arbitral Tribunal to Promote Commercial Arbitration in South Korea (상사중재 활성화를 위한 중재판정부의 임시적 처분 제도의 개선 - 2016년 개정 중재법을 중심으로-)

  • Arbitration is a consensual process in which a dispute is resolved by an impartial arbitrator outside the courts. Arbitration is flexible, neutral, time- and cost-efficient, and confidential. In 1985, the United Nations Commission on International Trade Law(UNCITRAL) enacted the UNCITRAL Model Law on International Commercial Arbitration to help countries reform and modernize their arbitration laws. In 1999, South Korea adopted the model law. Later in 2006, UNCITRAL amended the model law to promote international arbitration. The amended model law includes, among other things, specific provisions regarding interim measures. In 2016, in order to adopt the newly amended version of the model law, South Korea revised its Arbitration Act. The revised act includes a more comprehensive legal regime regarding interim measures, including definitions, types, processes, requirements, the court's recognition and enforcement, and liability. This paper examines the revision of the Arbitration Act of Korea and its legislative intent, presents the problems, and offers recommendations for resolving the problems.

  • 2008년 8월 국가에너지위원회는 제1차 국가에너지기본계획을 공표했다. 이 계획에 따르면 정부는 온실가스 저감, 에너지 안보 강화, 신성장 동력 육성 등을 위해 신 재생에너지의 비중을 2007년 2.4%에서 2030년 11%까지 높일 것이다. 이런 목표가 달성되려면 풍력, 태양광, 해양에너지, 바이오매스 등 재생가능 에너지 원별로 보급이 크게 확대되어야 한다. 2030년이면 태양광 발전 설비용량은 지금 보다 약 10배 증가한 3,504MW, 풍력발전은 설비용량은 지금 보다 약 12배 증가한 7,301MW에 이를 전망이다. 그러나 이런 보급 목표를 달성하기까지 여러 가지 장애와 난관이 존재한다. 극복해야 할 문제 중 하나가 재생가능 에너지 설비의 입지를 둘러싼 갈등 현상이다. 국내에선 태양광 발전소가 산지에 다수 들어서면서 산림 훼손 논란을 불러 일으키고 일부 지역에선 태양광 발전소 가동이 동 식물 피해를 유발한다는 민원까지 등장하면서 계획이 취소되거나 변경되는 사례가 발생하고 있다. 풍력 발전도 계획이나 시공 과정에서 환경영향을 둘러싼 갈등이 불거지면서 공사가 중단되거나 계획이 보류된 사례가 발생하고 있다. 현재의 제도와 여건에선 이런 갈등이 더욱 심화 증폭되어 중 장기적으로 신 재생에너지 보급 목표의 달성이 불투명해질 수 있다. 이 논문에선 국내 태양광 발전과 풍력 발전 시설의 입지와 운영 과정에서 발생한 갈등 사례를 분석하고 갈등 완화와 해소를 위한 정책적 시사점을 도출하고자 한다.

  • In order to review the recycling status of urban mine resources in Taiwan, background and history of recycling industries, system of the recovery fund management committee(RFMC), copper recycling with non-ferrous metals, recycling of ELV(end of life vehicles) and recycling of EAF dust were surveyed. Taiwan is a leading country of the world in the metal consumption per capita. Therefore, a lot of waste metals were generated. In other words, urban mine resources are abundant in Taiwan and have some advantages in recycling. There are more than thou-sand recycling plants in Taiwan. Half of them are non-ferrous metal recyclers.
