This study investigated and analyzed the perceptions of passengers on various topics related to passenger ship operation by targeting the passengers (passenger ship consumers) at the coastal passenger terminals in three regions, Incheon, Mokpo, and Tongyeong, where many coastal passenger ships operate in Korea. . The survey period was from October 1 to October 11, 2019, just before the outbreak of Corona 19, and the number of samples was 277 The analysis was divided into two elements. As a result of the analysis, for items that both islanders and the general public did not respond to more than 50% positively, a more in-depth review of policies and fare policies for transportation-disabled facilities through comprehensive fare evaluation such as the excellence of transportation-disabled facilities, the appropriateness of fares, and the appropriateness of fare guidance. was found to be necessary. It is expected that this study will be able to prepare for re-opening after COVID-19 and be used in public transportation policy.
The summary of the case is as follows: a Korean passenger booked and purchased a business class ticket from Air France that was scheduled to depart from Paris and arrive in Seoul. When the passenger arrived at the check-in counter, he was told that all business class seats were occupied. It was because the flight was overbooked by Air France. The passenger cancelled the Air France flight and took another air carrier. After arriving in Korea, he brought suit against Air France for damages. The purpose of this article is to discuss the governing law when interpreting the contract of international air carriage in accordance with the Korean Private International Act (2001) and to analyze air carrier's civil liability for the bumped passenger in the overbooking case. If the parties have not chosen the applicable law the contract shall be governed by the law of the habitual residence of the consumer in the following situations: prior to the conclusion of the contract, the opposite party of the consumer conducted solicitation of transactions and other occupational or business activities by an advertisement in that country or conducted solicitation of transactions and other occupational or business activities by an advertisement into that country from the areas outside that country and the consumer took all the steps necessary for the conclusion of the contract in that country or in case the opposite party of the consumer received an order of the consumer in that country [Article 27 (1), (2) of the Private International Act]. Since the contract of international carriage falls into the consumer contract, the Supreme Court viewed that the governing law of the contract in this case would be the law of the habitual residence of the consumer (Supreme Court Decision 2013Da8410 decided on Aug. 28, 2014). This interpretation differs from the article 5 (4) of Rome Convention(80/934/EEC) which declares that the consumer contract article shall not apply to neither a contract of carriage nor a contract for the supply of services where the services are to be supplied to the consumer exclusively in a country other than that in which he has his habitual residence. Even though overbooking can be considered as a common industry practice, an air carrier must burden civil liability in case of breach of contract for the involuntary bumped passenger(Seoul Central District Court Decision 2014Na48391 decided on Jan. 29, 2015). In case of involuntary bumping, an air carrier must offer re-routing to passenger's final destination by an alternative flight. If an air carrier fails to effect performance in accordance with the tenor and purport of the obligation, the involuntary bumped passenger may claim damages(Article 390 of the Civil Code).
The Montreal Convention is an agreement that governs the liability of air carriers for injury and death to passengers travelling internationally by air. The Montreal Convention serves as the exclusive legal framework for victims and survivors seeking compensation for injuries or death arising from accidents involving international air travel. The Montreal Convention sets monetary liability caps on damages in order to promote the financial stability of the international airline transport industry and protect the industry from exorbitant damages awards in courts that would inevitably bankrupt an airline. The Convention allows a litigant suing under the Convention to avoid the liability caps in instances where the airline's culpability for the injury or death is the direct result of negligence, another wrongful act, or an omission of the airline or its agents. The Montreal Convention identifies specific locations as appropriate venues to advance claims for litigants seeking compensation. These venues are closely tied to either the carrier's business operations or the passenger's domicile. In March 2015, in an act of suicide stemming from reactive depression, the co-pilot of Germanwings flight 9525 intentionally crashed the aircraft into the French Alps killing the passengers and the remaining crew. Subsequent to the crash, there were media reports that Lufthansa made varying settlement offers to families of the passengers who died aboard the flight ranging from $8,300 USD to $4.5 Million USD depending on the passengers' citizenship. The unverified offers by Lufthansa prompted outcries from the families of the decedent passengers that they would institute suit against the airline in a more plaintiff friendly jurisdiction such as the United States. The first part of this article accomplishes two goals. First, it examines the Montreal Convention's venue requirement along with an overview of the recoverable damages from countries comprising the citizenship of the passengers who were not American. The intentional crash of Germanwings flight 9525 by its First Officer encompasses the possibility that Lufthansa may be exposed to unlimited compensatory damages beyond the liability caps contained in the Convention. The second part of this article explores the application of the Convention's liability limits to the Germanwings flight to demonstrate that the likelihood of escaping the liability limits is slim.
Seosan-Daesan Port is the sixth largest port in Korea, and it promotes port infrastructure expansion, regular route development, overseas marketing, and port incentive systems for continuous growth. In addition, the port is planning to open a regular car ferry line to Weihai, China. This study aims to provide useful research data for effective decision making by analyzing the feasibility of opening the Chinese (Weihai) car ferry route of Seosan-Daesan Port. Currently, some car ferry routes that operate between Korea and China are open at Incheon Port, the Port of Pyeongtaek-Dangjin, and the Port of Gunsan. In order to estimate the volume of cargo that will be created when the car ferry route from Seosan-Daesan Port to Weihai opens, this research analyzes the domestic cargo volume from the Chungcheongnam-do region, where Seosan-Daesan Port is located, to each of the regions where the other ports are located. We estimated the volume of cargo that can be transported on the car ferry from Seosan-Daesan Port to Weihai. As a result, by 2020, about 76,000 passengers and about 50,000 tons of cargo could be created. Suggestions were made for policy strategies that would revitalize passenger numbers and secure the cargo volume of the car ferry, along with a discussion of and the port incentive system.
Korea and China have maintained sea routes between two nations through the shipping conference which was established in May 1993. Due to this effort, the market of Korea-China car ferry on Yellow sea makes growth year by year. The car ferry business has shown fierce competition because it has huge impacts on regional and national level economy. In this respect, the aim of this research is to analyze the structural analysis for ports of Korea-China car ferry using Shift Effect(SE) method. As a results, passengers and cargo volumes of Incheon port continuously transfer to Pyeontaek and Gunsan port. Moreover, absolute growth rate of Incheon port do not reach the potential growth rate. The competitiveness power of Incheon port has lower position compared to Pyeontaek and Gunsan port. The cargo volumes of ports located on western coast of Korea have increased recently, however, passengers and cargo volumes of Incheon port have shown lower increasing rate compared to average of Korean western coast ports. For Incheon port, high value added cargoes which give large profit on port side, have to be attracted. Moreover, Incheon port has to become a specialized port.
A coastal ferries, which serve as a mode between mainland and offshore islands, are frequently used by islanders and travelers visiting islands. Therefore, it is located in a place with good accessibility to the downtown so that users can use it conveniently. However, research on the built environment and walking environment of coastal ferry terminals has not been conducted to ensure that elderly islanders and general travelers can use comfortably the coastal ferry terminal. In this study, with a focus on the coastal ferry terminal space, the walking section was set as 1)the accessibility of the coastal ferry terminal, 2)the built environment for using the coastal ferry terminal, and 3)walking environment in the ferry boarding and disembarkation at the coastal ferry terminal, and 4, 5)walking environment in the ferry. An evaluation tool was developed to measure the walking environment for each walking section, and the importance and satisfaction of users were analyzed using the IPA for the Yeosu Coastal Ferry Terminal. As a result, in the process of approaching the ferry terminal, 'convenience of using public transportation by foot' and 'convenience of using signposts guiding the location and direction of the ferry terminal' were investigated as concentrated areas. On the other hand, the built environment inside the ferry terminal and the walking environment showed that the satisfaction of the users was high. Regarding the walking environment from the ferry terminal to the ferry, the 'surface walking environment of the walking path', 'convenience of walking with luggage', 'convenience of walking in the slope section', and 'convenience of walking in the ferry ramp section' showed low satisfaction. This study can be used as basic data for improving the facilities and walking environment of Yeosu Coastal Ferry Terminal and is expected to be used as data for comparative research with other coastal ferry terminals.
This paper annually estimates the economies of density, scale and scope with the data of cost and output of 27 leading air carriers to suggest the political findings and strategies of raising the cost efficiency of our air transport industry. The estimation results and their implications are as follows. First, KAL and Aha would reduce their cost if they could increase international route density. Second, KAL and AAR would reduce their cost if they could expand the network but save their cost more effectively if they could increase international route density rather than expand the network. Third, the minimum efficient scale that minimize average cost of two national flag carriers which operate by the present output ratio among domestic passenger, international passenger and freight appears to be larger than each present output level of KAL and AAR. Meanwhile, it appears that minimum efficient scale of small size low cost carriers which operate domestic-oriented route is much smaller than minimum efficient scale of national flag carriers. Finally, it appears that there exists the diseconomies of scope between domestic passenger and the other outputs, that is, international passenger and freight and therefore save their cost if freight output ratio is higher and domestic passenger output ratio is lower than the Present level.
This paper deals with modal shift projects and policy of modal shift services at home and abroad. This study aims to review the results of foreign modal projects in advanced countries and to suggest policy directions for promoting modal shift services in Korea. This paper consists of three main sections: concept of modal shift policy; analysis of modal shift projects and policy at home and abroad; policy directions of modal shift services in Korea. In recent years, shippers who shift mode from truck to rail or coastal shipping are subsidized by the government. The government intends to encourage modal shift services of shippers, as shown in the example of Marco Polo in EU. It is identified that the government should devise effective policy for the successful implementation of truck-rail modal shift in Korea. It is suggested that the policy goal of modal shift must be clear and its attainment is feasible in order to promote modal shift services here. It also turns out that indirect supply policy works better than direct one. Freight transport environments differ between countries. It, thus, hard to directly apply foreign policies to Korea's freight transport field. Korea is at an inceptive stage of exploring foreign modal shift policies and promoting modal shift services in Korea. We will gain from the wide range of case studies, which analyze the modal shift successes and failures experienced by advanced countries. It is necessary to use them with care.

Freight and passenger transport operators must converts the operation records of digital operation recording device (Digital Tachograph) that is mounted on their vehicle in a certain format, and report them to governmental agencies. However, for most of the individual carrier who cannot access a computer environment easily and are not familiar with the use of computer, it has given a big inconvenience to them because the procedures for entering the data obtained from the operation are so complicate. Therefore, in this study, a mobile system for converting the operation record file to request form of a government agency is designed and developed, so that the converted file can be submitted to the government agency in a simple way through the personal mobile device. By entering the data obtained from an actual operation recording device into the system, converting the data in the proposed algorithms, and checking the contents of the converted file in data viewer, it was confirmed that the proposed functions is working properly in the system.
During more than 20 years of practice, Civil Aviation Law has experienced three times of amendments since it was enacted in 1995. But these revisions are limited to the technical level. The problems and limitations have become increasingly prominent in its implementation. Firstly, the civil aviation law is the result of interests game among several departments and some legal issues was left behind and the regulation was very vague as a result. Secondly, the process of aviation legislation is the process that the country has undergone profound changes and social transformation. The 20 years is long enough for the society to undergo tremendous changes and 1995 version of civil aviation law does not keep pace of development of economy. There was a serious lag between reality and the law. In order to actively promote the development of the aviation industry and overcome implementation issues of the Civil Aviation Law, Civil Aviation Administration of China (CAAC) initiated modification procedure the law and published new draft of Civil Aviation Law in August 2016. The spirit of this modification is to learn and absorb new achievements of domestic and foreign legislation and the International Convention on civil aviation. Furthermore, the purpose of the revision is to provide favorable policy for the development of civil aviation industry and improve aviation safety and supervision, strengthen and protection of consumer rights and interests, to enhance the safety of civil aviation activities, and promote the development of general aviation. This revision concerned to the 78 articles which are revised or deleted and 24 articles added. The highlights of the draft include but not limited to the enhancement of security management, clarification of the main responsibility for production safety. And also it added the provisions related to the construction of effective tracking capability of public air transport enterprises and license system on the transport of dangerous goods. Compared with the existing civil aviation law, the draft has made a great improvements. But there are several deficiencies and limitations in the drafts. These problems need to be supplemented and perfected through further amendments in near future.
