U.S. Rules on Enhancing Airline Passenger Protections (미국 연방법규상 항공여객보호제도에 관한 연구)

  • Recently, U.S. Department of Transportation (DOT) expanded the "Enhancing Airline Passenger Protections" on August 23, 2011 and October 24, 2011. The Rule regulates tarmac delays, denied boarding compensation, customer service plans, and fare advertising. The adopted rule is to protect passengers by improving passenger service requirements on U.S. national or domestic carriers and foreign air carriers as well. The major issues are as follows: First, regarding to so called Tarmac Delay, carriers must establish a Tarmac Delay Contingency Plan setting forth the number of hours the carrier will permit an aircraft to remain on the tarmac at U.S. airports before allowing passengers to deplane. Carriers also must provide passengers with food and water in the event the aircraft remains on the tarmac for two or more hours and must provide operable lavatories and medical attention while the aircraft remains on the tarmac, irrespective of the length of the delay. Carriers also must create and retain records regarding tarmac delays lasting more than three hours. Also they need to update passengers every 30 minutes during a tarmac delay of the status of the flight and the reason for the delay, allow passengers to deplane if the aircraft is at the gate or another disembarkation area with the door open. Second, carriers now must adopt a "Customer Service Plan" that addresses offering customers the lowest fares available, notifying customers about delays, cancellations, and diversions; timely delivery of baggage; accommodating passengers' needs during tarmac delays and in "bumping cases"; and ensuring quality customer service. Third, the new regulations also increase minimum denied boarding compensation limits to $650 / $1,300 or 200% / 400% of the fare, whichever is less. Last, the DOT also has modified its policies related to enforcement of Rules pertaining to full fare advertising. The Rule states that the advertised price for air transportation must be the entire price to be paid by the customer. Similarly, Korea revised the passenger protection clauses within Aviation Act. However, it seems to be required to include various more issues such as Tarmac Delay, oversales of air tickets, involuntary denied boarding passengers, advertisements, etc.

Compensation for flight delay and Regulation (EC) No. 261/2004 - Based on recent cases in Royal Courts of Justice - (항공기 연착과 Regulation (EC) No. 261/2004의 적용기준 - 영국 Royal Courts of Justice의 Emirates 사건을 중심으로 -)

  • On 12 October 2017, the English Royal Courts of Justice delivered its decision about air carrier's compensation liability for the flight delay. In the cases the passengers suffered delays at a connecting point and, consequently, on arrival at their final destination. They claimed compensation under Regulation 261/2004 (the "Regulation"), as applied by the Court of Justice of the European Union (the "CJEU") in Sturgeon v. Condor [2009]. The principal issues were whether delays suffered by the passengers during the second leg of their respective journeys were compensable under the Regulation, whether there was jurisdiction under the Regulation and whether the right to compensation under the Regulation is, insofar as non-Community air carriers are concerned, excluded by virtue of the exclusive liability regime established under the Montreal Convention 1999. The passengers, the plaintiff, argued that the relevant delay was not that on flight 1 but that suffered at the "final destination". They maintained that there was no exercise by the EU of extraterritorial jurisdiction as the delay on flight 2 was merely relevant to the calculation of the amount of compensation due under the Regulation. The air carrier, the defendant, however argued that the only relevant flights for the purpose of calculating any delay were the first flights (flights 1) out of EU airspace, as only these flights fell within the scope of the Regulation; the connecting flights (flights 2) were not relevant since they were performed entirely outside of the EU by a non-Community carrier. Regarding the issue of what counts as a delay under the Regulation, the CJEU held previously on another precedents that the operating carrier's liability to pay compensation depends on the passenger's delay in arriving at the "final destination". It held that where the air carrier provides a passenger with more than one directly connecting flight to enable him to arrive at their destination, the flights should be taken together for the purpose of assessing whether there has been three hours' or more delay on arrival; and that in case of directly connecting flights, the final destination is the place at which the passenger is scheduled to arrive at the end of the last component flight. In addition, the Court confirmed that the Regulation applied to flights operated by non-Community carriers out of EU airspace even if flight 1 or flight 2 lands outside the EU, since the Regulation does not require that a flight must land in the EU. Accordingly, the passengers' appeal from the lower Court was allowed, while that of air carrier was dismissed. The Court has come down firmly on the side of the passengers in this legal debate. However, this result is not a great surprise considering the recent trends of EU member states' court decisions in the fields of air transport and consumer protection. The main goal of this article is to review the Court's decision and to search historical trend of air consumer protection especially in EU area.

  • With the growth of airline management, as well as computer and IT security, the international trade in this modern society has been rapidly increasing, Along with the advancing, airplanes have become a universal means of communication. However, the complications associated with airplane safety have also been brought up as a result, the most concerning of which is terrorism. One of the main counterplans for preventing terrorism is Ground security activities the core of Ground security activities is absolute safety for passengers in both passenger terminal and freight terminal. Subastral security refers to physical protection, proximity control and 100% security search and freight guarding of the passengers' possessions, and the personnel's duties to perform such jobs are be! coming more crucial. On the other hand, Airport security check has bee n gradually developing since the 1960's, when hijacking began to take place. Although the airports have been providing more safe and comfortable services to their customers, terrorism is still happening today. When Ground security activities is minute, the users feel displeasure and discomfort, yet considering solely their convenience can brings problems in achieving safety. Since the 9.11 terror in 2001, the idea of improving and strengthening airport security was reinforced and a considerable amount of estate is being spent today for invention and application of new technology. Various nations, including the United States, have been improving their systems of security through public services; public police department is actively carrying out their duties in airports as well. In San Francisco International Airport, private police department is in charge of collection of data, national events, VIP protection, law enforcement, cooperation within facilities, daily-based patrol and traffic control. Under guidance and supervision of national organizations, such as TSA, general police department interprets X-Rays, operates metal detectors, checks passports or IDs and observes reactions to explosives. Under these circumstances, studies about advancement of cooperation and duties of general police department and private police department necessitated: especially about private police department and their training for searching equipments, decrease in number of turn over rate, invention of technology and prior settlement in estate for security. The privacy of the public, who make up the major population of airport passengers, must also be minimized. In the following research, the activities of police departments in San Francisco International Airport will be analyzed in order to understand recent actions of the United States on airport security.

  • This thesis investigated basic thinking of Pansori reading text appearance. Among Pansori reading texts, it is versions include unfamiliar contents and scenes in text. They was created by writers of Pansori reading text. Why created a writers of Pansori reading text them? First, writers of Pansori reading text created new contents and scenes in order to show their knowledge. Reading texts of this feature are 28pages version Chunhyangjun belonged to Kim Kwang-sun, 87pages version Chunhyangjun belonged to Sa Jae-dong, 154pages version Chunhyangjun belonged to Hong Yun-pyo etc. This reading texts was effected on knowledge culture of Chosun later period. Second, writers of Pansori reading text created new contents and scenes in order to reenact festivities field. Reading texts of this feature are 75pages version Chunhyangjun belonged to Kyungsang university, 52pages version Chunhyangjun belonged to Keimyung university etc. the former shows story field and Pansori field, the latter shows play field of Walja. Third, writers of Pansori reading text created new contents and scenes in order to lampoon yangban authority. Reading texts of this feature are 72pages version Chunhyangjun belonged to Chungnam university and it's affiliation, 59pages version Chunhyangjun belonged to Park Sun-ho and it's affiliation etc.

An improved methodology for estimating traffic accident cost savings in the (preliminary) feasibility study ((예비)타당성조사의 교통사고 감소편익 산정방안 보완 연구)

  • This paper proposes an improved methodology for estimating traffic accident cost savings in the transport appraisal. Four major problems from the existing framework are identified and their alternatives are suggested. First, casualties in the established approach are classified by just two types of 'killed' and 'injured'. This study supplies the indices of fatality further details. Namely, road victims are regrouped by 'killed', 'seriously injured', 'slightly injured', and 'accident reports'. Those of railways are similarly sorted by 'killed', 'seriously injured', and 'slightly injured'. Second, damage only accidents are not satisfactorily considered in the current arrangement. The accidents should be considered as one of the accident types and the social cost of them should also be evaluated. Third, the unit cost of accidents is given by the total value. The unit cost is consisted of several elements and each loss would be useful for a policy frame. This study breaks down the total figure into four pieces of costs, namely production loss, medical treatment, property loss, and administrative costs. Finally, there is inconsistency in the audit between roads and railways. Road accidents are analyzed by road types. On the other hand, patronage or others is the classification rule of rail accident costs. This paper suggests a way that the accident costs of two modes can be coherently estimated based on the level of services by each mode. The result of this study is expected to help frame more cautious social overhead capital investment policies.

An Effect Analysis on the Management and Service Evaluation System for Bus Company (시내버스업체의 경영 및 서비스 평가제도 도입 효과분석)

  • Gyeonggi-do has conducted bus management and service evaluation of bus operating company since 2005 under the law for promoting public transportation. The evaluation results are used for improving bus service, making policy, and estimating incentives to bus companies. A lot of cost and man-month are needed to evaluate bus management and service for bus operating company, and many companies are against the evaluation. Therefore, the effect analysis on evaluation system should be followed to maintain it. This research results in the evaluation system has positive effects through quantitative and qualitative analysis. The data of bus company's operation condition in 2005 and 2006 are used for a comparative analysis. From the survey result for the company, bus drivers, and administrators, it results that positive effects are predominant. The results of this research could be used for a shield against some criticism about appropriateness of the evaluation criteria and effectiveness of the evaluation system. For improving bus service, evaluation items and criteria could be added or adjusted based on this research.

  • 응급의료에 관한 법률에 따라 구조 및 응급처치에 관한 교육의 대상자로 일반시민인 구급차등의 운전자, 여객자동차운송사업용 자동차의 운전자, 보건교사, 경찰공무원 등에게 심폐소생술 교육을 실시하여 26,900명이 과정을 수료(한국, 2007)하였으나 초중고 학교 교과과정 중에는 체계적인 응급처치 교육이 없고 교육강사, 교육장비 등이 취약(한국, 2005)하여 교육체계의 확립이 필요한 실정이다. Kerschaver 등(1989)은 학생들을 대상으로 심폐소생술 훈련을 하는 것은 효과적이고 11살 부터 단순화한 내용으로 보다 쉽게 교육을 시작할 수 있을 것이라고 했으며 Lester 등 (1996)은 지식과 술기 능력 간에는 상관이 없으나 중학교 1학년 때가 적절한 훈련시기라고 했고 Urey 등(2003)은 의무과목으로 6-7살 초등학생을 위한 응급처치 프로그램, Lubrano 등(2005)은 8-11살 학생을 대상으로 하는 응급처치 교육 프로그램의 운영을 보고했다. 박 등(2006)은 초등학교 5-6학년 학생과 성인 간의 심폐소생술 교육 효과를 분석하여 학생군이 과정에 대한 이해는 우수했으나 술기에서는 적절한 흉부압박이 미흡했다는 결과를 제시하여 초등학생을 대상으로 하는 이론 교육이 효과가 있었으나 실습 교육은 체격에 제한을 받는다는 점을 시사했다. 체격은 물리적으로 측정, 확인할 수 있는 사람 몸의 상태로써 성별, 키, 몸무게 등의 전체적인 것과 각 부위의 크기, 모양, 비율 등의 부분적인 것으로 구분할 수 있으나 여기서는 키, 몸무게가 흉부압박에 영향을 끼쳤다고 볼 수 있다. 따라서 본 연구에서는 초등학교 6학년 학생을 대상으로 체격조건(키, 몸무게)과 성인 마네킨 흉부압박 깊이 간의 상관관계를 밝히고 회귀식을 도출하여 효과적인 심폐소생술이 가능한 대상을 제시하고자 한다.

Air passenger demand forecasting for the Incheon airport using time series models (시계열 모형을 이용한 인천공항 이용객 수요 예측)

  • The Incheon airport is a gateway to and from the Republic of Korea and has a great influence on the image of the country. Therefore, it is necessary to predict the number of airport passengers in the long term in order to maintain the quality of service at the airport. In this study, we compared the predictive performance of various time series models to predict the air passenger demand at Incheon Airport. From 2002 to 2019, passenger data include trend and seasonality. We considered the naive method, decomposition method, exponential smoothing method, SARIMA, PROPHET. In order to compare the capacity and number of passengers at Incheon Airport in the future, the short-term, mid-term, and long-term was forecasted by time series models. For the short-term forecast, the exponential smoothing model, which weighted the recent data, was excellent, and the number of annual users in 2020 will be about 73.5 million. For the medium-term forecast, the SARIMA model considering stationarity was excellent, and the annual number of air passengers in 2022 will be around 79.8 million. The PROPHET model was excellent for long-term prediction and the annual number of passengers is expected to be about 99.0 million in 2024.

  • This paper annually estimates the economies of density, scale and scope with the data of cost and output of 27 leading air carriers to suggest the political findings and strategies of raising the cost efficiency of our air transport industry. The estimation results and their implications are as follows. First, KAL and Aha would reduce their cost if they could increase international route density. Second, KAL and AAR would reduce their cost if they could expand the network but save their cost more effectively if they could increase international route density rather than expand the network. Third, the minimum efficient scale that minimize average cost of two national flag carriers which operate by the present output ratio among domestic passenger, international passenger and freight appears to be larger than each present output level of KAL and AAR. Meanwhile, it appears that minimum efficient scale of small size low cost carriers which operate domestic-oriented route is much smaller than minimum efficient scale of national flag carriers. Finally, it appears that there exists the diseconomies of scope between domestic passenger and the other outputs, that is, international passenger and freight and therefore save their cost if freight output ratio is higher and domestic passenger output ratio is lower than the Present level.

The Study of Compaction Characteristics of Cataclasite Fill Material using Large and Standard Compaction Tests (대형다짐시험 및 표준다짐시험을 이용한 파쇄암 성토재의 다짐특성 연구)

  • The new airports apply the systematic runway foundation construction to build the high quality runways in order to take the leading position to win future aerial demands and stay ahead of competitors. This study is intended to supplement the weakness of existing standard compaction test to minimize residual settlement of lower weak foundation during operation of passenger berthage. The fill material was sampled from 4 construction sites using the fill material with diameter of 100mm or less, and the standard compacting test (KS F 2312), large circular mold compacting test, and water-replacement field density test (ASTM D 5030) were conducted. The regression analysis of correlation of the field density test and the standard indoor compaction test showed the unreliable value at P-value of 0.05, and the regression analysis of the field density test and the large indoor compaction test showed the high correlation with R value of 0.8878. It is judged that the construction of overall uniform quality can be assured as the site condition is truly reflected only if the compacting test method is selected in consideration of maximum size of fill material when evaluating the maximum dry density used in design and construction.
