This study is a basic research on looking onto bringing performance warranty contract into the country, to consider the usage in architecture which it is usually used on road pavement in developed countries. The study will also apply performance warranty contracts on public private partnerships through examination and analysis of various matters which will lead to globalization of the korean architecture industry, the increase of quality of result, better convenience for the orderer, the decrease of cost, and the acceleration on research for technical development.

Following the successful entry of Korean builders into overseas construction markets, Korean architects have also become active abroad, and have expanded their market share centered on the Southeast Asia and Middle Eastern areas through Design-Build contracts. However, there have also been However, conflict can arise among the project applicants in the contract stage due to the special characteristics of overseas construction. This sometimes leads to the failure of a project. Using statistics and case studies, this study identified problems in the overseas construction market. It analyzed inefficient factors of the architectural design contract phase in the overseas through a survey and an interview of specialists. Based on the results, this study suggested a master architect system, and some resolutions to the problems of organizing an internal evaluation system. It is expected that the results can be used as practical data for companies that want to advance into the overseas market.

기계설비공사의 하자담보책임기간은 <건설산업기본법시행령 제30조 관련 별표 4>, <국가를 당사자로 하는 계약에 관한 법 시행규칙 제70조 관련 별표 1> 및 <주택법시행령 제59조 제1항 관련 별표 6>에 의하여 2년 이내로 규정되어 있다. 그러나, 일부 발주기관 및 건설업체에서 기계설비공사의 하자담보책임기간을 법으로 정한 기간을 초과 설정하여 하자보수 비용 및 하자보증수수료 증가 등의 민원이 발생되고 있어, 건설교통부 및 재정경제부는 하자담보책임기간을 법으로 정한 기간을 준수하여 줄 것을 발주기관에 협조 요청한 바 있다. 이와 관련 대한설비건설협회에서는 기계설비공사 하자담보책임기간을 법으로 정한 기간을 정하여 줄 것을, 시공능력 300위 이내의 일반건설업체 대표이사와 하도급계약담당 부서장에게 요청하였다. 또한 계약 체결한 기계설비공사의 하자담보책임기간이 법으로 정한 기간을 상회하는 경우에는 회계통첩에 의하여 계약서상의 기간을 조정하여 하도급계약시에는 법으로 정한 하자담보책임기간을 설정하여 줄 것을 요청하였다.

Integrated project delivery (IPD) is suggested as an alternative to traditional delivery methods such as design-build (DB), design-bid-build (DBB), and construction management at risk (CMR). Many foreign research studies have approached IPD not only in the contractual aspect but also the work implementation method aspect. However, most research projects in Korea have focused on the contractual aspect of IPD for asserting that the characteristics are the critical matter. The Korean institutional and legal system does not permit the multi-party agreement; therefore, it is difficult to adopt IPD in Korea's construction industry. The researchers do not wait the system to be changed, but we do identify the possibility of adopting IPD in Korea in the perspective of work implementation method, except the contractual characteristics. Thus, the goal of this research is to identify one project that does not include IPD agreement but utilizes other IPD characteristics whose contractual results have similar performance to those that utilize all characteristics of IPD including agreement. This research is expected to enhance performance of the construction project in a Korean construction environment by embracing IPD characteristics as overcoming limits and bounds of the traditional delivery method.

강섬유 보강 콘크리트는 콘크리트 내에 강섬유를 임의로 투입함으로써 취성의 콘크리트 물성을 연성적으로 향상시킴과 동시에 압축, 인장, 휨 강도를 증가시킨 새로운 구조 신소재라고 할 수 있다. 과거 70년대가 SFRC의 재료적 물성에 대한 실험적 시기였던 반면 현재는 현장에 SFRC를 시공하는 응용단계라 할 수 있다. SFRC의 우수성은 선진 외국의 경우 일반적으로 기업, 정부, 계약관계자 등에게 잘 인식되어 있어 이미 많은 시공현장에서 응용되고 있다. 이로 인하여 외국(미국, 일본, 유럽 등)의 경우 구조적으로 안정되고 경제적인 구조물을 실현하고 있으나 국내의 경우는 안타깝게도 SFRC에 대한 인식이 아직 일반화되어 있지 않으며 시공현장도 매우 드문 실정이다. SFRC에대한 연구는 국.내외 학회에서 꾸준히 연구, 개발하고 있으며 이들 연구결과가 경제적이고 우수한 구조물을 실현하는데 기여할 수 있기를 기대한다.

국가 발주 공사는 3월 1일, 지방자치단체 발주 공사는 3월 9일 예정가격을 작성하는 사업부터 표준시장단가 제도가 적용된다. 대한설비건설협회(회장 이상일)를 비롯한 건설관련 유관단체에서는 실적공사비의 불합리한 공사비 산정 기준 및 운영관행에 대해 폐지 건의를 지속적으로 해왔다. 정부는 이같은 건의를 받아들여 지난해 12월 17일 실적공사비 제도개선을 위한 공청회를 개최하고 개선안을 발표했으며, 이번 계약예규 개정을 통해 개선됐다. 이에 따라 실적공사비 제도를 대체하는 새로운 공공공사비 산정 방식인 표준시장단가 제도가 지난 3월 1일부터 시행에 들어감에 따라 기획재정부는 국가계약예규를, 행정자치부는 지방계약예규를 개정해 각각 지난 3월 1일과 3월 5일 공포하고 시행에 들어갔다. 각 개정 계약예규는 실적공사비의 명칭이 표준시장단가로 변경됨에 따라 용어를 수정했고, 실적공사비 제도 적용배제 범위를 신설했다. 또한 적용배제 공사범위는 300억원 미만 공사 중 100억원 미만 공사는 실적공사비(표준시장단가) 적용을 폐지하고, 100억원 이상부터 300억원 미만 공사는 2016년 12월 31일까지 한시적으로 적용하지 않는다. 정부는 100억원~300억원 공사에 대한 '실적공사비 적용 배제제도' 연장 여부를 2016년 하반기에 실적공사비 현실화 수준 등을 평가하여 재검토할 예정이다. 한편, 표준시장단가 제도는 공사비를 산정할 때 현행 계약단가 외에도 시공단가와 입찰단가 등 다양한 시장 거래가격을 반영하는 제도로, 지난 1월 22일 국가정책조정회의를 거쳐 확정된 '공공건설 공사비 적정성 제고방안' 후속조치의 일환으로 공공공사비 예정가격 산출방식의 하나인 실적공사비제도를 개선한 것이다.

A construction project consists of many types of contracts. In the process of selecting the successful contractor after bidding, there will inevitably be fierce competition, which may lead to corruption or bribery. Even after signing the contract, during the period of settling the amount of the contract, bribery could occur. Such corruption could harm the development of the construction industry. It is, therefore, necessary to establish a strategy to prevent corruption by strengthening the transparency of the bidding process. In this study, to prevent corruption in the construction industry, a new service is proposed in which the successful bidder is selected by a professional third party, and the introduction of diverse delivery systems for construction projects and the invigoration of alternative methods of settling disputes are also proposed in this study.

We need the contingency cost in order to deal with the uncertainty to be accompanied inevitably at the construction and an every kind risk not to forecast in advance. And also the contingency colt needed for the change order and we need it for reduction of the delay and reduce the trouble between owner and constructor. This study, through checking and analyzing the risk factor, in the step of domestic construction, suggests optimal management reserve to specific business about the contract type and the scale. The main results of this research are summarized as follow. First, I investigated the recognition about the contingency cost, grasped the risk to be happened at the construction step and found out the frequency occurrence, through making up question to engineer are carrying out their job in the domestic construction. Second, I computed optimal contingency cost rate by the statistics investigation, and proposed an improvement plan and problem when compute a contingency cost.
