  • A Study on the Countermeasures against International Computer Crime focusing on the Police Investigation Procedure. These days, much more intelligent, varied and advanced techniques for computer crimes have been used than for development of technology. In particular, it has been reported that the damages are enormous. Damages of some computer crimes can not be accurately reported. This study is to speculate specific types of computer crimes and obtain its prevention and countermeasures centering on the Police Investigation Procedure. In particular, it is to speculate international cooperation under the condition that global damages occur frequently due to preparation of advanced network environment.

  • 세종전자사전이 궁극적으로 범용전자사전을 지향한다는 점에 비추어 볼 때, 텍스트 자동 분석과 생성, 정보 검색 및 자동 번역 등에 활용될 데이터베이스로서의 전자사전은 자연 언어 어휘의 내적 구조와 기능방식에 관한 정보들, 가령 음운 통사 의미 화용적 가치와 실현 조건 등에 관한 정보들을 체계적이고도 정교하게 담고 있어야만 한다. 의존명사, 대명사, 수사 범주에 속하는 언어 단위들은 단일 명사와 구별되는 어휘 통사적 속성들을 지니며, 사전의 기술 구조에는 그 정보 값들을 체계적으로 명시화할 수 있는 정보 항목과 표상 구조가 설정되어야 한다. 가령 의존명사처럼 통사 의미적 자율성을 지니지 않는 언어 요소의 경우, 어휘 관계 정보보다는 인접하는 여타 언어 단위들과의 호응관계나 결합제약 조건들이 더 중요한 정보일 수 있다. 본 사전이 체언사전의 하위사전으로 별도로 구축되는 것은 단일어 사전에서 그러한 정보들을 효과적으로 표상하기 어렵기 때문이다. 그러나 본 사전은 실제적으로는 체언사전에 통합되어 운영된다는 점에서 이중적 지위를 누린다고 하겠다.

Study on Digital Investigation Model for Privacy Acts in Korea (개인정보보호법 기반 디지털 포렌식 수사 모델 연구)

  • As recently Privacy Acts in Korea enforced in domestic companies' personal information management needs of a growing obligation for the safety measures and the right of personal information collection, use, limitations, management, and destroyed specifically for handling personal information. Such this regulations should be required technical and policy supports. Accordingly, for the enterprise incident has occurred, the personal information management system behave correctly operating to verify that the safety measures taken, and be determined by the specific preparation to be done. So the first, preparation phase corresponds to the upcoming digital forensic investigation model. On the other hand, the response team also carried these measures out correctly, it needs to be done to check the compliance of Privacy Act. Thus a digital forensics investigation model is strictly related with the implementation of the Privacy Acts and improve the coping strategies are needed. In this paper, we suggest a digital forensic investigation model corresponding to Privacy Act.

  • 국토해양부는 수자원 상황을 효율적으로 모니터링하기 위하여 하천수 관리자, 하천수 사용자 및 일반 국민에게 하천유량, 사용량 및 기타 수문정보를 실시간으로 제공할 수 있는 모니터링 시스템을 시범 구축하였다. 향후 유역 물수지, 하천갈수상황을 분석할 수 있는 시스템을 추가하여 전국의 하천유량을 실시간으로 모니터링하고 관리하기 위하여 실시간 물관리시스템 구축을 추진 중에 있다. 구축된 실시간 물관리 시스템의 효율적 운영을 위해서는 하천 유량 등 수문정보와 더불어 하천 취수량 정보가 필수적이다. 본 연구에서는 실시간 물관리의 핵심자료인 하천수사용량을 실시간 수집할 수 있는 "영상을 이용한 실시간 하천수사용량 수집시스템"을 개발하였다. 개발된 시스템은 유량계 혹은 전력량계를 통해 표출되는 관련정보를 CCTV 카메라로 촬영하여 영상을 취득하고, 문자인식 알고리즘을 활용 수치로 변환하여 사용량을 제공해 주는 시스템이다. 관리자는 영상을 촬영한 후 문자로 인식된 사용량 주서버에 전송하여 저장하기 때문에 사용량과 함께 현장상황을 확인할 수 있다. 개발한 시스템은 다양한 형태의 유량계, 전력량계로 구성되어 있는 계측시설에 대해 적용이 용이하고, 기존 유량계 등을 그대로 활용하여 자료를 수집할 수 있기 때문에 저비용으로 하천수사용량 자료를 수집 관리할 수 있다. 현재 국토해양부에서는 "하천법"에 근거하여 용도별 일정규모이상의 하천수사용자에 대해 일사용량을 월별로 수집하고 있으나, 자발적인 선사용 후보고 체계로 객관성확보가 어렵고 실시간 물관리를 위한 자료로 활용이 곤란한 상황이다. 그러나, 본 시스템을 통해 하천수사용량을 수집할 경우 실시간으로 수치화된 사용량과 영상자료가 전송되어 서버에 저장할 수 있어 객관성을 확보하고 활용도를 높일 수 있는 장점이 있다. 본 시스템은 한강 홍수통제소 관할 허가지점에 3개소, 금강 관할 허가지점에 1개소에 시험적용하여 평가한 결과, 저비용으로 하천수 취수량을 효과적으로 수집할 수 있는 것으로 평가되었다.

  • 최근 소송에서의 디지털 증거의 비중과 수사과정에서의 디지털 포렌식의 중요성과 관심이 높아지고 있으며, 미국을 포함한 여러 국가들은 이러한 추세를 반영하여 효과적인 디지털 증거 수집과 분석을 위한 법제들을 마련하고 있는 상황이다. 국내의 경우도 디지털 포렌식 기술에 대한 관심과 실제 사건해결에 있어서의 이용도가 높아지고 있음에도 아직까지 관련 법제들은 미비한 상황이다. 본고에서는 먼저 '국가 디지털 포렌식 법률 체계'를 제시하고 각각의 구성요소들에 대해 살펴 본 후, 국가 디지털 포렌식 법률 체계에 기반하여 미국의 법제 현황과 국내 법제 현황을 비교한다. 또한 디지털 포렌식 수행 절차에 따른 법적 요구사항들을 정의해보고, 국가 디지털 포렌식 법률 체계 완성을 위한 추진방안을 제시한다. 마지막으로 효과적인 디지털 증거의 수집 분석과 디지털 포렌식 기술 활성화를 위해 국내 법제들이 나아가야 할 방향과 추진방법을 제시한다.

The Developmental Program of Emergency Medical System in Correctional Facilities (교정시설 내 응급의료체계 발전방안)

  • The purpose of Emergency Medical System(EMS) is what a patient returns to society with recovering mental tone in the shortest time as giving prompt and proper medical treatment to patient in emergency situation, and the Correctional Administration(CA) is purposed for the convict to return and settle down to society after release from prison in success as executing schooling, enlightenment activity, vocational training to convict who was quarantined from the society for the term of imprisonment. The EMS and CA will coincide each other which is reverting people to society in safety. This study aims to suggest the developmental program of EMS in correctional facilities through the cause of emergency situation, system, human resources, establishment, medical equipments, state of budget and the point issue for safety of victim who has many chances that is exposed to physical damage and disease because of particularity of lower culture in correctional facilities and the staff who works there. First, in the view of the correctional facility security system, a proper number of the emergency rescuers should be employed. Second, the effective transportation system along with some emergency medical equipment needs to be established. Third, the correctional officers and the prisoners should be learned the first-aid training which is realistic, practical and systematic. Fourth, the cooperative system should be established such as 1339 emergency medical information center in society. Fifth, the Ministry of Health and Welfare must increase EMS budget for correctional facilities.

Comparative Analysis of Anti-Terrorism Act and its Enforcement Ordinance for Counter-Terrorism Activities (대테러 활동을 위한 테러 방지법과 시행령의 비교 분석)

  • As the need for anti-terrorism legislation has been continuously argued, Anti-terrorism act has been enacted and enforced. On the other hand, there still remain a lot of points to be discussed regarding the definition of the concept of terrorism, matters of human rights violations, strengthening authority of the investigation and intelligence agencies, and mobilization military forces for the suppression of terrorism. Also, reviewing Anti-terrorism act and its enforcement ordinance draft, this legislation seems to regulate terrorist groups like IS. If so, in the case of terrorism of North Korea or domestic anti-government organizations, whether this law would be applied could become an issue. In the case of terrorism of North Korea, Ministry of National Defense has a right of commandership in the military operations, however, it is also possible to apply the article 4 of Natural Security Act a crime of performing objective-or a crime of foreign exchange on Criminal law as legal grounds for not military terrorisms but general investigations. Therefore, it is necessary to involve consideration about this matter. Furthermore, in the view of investigation, Anti-terrorism act and its enforcement ordinance draft do not mention Supreme Prosecutors Office and Ministry of Justice that conduct investigations. In the case of terrorism, the police and prosecution should conduct to arrest criminals and determine crimes at the investigation stage, however, any explicit article related to this content in Anti-terrorism act and its enforcement ordinance draft was unable to be found. Although Anti-terrorism act is certainly toward preventive aspects, considering some matters such as prevention, actions on the scene, maneuver after terrorism, arresting terrorists, investigation direction, cooperation, and mutual assistance, it is necessary to reflect these contents in Anti-terrorism act. In other words, immediately after terrorists attacks, it is possible to mobilize the military operations by Integrated Defense act in order to arrest them in the case of military terrorism. Nevertheless, because both military terrorism and general one are included in the investigation stage, it needs to begin an investigation under the direction of the prosecution. Therefore, above all, a device for finding out the truth behind the case at the investigation stage is not reflected in the current Anti-terrorism act and its enforcement ordinance draft. Accordingly, if National Intelligence Service approaches information at the prevention level in this situation, it may be necessary to come up with follow-up measures of the police, the prosecution, and military units.

  • Many of crimes are solved by the report of people. Therefore, countries pay compensation to crime reporter. However, the current system of compensation is focused on the report of criminal fact and criminals arrest, so that there is no compensation on the providing evidence. On the other hand, since the current judicial system adopted the principle of trial by evidence, all the facts are made by the evidence. But it is impossible to obtain all the evidence only by law enforcement agencies. Therefore, it is necessary for people to report the evidence positively. So it is necessary to positively take advantages of smart phones, vehicle black boxes and cctvs. Various incentives such as compensation would be needed to require the evidence of smartphone or black box, cctv. In order to strengthen evidence report, it will be needed the legislation of crime report compensation, smartphone apps development including the provision of various incentives.

  • The use of DNA in identification is growing. The criminal DNA databases are in operation in some countries including the UK, Austria, Germany, and US. The militaries and law enforcement agencies in these countries have used the DNA profile. In Korea, DNA identification has been used in determining paternity and in criminal cases since the middle 1990's, and in recent years law enforcement agencies are promoting a national DNA database for identification. The DNA database threatens our civil liberties because of its potential to be used as an instrument of surveillance. Expanding the database puts increasing numbers of people on a 'list of suspects'. Nevertheless, there is little social concern about using DNA database for identification. This paper reviews social issues related to the establishment of DNA database and investigates the features of DNA profile and DNA Database establishment project promoted law enforcement agencies.

Gambling had spread gradually in our society and these trend caused much problems. It is true that confrontation was insufficient extremely in reply than gravity of gambling. Tend to recognize gambling by one of leisure life by effect of lawful gambling so-called such as horse racing, casino. While pernicious evil of gambling to our society, police's confrontation system is not effective. The police does technique investigation to look for and arrest criminal using criminal's fixed means and method and habit. Crime who correspond to technique investigation is prescribing to crime technique mutual assistance data administration rule. Gambling is excepted in technique crime's subject despite is very repeatable and is crime who have habit. The police must improve in gambling criminal investigation system for society public order.
