Legality of the Welfare Benefits Termination and Modification Procedure under the National Basic Living Security Act: Applying the Due Process of Law Principle (국민기초생활보장법상의 급여변경 및 중지절차의 적정성에 대한 법적 고찰 : 적법절차원칙의 적용)

  • The Korean government's recent large-scale termination and modification of welfare benefits revealed a procedural problem under the National Basic Living Security Act. Under the Act, welfare recipients have a legal right to make complaints only after the termination or modification is enforced; the Act fails to provide the recipients with an opportunity for a hearing before termination or modification, and this creates serious threats to the recipients, whose livelihoods are dependent on welfare benefits. Korean jurisprudence has adopted the due process of law principle. The principle originated from the due process in US jurisprudence, and Korea has applied it broadly to any government actions that restrict individuals' constitutional or legal rights. This paper reviews the termination or modification procedure under the Act with the lens of the due process principle and criticizes that the current law is not in compliance with the principle. In supporting that such termination and modification procedure infringes on welfare recipients' protected rights, this paper discusses two theories as to what rights are protected. First, termination or modification of welfare benefits can be considered as deprivation of property. The 'property' theory may be weak under Korean jurisprudence, because the concept of property under the Korean Constitution is narrowly construed. Second, this paper relies on the constitutional provision that recognizes "the right to a life worthy of human beings," which requires the State to guarantee minimum standard of living for all. As welfare recipients are deemed to receive benefits as a right under the Constitution, any deviation from the minimum requirement would constitute a violation of constitutional rights. In any case, termination or modification of welfare benefits that are concretized under the Act should be protected under the due process principle, because the principle would cover any government actions that restrict established legal rights. This paper argues that the procedural due process requires the recipients be guaranteed an opportunity to have a hearing before the termination or modification is enforced. An independent decision-maker should hear the proceedings, and the recipients should have an option to orally present their opinions in front of the decision-maker. The hearing process under the Administrative Procedures Act of Korea offers elements that would satisfy these procedural requirements. Thus, this paper concludes that the National Basic Living Security Act should be amended to adopt the hearing process under the Administrative Procedures Act in its termination and modification procedure.

Economic Inequality in Perceived Oral Health Behavior among Adults in Korea (한국 성인의 경제적 불평등에 따른 구강건강행태)

  • This study was conducted to investigate the status of oral health behavior according to economic inequality in Korea. Raw data for the 3rd year (2015) of the 6th national health and nutrition survey were analyzed. Among surveyed individuals, adults over the age of 19 were designated as research subjects. The results indicated that a smaller 'house income' was associated with a higher supply and demand experience for basic living and a higher DMFT. Additionally, a higher DMFT was associated with a lower 'house income', lower 'education level', and the 'experience of basic living security received'. Oral health behavior inequality was caused by economic inequality. Overall, these results indicate that it is necessary for the oral health service of vulnerable groups to strengthen preventive activities through comprehensive arbitration policies regarding the social decision factors of public health projects.

  • The purpose of this study was to find concrete measures to improve the subjective health level, happiness and quality of life of the elderly according to economic level and to propose social and policy alternatives accordingly. As a research method, 63,929 elderly people aged 65 or older were surveyed using the Community Health Survey (Indicator Bank) _v09, and the frequency of health use by economic level, subjective health level, euphoria and quality of life Analysis and Chi square analysis and independent t-test. Multi variate logistic regression analysis was performed with subjective health level as a dependent variable and multiple linear regression analysis was performed to determine the factors affecting euphoria and quality of life. The results of the study are as follows. In the case of recipients, medical use was lower than that of non-recipients, lower education level, female age of 75 years or older, and less stress, In case of present or past recipients, the result of non - receipt increased as the subjective health level was worse, and the non - recipient had higher euphoria and quality of life. As a result, there is a need for alternatives to increase opportunities for medical use among the recipients, with particular attention being paid to women and elderly people over 75 years old. It is expected to be used as a basic data to effectively improve the health promotion, happiness and quality of life of the elderly people of low income group.

A Study of Labor Entry of Conditional Welfare Recipients : An Exploration of the Predictors (취업대상 조건부수급자의 경제적 자활로의 진입에 영향을 미치는 요인에 관한 연구)

  • This paper examines the labor entry of conditional welfare recipients. This paper focuses on two questions. First, what is the percentage of conditional welfare recipients who have labor entry? Second, what are the predictors in the labor entry and the duration to the entry? Using Data about 917 welfare recipients who participated in the self-sufficiency programs of the Offices for Secure Employment in Seoul, this paper attempts to answer the above questions. Logistic regression analysis and survival analysis are adopted to identify variables predicting labor entry of conditional welfare recipients. This paper also utilizes a multiple imputation method to deal with the limitation of data by the missing values in some variables. The major findings are as follows: about 43.8% of the conditional welfare recipients have successful labor entry; and in the labor entry and the duration to the entry, gender, household, information and referral services for employment, health and willingness for self-sufficiency are the predictors that are statistically significant. Among these variables, health and willingness for self-sufficiency are more noticeable; it is recognized that programs to care for health of welfare recipients who want to have the labor entry and counseling programs to strengthen welfare recipients' willingness for labor entry are very important for them to be successful in the labor entry. This paper provides a basic knowledge about realities of the conditional welfare recipients' labor entry, identifies research areas for further research, and develops policy implications for their self-sufficiency.

Benefit-Cost Analysis and Sustainability of National Pension (국민연금의 수급부담구조분석과 지속가능성)

  • The National Pension of Korea is a public social security system designed to alleviate social risks and poverty that has had a major impact on the quality of life for the aging population. However, a rapidly aging population and low fertility threaten the sustainability of national pension in Korea. The National Pension Research Institute publishes a nancial projection every ve years; consequently, the government has lowered the entitlements for the sustainability of national pension based on the projection results. The current reform of the pension system that arbitrarily reduces the entitlements might detract from the income security role of the national pension for pensioners without accounting for the highest elderly poverty rate in the OECD countries. We first discuss methods for the financial projection of the national pension in terms of population, subscribers, and pensioner projections in order to estimate the pension reserve fund and the financial depletion year. We also conduct a sensitivity analysis for population variables, institutional variables, and economic variables based on pension reserves and the financial depletion year. We evaluate intergenerational fairness between the income hierarchy by conducting a money's worth analysis. Finally, we investigate the possibility of the sustainability of national pension by adjusting pension contributions and entitlements (income replacement rate). A new dependency ratio shows that a simple reform of the national pension does not secure the sustainability of the national pension without adapting a pay-as-you-go system.

사학연금 실업급여를 대비한 재해보상급여 활용방안 연구

  • 본 연구의 목적은 폐교로 인해 퇴직한 사립학교 교직원을 대상으로 사학연금의 재해보상기금을 활용하여 실업급여를 제공하는 방안을 모색하는데 있다. 이를 위해 먼저 폐교 퇴직 교직원 현황 및 사학연금에서 폐교로 인한 퇴직 시 연금 지급규정, 재해보상 관련 쟁점, 고용보험 임의가입방안 관련 쟁점 등에 대해 고찰하였다. 다음으로 폐교로 인한 퇴직 교직원에 대한 정책방안들로 현행안, 재해보상기금을 활용한 구직급여 제공방안, 고용보험 임의가입안에 대한 재정추계를 실시하였다. 주요 분석결과는 다음과 같다. 첫째, 불과 5년 뒤인 2024학년도부터는 대입가능자원이 대학입학정원을 크게 밑돌 것으로 전망되고 이로 인해 대학의 통·폐합과 구조조정 등이 발생하여 현재보다 훨씬 더 많은 대학이 폐교될 것으로 예상된다. 둘째, 현행 사학연금법 상연금지급개시연령은 65세이나, 공무원연금법을 준용하고 있는 사학연금에서 폐교로 인해 퇴직하는 경우 퇴직 때부터 5년이 경과한 때 연금을 지급하는 규정으로 인해 여러 문제점들이 발생하고 있다. 셋째, 폐교로 인한 비자발적 퇴직 교직원의 소득활동 중단에 따른 소득 대체 및 생활안정을 위한 방안마련이 시급하다. 넷째, 산재보험과 공무원연금·군인연금 등 공적 재해보상제도들은 모두 업무상 또는 공무상 사고나 질병으로 부상·질병·장해·사망이 발생하면 재해로 정의하고 있어 사학연금에서 폐교를 재해로 포함시키는 것은 적합하지 않으며, 실업에 대응하는 사회보장제도인 고용보험에 포함시키는 것이 보다 타당할 것으로 보인다. 다섯째, 사립학교 교직원에 대한 고용보험적용 여부를 논의하기 위해서는 대학교수의 법적 지위와 근로기준법의 적용가능성이 중요한데, 향후 대법원이 대학교수를 근로기준법상 근로자로 판단한다면 사학 교직원의 고용보험 가입도 가능하게 될 것이다. 여섯째, 사학연금가입자들을 위한 고용보험 도입이 바람직하나, 이것이 단기간 내에 실행되기 어렵다면 고려 가능한 대안으로 공무원연금과는 다른 사학 교직원 직무에서 발생하는 재해의 특성을 고려하여 사학재해보상제도에서 폐교로 인한 퇴직을 재해보상에 포함시키고 구직급여를 제공하는 방안을 검토해 볼 수 있다. 또한 재정추계결과는 다음과 같다. 첫째, 현재 폐교로 인한 퇴직 시 제공되는 연금 대신에 재해보상기금으로 구직급여를 제공할 경우 사학연금기금에 재정적으로 상당히 긍정적 효과가 있을 것으로 예상된다. 둘째, 폐교로 인한 2018년 현재 연금수급자(285명)의 예상 연금급여액 추계에 의하면 2050년까지 누적해서 볼 경우, 재해보상기금을 활용하여 구직급여를 제공하는 방안이 폐교로 인한 퇴직 시 연금을 지급하는 현행안보다 2018년 현재가치로 123억 원 정도 유리한 것으로 나타났다. 셋째, 현재 수급자와 미래 수급자의 예상 연금급여액 추계에 의하면 2028년까지 누적해서 볼 경우, 재해보상기금을 활용하여 구직급여를 제공하는 방안이 현행안보다 2018년 현재가치로 747억 원 정도 재정적으로 유리한 것으로 나타났다.

입력수급전망(入力需給展望)과 고등교육(高等敎育) 개혁과제(改革課題)

  • 본(本) 연구(硏究)에서는 인력계획(人力計劃)을 위한 인력필요량(人力必要量) 예측(豫測)에 초점(焦點)을 맞추기보다는 인력공급전망(人力供給展望), 인력수요분석(人力需要分析), 수급간(需給間) 상호관계(相互關係)등에 주목함으로써 고등교육제도(高等敎育制度)의 개혁과제(改革課題)를 도출(導出)하고자 하였다. 인력공급(人力供給) 측면에서는 2000년대 고졸자의 격감(激減)을 전망(展望)하고 이에 근거(根據)하여 대학교육(大學敎育)에 대한 초과수요(超過需要)를 전제로 하였던 규제위주(規制爲主)의 교육제도(敎育制度)의 근본적인 변화(變化)가 요구됨을 보인다. 인력수요(人力需要) 측면에서는 우리 경제(經濟)가 지식집약경제(知識集約經濟)로 이행(移行)함에 따라 고등교육(高等敎育)의 양적(量的) 팽창(膨脹)보다는 질적(質的) 향상(向上)이 보다 요구되고 있음을 논의한다. 또한 수급간(需給間) 상호관계(相互關係)에도 주목하여 직업기술(職業技術) 고등교육기관(高等敎育機關)과 기업(企業)을 연계(連繫)하는 네트워크가 구축(構築)되어야 함을 강조(强調)한다. 이러한 인력수급분석(人力需給分析)을 바탕으로 대학(大學)의 경쟁여건(競爭與件) 조성(造成)과 직업기술 고등교육의 산(産) 학(學)네트워크 구축(構築)을 위한 교육개혁(敎育改革)의 기본과제(基本課題)를 제시(提示)한다.

Effect of Long-term Care Utilization on Health Care Utilization of the Medicaid Elderly (국민기초생활보장수급자의 장기요양 서비스 이용 여부가 의료 이용에 미치는 영향)

  • This study examined the effect of long-term care utilization on the health care utilization of Medicaid elderly. The subjects were 5,834 long-term care insurance with the level 1 Medicaid elders, who received either service or non-service. This study examined the impact of long-term care service on the probability of health care utilization and the costs of health care utilization. The total medical cost and inpatient day between 2009-2007 were significant factors affecting long-term care utilization (${\beta}=.29$, p< .001, ${\beta}=.33$, p< .001 ) and this variable explained 22.6% of the total medical cost and 22.4% of the inpatient day. The results showed that non-service in long-term care was associated with an increase in health care utilization. The current long-term care insurance system should place higher priority and more resource allocation on long-term care utilization to increase the efficiency of the insurance system.

A study of social welfare officials' recognition about improving 'National Basic Livelihood Security Program' (국민기초생활보장제도 개선에 대한 사회복지전담공무원의 인식 연구)

  • This research has analyzed the options of improving 'National Basic Livelihood Security Program' and factors influencing on them, focusing on the 345 social welfare officials' recognition and assessment of the program. As a result of the analysis, some difference has been identified in the assessment of respective options in accordance with how social welfare officials recognize and assess the program and its recipients. The assessments as to the options of improving restrictions on the able-bodied poors, implementation of the individual benefit method, and so forth were shown differently according to the age; years of service; amount of work; rationality of the criteria for selecting recipients; levels of payment by the 'National Basic Livelihood Security Program'; possibility of the recipients' exit from poverty; achievements of the self-supporting program; and evaluation of the program improvement efforts of the government. Based on this result of analysis, key tasks and improvement options for the 'National Basic Livelihood Security Program' have been explored on the occasion of the 10th anniversary of the program.
