  • 사전재해영향성검토 협의제도는 개발로 인해 발생할 수 있는 재해유발 요인을 사전에 검토하여 이를 사전에 제거하는 것이 목적이다. 사전재해영향성 검토는 1996년부터 시행한 재해영향평가의 한계점을 보완하기 위하여, 2005년 개정된 자연재해대책법에서는 사전재해영향성 검토협의제도를 포함하였으며, 2005년 8월 17일 동법 시행령을 개정 공포하여 사전재해영향성검토 협의제도를 본격적으로 시행하게 되었다. 본고에서는 사업 대상 지구를 "부산장안지구 택지개발사업(1단계)"로 선정하였으며, 개발에 따른 재해 발생요인, 즉 유출량 증가에 따른 하류부의 홍수피해 가중, 토공 공사에 따른 토사유출량 증가, 절 성토계획 따라 유발되는 사면의 불안정에 대한 사전검토를 목적으로 하였다. 사업시행에 따른 개발중 토사유출량의 증가와, 개발후 홍수유출량의 증가로 재해의 위험이 예상되어 개발 중의 임시저류지 겸 침사지 2개소와 개발 후의 영구저류지 1개소를 계획하여 홍수유출량을 $2.48m^3/sec$을 줄이고, 토사유출을 90% 포착하였다.

  • 본 연구는 사전재해영향성 평가제도의 개선 방안을 제안하기 위해 환경영향성평가의 연혁 변화 및 DB 구축 시스템에 대해 살펴보았다. 또한 재해 사전 분석의 이론적 개념을 분석하여 사전재해영향성 평가제도의 이론적 개념을 살펴보았다. 이러한 결과를 바탕으로 사전재해영향성 평가의 문제점을 도출하고 개선방안을 제안하였다. 이러한 결과를 바탕으로 사전재해영향성 평가의 문제점을 도출하고 개선방안을 제안하였고, 또한 사전재해영향성평가 문제점을 환경영향성평가 비교 분석을 통해서 사전재해 영향성평가 개선방안을 제안하였다. 개선방안으로 첫째 정책적 개선안으로 행정계획 지침 분리, 소규모 개발 사업 간소화 등을 제안하였다. 둘째 기술적 개선안으로 통합관리시스템 개발, 사후재해영향성검토제 도입을 제안하였다.

  • Rapid urbanization has elevated the risk of urban flooding due to the increase in the impervious surface, causing environmental disasters and environmental pollution problems, such as lowering the groundwater level and increasing water pollution. In Korea, low impact development (LID) techniques have been introduced to minimize these environmental impacts and maintain the water cycle soundness. However, most small-scale development projects are in blind spots because there is no legal basis for rainfall runoff management. Small-scale development projects that increase the surface runoff of rainwater are required to mandate the application of LID facilities in accordance with the polluters' responsibility principle. Therefore, it is necessary to implement a preliminary consultation system for water cycle recovery. This study focuses on the cost-benefit analysis on the application of LID techniques for small-scale development projects. The scale of nationwide small-scale development projects used for cost-benefit analysis were defined as buildings with a land area of more than 1,000 ㎡ or a total floor area of 1,500 ㎡. As a result of analyzing the cost-benefits from the installation of LID facilities, they were found to be much lower than the economic standard value of 1. This might be due to the high cost of facilities compared to the scale of the project. However, considering the overall environmental value of improving the water environment and air quality by the installation of LID facilities and the publicity of reducing the operating cost of sewage treatment facilities, the introduction of a prior consultation for small-scale development projects is inevitable. In the future, institutional and financial support from local governments is required to improve the cost-benefits with the introduction of a prior consultation for small-scale development projects.

Study on Policies for Integrated Pollution Prevention and Control (통합적 환경관리의 정책적 도입방안에 관한 연구)

  • Integrated Pollution Prevention and Control(IPPC) has become an idealistic environmental prevention concept in developed countries and corresponds with principles of Industrial Ecology. The concept of emissions regulatory integration is a key factor for an integrated environmental management system. While most EU member countries have a cross-media regulatory system, Korea has a media-specific regulatory system which was found to have significant environmental management problems. The purpose of this study is to integrate the emissions regulatory system by resolving difficulties through procedural, organizational, and substantive analysis of integration. To this end, the following research was performed: The first task was to determine the target of the integrated emissions regulatory system. In connection with this, the "IPPC directive" of the EU and the "PPCA 2000" schedule 1 of the UK, as well as environmental laws in Korea were compared and analyzed. The second was to design a regulatory system model. This model was divided into three groups after considerations were made regarding the time it would take for the pre-application,application, and permission stages. Lastly, on the basis of this research, a revised bill for an integrated emissions regulatory system was suggested. Nevertheless, substantive analysis of integration focused on BAT requires supplementation in order to make the integrated emissions regulation system operate normally as an environmental management policy and regulation method. To this end, the specific characteristics of Korean society, culture, and law should be actively considered.

Improvement of Review System on Sea Area Utilization-Impact by Marine Environmental Management Law (해양환경관리법상 해역이용영향 검토기관의 발전방향)

  • This study investigated the status and problems of marine-related environmental impact assessment and a utilization-consultation system in Korea and suggested improvement of the review organization. Also, it conducted SWOT analysis based on evaluation of functions, roles and performance of the marine environmental impact assessment center and proposed development strategies of the center through introduction of expert opinions and advanced systems. The performance statement-review by the center in 2007 included 358 cases in total; 165 (46.1%) for consultation on utilization of sea area, 104 for environmental impact assessment (29.0%), and 89 (24.9%) for prior environmental review. The consultation on utilization of sea area can be divided into that for public water surface-use (41%) and reclamation (32%), and sea aggregate extraction process (21%). Although bad impacts on marine environment are reducing under the current system, there are some limits and problems to supplement it in terms of content, system and operation. Review system on sea area utilization-impact(marine environmental impact assessment center) by marine environmental management law needs to obtain expertise, fairness and efficiency and, to do so, have operational supports and institutional improvement to maximize its own functions and roles. At the same time, it is necessary for the center to establish identity and the status as a professional review organization by setting active development strategies inside the center. Finally, it should strengthen an consultation system of marine environmental impact assessment led by the related ministry to achieve effective coastal management.

건축물 용도변경제도와 허가절차 개선 방향

  • 건축법이 올 정기국회에서 개정될 예정이다. 이를 위해 건설교통부는 지난 7월 10일 입법예고 하고 법제처 및 관계부처 협의를 진행중인 것으로 알려졌다. 입법예고 내용중 상업지역 공동주택에 대한 일조기준 폐지 및 건축물의 일조기준을 남쪽기준으로 변경, 허가기준 고시, 피난 및 내화 등의 건축기준을 설계기준으로 고시, 사전승인대상(21층이상 10㎡이상)을 시도에서 직접 허가가능토록 하는 등 절차와 기준에 대한 대폭적인 변경이 예상되고 있다. 그러나 무엇보다도 일반인의 관심을 끌었던 것은 일간신문에서 중점보도한 "용도변경이 자유로워져 건축물을 마음대로 사용할 수 있다"와 "건축인허가시 건축사확인으로 허가 가능한 대상이 확대된다"는 것이었다. 따라서 용도변경제도와 허가제도의 개정 내용과 이를 시행시 발생하는 문제점과 함께 개선방안, 선결되어야 할 문제와 관련, 병행해서 개정되어야 할 과제 등을 살펴보고 바람직한 제도개선 방향에 대해서도 제안해 본다.
