국회의원 개인배경과 입법: 입법 메커니즘과 16대와 17대 국회의 입법생산성

  • 이글은 대의민주주의에서의 입법 메커니즘에 대한 이론적 논의를 전개한다. 이러한 논의를 근거로 한국 국회의원의 입법생산성에 영향을 미치는 변수들을 도출하고, 이 변수들이 16대와 17대 국회의 입법생산성에 미치는 효과를 분석한다. 이글의 경험분석은 국회의원의 입법생산성은 이들의 학력, 법조경력, 관직경력, 의정경력 같은 개인적 배경과 서로 무관하다는 사실을 보여준다. 이글의 경험분석에 의하면, 국회의원들의 개인배경보다는 원내 정당간의 역학관계와 소속정당의 여당지위, 그리고 의회요인들이 국회의원들의 입법생산성에 영향을 미치는 것으로 밝혀졌다. 이러한 분석결과는 한국 대의민주주의의 작동과 관련된 함의를 제공한다. 국회의원의 입법활동에 대한 정보를 접하기 어려운 환경에서는 국회의원의 개인배경에 의존하는 국회충원 방식이 대리인문제를 유발할 가능성이 높다. 이글은 국회의원 입법활동에서 발견되는 대리인 문제의 해소를 위한 제도적 방안들에 대해 논의한다.

German Historicism, Positive Historical Science and the Establishment of Archival System of the 19th Century: Ranke, Sybel, Lehmann and the Principle of Provenance/Original Order (19세기 독일의 역사주의 실증사학과 기록관리 제도의 정립: 랑케, 지벨 그리고 레만과 출처주의/ 원질서 원칙)

  • This article shows how the tradition of German historicism and positive historical science contributed to the establishment of German archival system, especially the principle of provenance and original order. The theory of historicism focused on the recognition and realization of the individuality of the history as a whole unit which is made up of the mutually and organically organized cultural entities. The theory of historicism as this kind of world view got its academic basis from the methodology of the positive historical science, namely the critical reviews on the archival sources which exist in mutually and organically organized record entities. In this context, the scholars of the historicism saw the establishment of the efficient archival systems as necessary. To some great degree, the emergence of the principle of the provenance and original order was its logical result. The author of this paper tried to highlight this point of view historically, on the basis of the activities of Ranke, Sybel and Lehmann around and in the Prussia Privy State Archives throughout the 19th century.

The Myth of Huang-ti(the Yellow Emperor) and the Construction of Chinese Nationhood in Late Qing(淸) ("나의 피 헌원(軒轅)에 바치리라" - 황제신화(黃帝神話)와 청말(淸末) '네이션(민족)' 구조의 확립 -)

  • This article traces how the modern Chinese "nation" was constructed as an "imagined community" around Huang-ti (the Yellow Emperor) in late Qing. Huang-ti was a legendary figure in ancient China and the imperial courts monopolized the worship of him. Many late Qing intellectuals appropriated this symbolic figure and, through a set of discursive strategies of "framing, voice and narrative structure," transformed him into a privileged symbol for modern Chinese national identity. What Huang-ti could offer was, however, no more than a "public face" for the imagined new national community, or in other words, a formal structure without substantial contents. No consensus appeared on whom the Chinese nation should include and where the Chinese nation should draw its boundaries. The anti-Manchu revolutionaries emphasized the primordial attachment of blood and considered modern China an exclusive community of Huang-ti's descent. The constitutional reformers sought to stretch the boundaries to include the ethnic groups other than the Han. Some minority intellectuals, particularly the Manchu ones, re-constructed the historic memory of their ethnic origin around Huang-ti. The quarrels among intellectuals of different political persuasion testify how Huang-ti as the most powerful cultural symbol became a site for contests and negotiations in the late Qing process of national construction.

Phenomenal Concept Strategy and A posteriori Physicalism (현상적 개념 전략과 후험적 물리주의)

  • A posteriori physicalists criticize non-physicalist arguments based on the framework of two-dimensional semantics. Most of them argue for physicalism based on the analogy between scientific identity statements and psychophysical identity statements. This paper argues for another version of aposteriori physicalism, so called physicalism employing 'phenomenal concept strategy' or 'exceptionalist strategy', which appeals to merely the nature of phenomenal concept without recourse to a semantic framework. Loar's phenomenal concept strategy employs the aspect of our recognitional ability of objects in criticizing non-physicalism, leading to the argument that phenomenal concepts are 'exceptional' in applying conceivability-possibility link. I critically examine Stoljar's, Chalmers', Raffman's criticisms against Loar's exceptionalists strategy. Loar's phenomenal concept strategy reflects well our psychological aspects surrounding the acquisition and the possession of 'phenomenal concept'. In several respects, Loar's exceptionalist version of a posteriori physicalism is the best explanation for accounting for both the explanatory gap and the a posteriority of psychophysical identity.

  • A wide range of health professionals have interest in changing the health behavior of individuals. To intervene effectively and to make informed judgements about how to measure the success of such interventions, health professionals must have an deep understanding of health behavior. This paper provides an overview of the thories of health-related behaviors and the strength and weakness of each, how the theories relate to others, and how they can be used in practice. The theories reviewed include Suchmann's stages of illness experience, Health belief model, Attribution theory, Fishbein's theory of reasoned action, Multiattribute utility models, Consumer information processing, and Anderson's models. Finally, this paper introduces the reader to interesting research findings in our country.

Creation of Operatic Narrative - Comparative Study of Murger's Novel 『la vie de bohème』 and Puccini's Opera <la bohème> (뮈르제 소설 <보헤미안의 생활 정경>과 푸치니 오페라 <라보엠>의 비교를 통한 오페라 담론의 창작 원리 연구)

  • A common fallacy found at opera works is to lean either toward 'opera as drama' or toward 'opera as music'. One of the historical examples of opera creation to overcome this fallacy is Puccini's $\grave{e}$me>. The composer Puccini and the librettists, Illica and Giacossa, found balance between these two extreme poles, which was made possible by keeping the color of the original novel "scenes de la vie de boh$\grave{e}$me" and simultaneously by reconstructing the most operatic characters and story. Their strategies, which can be summerized as 'simplification', 'romanticization and re-creation of characters', and 'realistic description of original atmosphere'. There strategy of adaptation and the 'episodic' feature as the outcome can be a good example for creators of new opera works.

A Comparing Study of Two Constructivisms on L.E.M. (배중률을 둘러싼 구성주의의 두 입장 비교)

  • Constructionists believe that mathematical knowledge is obtained by a series of purely mental constructions, with all mathematical objects existing only in the mind of the mathematician. But constructivism runs the risk of rejecting the classical laws of logic, especially the principle of bivalence and L. E. M.(Law of the Excluded Middle). This philosophy of mathematics also does not take into account the external world, and when it is taken to extremes it can mean that there is no possibility of communication from one mind to another. Two constructionists, Brouwer and Dummett, are common in rejecting the L. E. M. as a basic law of logic. As indicated by Dummett, those who first realized that rejecting realism entailed rejecting classical logic were the intuitionists of the school of Brouwer. However for Dummett, the debate between realists and antirealists is in fact a debate about semantics - about how language gets its meaning. This difference of initial viewpoints between the two constructionists makes Brouwer the intuitionist and Dummettthe the semantic anti-realist. This paper is confined to show that Dummett's proposal in favor of intuitionism differs from that of Brouwer. Brouwer's intuitionism maintained that the meaning of a mathematical sentence is essentially private and incommunicable. In contrast, Dummett's semantic anti-realism argument stresses the public and communicable character of the meaning of mathematical sentences.

Studies on the Contemporary Trends of Utilitarianism (현대 공리주의 동향에 대한 연구)

  • The development of contemporary utilitarianism can be taken to be an aggregation of many attempts to surmount the limitations of classical utilitarianism. In these attempts, contemporary utilitarianism suggests alternatives to 'hedonism' and 'act-utilitarianism' which have been regarded as the common essential elements of classical utilitarianism. First, contemporary utilitarianism replaces the concept of 'happiness' or 'pleasure' in the classical utilitarianism with that of 'desire-fulfillment' or 'preference-satisfaction'. Through this replacement, contemporary utilitarianism tries to avoid the skeptical challenge to the mental state theory inherent in the classical concept of utility, and also to provide a more extensive conception of utility for a more satisfactory explanation of human welfare. Second, the development of rule-utilitarian theories which can evade the criticisms about 'counter-productivity' and 'counter-intuitiveness' of act-utilitarianism constitutes another important trend of contemporary utilitarianism. Characteristically, rule-utilitarian theories developed in the contemporary utilitarianism grope for some utilitarian system that can embrace socially accepted general norms. Lastly, contemporary utilitarianism responds to the criticisms related the problem of justice by reinterpreting the first principle of utilitarianism. This reinterpretation is an attempt to explain the egalitarian basis of utilitarianism through Bentham's dictum 'everyone counts for one, none for more than one'. It seems true that many influential criticisms in the latter half of 20th century cast a deep shadow on utilitarianism. But through the above attempt, contemporary utilitarianism proceeds to a better explanation of human welfare.

The commonality between German Neo-expressionism and Chinese Modern ink painting (독일 신표현주의와 중국 현대 수묵의 상통성)

  • Although German Neo-expressionism and Chinese modern ink painting are separated by thousands of miles in geographical space, they have a similar origin time, and there are many commonalities between them. In the aspect of creative attitude, artists of both styles can absorb and resist foreign styles, return to the past and conquer the tradition. In the aspect of formal expression, the objects of both paintings are representational rather than realistic, and the material characteristics of the media are emphasized. At the inner spiritual level, both expressionism and modern ink painting pay attention to social concern, and show the uncertainty of postmodernism together. The commonality between German neo-expressionism and Chinese modern ink painting does not mean to eliminate the difference, but to maintain the coexistence of difference and commonality.

A Critical Study on Ideology and Reality of Silmido (영화 [실미도]의 이데올로기와 리얼리티에 대한 비판적 고찰)

  • Silmido [실미도 2003] captures the covered historical reality and describes the spectacular training process of the special army stationed at Silmido in vivid detail. As a result, a fictional space is turned into a reality film. The film shows ideological inconsistency of the critical view about the fascism of government authority and at the same time the political aid about government authority. The film creates dramatic and friendly effect through melodramatic and emotional exaggeration called sinpa about historical events to produce the pleasure of assimilation based on the trust of the audience. Here, individual assimilation is subjectivity achieved through the general sympathy coming from the tragic national discourse. Silmido appeals to the imaginary community not in a logical but in an emotional way. The spectacular action and realistic images are supported by national tragedy divided into the South Korea and the North Korea, and integrated sentimentalism to amplify the tragedy. Silmido tries to strengthen the tragic situation caused by the division ideology through this sentimentalism called sinpa. In contrast to the brutality of the relentless military regime, the sacrifice of good-hearted Silmido force members is heroically portrayed.
