Healthcare Legislation Cases in the National Assembly Petition System: Focused on Petitions to the Health and Welfare Committee of the 13th National Assembly through the 20th Assembly (국회 청원제도를 통한 보건의료 입법사례 연구: 13-20대 보건복지위원회 청원을 중심으로)

  • The right to petition is a classical right of the people in constitutional states, and in Korea, it is a statutory right in the Constitution, the National Assembly Law, the Petition Law, and the Local Autonomy Act. The healthcare community first made a successful petition to the National Assembly when it achieved the amendment of the Government Organization Act through a petition to the National Assembly for the independence of the Ministry of Health, and this achievement served as the basis for further petitions. Since then, the healthcare community has successfully achieved the enactment and amendment of related occupational laws through National Assembly petitions, such as the amendment of Article 41, Paragraph 7 of the former Medical Insurance Act (Korean Medical Association, 14th Assembly), enactment of the Dental Health Act (Korean Dental Association, 15th Assembly), and amendment of the Health Functional Foods Act (Korea Pharmaceutical Association, 16th Assembly). Its petition accomplishment rate is higher than the total petition accomplishment rate of the Health and Welfare Committee of the National Assembly. However, along with the overall decrease in the number of National Assembly petitions, the Korean Medical Association and Korea Pharmaceutical Association have not achieved any results through petitioning since the 16th Assembly (June 2000), and the Korean Hospital Association and Korean Nurses Association have not achieved any results through petitioning since the 17th Assembly (April 2004). Furthermore, no National Assembly petitions have been made at all for 5 years (2014-2018). The Korean Medical Association and Korea Pharmaceutical Association previously showed a high petition accomplishment rate through their accumulated experience with National Assembly petitions and vigorous policy assistance from doctors/pharmacists/nurses turned lawmakers. More specifically, healthcare organizations have achieved results by actively conducting organized activities with the National Assembly, as implemented by a national assembly director and employees, and in case of petitions for legislation, each group has established infrastructure for reviewing the relevant laws by appointing a legislative director, as well as a legal advisor and advisory counsel. Although the organization that has submitted the most petitions to the National Assembly is the Korean Hospital Association, the group with the highest petition success rate is the Korean Medical Association, which may be linked to the relatively high proportion of doctors who have become lawmakers. Furthermore, the fact that other healthcare organizations were highly interested in petitioning the National Assembly has had major implications for the petition activities of healthcare organizations.

Comparison between the General public and Hospital staff on the Perception of Specialized Hospital Competencies (전문병원의 전문성역량에 대한 일반인과 병원종사자들 간의 인식비교)

  • This study compared and analyzed the levels of expectations of specialized hospitals, and the recognition of professional competency in specialized hospitals for the general public aged 20 years or older and those professionals on the hospital staffs who had more than three years of experience. The research period ran from July 2018 to May 2019. T-test and regression analysis were used for the analysis of the data. Research result; There was no difference in the level of expectations for the specialized hospitals between the general public and the hospital staffs. It was shown that the professional factor affecting subjective expectations of the specialized hospitals was a difference in the way of thinking between the general public and the hospital staff. The professional factor affecting the expected level of hospital use for the general public and hospital staffs was confidence in the doctors. However, the professional factors affecting the credibility of doctors differed between the general public and the hospital staff. The factor for the general public was excellent technical skill in the field, and the factor for the hospital staff was the specialized ability of doctor and their years of medical service. It is thought that efforts are needed to reduce the difference between the perception of hospital staff and that of the general public in order for specialized hospitals to continue to develop.

Status of Employment-Related Qualifications Similar to a Medical Laboratory Technology Major (임상병리기술학 전공 유사 취업연계 자격 현황)

  • This study evaluated the various qualifications that can be linked to employment similar to the medical laboratory technology major. The qualifications for employment outside the medical laboratory technology major are industrial health instructor, doping control officer, audiologist, sign language interpreter, health education specialist, claim adjuster, Korea life underwriter, administrative manager, hospital administrator, insurance review manager, and hospital coordinator. The qualifications for employment similar to the medical laboratory technology major include the clinical research coordinator, clinical research associate, anatomist, analytical chemistry analysts, hazardous materials industry engineers, biotechnologist, biosafety managers, biotechnology technicians, medical device quality officers, animal care nurse, industrial engineer hazardous material, bioprocess engineer, biosafety officer, certified technology consultant, director of medical device quality control, laboratory animal technician, animal nursing technician, and cruise medical manager. Therefore, it is necessary to conduct a social analysis survey of the various qualifications currently held by medical technologists. In addition, it will be necessary to investigate the current status of medical technologists working in other fields. In the future, medical technologists should expand the scope of their work through efforts to strengthen their individual work capacity, share cases, and strengthen their expertise.

Factors Affecting Intention to Quit Smoking of Current Smokers by Gender (성별에 따른 흡연자의 금연의도 관련 요인)

  • This study is to identify the factors related to smokers' intention to quit smoking and the differences between male and female smokers. We used data from Community Health Survey of 2017 and a total of 39,435 participated in the study. It was analyzed through IBM SPSS Statistics 23.0 to conduct frequency analysis and binary logistic regression analysis. We found that gender, age, marital status, education, household income, subjective health, attempts to quit smoking, exposure to quit smoking campaigns, education to quit smoking, and number of cigarettes per day are related to the smokers' intention to quit smoking. For male smokers, education and household income are relevant to their intention to quit smoking, unlike female smokers. The findings suggest that smoking cessation campaigns and education are necessary for smokers with low level of education or income. Further, it indicates that gender differences should be taken into consideration upon intervention program.

  • This paper analyzed experientially political conducts of the political players on privitization of healthcare service and public healthcare sercive aftrer the democratization in order to determine the influence of democracy on the development of a welfare state. For this purpose, the contents of the major daily newspaper reports from 1993 to 2012 were analyzed. As a result of such analysis, it was found that the political parties did not drive the policy even after the democratization reflecting the demands of the people, political parties had a strong conservative stance and did not show a consistent ideological inclination in their policies. Second, even though the role of the civic movement in the public healthcare service issue became larger after the democratization, policy decisions were driven by the government in an authoritative manner. In addition, the degree of contribution by the civic movements to the development of public healthcare service did not offset the influence of the president and the finance ministry on the development of privatization. Third, both the development of public healthcare service and privatization progressed simultaneously under the Kim Dae Jung, Rho Mu Hyun and Lee Myung Bak administrations after the democratization and it is thus difficult to argue that the qualitative nature as a welfare state was changed after the democratization. However, the degree of development as a welfare state differed depending on the ideological inclination of the presidents, the capacity of the welfare ministry and the ministry that drove the privatization.

우리나라 직장 정신보건제도의 방향과 전망

  • 우리 사회에서 일정 정도 이상의 사회와 가정에서의 기능상의 부적응을 초래하는 정신적 문제는 경제활동인구에 있어 가장 흔한 보건의료상의 문제일 것으로 추측되고 있으나, 현재까지는 정신보건제도 마련에 있어 가장 극심한 부적응을 보이는 정신적 장애를 지닌 환자를 위주로 수용시설과 지역사회에서의 재활과 관리에 그 초점을 두어 왔다. 즉 직업스트레스와 같은 일시적인 사회심리적 갈등으로 인한 신체증상의 호소나 알을 및 약물중독으로 인한 사고의 발생으로부터 일생동안 관리되어야 하는 지능저하나 학습장애와 같은 만성적인 문제에 이르기까지 다양한 스펙트럼을 보이는 사업장과 지역사회에서의 정신적 문제들 중 그 일부만이 제도적으로 관리되어 왔다. 실제 그 동안 직장 내 정신보건문제에 대한 행정적 관심은 일부 장애인의 취업 문제를 제외하고는 없었다고 하여야 할 것이다. 그러나 한편으로 우리 사회의 산업구조와 경제사회적 조건의 변화에 따른 노동내용과 조건상 유연화의 증대가 많은 직장에서 노동강화로 이어진다는 점, 그리고 가족 및 교류집단을 비롯한 전통적인 사회적 지지구조가 와해되고 있다는 점과 정신적 문제로 인한 기능상 부적응의 척도가 한편으로 사회적 가치관의 변화에 따라 계속 그 영역이 넓어지는 방향으로 변화하고 있다는 점등에서 직장 내 정신보건 문제는 앞으로 더욱 그 비중이 커질 것으로 판단되고 있다. 문제의 심각성에 대한 관심이 요구되는 현재의 시점에서 제도적 접근에 대한 검토 또한 시작되어야 할 것으로 판단되고 있다. 현재까지 기업 내에서 이루어지고 있는 정신보건관리의 현황을 단편적으로 파악해 보았을 때, 단지 일부 기업에서 취업시 내지는 부서 배치시 성격검사를 비롯하여 적성검사를 실시하고 있으며, 기업윤리확보 차원에서 비정규적으로 사기앙양을 주목적으로 하는 집단적인 교육이나 단체훈련이 이루어지고 있으나, 정신심리적 문제를 개인적 차원에서 그리고 또한 조직적 차원에서 체계화된 프로그램으로 관리하고 있는 사례는 아직 없다. 앞으로 직장 내 정신보건문제에 대하여 제도적인 접근을 하기 위하여서는 다음과 같은 세가지 조건들이 구비되어야 할 것으로 판단된다. 첫 번째로 문제점 그 자체의 내용과 그 규모에 대한 정확한 파악과 예측이 가능하여야 한다. 즉 제도 전체의 운영을 객관적으로 평가하고 개선할 수 있는 기제가 함께 있어야 제도가 실제적인 기능을 할 수 있다는 최소한의 목적이 달성될 수 있다. 두 번째로 문제점의 관리를 위한 효과적인 개입내용 및 개입지점의 확보가 가능하여야 한다. 특히 직장 내에서 수행할 수 있는 프로그램이 개발되어야 하며, 이는 시범사업과 시장을 통한 소비자, 즉 사업주들의 자발적인 선택을 통하여 검토되고 걸려져야만 한다. 마지막으로 제도 운영의 대상, 특히 정신보건문제를 안고 있는 노동자들의 자발적인 동의가 확보될 수 있어야 한다. 이는 정신적 문제가 안고 있는 편견과 그로 인한 차별이 가져다주는 문제를 함께 고려하면서 제도가 운영되어야 하며, 이에 있어 제도 운영상 노동자들의 주체적인 참여가 필요하기 때문이다. 이상 고려되는 직장 내 정신보건문제에 대한 제도적 접근을 담기 위하여서는 프로그램 개발이나 전문가 집단의 양성과 같은 단순한 기술적 접근과 이들의 인허가 및 사업화에 따른 적용기준 및 의무의 설정과 같은 제도적 접근에 그쳐서는 그 실효성을 담보하지 못할 것으로 판단된다. 보다 중요한 것은 이러한 정신보건문제에 대한 노사의 공감대를 이루어 내는 것이며, 사회 전반적인 인식의 확산과 더불어 바람직한 관리모습에 대한 사회적 가치관을 도출해 내는 것이 제도적인 접근의 성공을 보장할 수 있는 기반 조건이 될 것이다. 이러한 점에 있어 정신보건문제를 바라보는 기존의 가치관이 부정적이고 고착화된 모습만을 강조하였으나, 이제는 점차 긍정적이 사회활동에 수반되는 역동적인 모습으로서 비추어지는 것이 많아진다는 측면에서 그 전망을 밝게 하여 주고 있다.

Problems of the Radiation Safety Management System and Legal Improvement Plans in the Department of Radiological Science: Focusing on the survey of the head of the Department of Radiological Science (방사선(학)과 방사선 안전관리제도의 문제점과 법적 개선방안: 전국 방사선(학)과장 설문조사를 중심으로)

  • The current radiation safety management system is also applied to radiation practices at universities. The application of the law raised concerns about poor radiation practice education and hindering the development of radiology. Accordingly, the Korean Radiology Professors Association needed to grasp the reality of the management system for radiation practice education at each university and the current radiation safety management system in the department of Radiological science. So, a survey was conducted on heads of radiological science departments across the country. Through the survey, it was found that the current application of the Nuclear Safety Act to radiation safety management in the department of Radiological science is excessively restrictive and not very effective. In addition, radiology practice education for the purpose of training health and medical professionals should be controlled by the Ministry of Health and Welfare and the Korea Centers for Disease Control, but there is a problem of being supervised by the Nuclear Safety and Security Commission. Therefore, in this study, as a legal improvement plan to solve this problem, first, a plan according to a partial amendment to the Higher Education Act, second, a plan to be supervised by the Ministry of Health and Welfare through the amendment of article 37 of the Medical Service Act, third, article 20-2 of the Enforcement Decree of the Medical Service Technologists Act was newly inserted to propose three measures to be supervised by the Ministry of Health and Welfare.

The Effects of Rehabilitation Therapists' Characteristics and Job Involvement on job Stress; in some Local Hospitals (일부지역 병원에서 근무하는 재활전문 치료사의 특성과 직무몰입이 직무스트레스에 미치는 영향)

  • Objective : The objective of this study was to evaluate the effects of rehabilitation therapists' general characteristics and job involvement on stress. The subjects of this study were occupational therapists and physical therapists working for long-term hospitals and general hospitals located in K and B cities, South Korea. Methods : The study investigated general characteristics, job stress, and job involvement by using questionnaires. Analysis conducted on total 144 questionnaires excluding 19 questionnaires, which did not satisfy the subject selection criteria. Results : The results show that job involvement had significantly positive correlations with job requirement, job autonomy, relationship conflicts, organization system, inappropriate compensation, job instability, and workplace culture. Secondly, marital status, wage level, and job engagement explained 46.6% of variations in job stress. Conclusion : The study was meaningful in examining the variables influencing the job stress of rehabilitation therapists. We expect that it can be used for improving the job environment of rehabilitation therapists.

A Study on the Healthcare Utilization Pattern of Foreign Nationals with National Health Insurance in South Korea (외국인 건강보험가입자의 의료서비스 이용 현황 분석)

  • The purpose of this study is to analyze the status of medical service use of foreigners living in Korea by their nationality and types of national health insurance. As of 2018, 1,058,886 people were extracted from the qualification DB, excluding people whose insurance premium is missing. The data analysis showed that nearly 78% of foreigners with national health insurance used medical services and the countries with the largest number of users were China, Vietnam, and the United States. The total cost of treatment per capita was highest in the United States regardless of hospitalization and outpatient. The number of medical treatments per person, and the medical expenses of outpatients & inpatients services were highest among the regionally-insured and the length of stay per person was highest among the workers' dependents. Lastly, it was found that Chinese and regionally-insured received much more benefits than other groups compared to the premium they pay. After July 2019, foreign nationals residing in Korea for six months or longer are obligated to enroll in the national health insurance program. Since the latest data was in 2018, the result did not properly reflect the current situation, but it is meaningful that it made basic data for future comparative analysis.

The Effects of Medical Service Quality for the Main Caretaker of Patients at the Convalescent Hospital for Seniors on Customer Loyalty (주보호자가 지각하는 요양병원 서비스품질이 고객충성도에 미치는 영향)

  • The purpose of this study is to examine the correlation between medical service quality, customer trust, customer satisfaction and customer loyalty in domestic convalescent hospitals. Participants in this research were individualis who assumed responsibility for being the main caretaker of patients that were in hospitalization The following main results were derived. First, among the quality of medical services, tangibles, realiability, responsiveness, empathy were found to have a significant positive effect on customer trust. Second, among the quality of medical services, tangibles, realiability, responsiveness, assuracne, empathy were found to have a significant positive effect on customer satisfaction. Third, among the quality of medical services, only realiability variable were found to have a significant positive effect on customer loyalty. This result means that customer satisfaction and customer trust plays a mediating role between the medical service quality and loyalty. Fourth, customer trust was found to have a significant positive effect on customer loyalty. Fifth, customer satisfaction was found to have a significant positive effect on customer loyalty.
