  • The purpose of this research is to review a grandparent visitation case which court decided grandparent visitation rights in 2016 for the first time, to determined how justices interpreted the best interests of the child standard. Based on the critical review of a target case, three categories emerged: parental rights, child's rights, and the developmental environment of child. These categories help to explain how courts influence the social construction of status withing families and child's rights. This research closes the study with implications and suggestions for future social policy.

  • At the Davos Forum in 2016, the Fourth Industrial Revolution, a reference to cloud Schwab, is dramatically changing our lives, and at its height, self-driving cars are emerging as the talk of the day. But there are still many hurdles to overcome before the nation can successfully introduce and establish self-driving cars. In particular, it is necessary to change the paradigm of the legal system centered on human beings to one that includes artificial intelligence. The stable operation of the self-driving car era requires drastic changes to the people-centric legislation system. That is, it is necessary to collect information on the total number of drivers of self-driving cars (what is available), general vehicles on general roads, civil and criminal liability issues in the event of traffic accidents, and collection of insurance problems concerning autonomous driving vehicles. In this study, a separate bill was proposed to address the various legal issues arising from the operation of self-driving cars from a legislative perspective by considering the domestic laws related to road transport, the current state of legislation on foreign soil and legal issues related to self-driving cars.

  • This article aims at the legislation of User-Protection Act in area of ICT. In these days telecommunication and broadcasting are getting more and more convergent. The paradigm of ICT is turning over from the service provider to the end-user. User protection has been in each erea of ICT (C-P-N-D) individually regulated. In the area of telecommunication it is important to protect the interest of user, who stands in contract with the service provider. And in area of broadcasting it is important to protect the interest of viewers, who stands "gratis" with the broadcasters without any contracts. For the more efficient user-protection it is also necessary to make a dedicated organization under KCC(Korean Communications Committee). In this early year the government organization was divided into MSIP(Ministry of Science, ICT and future planing) and KCC. The user-protection act will be very important instrument of ICT regulation in the era of creative economy. It is necessary to establish a new frame act of user protection. It is also necessary to make start to establish a new system of user education in erea of ICT. It is strongly expected the new act will be a turning point of ICT development in Korea.

Utilization of High-precision Spatial Information Based on Large-scale Digital Map (대축척 수치지도 기반의 정밀 공간정보 활용방안)

  • A digital map of 1/5,000 scale provides basic information to be utilized in various businesses, such as in land management, urban information system of a local government, navigation of private sectors and others. 1/5,000 digital map, which contains information of the entire land of South Korea, is performed as a national fundamental map, however, comparing to 1,000 digital map, it has some difficulties in terms of positional accuracy and attribute data for applying in urban areas. Also, since the paradigm of spatial information services has been changed, more accurate positional information and rich attribute information are required for the government businesses and private map services. Particularly, demands for the high precision spatial information based on large-scale digital map is increasing in facility managements due to rapid changes in urban areas and various spatial analyses. For those reasons, this study proposes how to apply and use precise spatial information based on 1/1,000 digital. Firstly, an analysis of legal system related to large-scale digital map and spatial information is conducted in the research. Afterwards, the ways are suggested to improve systematical utilizations of 1/1,000 digital map. We also define existing applications of spatial information in public and private sector, and recommend methodology that can be utilized high precision spatial information.

  • 지리정보유통은 연계(network)의 경제활동이라 할 수 있다. 이러한 경제활동이 원활히 움직이고 활성화되기 위해서는 유통체계를 구성하는 주체, 객체, 수단, 환경이 적절히 조화를 이루어야 한다. 그중 유통주체인 공급기관-수요기관-유통기관은 유통기관을 중심으로 상호 유기적으로 연계되어 있어야 한다. 특히 지리정보는 시간의 변화에 따라 동적으로 변화하고, 단순한 자료나 정보가 아닌 이를 이용하여 새로운 부가정보 생산이 가능한 정보로 적극적인 공개를 통하여 그 활용성을 극대화시킬 수 있다. 따라서 국내에서 생산된 지리정보를 보다 효율적이고 가치 있게 활용하기 위해서는 우선적으로 지리정보유통 활성화가 이루어져야 한다. 지리정보유통 활성화를 위해서는 첫째, 공급기관이 유통체계에 적극적으로 참여하도록 법제도를 강화해야 한다. 둘째, 지리정보유통추진협의회를 구성하여 공급기관과 유통기관간의 상호 원활한 협력관계를 유지한다. 셋째, 새로운 지리정보를 발굴할 수 있는 지리정보 발굴체계를 도입한다. 넷째, 앞의 세 가지 업무를 체계적이고 적극적으로 수행할 수 있는 지리정보유통관리기구를 설립 운영한다. 본 연구에서 제시한 활성화방안을 기반으로 국가GIS 기본계획의 목적에 부합하는 충분한 지리정보를 확보하고 공급함으로써 범국민적인 유통 활용이 보다 빠르게 정착될 것으로 기대된다.

  • An Intelligent information society means intelligent superconducting society that goes beyond information society where information is centered. Now that artificial intelligence is specifically discussed, it is time to start discussing the laws and systems for intelligent information society, where artificial intelligence plays a key role. At some point it may be too late to cope with singularity. Of course, it is not easy to predict how artificial intelligence will change our society. However, there are concerns on what kind of relationship should humans build with AI in the intelligent information society where algorithms rule the world or at least support decision making of humans. What is obvious is that humans dominating AI or ruling out AI will not be the answer. Discussions for legal framework to respond to the AI-based intelligent information society needs to be achieved to a level that replaces the current human-based legal framework with AI. This is because legal improvement caused by the paradigm shift to the intelligent information society may assume emergence of new players-AI, robots, and objects-and even their subjectivation.

Precautionary Principle for the Protection of Space Environment against Solar Electromagnetic Storm (우주전파재난과 우주법상의 사전주의 원칙에 관한 연구)

  • Solar flare and storm may give an adverse effect upon electromagnetic environment around the Earth, so that various kinds of satellite cease to normally function. This kind of space storm disaster is characterized by the uncertainty about when and what size. Recently the UN has been paying attention to this plausible disaster. Particularly the COPUOS has taken the view that this disaster would threaten the sustainable space environment. The precautionary principle, rooted and excercised in the environment protection filed, has been adopted in the case of disaster with uncertainty. The reports and opinions given by the expert and representatives of the member States have stated that the precautionary principle should be adopted for the purpose of dealing with this disaster. On the other hand, it is advanced that the principle has been already included in the space law principle enshrined in the 1967 Space Treaty. The Treaty has adopted the freedom of navigation and use of the outer space for the interest of all States as the basic principles. Sustainable environment is necessary for implementing the principle. Therefore, the rules for the protection of sustainable space environment should be based upon the space law principle.

The Relation between the Income Smoothing and the Consumption Smoothing: the EU Case (EU 국가 소득의 고찰을 통한 소득위험분산과 소비위험분산 간 관계 분석)

  • This study empirically examines whether income smoothing effectively contributes to consumption smoothing. Since international factor movement plays an important role for income smoothing across countries, net factor income across countries deserves more attention in considering income smoothing than attention having been paid by previous studies in the literature. Most of previous studies assume that net factor income has the same degree of effects on consumption as GDP. For the case of 12 EU countries during the period from 1999 to 2010, our empirical investigation observes that the response of consumption with respect to net factor income is severely lower than the response of consumption with respect to GDP, and further net factor income has ignorable effects on the consumption. This evidence implies that the income smoothing via international factor movement is less significant in contributing to the consumption smoothing. In the sequel, our finding suggests that legal and institutional process for transferring net factor income across countries should be eased further to improve contribution of income smoothing to consumption smoothing.

  • 현재 구축되어있는 방재시설의 능력은 기후위기로 인해 수용가능한 극한강우량의 범위를 넘어서고 있어 대형화된 홍수로 인한 피해가 꾸준히 발생하고 있다. 이로 인해 잠재적 홍수로 인한 도시회복도 관리와 홍수로 수반되는 피해에 대한 복구의 중요도가 높아지고 있다. 회복도는 도시의 재해 취약성, 저항, 적응, 복구, 완화에 대한 능력을 포괄하는 개념으로써 최근 주목받고 있는 개념이지만 대부분의 연구는 주로 시설에 대한 회복도 평가가 이루어지고 있다 (Sen et al.,2021). 또한 재해 후 도시복구에 관한 연구는 다수 존재하지만 복구에 따른 지역의 회복도 변화와 라이프라인과 같은 주요 시설의 복구에 따른 회복도 차이를 고려한 연구는 미비한 실정이다. 따라서 본 연구에서는 도시침수 발생 후 라이프라인을 고려한 도시복구 우선순위 산정모델을 개발하고 재해관리의 효율성 향상측면에서 도시의 기능적 회복도를 평가하였다. 이를 위해 라이프라인 중 도로 복구결과의 평가를 위하여 리스크 매트릭스 기법을 이용한 도로위험도평가를 수행하였으며 도시의 회복도를 측정하였다. 회복도를 크게 홍수로부터 도시가 받은 영향과 재해복구역량으로 구성하였으며 정량적인 평가를 위해 각각 손상함수와 재해재난목적예비비를 활용하여 산정하였다. 이후 복구우선순위를 산정하였으며 복구와 도시회복도와의 관계를 분석하기 위하여 재해연보 자료를 기초로 회귀분석을 통해 복구비용을 추정하였다 (유순영 등.,2014). 시범지역에 적용한 결과 시설 및 도로 복구에 따른 도시영향의 변화보다 복구비사용으로 인한 재해복구역량의 변화가 더욱 크다는 것을 확인하였다. 이는 재해재난목적예비비의 중요성이 크다는 것을 의미하며 향후 추가적인 인문학적, 법제적 요소가 회복도에 미치는 영향을 연구한다면 도시회복도 향상 및 도시복구에 관한 정책적 의사결정에 큰 도움이 될 것이다.
