This paper analyzes the effects of asymmetric reimbursement in a delegate model where the lawyers for a citizen and a polluting firm work on a contingent-fee basis. The major findings from the paper are as follows: (i) the asymmetric reimbursement triggers environmental conflicts by increasing the citizens' expected surplus; (ii) it enhances the possibility of settlement by decreasing the magnitude of expected loss less expected surplus; (iii) settlements reduce the total litigation effort levels, thus curtailing the rent dissipation; (iv) The total litigation effort levels increase if the conflicts result in trials rather than settlements.

우리의 생활공간에서 실내공기, 소음, 전자파 등 생활공해로 인한 피해는 시시각각으로 일어나고 있다. 그 동안 깨끗하고 쾌적한 실내환경과 정온한 생활환경 속에서 모든 국민이 건강하게 생활할 수 있도록 다양한 생활환경관리 정책을 추진해 왔다. 하지만, 정부의 노력만으로는 한계가 있다. 국민이 편안한 생활환경의 창출을 위해서는 그 구성원의 자발적인 노력과 참여가 필요하다.

특허권의 중요성이 새삼 부각되고 있다. 발명으로 발생하는 권리는 국제적 성격을 띠어 세계 각국에서 특허를 취득하므로 최근 삼성-애플 특허분쟁에서와 같이 세계 각국에서의 법정에서 다발적으로 싸움이 벌어지는 것이다. 특허분쟁에서는 강력한 특허가 있어야 하며 강력한 특허는 종업원 발명자의 창의적 노력으로부터 가능하다. 강력한 특허는 곧 가치가 큰 직무발명을 말한다. 강력한 특허를 위해선 직무발명자에게 발명의욕을 고취하는 직무발명보상제도를 잘 활용할 필요가 있다.

The purpose of this research is to survey elementary pre-service teachers' in understand the legal Units, focusing on seven basic unit such a 'm', 'm2', 'L', 'kg', 'K', 'cd', 's'. This study specifically investigates whether the students understand the legal units. The subjects were 1096 students from the University of Education in Jinju, Gyeongnam. Data was collected through a questionnaire which was designed by this research and checked by authority, and the frequency and percentage of responses to each question were obtained and analysed. The survey was the legal units on interesting, using the experience of confusing and understanding of elementary pre-service teachers. The Korea Government is regulating using traditional measures such as 'pyeong' or 'don' in commercial transactions change to adopt the metric system for as a subsidiary the first of July, 2007. The interesting of the legal units dose not exceed a positive answer to the question 52.1%. Their were answered that the experience of the confused of 60.1% in the life. How to do efforts for the settle down of the legal units that answered broadcasting>in class>a campaign>study and training by an academic year in oder. Findings show regardless of academic year, gender and from the department of liberal arts or the science department all the students knew very well that 'm' '$m^2$', 'L', 'kg' are included in the legal units, compared to the others low percentage of 'K', 'cd' and 's' the legal units. In case of time(s), women has correct answered 2.7 times than man. In case of academic year, except for the third-year students was not to exceed 50%. In case of from the department of liberal arts or the science department contrary to one's expectations increase of 50% or more correct answer while half the students scored in science. The elementary pre-service teachers are seems to thinking separate the legal units with their in university life. Also elementary pre-service teachers are the lack of interest on society. Their should be for settle down of the legal units through learning to class in university, newspapers, strengthen publicity activities of broadcast media's further more by maintenance efforts of the government.

Legal deposit system is an essential tool for a national library to ensure the preservation and access to a nation's intellectual heritage over time. Substantial amounts of digital materials of national cultural value are already being published. There is a global trend towards extending legal deposit to cover digital materials in order to maintain comprehensive national archives. This paper gives a progress report of some countries around the world whose legal deposit laws have already updated or are under revision. Some strategies are suggested for the digital collection building of the Korean National Digital Library which will open in 2008.

정보저장매체에 저장된 디지털정보로부터 범죄 단서를 찾고, 법정에 증거로 제출하기 위한 일련의 활동을 일컫는 디지털 포렌식의 개념과 기법이 국내 수사기관에 도입되어 활용된 지 10여년의 시간이 흘렀다. 그러나 디지털증거라는 새로운 개념의 탄생은 최근까지 정보의 압수대상 여부 논란 등 수사실무에서의 혼란을 초래하고 있다. 기존 증거와 구별되는 디지털정보의 특성으로 말미암아 증거로 활용함에 있어 필요한 별도의 절차적 기술적 조건이 요구되고 있으나, 과거 규정과 지침만으로는 디지털증거를 취급함에 있어 해석, 처리의 혼선을 가져 왔으며, 아직 명확하고 구체적인 실무 지침과 규정은 마련되지 못하고 있는 실정이다. 디지털증거 확보체계는 이러한 혼선을 최소화하기 위해 디지털증거의 증거능력 유지를 위해 필요한 최소한의 요건을 정의하고, 이를 바탕으로 법정 제출시까지 동일성, 무결성과 이를 증명하기 위한 보관연속성(Chain of Custody) 등을 유지 관리하기 위해 수사기관간에 구축하고 있는 인프라 시스템이다. 본 고에서는 수사기관간의 디지털정보, 디지털증거 처리, 유통, 취급에 있어 문제점을 살펴보고, 이를 보완 개선하기 위한 그간의 노력과 향후 발전방향에 대해 고찰해 보고자 한다.

대한설비건설협회는 그동안 설비건설업계가 공사대금을 제대로 받을 수 있도록 하도급대금지급보증제도 개선에 많은 노력을 기울여 왔다. 특히 국토해양부 장관과의 간담회를 비롯하여 건설산업 공생발전위원회를 통해 제도개선을 건의한 결과 하도급대금 지급보증 책임범위 확대 및 보증금 청구 시 청구일로부터 15일 이내에 지급토록 하는 등 건설공제조합의 약관을 개정하는 성과를 거두었다. 이로써 설비건설업계는 하도급대금 보증금을 원활히 받을 수 있게 됐다. 그러나 대한설비건설협회의 이러한 노력에도 불구하고 글로벌 금융위기 이후 100대 종합건설사 중에서 30여개 사가 부도 및 워크아웃, 법정관리 등으로 건설환경은 더욱 열악해지고 있다. 이에 따라 원도급업체가 부도날 경우 공사대금을 받을 수 있는 방법인 유치권과 하도급대금지급보증에 대해 설비건설업계의 관심이 커지고 있다. 본지는 유치권과 하도급대금지급보증에 대해 살펴본다.

This study identified the perceptions of library staff by type of library week through a survey and sought content that the library community should review to revitalize the legal library day and library week in the future. As a result of the analysis, it was found that the library staff's experience of participating in the library week and satisfaction with the event support of the host organization were low. In addition, it was found that awareness of the legal library day and library week, which will be implemented from 2023, is quite low. There were many opinions about the national publicity of the library and sufficient budget support for the event as a focus for the promotion of Library Day and Library Week in the future. In order to effectively promote the legal library week in the future through an awareness survey of library staff, various efforts are made to improve the awareness of the library community, cooperation with other library types to induce participation in various types of institutions, and the formation of a promotion committee within the association for each type of library, and use of various media It was confirmed that active media publicity and securing budget were necessary.

Since the introduction of the eco-friendly concepts in river management more than 40 years ago, many efforts have been made, such as the improvement of laws and systems, and research and development, and now river environment management is becoming the main issue of river management along with the flood damage reduction. This paper reviewed the history of improvement in relevant laws, and the current river plans prescribed by law. And as a way to improve the effectiveness of river environment management, the importance and implementation method of the level of naturalness survey of physical habitats in rivers were proposed.

The estuary of the Han River constantly suffers from pollutants and pathogenic microorganisms which could cause serious damage to aquatic organisms living there. Despite of this potential risk, it is hard to find any reliable scientific reports on the status of reportable disease infection to the organisms living in this area. In this study, cyprinid fish and crustaceans in Jeonryu-ri, a region of the Han River estuary, were investigated for the infection by representative reportable communicable diseases(SVC, spring viraemia of carp; KHVD, koi herpesvirus disease; EUS, epizootic ulcerative syndrome; WSD, white spot disease) and parasites. Peripheral fish and primary freshwater fish were observed in Jeonryu-ri with cyprinid caught most frequently. Crustaceans were mostly marine species. No positive bands to any of the reportable diseases were produced in any of the fish and crustacean examined in this study by PCR. No trace of Clonorchis sinensis, a liver fluke potential threat to human health, was detected in any of fish samples. However, many fish were infected by metacecaria of other flukes, and other various parasites such as nematode, cestode, copepod, monosite and acanthocephalan. These results suggest that important aquatic organisms in the Han River estuary is not seriously polluted yet. However, it is important to keep monitoring the diseases since the water quality in this region is constantly changing, and devastating influence of infectious diseases is unpredictable. Further, it is required to expand monitoring area toward upstream and increase the number of fish for examination.
